>> i just asked him if i could get a fist bump. >> reporter: another guest asked about the death penalty ruling, that it was unconstitutional. >> he was wonderfully optimistic, and criminal justice is an issue close to his heart. gave me great confidence that criminal justice continuesing to an important issue for him. >> this was the president et cetera 18th bay area visit. david louie, abc 7 news. >> in san jose, a man has filed a lawsuit against the san jose police department. that violent incident was caught on cell phone video, as police grabbed 23-year-old nate howard and forced him to the ground. he was in san jose to give a keynote speech. wayne freedman joins us from san jose. wayne? >> cheryl, the incident just happened a few feet away from us. it was last may 24th. the san jose police department receives some 200 complaints

every year. >> this is the incident, march 24th captured on a cell phone. it shows san jose police and a group of african-americans, many of them san jose state students. watch carefully as police throw 23-year-old nathaniel howard to the ground. his lawyer says for no reason. to date the lawyer committee for civil rights filed a conduct complaint against the san jose police. >> there is concern that excessive force yew used and the allegations in this complaint are that excessive use of force was implemented, that it was unwarranted, because he posed no danger, no threat to public safety and didn't appear tore interfering with the officers' duties. >> in a than natural howard is a motivational speaker who teaches high school students to write and perform poetry. he had made a speech earlier that day as san jose state's graduation ceremonies.

after the incident he filed a complaint with the internal affairs division. when he heard nothing from them, it escalated with the complaint to the independent police auditor. >> we determine if their investigation was thorough, fair and objective, if the analysis was objective. if we disagree with how they've handled it, we send it back. an oakland woman has been arrested for leaving her children locked in a hot car while she gambled. livermore police arrested her at casino 580. they say she let her two children, ages 2 and 3, strapped in their child seats inside her car in the casino parking lot. she is accused of child endangerment, her children have been placed in protective custody. they were not injured. firefighters are at six flag discovery yay kingdom after a fire on one of the rides. it shows you crews putting out the fire on the thrill a gorilla

. since then, 34 israelis and more than 700 palestinians have been killed in the fighting. the u.n. has condemned both sides for a growing number of civilian deaths. the first bodies of the victims on malaysia flight 17 are now back in their homeland. 40 wooden coffins were carried off a plane this morning in the netherlands. and then a procession of 40 hearses carried those bodies to a military base for identificati identification. 193 of the 298 people killed on that plane were dutch. meanwhile, the black boxes arrived in england today for analysis. runna continues to deny in i direct involved in the attack, and is blaming ukraine. >> we know that the ukrainance didn't have any kinds of missiles and instead haven't used any during this conflict. >> adding to the growing tension, two ukrainian military

jets were shot down today. not far from where that passenger plane was downed. a well-known designer died yet. 38-year-old george was the founder of infinite collective. he designed many mechanical devices. san francisco police say she was riding his skateboard along 8th street when he collapsed. authorities have not determined the cause of his death. two gang members who killed a toddler in east oakland three years ago learned their fate today. it's a tough sentence and the little boy's family is apparently satisfied with it. vic lee is live at the courthouse with the story? vic? >> carlos navez' mother sobbed quietly as the judge spoke about the cruelty of the shooting. judge jeffrey horner called it cal louse alou

callous, and horrifying, in his own words. prosecutor ben belltramo says that carlos' family believes justice has been accomplished. >> they ask the court that the court impose the most maximum penalty allowable under the law so, that any other family -- no other family would face this tragedy again at the hands of these defendants. >> lawrence denard was given 137 years to life. willie torrance will serve 121 years to life. their family and friends came to the hearing. carlos' mohr and grandmother attended. the 3-year-old was shot as his mother pushed him in his red and blue scooter down international boulevard near 64th. two others standing nearby were wounded. the apparent targets were rival gang members. the child was hit by a stray bull let. a massive police hunt ensued

with officers working overtime up a departmentwide tactical alert, all looking for the killers. before he passed sentence, the judge said at 3 years old carlos nava had every reason to believe his world would be safe, filled with love, that he would be protect to do dream and grow. all of that was ripped aid part. denard's attorney annie bellas says her client has always maintained his innocence. >> the witnesses came in and didn't identify lawrence, because he was not there. demonizing and dizzy humanizing people from our community does no justice to anyone. >> reporter: she says she will appeal the sentence. the two must serve at least 100 years before they can be paroled. vic lee, abc 7 news. a federal grand jury issued a three-count indictment against kwan fam howard, a well respected -- he is accused of

stealing money, jewelry passports, prescription drugs and weapons. investigators say howard told his staff to let him known anytime expensive items were loose in the mail. they say he would confiscate those items. the city of francis has a new balanced budget tonight. the mayor signed the two-year 17.2 billion budget this morning after it was unanimously approved. the budget includes $50 million in new fund fog affordable housing $56 million for social services including help for seniors and veterans. $83 million for the street's repaving program and 10% increase for muni. the city of oakland has been trying to improve education and close the literacy ga many for a long time, but today it received some high-powered help from former secretary of state and possible presidential candidate hillary clinton. laura anthony has the story. >> you talked to yourings sister and show her books?

enrollment growth at california state university would be cut in half this fall due to a funding shortfall. the system was expecting to admit 20,000 additional students this fall, but that number is anticipated to be 10,000. "los angeles times" reports that state funding fell short of expectations by $95 million. still official at uc say the number of new students from other states and nations will will increase in tall expecting to reach over 20%. an international ring of hackers is accused of accessing more than 1,000 stub hub user accounts, and using them to buy tickets. police announced seven people from the u.s., russia, england and canada face charges in this

case. they're accused of using the stolen information to buy 1$1.6 billion worth of tickets and then reselling them. stub hub says thieves accessed data there other retail sites or through mall ware on customers' computers. they detected the breach last year and gave refunds. urban outfitters is being compared by a bay area addiction treatment center. they handied on the pens that looked like, check it out hypodeterminic needle to promote the partnership with the hair salon called hair-owin. they have i love hair-owin on them. it says that campaign is in poor taste, but they worry that drug addicts might have a relapse. >> people that have been shooting heroin see a fake syringe that look just like what they used to shoot up triggers the desire to use drugs, to do

abc7news.com, click on the sections tab and look under 7 on your side. you may recall the story of the aggressive comcast agency who kept the customer on the phone for 20 minutes trying to talk him out of the cancelling a service. a leaked memo written by a comcast executive said the agent was doing what he was trained to do. the now infamous call was recorded by a journalist, the agent would let him cancel. >> help me understand why you don't want faster internet. >> help me understand why you can't just disconnect us. >> comcast apologized after that recording went viral, and then dave watson said he was listening to the call was painful, but the employee was just doing the job. watson wrote -- the agent did a lot of what he trained him and paid him and thousands of other retention agents to do. he tried to save a customer.

here. from your emeryville camera, just in cloud inness, patchy low clouds tonight. getting hot the next few days and it will remain warm at the coastline as the sea surface temperatures remain on the warmer that is average side. that cold front moving away from us, slightly drier area follows. what we'll see is a big change-up in our weather. hot air will start to move in our direction. we're shifting to a hot pattern into the weekend. tomorrow morning patching of fog, mild out there in our inland valleys, and pretty clear skies, as the humid yet as left us, it certainly feels better than days past. tomorrow morning the fog that will be around first thing will clear out quickly. we're not expecting any patchy drizzle. a big warm-up for tomorrow afternoon. 70s coast side, 90s inland, it will be sunny from coast inland.

architectural firm. you can see the two new towers there. what do you think? the design includes what would be the second tallest building in the city at 910 feet high. the towers are part of a redevelopment effort for a block of the city's south of market area at 1st and mission streets. a father and his kids were kicked off a plane for something he said on twitter. on sunday he was trying to board a flight in denver in the a boarding group, but a 6-year-old and 9-year-old kids were in a different boarding group. the agent wouldn't let him board with his kids in the a group. once he got to the he tweeted about what happened, but was soon ordered off the plane. >> something to the effect of, wow, rudist agent in denver, kimber gate c-39, not happy, and that her safety feels threatened at this point because of what i tweeted. >> well, after deleting the tweet, watson and his kids were

allowed on the flight. southwest has since apologized, but watson says he is never flying southwest again. another parent, this time in missouri, got in trouble for social media posts involves that are kinds mandy kay wilson tonight a picture of her son during hess doctor's appointment. she said a doctor and security guard confronted her ade said what she does violated patient privacy laws. >> you can't take pictures. it's against policy. she was waving her hands in my face, and i was kind of like, i've been able to take picture here before, i don't know what the problem is. you've never said anything before. i've always taken picture. >> wilson says the security guard demanded her phone so he could delete the picture. instead wilson left. coming up next, a sweet gesture from a new neighbor. >> why basketball phenom lebron james is apologizing to his new neighbors in ohio. that story is coming up.
