police have decided whether a racecar crash involving nascar champion tony stewart is a criminal case or a tragic accident. investigators are now revealing details about the crash that killed 20-year-old kevin ward, jr. in upstate new york. three-time nascar champion 0 tony stewart hit ward with his car when ward walked on the track in the middle of a race. here's the story. >> tonight, nascar driver tony stewart says there aren't words to describe the sadness he feels after hitting and killing a fellow racecar driver last night.

>> it's just an unbelievable tragedy. >> witnesses say the driver, 20-year-old kevin ward, jr., appeared angry after crashing during a race near rochester last night, getting out of his car and walking on the dirt track, pointing aggressively at stewart's approaching car when he was hit. >> that is a dimly lit part of the track. that is something that is looked at. there is no evidence in hand or no facts that would support a criminal charge. stewart, cooperating with investigators pulling himself out of today's nascar race at watkins glen, saying it's a verbal emotional time for all involved and the reason i decided not to participate today. >> stewart is known as a fiery, controversial racer. last year he was caught on camera punching driver joey logano, and in 2011 he was questioned by australian police after reportedly hit hitting the

owner of a racetrack. he return to racing after he broke his leg last year. he said his thoughts and prayers are with ward's loved ones. >> people have left flowers mourning the loss. the sheriff says they're still investigating. happening now. wildfire fears height 'ed today witch thunderstorms and lightning expected in part0s norway california through tomorrow. several counties under a red flag warning, you can see them on red on a national weather service map -- the fire weather watch is in effect for other counties, including sacramento and solano county. abc7 emergencies frances dinglasan is tracking the weather. >> live doppler 7hd showing you the area of the map where we have the weather watch. this does include areas in solano county, vallejo, benecia.

the red-flag warning in higher elevations, and we have had numerous thunderstorms and lightning strikes in the sierra. here's all the lightning near lake tahoe. this is all due to a low pressure system bringing some moisture into the bay area. we will have a chance of lightning as well tomorrow, into tuesday. i'll let you know more about that and have the forecast coming up. >> four wildfires continue to burn this evening in northern california. all north of sacramento. together they story scorched nearly 146 square miles. fires started july 31st and destroyed seven homes and two commercial buildings, now 45% contained. to developing news in san jose where thety is preparing to clean up a homeless encampment

amid appearinger and confusion. homeless advocates rallied at the jungle. it's silicon valley's largest homeless encampment. we're live in san jose to see why not everyone is happy about the cleanup effort. reporter: on friday the city posted signs letting people know they were planning to clean up part of the park, and they had the days to pack up their things and leave. today i spoke with the city's homeless services director, who told me they're only cleaning up a small section where ten or so people lived. >> this is home for us. and as bad as it may look or whatnot, this is home. >> raul hernandez has called the jungle his home for six years. he is worried he might be forced out. a notice found on his tent friday says the city of san jose will bell cleaning up illegal encampment and trespasses face

criminal prosecution. homeless advocates rally to patriots what they believe was an eviction. some already started packing. >> there's over 200 people living down below and those people have needs and the city is just ignoring those things. >> not so fast. the city's homeless services manager, who could only be reached by phone, says they have plans to clean one section of kelly park, not the entire thing. cleanup crews will pick up garbage on the eastern bank of coyote creek. there are also plans to put up fences in the dirt lot to keep out illegal dumpers. pastor scott wagers with the ministry that organized the protest says it will prevent them from dropping off food donations. >> the churches want to help the city, but the city is going to make it impossible because the city strategy, in my opinion, is to try to isolate the homeless. >> some other residents, like sammy, want the city to take a tougher stand on the encampment, saying it's a safety and health

hazard. >> it's time to clean this mess up. the merchants around here are going crazy. everywhere you go there's penal panhandling. >> cleanup starts monday morning at 7:00 a.m. >> they do not plan to throw away tents or personal property. the city holds on to those items to be picked up for 90 days. live in san jose, abc7 news. >> new details tonight. police confirm man accused of a deadly stabbing in san jose is the victim's son. a man stabbed his father several times and wounded his mother last night inside a home on charter oak place. police arrested the son five blocks away. neighbors say he is in his 20s and say there's been previous conflicts between the man and his parents. >> man. died after being struck by several cars on eastbound 80 just after the carquinez bridge

toll plaza. the first man who hit the man says he saw him with his peripheral vision was not able to stop in time. details on a deadly crash involving a large brick pizza oven on friday. the chp now identified the victim as dwayne usher of vallejo. he was waiting to turn on to lake veil highway when the trailer carrying the oven broke loose, slamming into his car, killing him and injuring his to sons, ages four and eight. the children have been released from the hospital. a woman riding in the passenger seates still in the hospital. investigators impounded the oven owned bay petaluma restaurant to determine itself was being properly towed. >> now to the crisis in iraq. american fighter jets bombed islam jim militants today while politicians argued whether president obama should escalate the u.s. military presence. fieger jets and drones destroyed an armored personnel carrier.

>> rescue crews helped passengers. the ride suddenly stopped, stranding passengers 45 feet in the air under the blistering sun. rescue workers provided humble las to those waiting to be rescued. commuters in the east bay tomorrow won't be stranded but delayed because of work on the caldecott tunnel. caltrans has been working on the number two bore this weekend, the one on the left as you go east. it will re-open at 7:00 tomorrow morning. only affects eastbound traffic on highway 24. workers are re-aligning the approach to bore number two to make the drive straighter. here's a live look at san francisco international airport where two runways are back open a month ahead of a schedule. they closed back in may.

we're in the final hours of the outside lands music festival. except for noise complaints the festival appears to be another big success. organizers said they've made adjustments in the sound and amplification system in response to complaints. the killers and fiesta will close out the festival tonight. >> time for a check on our weather with abc7 news meteorologist frances dinglasan. a little clearing today. >> we saw more sunshine and temperatures were a little warmer, about i want to take you up to the tahoe area. there have been numerous lightning strikes, and you notice there could be heavy rain in some areas. this is all due too an area of low pressure that is just circulating off our coast, and

you kind of see this counterclockwise circulation, a chance of lightning over coastal waters tonight and tomorrow. what this means for us and in the bay area, we saw some partial clearing as the air circulated this way, counterclockwise again. but with the continued circulation into tomorrow, we could see some lightning strikes tomorrow afternoon, into tuesday, most likely in some of the higher elevations. i'll take you back up to tahoe with the live view. we can see the lying rain falling from the clouds right now. temperatures in san francisco, 67. oakland, 70. san carlos, 73. san jose, 77. also, take you to another live shot, this time beautiful bay. some high clouds over parts of the bay as well. temperatures were a bit warmer. santa rosa, 76. novato, 77. fairfield, 81. con ford, 75 -- concord, 75. quite a range but we did warm up

compared to yesterday. saw more sunshine and you notice. sfo 12 degrees warmer compared to 24 hours ago. we're showing you a shot now of more blue skies over san jose. so, we're going to see a chance of spotty drizzle again overnight. lightning is possible tomorrow. monday into tuesday. but we'll have the best chances of seeing it in higher elevations so some of the east bay hills possibly. and then a versutele and slow warming trend that continues. this week into next weekend. very, very subtle. so the water vapor image shows you the moisture content in the atmosphere. we saw the circulation of the low again. that moisture will pull up, bring us a chance of lightning tomorrow. it's slight. we'll see spotty drizzle overnight into tomorrow. the forecast model shows the clouds spilling in again to the bay overnight. we did get a few areas in the

higher elevation reporting was 01 of an inch today. so, overnight lows in the 50s. 56 in san francisco, san mateo and oakland. a very narrow band of temperatures, mid-to-upper 50s. tomorrow should be another pleasant day. warm in the south bay. san jose, 81. 85, morgan hill. a comfortable 74 in santa cruz. we'll see upper 70s through redwood city, mountain view and could get more clearing along the coast, so 65, pacifica, 6 of downtown san francisco, and upper 70s in petaluma, napa, 75. east bay, low 70s. inland numbers, warm again. so holding steady compared to today's numbers. so 82 in walnut creek and in pittsburg, a little warmer in antioch. here's the accuweather
