accused of injecting a man with a lethal dose of heroin and then leaving him to die on his luxury yacht. tonight we now know the identity of the victim. good evening. i'm dan ashley. new information tonight on this bizarre story. tonight we now know the victim is this man, 51-year-old forest hayes, a silicon valley scute -- executive. they say he was murdered by this woman, alex tikelman. alan wang has details. alan? >> most people here thought it was a suicidal overdose million today. now less are saying this is where the femme fatal met an executive and left him on his yacht to die. how she did it is how police say is disturbing. >> it is a big, nice boat. it is a nice power boat. it was a very nice power boat. >> people at the santa cruz harbor only knew the owner of the luxury yacht, the escape, died on board of an overdose, but today the real story

emerged. >> we uncovered the video that was available. >> police say they watched surveillance video of forest hayes. the former senior director of apple's worldwide operations as he was injected with heroin , supplied and administered by 26-year-old high-priced prostitute alex tikelman. hayes was working on google x at the time of his death. tikelman never tried to help him or call 9-1-1. >> she was so callus that in gathering her things she was literally stepping over the body and at one point stepped over the body to grab a glass of wine and finish the glass of wine. >> her fingerprints were discovered on the wine on on july 4th police posing as a potential client lured her to a hotel where they arrested her. >> she was callus and noncaring about the state of the victim in this particular case. we feel that warrants the second-degree murder. >> police say she is also being investigated for a similar death in another

state. in santa cruz, alan wang, abc7 news. >> the search goes on for three men who robbed an elderly man at gunpoint in his own home. lisa amin gulezian is live with a story you will only see on abc7 news. lisa, he is scared, obviously, but thankfully not hurt.ery tru. >> very true. he is physically unharmed, but he is very shaken up. he is 78 years old, and he is a very soft spoken man, very nice and he agreed to talk to me about the robbery that happened in this neighborhood, in broad daylight. we agreed not to identify him. >> first one open my door and shove a gun in my face. >> it was the scarest --scariest scariest moment in this 78-year-old's life. from the surveillance video you can see him pulling up to his house. and then three men walk up the street and follow

him into his garage. >> .ed the dpun at my face and says give me your watch. give me your wallet. >> they took off with the victim's rolex, cell phone and car keys. here are the suspects bolting across the man's front yard and down the street. police still haven't found them. >> these are violent criminals and we don't want this to happen a to anyone else. >> neither do those living in this community lined with multimillion-dollar homes. residents here aren't taking this lightly. especially since robbery in the city are up 8% compared to last year. >> it is more anger. somebody things we are vulnerable and we don't want somebody to think like that. >> they are organizing a meeting to consider forming a neighborhood watch group adding surveillance cameras and a security guard. the victim wishes it never happened. >> the worst part for me, i am always scared.

>> lisa amin gulezian, abc7 news. >> city leaders in antioch promised more resources to fight crime after another shooting today. a 23-year-old pittsburgh man was found dead at the delta view apartments this afternoon and another man was found critically injured just blocks away. sky 7hd shows investigators collecting evidence. in the last 11 days, 11 people in antioch have been shot. our media partner, the sanury nd overtime to increase targeted police enforcement. they are in the process of hiring more cops. only on abc7 news, a key witness to the shooting death of a santa rosa boy by a sheriff deputy says he doesn't believe the deputy was justified. the attorney cleared him of wrongdoing in the october shooting of 13-year-old andy lopez. he says the air soft gun andy was carrying at the time looked like a plastic toy, but

it could have been real. >> i tell him to put that thing away. >> did he pay attention to you? >> he don't pay no attention. my reaction, i don't think it is necessary to kill this guy. >> andy lopez's family and activists believe he overreacted even though the district attorney ruled he did act in self-defense. >> a surfer had to be rescued near the rocks of san francisco's ocean beach. he got trapped by the tide near the cliff house just before this evening. we'll show you the video. there you can see him sitting on a huge rock as the waves crash around him. a fire crew arrived and set up ropes with a harness. one firefighter scaled down and strapped the surfer into it. the rest of the and crew and another surfer pitched in to help pull him up. as you can see they were able to get him over the steep cliff. the surfer popped to

safety. the crowd watched the whole thing unfold from the cliff house restaurant above. >> we saw a yellow surfboard tumbling. we looked and looked for the surfer, and then we found him down below. it was pretty scary. >> the surfer is from belgium. he said he got knocked off the surfboard and could not retrieve it. he is okay tonight. we have new details in the civil case filed by giants fan brian stowe who was so badly beaten. deliberating jurors sent a question to the judge. attorneys spent 10 minutes to review case documents to find an answer. the judge instructed that the question remain private. it was the jury's first note in three days. deliberations will continue tomorrow. stowe remains brain damaged after an attack outside dodger stadium in 2011. his family is suing the team and former owner for millions saying there was not enough

security that day at the ballpark. some developing news, a new state proposal would fine people who waste water up to $500 every day. the water resources board is now considering emergency regulations to reduce water use during this terrible drought. violations would include cleaning sidewalks with hoses over watering lawns so that the water floods on the streets and washing cars. if approved any public employee would be allowed to enforce the law. the board will hold a public hearing next wednesday and then consider adopting the rules for the rest of the year. we will follow it and let you know what the decision is. two mountain lion sightings and tonight police are issuing a warning for the folks nearby. the first sighting happened on july 1st near a backyard so fernwood street. the second was on sunday in an unincorporated area on queens lane. police say residents should avoid hiking or walking when the mountain lions are most

active. that's at dawn, dusk or at night. if you see one, do not approach it. do not run. try to look bigger than you are by waiving your hands a in the air and throwing rocks at it. try to be as intimidating as possible. now you can get a california cab to go with those fresh carrots. governor brown signed a bill that immediately allows wine tasting at farmer's markets. it has been legal to sell wine at farmer's markets. until now tastings have been off limits. those in the wine industry say it could be a big benefit to the smaller wineries that can't afford a tasting room. >> you have to pay somebody to staff it and you have to get all of the licensing. it is a challenge to jump over that. if you can set up a booth the cost will be relatively inexpensive. >> the measure requires the tasting areas to be separated from the rest of the farmer's

did you n the difference? did you feel it in the air? we are returning to a more stable atmosphere. the marine layer is back in business. a beautiful view. let's check out live doppler 7hd and i will tell you what i'm talking about here. really we lost the sub tropical connection. it was muggy and we started to see more sunshine. the low clouds and the fog are making a pretty good push. the marine layer deepened and that means not just the coast dealing with the gray skies, but it is already cloudy around oakland and hayward right now as we take a look. and we even have patchy clouds around santa rosa as well. here is the difference in our temperatures. compared to 24 hours ago, con -- concord and livermore, you were in the 70s. the marine air is starting to kick ins 12 dries cooler. and we have lost the cloud cover we had, the extra clouds. here is our view and it is looking toward downtown oakland. that's the murky view you will have to deal with for your

morning commute. 57 in san francisco and oakland and 60s san carlos and gilroy and half moon bay. here is the view from our exploratorium camera. piste 6 in santa -- 56 in santa rosa. fairfield, concord and livermore. here is another picture. it has been another breezy afternoon. breezy out toward fair field. but that is what is carrying the marine layer in. spotty morning drizzle the next two days and we are looking at cooler weather in the afternoons. this afternoon our temperatures dropped in san rafael, san francisco, oakland, san jose, but the inland highs came up with a little more sunshine. fog makes a push for our bay as we head toward the morning. patch patchy drizzle.

it is going to feel cooler. low 50s to low 60s tomorrow morning. most of the bay area is starting out gray with the exception of the inland valleys. then look what happens. the fog pulls away from the bayside communitiemorning an lae morning and by the afternoon we are looking at mainly 80s inland and secretaries coast side. we will call it a cooler wednesday afternoon. typical high temperatures for this time of year. 88 in antioch. 69 oakland and napa 64 and san francisco 60 and half moon bay. fog will linger there. 76 in palo alto and 79 in san jose. the seven-day forecast, the best thing about the deepening marine layer and drizzle, the fire danger is reduced. upper 50s to the upper 80s. we drop you a little more thursday, friday bay and inland and then over the weekend it is a gradual warming trend. >> that's very much. larry is off and shu is here. somebody has to win and somebody has to lose. >> it seems to be the same people winning.
