in missouri tonight a friend of michael brown, the teenager killed by police confirmed the two did steal something from a veengs store just before brown was shot. here is surveillance video showing the clerk stopping two people, police say the man in the red hat is brown. he pushes the clerk, and then walks out. police say he took a $50 box of cigars. today, brown's family says

police released the video to draw attention away from the shooting. >> whatever that took place there had nothing to do with an individual getting down on his hands and knees, raising his hands in the air and saying don't shoot. this is a universal call for i surrender. i can hear my cousin's voice saying don't shoot. >> the police chief says the officer didn't know the teen was a suspect. he was stopped because they were walking down the middle of a street, blocking traffic. another protest is scheduled for tonight. his family has called for no violence and are pleased the federal government has begun an investigation into this shooting. >> an austin grand jury indicted texas governor rick perry for abuse of power the republican governor accused of carrying out a threat to veto $7.5 million for state public integrity unit.
