broadcast center, this is abc news. >> i'm ama daetz, we begin with developing news, a verdict in bryan stowe's civil suit, a jury awarded him $18 million. the giants fan who suffered a brutal beating by giants fans in >> he had been drinking, jurors ab solve mccourt and stowe and determined the team is responsible for a quarter of the

verdict. >> stowe was not in court, the family says the sisters will tell him about this verdict. >> we were in the courthouse and the judge was named victor e. chavez, and i'm going to tell bryan it was victory chavez. >> i feel like it is a victory. it is a big weight off our shoulders, we have been waiting three years for this. >> stowe's parents say he requires 24-hour care, the suit asked for $37 and a half million for his lifetime care and compensation for lost earnings. so again, that verdict is $18 million in total. the award includes more than $2 million for stowe's past earnings and future. he worked as a paramedic before he was attacked. >> more than 10 million, and $5 million for economic losses, the pain and suffering by stowe and his family. >> the family had sought $50

million. >> they laid the rest of the blame on the men who pled guilty in the attack. >> the attorney is live with us from his office in redwood shores with a little bit on what this verdict means for the stowe family and others in general. mike, how much of that money will the family actually be able to get? >> well, dan, i have the numbers here and what they will be able to get is about 13 million from the dodgers, the problem with that is that the jury went with the defense numbers as far as how much the cost of care will be. so really it is questionable whether the amount that stowe gets will even take care of his lifetime medical costs. >> all right, because they didn't get anywhere near what they initially were asking for. now, mike, the dodgers were found partially responsible for

the attack. so what does this verdict mean for other sports teams and how much security they provide at games? >> this is not new law. any business owner that charges to come on to their property has to take reasonable steps to make sure that property is safe. but what this does is say that that law applies to any sports facility and applies in particular to sports parking lots. you have to have adequate lighting. and if you know there is a risk of basically a criminal element in the parking lot you have to provide security. and that applies now to basically any sporting activity. >> i would think so. mike, last question here, would you expect appeal like -- i can't imagine there would not be an appeal, and if so how long would that hold up the payment? >> appeal could take really at least a couple of years. but honestly the award is actually a defendant-friendly

award. it is far, far less than plaintiffs had asked for. and given that it is really questionable on whether all the money is likely to go to stowe's cost of care. so in a sense he really didn't get anything out of it. so i don't know if even the dodgers will actually appeal. >> okay, thank you for joining us this afternoon to give us insight into the stowe verdict. >> terrific insight. well, coming up at 5:00, we'll have reaction from the verdict, including from the giants. and the woman accused of giving a tech executive a fatal dose of heroin appeared in court today but did not enter a plea. 26-year-old alix tichelman is charged with felony manslaughter and having and transporting drugs. police say she is a prostitute. police say she met 45-year-old hayes on his yacht, he took the drug and passed out and died.

>> she was literally stepping over the body and at one point stepped over the body to grab a glass of wine. >> investigators lifted her prints from that wine glass, tracked her to folsom where an officer posed as a client and arrested her on the fourth of july. she is due back in court july 16th. tichelman is also under investigation for a death in another state. and tough new water restrictions appear heading our way as the state is ready to move forced cutbacks that water users have not made on their own. >> in january, the governor asked for dropbacks on water use due to the drought. few of the agencies followed his lead and now mandated cuts are on the horizon. >> more from livermore, nick? >> reporter: dan, ama, good evening, this is the duct that

feeds along the rivers in the valley, and just one of the major water resources. >> we went to mandatory conservation. >> reporter: the livermore city leader saw what the drought was doing and took action early on by implementing mandatory water conservation. since then, livermore has met or exceeded the water conservation goals, but other communities have not been as conservative either not cutting back or ignoring the calls altogether. so this week, state regulators made it clear they're looking at new rules for all of california. >> the idea is to make the regulations apply statewide. the water conservation apply statewide. >> reporter: if approved the water conservation disruption will come with a fine, for things such as washing a car without following restrictions.

everything seemed to be a continuing canvas of green. today, lush lawns across the tri-valley have been placed by gold and amber colored blades of grass, looking like strands of wheat. >> well, i think it is a big concern. >> reporter: which is why she is concerned about the use. >> we'll just put a little water on them and have a little extra color for the summer. >> reporter: most water agencies in the bay area have cut back some, but hardly enough to avert a crisis. now, they will have to act within 30 days to restrict outdoor irrigation to no more than three days a week or take steps to conserve the amount of water. >> take shorter showers, don't use a lot of water for just wasting it. >> reporter: agencies that don't apply could face fines as much as $10,000 a day. in livermore, nick smith, abc 7

news. and in the valley it is dire. the valley does not get any water this year, and heavily relies on ground water. >> abc 7's cornell barnard has more. >> reporter: yeah, guys you know the drought is only getting worse here in wine country. and they all depend on the water for the vineyards, the ripening of the grapes is already happening here, signaling an early harvest. it is in full swing here at the napa valley, this 2012 cabernet will soon be shipped out. but getting down the assembly line is work. >> it takes water to make the grapes and wine. >> reporter: the water and wine president says it takes a gallon to produce one bottle of wine. all the water is needed to clean

and sterilize tanks. the mandatory water restriction this summer could be devastating to california's most famous export. >> i just heard of the avocado farmers pulling out their trees. i mean, the same thing could happen here and it would be devastating to our industry if we had to pull out vines. >> reporter: the water is essential here, that is why tom davies is relying on the crops. the severe drought here as caused this well level to drop so low it has made water supplies unusable. >> i have tried filter systems, nothing will work. >> reporter: so this is down 250 feet lookingñi for water. the search for water is costing steve more than $25,000. >> it is necessary, the water is a part of everyday life so when the situation comes up, you rearrange the priorities. you find the money, there is really not an alternative.

just got a little safer for the police department's k-9 unit. the four-legged officers will now wear bullet-proof vests just like their handlers. the group cover your k-9 helped with packs and immediate care if a k-9 is hurt in the line of duty. now the vests weigh about four pounds each, and officers say the dogs don't seem to mind. they used such events as dog washing events to make the vests and give them to k-9 units across the state for free. and in argentina today, just moments ago the south america team won, argentina's goalie stopped two penalty keys from the dutch to set up the winning kick. argentina goes on to sunday's final against germany. the celebration may not stop for

live from the kgo tv broadcast center, this is abc 7 news. president obama's two-day fundraising trip to texas will not include a visit to the border where thousands of children from central america have arrived. texas governor rick perry greeted the president as he arrived in dallas. the two held a private meeting to discuss the immigration issue. >> the issue is not that people are evading our enforcement officials. the issue that we're apprehending them in large numbers. and we're working to make sure that we have sufficient facilities to detain, house and process them appropriately. >> republicans are blasting the administration as it asks for

well. i bet that made him really happy. and a retailer agreeing to pay claims for overcharging customers. yeah, this is pretty big news, others filed a lawsuit against o'reilly auto parts, the over-charged people hundreds of times for such things as oil and parts. o'reilly agreed to pay $100 million for the suit. the spokesperson said they would pay for every person discovering the over charge, the spokesperson for the company said there was no comment on the lawsuit. and suit brought by consumer watch dog against anthem saying they gave false information about plans to operate on the affordable care act. it claims the company deceived

customers about the size of position network, deductibles and other important information. the suit also claims blue cross delayed claims so customers could not get care. anthem responded by telling abc on your side that we provide our services through our directory. while the vast majority of incidents were correct, many were not listed. they decided to provide for individual members. and target stores looking to brighten their image after last year's disastrous data breach. the company will for every purchase of a target brand school supply the retailer will donate the same item to children in need. the campaign runs from july 15th to august 2. target hopes to donate them for 2 million children. they hope to regain customer

>> reporter: hey, well, i guess i'm the lucky one, i wanted to share it with you. it says visit levy's stadium. well, of course it was on my bucket list. but you know something, done, been there. it was fabulous, i'm so glad i did it. now with regard to the food i can honestly tell you that that could not taste like your typical stadium food. it was delicious. i'mçó going to sum it up one wa heaven on earth. it may not be the french laundry, but let's just say magni magnifique describes the food in the stadium. >> we have asian food, mexican, barbecue, sausages. >> reporter: of course, no one is thinking of doing away with tradition here except that this may just be the healthiest dog you have ever tried. >> it is hormone-free meat, the natural casing, they're actually hung and smoked which is something that is unusual for a hot dog at a stadium.

>> reporter: ryan stone has traveled around the world as a chef before landing this job, he loves all that is on the menu. so don't ask him which one is his favorite. >> that would be like asking a parent of three to pick their favorite child. it's not fair. >> reporter: for vegans, there will be no tofu served here. instead they will have things like portobello mushrooms served on the bun, and the final meals will be served instantly to make sure everything is fresh. he is the general manager of the company. >> we have 63 concession stands and portable concessions. >> reporter: there will be 60 huge wood-stoked pizza ovens, and more than a thousand beer attractions. there will be a kitchen and bar for each area. >> we offered everything you want at the facility, offered in

patchy drizzle coming up. details straight ahead. live from the kgo tv broadcast center. this is abc 7 news. it is not going to be 100%. not for a long time, maybe never, but what he gets is going to help him through now. >> an $18 million civil verdict today for the family of brian stowe. the man left brain damaged after he was beaten at dodgers stadium in 2011. but only a portion of that money will come from the los angeles dodgers. i'm dan ashley. we have team coverage for you. >> we begin with felix michaelson in los angeles. >> reporter: well, dan, this trial has been under way for several weeks, the stowe family has waited three years for this verdict. they sat in the courtroom as the verdict was read, and were in tears. >> brian michael stowe versus

l.a. dodgers. >> reporter: a jury said the dodgers did not provide enough security for opening day 2011 when giants fan bryan stowe was severely beaten. >> the dodgers, llc, yes. >> reporter: the jury awarded stowe more than $18 million in damages, the dodgers will have to pay about $14 million of that. with norwood and sanchez responsible for the rest. the dodgers owner frank mccourt was not found negligent at all. the family was asking for about $35 million in damages but say they're grateful with the verdict. >> we're through with it, bryan got some money, and it will be towards his recovery. >> reporter: the dodgers have not decided yet whether to appeal. >> don't necessarily agree with every part of the decision but we certainly respect the decision. >> reporter: the jury deliberated for several days and at one point said they were
