this week an appeals court in san francisco take up the lawsuit by san jose against your league baseball asking to strike down the antitrust exemption used to block efforts by the a's ownership to move to san jose. san jose is their territory. >> they could lebanon oakland and relocate to another city if they will pay. the case goes to court tomorrow. a ruling is expected in the fall. >> crews in san francisco will clean up at the outside lands festival which wrapped up yesterday in san francisco. dozens of musical acts performed during the festival at golden gate park including kanye west, and tom petty and the heartbreakers. there were a few parking and noise complain issues and several were arrested for selling fake tickets.

bloomy-looking monday morning. this is downtown san francisco and mike will have the forecast. leyla gulen is following the traffic. investigators are asking racing fans to hand over videos or photo they have of a fatal accident involving tony stewart who hit and killed another driver over the week end. the question is: was it an accident? accident? or not? >> racing community mounts the loss of kevin ward jr. the future of one of nascar's biggest stars is in question, tony stewart. he did not race in the cup and decided to pull out after saturday's horrible tragedy at the track. >> during the race kevin ward spins out and hits the wall then ward gets out of the car and as you can see in this video
