it is muggy this morning. >> it has been a roller coaster, up-and-down, up-and-down it is more human because we have increasing marine layer and it will stay with us for the duration of the week end. live doppler 7 hd shows we are certainly picking up returns of coastal fog and patchy drizzle. you may have to use the windshield wipers. you can see we have a bit of a breeze and mostly cloudy start to the morning with increasing clouds across the bay area and it will dissipate revealing a little bit of sunshine and most of the sun is going to be inland. the, few days it will be warmer and with the muggy conditions it could be hotter with the full seven-day outlook straight ahead the right now we are headed into san jose where matt keller is on the scene of the fatal crash northbound 101 at lawrence expressway a signature alert

with an investigation taking place so that can impact your commute. plan ahead. 101 looks like traffic is moving along fine. further in san jose northbound 880 we have an accident possibly blocking one lane so far, though, traffic is moving along fine. mass transit, muni, bart, ace train, running on time and this is the bay bridge toll plaza where traffic is light. friday lite. more on the sig-alert in the south bay, the deadly crash in sunnyvale we will keep the busy 101 off-ramp closed. matt keller is on the scene with more on the breaking news. we i was told by c.h.p. the woman who died in the accident is the registered owner of the honda accord that is in the ditch off the lawrence express we. this is off northbound 101. it is believed the driver was

her husband. he is at the hospital. a blood test having done. he is expected to be charged with felony d.u.i. and vehicular manslaughter. c.h.p. says the driver was speed when the car flipped into the ditch before 2:00 a.m. and investigators believe no one was wearing a seatbelt. firefighters had to arrive to rip-off the door and take owe the victims. three men and a woman were taken to the hospital with moderate to major injuries. the coroner took arrest the fatal victim's identity. investigators believe all the occupants were away the same age, this their 20's and c.h.p. says the smell of alcohol from the occupants was overwhelming. >> the surviving female, it was her 23rd brought and we assume they were coming from a birthday celebration. from how they were dressed. >> the investigation could take a few more hours and they hope to have the lawrence expressway off-ramp open by 7:00 a.m. this

morning. >> developing news concerning the malaysian airline shoot down. there are conflicting reports this morning of whether the plane's black box recorders have been found and who has them. katie marzullo is in our newsroom with the latest on the crash. the black boxes are very important. they could be. the crash site is controlled by pro-russian rebels and they have recovered the data and voice recorders and will send them to now but this morning an aviation expert says the black boxes may not be crucial as we already know what happened to the plane. he says more important will be the forensic investigation at site with analysis of the wreck an helping what kind of missile was used and where it came from. >> 298 people on the plane were killed including three infants. also, 100 people who were headed

to the international aids conference in australia including a pioneer in aids research. not every passenger's nationality is determined, no americans have been identified. 181 bodies have been locationed so far at the site and the malaysian government is sending a 62-person team. >> it is essential the integrity of the site be preserved out of respect for the investigation and for those would have died. the plane had a clean maintenance record in the last check was july 11 and it got a clean bill of health. a senior administration official telling abc that f.b.i. and ntsb officials are headed to ukraine in an advisory role in the crash investigation and not clear whether they will go directly to the crash site or elsewhere

>> covering fremont, palo alto, north bay and all the bay area, this is abc7 news. there is a new legal twist in a police beating seen being punched by a c.h.p. officer in los angeles filed a lawsuit claiming assault and battery and excessive force. the officer had to subdue the woman when she what not stop waking in and out of traffic but the officer went too far according to the family. the attorney says c.h.p. is trying to demonize her by questioning her mental health. >> the prosecution are undecided awould whether to charge a santa rosa woman with attacking a 12-year-old boy at school. the mother was arrested in may after going to the school and confronting the boy would claimed she was bullying her daughter. the 30-year-old is accused of grabbing the boy by the throat

has how long the ramp could be close asked heartbreak new details of people involved. >> this was a birthday celebration that turned deadly. a survivor turned 23 yesterday and another young woman died here at the accident site. you can see the vehicle in the ditch. investigators say none of the five inside the car was wearing a seatbelt. >> we showed up some were outside the car, some were still trapped. we had a female partly ejected. we tried for extricate them but we could not until the fire department showed up. >> c.h.p. says before 2:00 this morning the driver took the lawrence expressway exit off northbound 101 in sunnyvale too fast and the car flipped into the ditch. three men and a woman were taken to the area hospitals with moderate to serious injuries. the woman who died was the regular officered owner and her husband was the driver.

a motorcycle officer with alameda county sheriff was the first to arrive and the sheriff says he had to shoot the suspect to protect himself and the woman. investigators are also looking into reports the subject was trying to hit the officer and the woman with his car. the suspect had a history of domestic violence. >> police in corte madera say a family doctor had no right to shoot another man who followed him home and drove his car into the doctor's garage. officials say the 71-year-old dr. simon and the other man had an altercation while driving. simon drove home and the other pulled in behind him not letting him close the garage. simon got out the garage, retrieved a .357 and shot the victim twice after shooting a warning signal. >> dr. simon as safe with access to cell phone and could call 1991 and armed with a handgun and no one was attempting to

enter the resident. >> in a statement the lawyer says that incident a clear case of self-defense. you can read the entire state on our website at abc7news.com. stockton police are defending the decision to fire at armed bank robbery suspects even though it resulted in the death of a hostage. misty holt-singh a mother of two was killed on wednesday after three men robbed a bank of the west branch and led police on an hour long chase. a memorial is outside of the branch and the chase ended with the two suspects dead. mit mist was used as a human shield by the only surviving suspect a 19-year-old jamie ramos. >> the suspect had to be stopped because of the fear of the continued tamed killing of police officers and others. >> it makes me angry. that could have been my wife,

evacuation notice for the town along the column why river because of an 18,000 acre wildfire. boys say flames reached the town in east central washington and the three rivers hospital is evacuated. 35 homes have burned since lightning ignited four fire on wednesday and the fires have merged into one mass i fire. a federal grand jury in san francisco has indicted fedex for knowingly shipping prescription drugs from illegal online pharmacies. the indictment accuses fedex of ignoring warnings for a decade and will plead not filly and say they cannot check every package they ship. in a strongly worked statement they say that "we have no interest in violating the privacy of our customers and we stand ready and willing to support and assist law enforcement but we cannot, however, do the job of law enforcement ourselves."
