hayes is a married father of five. 4:31. flee men followed an elderly homeowner into his garage and problem him at gun point in a quiet neighborhood of multimillion dollar homes. we report from san jose with the story you will only hear on abc7 news. >> the first one opened my door and shoved a gun on my face. >> the most scary moment in this 78-year-old's life, finishing running errands on sunday. from the surveillance video you can see him pulling up to the house. three men walk up the street and follow him into his garage. >> pointed the gun and said "give me the watch, your wallet." they took off with the victim's rolex and cell phone and car keys. they bolt across the front yard and down the street. police have not found the suspects.

investigators are collecting evidence shown here and the wounded man was shot at the apartment complex but fled. in the last 11 days, 11 people in antioch so been shot. the city is authorizing police overtime to put more officers on the street. antioch is in the process of hiring additional officers. a key witness to the shooting death of a boy by sheriff deputy says he does not think the deputy was justified. on monday the district attorney cleared erick gelhaus of wrongdoing in the october shooting death of 13-year-old andy lopez. that sparked two days of protests. the witness was driving by and saw lopez with the toy ak-47 and warned lopez that a sheriff patrol car was approaching. >> i told him to throw that thing away because the police was behind. he don't pay no attention. my reaction.

coliseum for the a's and raiders the development teamworking to build the raiders a new football stadium is urging city officials to reject a lease extension for the a's. the raiders hope to have a new multiuse stadium constructed by 2018. the plans with developers from the coliseum city project call for the stadium to be demolished in 2015. oakland city council members are trying to decide whether to approve a lease deal that keeps the a's at the coliseum through 2024. the proposed lease would not require the a's to vacate the coliseum until after the 2016 season. >> san mateo police issue a warning to neighbors after two mountain lion sightings first on july 1 on fernwood street and second on sunday in unincorporated area of queens hane. police say residents should avoid hiking or walk when mountain lions are most active

the black band appeared monday and no one knew what it was. someone thought it might be an algae bloom or oil slick. the number fish is said to be in the millions. >> how many pizzas can you make with that? >> plenty. >> a surfer is fine after being rescued near san francisco's ocean beach. he was trap by the cliff house before 7:00 and you can see him in the pictureds sitting on a huge rock as the waves crashed around him. a fire crew arrived and set up ropes. a firefighter scaled down and strapped the surfer into it. the rest of the fire crew and another suber pulled him to safety. they got him over the see cliff. the sufferer hopped up to safety and the crowd watched it unfold from the cliff house restaurant. the surfer is from belgium and he was knocks off the surfboard and could not retrieve it.
