today, he testified on a civil law against him on what happened new year's morning 2009. we're live outside of the court house with the story. vic? >> reporter: oscar grant's father, oscar grant junior, in prison filed a lawsuit against mehser mehserle. this also, his best friend, also detained that fateful night. caldwell is now dead, his lawsuit is alive the defendant today took the stand. oscar grant junior is suing johannes mehserle, claim egg has been deprived of a relationship with his son, who was shot to death. grant was in the plaintiff's

table. he was transported from a prison, where he is serving a life sentence for murder the trial resumed this morning with a tax worker testifying as to what she saw of the altercation. michael greer took the stand as well. but the dramatic moment of the day came when attorney mccoy showed this cell phone video of the shooting. mehserle never looked up. plaintiffs lawyer mccoy led mehserle through a lit tany of questions but the main line of question had to do whether mehserle intended to shoot grant. >> he drew the firearm because he mistakenly thought oscar grant had a gun you don't go and bring a taser out to try to out when presented

with a gun. that showed he intended to kill him. >> the mother of grant's best friend, john caldwell detained along with the others his lawyers claim his civil rights were violated he was murdered three years ago during a drive by shooting. >> with oscar deceased now, and also, john, too, it is just hard to believe. i don't know what to say. i'm a mother. i'm an aunt. i've been in a lot of pain through this. >> the trial resumes on friday. >> raymond shrimp boy chow will not be getting out of jail soon. a magistrate denied bail today the former gangster is one of 29 defendants in a corruption case including stat senator leland yee. 12 witnesses testified but says they lacked information about the current charges against chow, and considered him a possible danger to the

vacation from utah. laura anthony joins us now. >> reporter: well, hi, cheryl. san francisco fire department just spoke to the issue a few minutes ago. they said the goal is to have an ambulance by ten minutes. and they admit in this case, of little cason shelton, it took 13 minutes the 2-year-old died last friday after a 6-foot dolphin statue outside of fisherman's wharf art gallery toppled on him his father, a doctor in utah made the call, reporting his toddler son was barely conscious and bleeding from the nose the fire department says at that time the closest available ambulance was across town at oak and stannin. 15 others were on calls. now, here is the time line as we know it the first officer arrived within one and a half minutes. the first firefighters, after
