located. 98th avenue. that's where we have do have traffic that's affected. also bart tracks they run right through that area so they might slow as they pass by the fire. eric, katie. >> thank you. it's 6:02 now. developing news from overnight. a wild traffic accident sends ten people to south bay hospital. several of them with life threatening injuries. this happened near the capital suppress way. that's where abc 7 reporter nick smith is. he joins us with this live report. >> reporter: good morning. we have new information. i can confirm that that driver is in his 20s. we know that he has been medically treated and released. he will be charged with felony dui. take a look behind me. you can see the crews are still here working to clear up the scene. santa clara county will have to clear up the debris before the intersection with open because the glass and oil and fuel spilled in the street.

they received a call about a crash at the intersection of east capital expressway near reed hillview airport at 9:30 last night. a black mercedes was speeding. ran a light, bread sided another car causing the mercedes to several times before bursting into flames. >> we are looking for causes of the accident. reason why the driver was driving at that high rate of speed. we were not in pursuit. we weren't behind this suspect's vehicle at any time. his sobriety is a question. we will be looking into that. >> investigators tell me once the car came to rest, the driver of the mercedes got out of the car and tried to run away but he was caught just a short time later. now, this is what we know. two children were hurt in the crash. the driver of the mercedes had three people in his car who are now being treated for life

threatening injuries. the cops used four fire extinguishers to try to put out the burning mercedes with people trapped inside. fire fighters had to use saws to cut the doors off. they are trying to clear up the last of this debris on the street. until they can take that away, this intersection will remain closed. we're told they are hoping to get it open within the next hour because they do want east capital expressway open in time for the morning commute. in san jose. abc 7. 6:04 now developing news from overseas. a significant victory being claimed over islamic in iraq. an iraqi spokesman said troops were backed by aerial support but didn't specify whether u.s. fighter jets participated.

into flames. officers battled the flames with fire extinguishers, they also arrested the driver of the mercedes after he tried to run away. the crash involved a total of 8 vehicles. police believe alcohol was a factor. >> police in east palo alto are investigating a shooting that took the life of one person and sent four to the hospital. gunshots hang out after 11:30 sunday night. police arrived to find 5 people suffering from bullet wounds. two were rushed to the hospital. another was pronounced dead at the scene. police do not have a suspect or motive in this shooting. >> we're learning new details this morning about a fan who died during sun's 49er's game. stadium staff responded to a cardiac emergency during the third quarter and administered cpr but the unidentified man did not regain consciousness and died of a heart attack. in a statement the team said the

traffic accident sends ten people to south bay hospitals. several of them with life threatening injuries. it happens near capital expressway. our reporter nick smith is live there this morning. nick. >> reporter: good morning there, katie. her doing their best to get this intersection clear so they can open the roadway in time for the morning commute of right now crews are cleaning up the last of the debris that was left behind. we know the driver was in his 20s and we also know that he will be charged with felony dui. there were no fatalities but at least ten people were taken to the hospital. cops say a b was speeding. ran a light, broad-sided another car causing the mercedes to flip several times and hitting other cars in the process before bursting into flames. the driver had three other people in his car being treated for life threatening injuries. you can see at the intersection they have removed the cars.

they are cleaning up the last of the glass and debris. we do know that everyone who was involved in the accident are expected to survive. their injuries right now east capital expressway remain closed but it should be open in the next 30 minutes in time for the morning commute. investigators have not said what cause that had driver to take off in the high rate of speed. >> in san jose, nick smith, abc 7 news. >> the family of a 2-year-old girl who was killed in a hit and run in san francisco held a vigil at the cross walk where she was hit. she was at a cross walk on mission street with her aunt and twin brother where she was hit around 10:30 friday night. now relatives are pleading with the driver of the car to turn him or herself in. san francisco police released this picture of the car. it is a white 4 door toyota or lexus sedan. so far it's the only lead investigators have.
