>> announcer: live from the kgo broadcasting center, this is abc 7 news. good afternoon. i'm dan ashley. >> and i'm sheryl jennings. prosecutors will not file criminal charges against deputy eric gelhal. >> he shot and killed 13-year-old andy lopez in santa rosa last year. the death of that teenager who was carrying a toy pellet gun designed to look like an assault rifle set off massive protests and criticism. >> wayne freedman joins us with reaction to today's decision. wayne? >> reporter: good afternoon, sheryl. here in sonoma county this is a decision that people had anticipated, waited for and that they had dreaded. there was no way that this decision by district attorney jill ravage would not be controversial, and it is

controversial. her decision, that the killing was justified. >> given his training and experience, he believed honestly and reasonably he was faced with ado or die dilemma. >> reporter: she showed the similarities between a real ak-47 assault rifle and the replica that 13-year-old andy lopez carried just before being shot and killed. it's been almost ten months since the shootings. today she announced no charges against the deputy. she said the shooting, while tragic, was self-defense. members and supporters of the latino community were outraged at what they describe as an injustice. >> he was a kid! he was shot because he was a kid carrying a toy gun where kids play! that is an injustice that cannot be permitted! >> this is like killing him again. this is killing -- like stabbing

his parents in the heart again. >> my hope is that, while people may not agree with my decision, they will come to understand the basis for it. >> reporter: in making a decision, district attorney ravage also published a 51-page synopsis here in my hand, explaining the decision and going into some of the details behind the decision. among some of those details, that the deputies warned the young man loudly at least twice, according to witnesses, to drop the weapon. another revelation, however, was that it was only a matter of seconds between the time they pulled up and the time they opened fire. live in sonoma county, wayne fre freedman. >> lopez's family released a statement that says, in part, this cowardly political decision sends the tacit message that law enforcement officials who use excessive force in sonoma county will not suffer meaningful

consequences and instead will enjoy immunity from prosecution. a series of shootings marred the fourth of july. >> nearly a dozen people were shot over five days, and police are investigating whether they are gang related or violence triggered by idle summer days. >> we are joined from the hawll of justice with that story. >> reporter: the violence seems to be sporadic, the shootings quick, the victims all ages. in one shooting, a 10-year-old child was hit and two other shootings the victims were in their late 40s. now, no arrests have been made. the latest shooting happened at about 10:00 this morning. >> they just killed jig so i ran up to the corner, seen his body laying on the ground. >> keith zin was known in the neighborhood as jig. his friends here say he did not deserve to die. >> just taking his daughter to school every day and go home and be with his wife. and they killed him. >> reporter: jig was shot this

morning on a corner facing a new apartment complex in the bay view. he died later at the hospital where family and friends gathered. residents also heard about the murder early this morning in the sunnydale housing development in near by ingleside. almost everyone we spoke to knew about the shootings, almost all in the bay view. 11 people were shot in 7 shootings, 4 died. the first was the afternoon of july 3rd when two were shot on connecticut street near 23rd. the violence continued saturday with three shootings nearby. three more on sunday and two fatal shootings this morning, the one in the sunnydale housing development and the last one on ironwood way. police tell abc 7 news they have yet to find a in any of the shootings. >> the victims don't have a whole lot in common. the age ranges are very different. where the incidents are

occurring is different. >> reporter: herbert only wanted his first name used. he's been in the bay view for some 24 years. he's seen this kind of violence before. >> for the summertime, it seems like this is when the violence really picks up. it could be because a lot of the young people is not working or doing anything. >> reporter: police tell us they're beefing up patrols in the area, making sure everyone knows they're out here in mass. vic lee, abc 7 news. a concord man will go to jail for the deadly mauling of his 2-year-old step grandson. three family pit bulls in martinez attacked thee ed ttodd. in april he was convicted of child endangerment and involuntary manslaughter. today he was sentenced to a year in jail and three years of probation instead of a long prison sentence. >> more relieved. the last four years has been hell.

i don't even mourn for jacob because of this case, i vnts been able to. i miss jacob. it was just an accident. i didn't expect any of this to hp happen. >> the family, including the boy's mother, asked the judge for leniency. check out what screeners found inside a man's shoe at the detroit metro airport yesterday. that is a knife tucked into the lining of the shoe. police arrest the man. the tsa spokesperson said it would have been fine for the man to traveled with the knife if he had put it in the checked luggage. the tsa is concerned about the rise it's seen in another kind of hidden weapon called a credit card knife. it looks like a credit card, but then it folds out 0 with a sharp steel blade inside. so far, this year, the tsa has confiscated 491 of these weapons using body scanners and metal detectors. more details this afternoon on a deal between the corinthian colleges and department of

education. the school agreed to sell 85 campuses and close 12 others. corinthian owns multiple colleges. none of the bay area campuses is closing down. you should know that. but a number of federal and state authorities have been investigating claims that corinthian falsified records and deceived prospective students. the company has more than 70,000 students across the country. evacuation orders have been lifted for people living near this fire. campgrounds remain closed along 128. so far the flames burned more than 6400 acres since friday. crews report the fire is about 35% contained. most of that fire has burned some hard to reach areas. investigators are still trying to figure out how it started. and cal fire continues to deal with hot spots as crews are try to surround the fire. officials say the fire burning near polk valley is 90% contained. it started last tuesday. the flames have charred 4300

acres. the fire also detroited two homes along with seven other structures. investigators are also looking for the cause of this fire. officials expect digging by wild pigs caused a levee to collapse. that flooded five homes and farmland. people sloged through knee-deep water. crews finally stopped the water by turning off a control valve. >> those pigs can do amazing amounts of damage. let's focus on the weather forecast as you go back to work. >> spencer christian outside checking it out. >> we've had variable conditions today, areas of sunshine but we've had low clouds and fog drifting in from the coast and high clouds from the east. we even had sprinkles reported around livermore but no measurable rainfall. you can see areas of moisture over the bay area right 0 now, but most of that moisture is evaporating in the air before it hits the ground.

meanwhile, areas of scattered storminess move through the sierra. it's the clouds and moisture from that activity moving through the bay area sky right now. here is a live view suit row tower, high and low clouds moving in from the coast. it's 65 degrees in san francisco right now, oakland 68, mid-70s at san carlos, san jose/gilroy 82. another view from our emeryville camera. interesting cloud formations, mid-70s in santa rosa, navarro 69. 87 in livermore. one more live view, a familiar sight of the golden gate bridge. we'll see fog and low clouds increase and high clouds as well. there will be areas of clouds and fog lingering in the monk but afternoon mainly sunny with high clouds continuing to drift through the zie. warm inland but cool at the coast. >> spencer, thanks so much.

covering novato, oakland, awful the bay area, this is abc 7 news. [ speaking spanish ] in mexico, an earthquake interrupted a live television broadcast this morning. at least five people are dead. the 6.9 quake was felt as far north as mexico city, through central guatemala and as far ouj south as el salvador. the quake damaged dozens of homes, triggered a number of landslides in the guatemalan state of san marcos. a federal judge has granted preliminary approval to a deal that would compensate former nfl players for concussion-related claims. last month the nfl agreed to remove a $675 million cap on damages, more than 4500 pliers have filed suit, some accusing the league of fraud for its handling of concussions. a famous restaurant in loss

gatos is closed today after being heavily damaged in an early morning fire. such a shame. the fire on village lane is getting the attention of foodies around the world. that's because man res sa is michelin two-star restaurant. >> reporter: it didn't look good for man res stssa about 3:30 this morning. a huge fire seemed to be devouring the restaurant. but it's locate noext a fire station. firefighters pounced on this one quickly and called in extra help with the second alarm. when the smoke cleared, the restaurant was still standing. >> the damage really is the roof. the damage on the inside is smoke damage and some water damage from the fire fight. >> reporter: another lucky break, the restaurant was closed all weekends for cleaning so no fresh food was lost in the fire. and firefighters say the staff was able to cancel this week's food order. firefighters don't think that that cleaning crew left behind anything that could start a

fire. >> i think that the cleaning crew might have done their business and been gone for a couple of days. no evidence of any equipment related to that kind of an operation hanging around. >> one firefighter tripped on debris and was hurt during the fire fight but is expected to be okay. the owner of the restaurant is out of town. his staff and pr representative refused to comment on the fire. but residents of loss gatos says the restaurant brought quite a presence to this town. >> puts us on the world map i suppose. little high end but part of the culture. >> this was a hot spot for even people from other countries and other states. it's kind sad to see something go like that. i know they worked real hard to keep that business. sorry to see it. >> reporter: fire investigators paying close attention to the rest raubt's gas meter outside the building. they say it was on fire when they got on the scene.

they're trying to figure out dwr and whether the fire started outside the restaurant or inside. in los gatos. president obama is pushing to place quality teachers in schools that need them the meest. the president hosted a group of teachers for lunch at the white house to talk about the administration's education priorities. the president announced an initiative to make sure every student an effective teacher. the president credits good teachers with helping him succeed. >> when i think about my own experience the only reason i'm here in the white house is because of extraordinary teachers as well as a pretty extraordinary mom and parent grandparents. everyone around this table probably feels the same way. >> the president's new initiative is called excellent educators for all. the education department plans to invest more than $4 million to help states and districts create plans to help place teachers. well, there's nothing more appealing than a bright, shiny

car. if you're looking to wash yours, it can look good but if the paint is dull or the paint is scratched, it doesn't look too hot. >> "consumer reports" tested products. >> here's michael finney. >> reporter: many new cars and suvs come with dark plastic trim that ends up looking dull and faded over time. and those shiny new cars usually end up with a few scratches, too. "consumer reports" tested five plastic trim kits and three scratch repair kits. >> they're essentially paint pens with clear coating and they fill in the scratches. >> to test, panels were especially painted just like a new car is and lightly scratched. then mark applied each of the products as instructed. all three filled the scratches as promised and made them look less noticeable. from this angle. but viewed from the side, they look more like a bad coat of

clear nail polish. for the plastic trimmers, mark used old dull car panels, each product was applied to a section and the panels were put on the roof to face the elements. some didn't last very long. the maguire's ultimately black plastic reor storer and the back to black looked completely faded by day 45. the turtle wax premium grade trim restorer looked faded by 57. but these two stood out from the pack, the like new for $18 and the $15 renew finish. still looked great after 70 days. >> so what can you do with those scratches in your paint? little bit for the next few days slightly. then we'll get another warm-up over the weekend. but things are nice and pleasant now. here is live doppler 7 hd, a mix of clouds at different levels of the atmosphere and moisture drifting over the bay area, coming mainly from the sierra. boy, there have been some showers it -- yshower showe showers, we're right in the middle of this presentation. overnight lows under partly cloudy skies, in the mid to upper 50s, mild overnight. a low of 63 in antioch and on we go to highs tomorrow in the south bay. look for highs in the upper 70s to mid-80s, about 85 at morgan hill, on the peninsula we'll see mid-70s to upper 70s, upper 50s to about 60 on the coast, downtown san francisco a high of 65, up in the north bay highs generally in the upper 70s to around 80. over on the east bay, highs from upper 60s to mid-70s and over the inland east bay mid-80s to

about 90 degrees at brentwood, which will be the warmest spot. now, we're going to give you the seven-day forecast early, but i'm going to go back and show you some i meant to show you at the top. a steady pattern like we have right now through are friday, then temperatures will start to bounce back, especially inland over the weekend. then by monday we'll see mid-90s inland. i wanted to start with this. i don't know how it skipped ahead. mainly sunny skies across the bay area now, lots of high clouds, maiply high clouds drifting in from the sierra where we've had scattered showers and thundershowers. it's weakening as it passes westward through the sierra foothills. then the moisture drifts over the bay area, pretty much evaporates before it hits the ground. but there have been sprinkles reported around livermore. have to mention the possibilities of sprinkles tonight. this is how it looks right now. these are our forecast features, fog and high clouds during the

madonna reported for jury duty in new york city after postponing it for a couple of times. the material girl was allowed to 0 arrive an hour late to not cause distraction. after talking with court officials, madonna was dismissed. she never did sit with the other pro speblgtive jurors and dwaent questioned for a panel. officials say she wasn't expected to permit but they're certainly happy she showed up when she was called. >> she would be a distraction, i think, on a jury. a 15-year-old girl and military family hit the road literally this weekend to salute our veterans. >> they gained so many friends and admirers along the way.

well, these quadcopters or drones are getting smaller and smaller and easier to control, even some people are building them from scratch. the problem is that the federal aviation administration isn't coming up with rules fast enough to keep up with the technology. this is video shot july fourth of the unofficial fireworks display over the mission district. eddie cadel decided to send up his quadcopter to get his images. he was very clear. this was taken for hobby purposes only. >> the faa has basically said there's no commercial use of these drones right now. they're figuring out the

regulations but currently if you were to fly them commercially you would be breaking their regulations. >> reporter: the problem is, videos li s like this one has r up more than 6 million views since it was shot last may of fireworks over disney world florida. it's been licensed by gopro. it raises the question, what's commercial use? >> if you're 0 a farmer doing quadcopter for fun, that's cool. but if you use it to go over your crops and get a sense of where it needs fertilizer, that would be considered illegal. >> this video was shot 0 last year of the fireworks over aquatic park in san francisco. he had been hoping to start earning money by getting aerial shots for real estate agents but he was recently cited for flying his quadcopter over ocean beach. >> i've actually lost several days of work because i'm like thinking i'm in big big big trouble. because from what i was reading, googling there was a guy i guess he was fined for flying over

treasure island $10,000. >> reporter: he was cited by a national parks police officer because ocean beach is federal park land. just last week, the national park service issued a temporary ban on the use of all remote controlled aircraft in their jurisdiction. it's temporary because the faa is the final authority, and that agency is still working on regulating all these small aircraft. >> i know they're working on these laws that will be passed ach after 2015, but why now just come after everybody without a warning? >> operators say the government is simply not moving fast enough for the new technology. in san francisco, abc 7 news. >> it is remarkable technology. the fourth of july weekend was a violent one in chicago especially where at least 14 people were killed. and are you ready for this? 82 different shootings. police killed two of those people and shot three of the wounded. officers either were shooting at suspects or getting shot at themselves. much of the violence took place on chicago's south side.

police blame it on gang members carrying illegal guns. >> it all comes down to these guns. there's too many guns coming in and too little punishment going out. our officers would not be forced to use their weapons if the offenders were not armed with illegal weapons. >> chicago police seized more than 100 guns over the weekend. so far chicago has 185 murders this year, which averages about 1 per day so far. that's actually down by 11 homicides from this time last year. in southern california, the death of a veteran lifeguard is being called a tragedy. the 15 hifr year veteran drowned while trying to rescue a swimmer off newport beach. they were hit by a wave. here's more from los angeles. >> reporter: lifeguards in shock and mourning in the southern california town of newport beach after learning late sunday that one of their own, 32-year-old ben carlson, drowned in rough ocean water while trying to

rescue a swimmer in distress. >> it's just an utter tragedy. >> reporter: the swimmeror made it back to shore, but carlson didn't. the authorities say a 10-foot swell pushed him under water. tello lifeguards began an intensive search 0 that lasted three hours. they used helicopters and rescue boats to look for carlson, a 15-year veteran known to be a strong swimmer. >> the other lifeguard person on the scene attempted to rescue and assist ben but was unable to find him because of the turbulent water and up to 10 to 12 foot surf. >> reporter: searchers found carlson's body around 8:00 p.m. sunday. in the aftermath, his friends and co-works remembered his professionalism and his cheerful demeanor. >> ben was a well-respected individual, always a nice guy, always was there to help somebody. he'd give the shirt off his back anytime. always had a smile on his face. >> reporter: the holiday was a busy time for lifeguards around

newport beach. they made hundreds of rescues of people who had gone too deep, given the strong currents and powerful winds. >> those lifeguards risk their lives and put themselves in harm's way to protect swimmers every single day. >> reporter: ben carlson's death was the first on-duty drowning of a lifeguard in newport beach 0 in more than 100 years. there is a victory for immigrant rights advocates that federal appeals court is blocking arizona's policies for denying driver's licenses to young immigrants who obtained work permits and avoided deportation under an obama administration policy. supporters of the immigrants argued they were being harmed by unequal treatment. the appeals court agreed. pope francis today begged for forgiveness when he met for the first time with survivors of sexual abuse by priests and other catholic clergy. the vatican says he expressed sorrow during a private mass with six victims.

francis called the abuse sin and grave crime. other abuse survivors not at the meeting say the encounter will not ease complaints that the vatican failed to punish bishops and others who tried to cover up this abuse. 63 girls and women escaped two weeks after being kidnapped by islamic extremists in nigeria. local leaders in born know say they escaped while their captors fought soldiers on thursday and friday. but nigerian officials denied those abductions ever took place. more than 2000 school girls are still missing after they were seize 0ed by the same group boko haram back in april. well, the annual running of the bulls began in pamplona, spain, today. people ran for their lives as the bulls chase them between a holding pen and the city's bull ring. the entire run takes about two minutes. if you're in there, it he seems like an eternity i'm sure. one person was gored, three

you have probably never seen a turtle move that fast before. a woman from italy found this turtle playing ball. showing quite a bit of agility. maybe one of the fastest moving turtles ever caught on camera, and delivers a mean head-butt, too. ♪ a kansas city released the tallest water slide in the world. don't watch this if you just ate something. it looks terrifying. it takes you on a vertical drop at over 65 miles an hour. the water slide is 168 feet 7 inches high making it taller than the statue of liberty and niagara falls. still a test run. not clear when it will be open to the public. >> i'll enjoy it on video. well, check out these
