guilty. >> the johannes mehserle testified today, this time it's a civil suit filed against him. abc7 vic lee joins us outside to explain. vic? >> reporter: there two lawsuits which the court consolidated into a trial. both against johannes mehserle. and the first one filed five years ago of the another is filed by his best friend, also detained by bart police officers that night. caldwell is now dead, but the court allowed his lawsuit to continue on behalf of his estate. >> he was looking forward to seeing his son, developing a greater relationship. >> oscar grant junior is suing johannes mehserle, charging he has been deprived with a relationship with his son.

grant was in court today with two state corrections officers behind him he was transported from a prison, where he's serving life sentence for murder. the trial resumed this morning with a worker testifying on the stand as to what she saw. other officers, oscar grant and his friends. michael career took the stand adds well. the moment of the day came when the attorney showed a cell phone video of the shooting. mehserle never looked up. it wasn't until afternoon, he finally took the stand. plaintiff's lawyer carefully led mehserle through a litany of questions about his career, training and night of the shooting but his main line of questioning had to do whether he intended to grant. >> he drew his firearm. he thought that oscar grant had

a gun. you don't go and bring a taser out to try to defend yourself, you're presented with a gun. that showed he intended to kill him. >> the mother of grant's best friend john caldwell was detained on the train. his lawyers claim caldwell's civil rights were violated he was detained unlawfully. caldwell was murdered three years ago. >> with both coulds os car deceased now, and and john, is hard to believe. i'm a mother and an aunt. >> the trial resumes on friday. >> a federal magistrate today denied bail for raymond shrimp boy chow, who is facing charges in connection with state senator lelandy's corruption case. chow is one of 29 defendants in

this case. 12 witnesses testified saying he turned his life around. but the magistrate deemed him a possible danger in the community. his attorneys plan to appeal that. he is charged with selling stolen liquor. >> a peninsula priest is recovering after being beaten by a homeless man the attack happened just before 9:30 this morning in burlingame. police say the 43-year-old was about to urineate on church grounds and the priest told him to stop. lewis punched the priest in the face. he suffered injuries to his face and broken elbow. lewis was arrested nearby. >> residents in the east bay city of albany are mourning the loss of their mayor. the 74-year-old peggy thompson passed away after battling cancer. flags flown at half staff today to commemorate the three decades of service to the community. thompson was a main stay in the

government. she spent 14 years on the city council and served 16 years on the school board. a public memorial service will be held on saturday. >> an east bay mother is outraged after learning her son was sent to clean the bathrooms as punishment for an alleged bullying incident the mother claims it's a case of racial discrimination. leanne joins with us the details leanne? >> reporter: yes. this is a copy of the clean up schedule. it's hard to read from where you are. but i can clearly see that it says boys bathroom clean up the name is under it. now, his mother told us she believes as a result of her son cleaning the bath rooms he got

and concerns. abc7 news is live at san francisco international airport with the story tonight. sergio? >> reporter: yes. it's the biggest sporting event in the world and brazil had years to get ready but there are unfinished airports there. there are hotels never built and still stadiums encircled in scaffolding. one family is leaving down there. they have not found accommodations for start of the stay. sebastian is rolling up an air mattress for the world cup trip to brazil. he hasn't found places to stay for part of the trip. planning for the family outing turned out to be tough. >> we hoped brazil would have a better infrastructure for transportation and hospitality. we didn't find that. >> there have been several protests in the run up to the

rick perry is in san francisco on what some are calling a rating mission he cruised into the state capitol in a tesla. california and texas among a handful fighting for that plant. jim wonderman says perry comes to california so often, he's now one of the state's top imports. perry says trying to bring business to texas is just good, clean, competition. >> if you get overtaxed and overlitigated you can't file the work force you need. go somewhere else and you do have that opportunity to grow and create more jobs.

good evening, abc7 fuss learned a controversial caltrans project has been notified of repeated violations of the u.s. clean water act and allowing pollution to run off into sensitive salmon habitat. it happened near highway 101. caltrans is building a six-mile freeway bypass around the town of willit. the first phase costing $210 million, involving the largest wetlands fill in 20 years. caltrans missed deadlines for improvements required by the state and federal government. we have planned to bring a comprehensive update but caltrans backed out of a scheduled interand refusing to speak on camera because the

claims we're biassed. we are not. they want us to submit questions and allow them to answer in writing only. we do accept written information but journalistic standards demand we ask for a face-to-face interview to ask follow up questions i wanted to do that. caltrans did give abc7 news a tour if bypass site, but no interview we focus on an issue caltrans photo and data speak for themselves. construction on the bypass is in the second year. work stopped for the winter rainy season. but it's back now. this is a huge construction site. six miles long. running right to a habitat for threatened coho salmon. caltrans required by law to make significant improvements to help the fish survive caltrans told us they went beyond the requirements they sent us pictures of debris

they cleared out of a creek. but these inspection photos show what happened later. look. this is february after a heavy rain when caltrans erosion control measures failed. you can see the creek here. let me highlight it. there it s pollution poured in, just at the time salmon were breeding. this is what supposed to happen. there is clear water a creek in marchen county. salmon are in trouble and spawn biologists told us sediment can be deadly. it can smother the eggs. >> the problems were so bad, the regional water quality control board notified caltrans it violated the clean water act with ten days of pollution over

the allowed level. officials would not talk on camera but documents show they ordered caltrans to make improveme improvements. caltrans submitted photos saying contractors immediately began work following the rain event to correct conditions and would do more as weather allowed. then, another big rain storm hit. water officials inspected the site and again found problems. they sent this list with more required corrections, with detailed photographs, documenting the issues. this creek supposed to be protected from sediment. you can see muddy water flowing down hill along with captions by staff saying things like inadequate erosion. no effective erosion control. slope failure. >> the drainage so overwhelmed caltrans tried to pump up the water with trucks and haul it away. water board says the trucks

inefficient and unsustainable strategy. we showed the photos to salmon protection network. >> water quality is degraded. >> cal trans is required to monitor water quality. pollution caused by suspended sediment was above allowed level at sometime on every day we checked. sometimes, by a lot. these readings are from the worst day, and what you're looking at now is our analysis. percentages show how high pollution went above the permitted level. many readings are more than 100% over what is allowed. a e mail acknowledged since february, it exceeded maximum allowed but said it happened with decreasing frequency. caltrans submitted more photos showing improvements

officials say they're committed to working with the water board and protecting water quality. but spawning season for the fish is over. a biologist with the state department of fish and wildlife told us there are young salmon and steelhead in the creek about a mile down the stream but no way to know whether more fish would have survived if less dirt had gotten into the water. the board says caltrans could be fined for the pollution violations. so far, that has not happened. caltrans refused to speak with us about any of this. in a letter a senior engineer says he does not agree with the water board finding that prop rags was inadequate. we have posted the inspection photos and full responses on our web site abc7 news.com. >> and now, to a major shake up in republican party. house majority leader eric cantor announced he plans to resign his leadership post this

summer after losing last night's primary. waits a major upset. cantor defeated by a little-known tea party candidate who opposes immigration reform. republicans are scrambling after one of the biggest upsets in political history. >> i intend to serve out my term as a member of congress and southern district of virginia i will be stepping down as majority leader. it's with great humility that i do so knowing tremendous honor it has been to hold this position. >> the election to replace cantor will take place next thursday. and the politicking has begun. republicans hoping to move up leadership ranks >> eric cantor was a good friend of mine. and a very good person for the party. >> nobody, not even cantor and his team could have predicted that unknown economics professor dave brat could have pulled out

a woman purchased a fairly large purse the purse turned out to be quite the bargain. katie bought this purse in december. in december she realized what she had. >> i lost a set of keys and dutched contents of the purse out on the curb. didn't find them, but felt in the lining my keys. >> turns out they slipped inside of the hole. she found a lot more than just her keys. she found a box top for hair coloring, movie stubs for a 10:30 showing of "hang over-2" and a note on a napkin. none of that belonged to her. yeah. she also found one more thing. a diamond ring. her immediate reaction? >> are you kidding me?
