ashley in for larry beil. >> angry but peaceful march and rally at the san francisco federal building where a federal lawsuit has been filed against alex nieto. >> abc 7 news reporter is live at the federal building with the latest. vic? >> reporter: the rally here at the federal building just ended. there were 50 people here, double that number during the march from the heights to the federal building. it has been a long, long day for the friends and family of alex nieto. >> the day started with a small, sunrise gathering at the site in bernal heights. dancers marked the five-month anniversary with an anniversary and calling the spirit from the other world. maria is angry at what she call

asz senseless police shooting. >> policy changes need to happen. officers need better training and think before they shoot. >> reporter: the 28-year-old was shot and killed last month. officers say they fired when he appeared to draw a weapon. it turned out to be a taser. >> this is the actual weapon mr. nieto had. >> reporter: he told a town hall gathering the officers thought it was a real gun. he never pointed the taser at officers. they hope a federal lawsuit will clear the air. >> we want transparency here to help the family cope with this devastating loss. it will help the community heal. >> reporter: the march through the federal building started before 1:00 this afternoon escorted by police. 100 people walked from bernal heights to the mission district. it took three hours to reach the

federal building. it was noisy, but peaceful. the attorney, john burris filed a lawsuit earlier in the day. >> there's now a time where we, as a city of black and brown, you know, lower economic class, working class folks, need to say we have had enough. >> reporter: an internal police investigation cleared the officers involved in the shooting. those at this rally want another review by the justice department. vic lee, abc 7 news. a man shot by police in june filed a $2 million lawsuit against the city. they claim police used unnecessary force when they shot him in the stomach outside a home on sycamore drive. his attorney says he was unarmed, made no threats and the police didn't say anything before shooting him. we were over levi's stadium earlier today as workers were

installing brand-new sod two games before the home game. they ripped out the grass yesterday after some players slipped on loose turf during practice on wednesday. the turf put in today is a temporary fix and will install a permanent field next week. players practiced at the regular training facility next door to levi's stadium. bruce ellington says he's confident in the new sod. the head coach, jim harbaugh seems ready to talk about anything else. >> i'm not an expert on it. hopefully when we play sunday, it's good and we will be ready to play. >> it will be right. we have total confidence in that. what more is there to wid l away here. >> the team is trying to intercept another problem. >> that's right. some are raising concerns about the railings ahead of the niners second game sunday.

>> katie marzullo has more. >> reporter: under cover of darkness, a shipment of new sod arrives at levi's stadium. then sky 7 shows crews putting in new turf. they ripped out the old, but new supergrass. after the first game, players were tripping and slipping. this morning, a team spokesman says heavy equipment will ensure it is pressed tightly into the ground and seamless. plus, he says it roots are twice as thick as normal sod. this morning, a one-man crew said for fan safety. personal injury attorney says the glass railings at the sky box level are too low at 30 inches, he says someone could easily fall. >> i'm sure the 49ers don't want fans getting hurt. it just seemed like when you have excitement, athletics and alcohol, this is just a disaster waiting to happen. >> reporter: california code calls for 42-inch railings at

most stadiums, but there are exceptions. the 49ers released a statement saying levi stadium passed all inspections prior to opening and have been ensured it is in compliance with laws and building codes. the niners play the chargers sunday. the turf will be ready to go. the team spokesman tells me the 49ers were not anticipated needing to replace the turf this early. itis not an uncommon practice in the nfl. the philadelphia eagles just resodded monday and played a game on thursday, he say, without any problems. katie marzullo, abc 7 news. one of the former owners of a petaluma slaughter house pled guilty to meat diseased towns. he faced three years in jail for processing contaminated meat from the company he co-owned.

76-year-old and two employees would chop off the heads of cancerous cows to pass a usda inspection. that led to the recall of 8.7 million pounds of beef earlier this year. the sheriff from marin county identified two men shot to death in mill valley's strawberry manor neighborhood. we were over their homes yesterday. 61-year-old ted robin of mill valley and 41-year-old andre ya. the victim was a musician in marin. this is a youtube clip of him playing in a gig with his wife during a show in 2009. it appears credin killed robin and went to his own yard and shot himself. two police officers in fairfield are under investigation for using work computers to look up women on dating websites, then search for them in police data bases. in one case, a witness said one

officer looked up women on care.com, a website used to find baby sitters and the other ran her name in data bases. they are still working their normal jobs at the department during the investigation. the senator says he will, quote, pursue his innocence after his release from sacramento county jail today. that's his mug shot on the right. they arrested him at 2:30 this morning on drunk-driving charges. he was driving the wrong way on a one-way street. this is him hours before the arrest. it shows him partying with other lawmakers, drinks in hand at capital city restaurant. his lawyer released a statement contradicting his comment saying he accepts complete responsibility for his actions. a back-up at the richmond-san rafael back up was

longer than usual this morning. >> late into the commute, it was slow going to get on to the bridge. >> wayne freedman is live at the toll plaza. wayne, explain the back up, please. >> reporter: well, it was unusual and a surprise. if we lived in a perfect world, all red lights would sync and there would never be a back up. it was a big one. take a look. here is the video from sky 7 and this after the back-up began to improve. if you were in it this morning, it may have made you late. now we know the reason why. on fridays, during summer, they have run the bridge with three toll takers instead of four due to historically lighter traffic on fridays. they have been trying to save money. clearly, something has changed. here is randy. he speaks for the mtc. what happened today that made the traffic pick up. >> it picked up. could be people going back to school. often folks don't work on friday. you are seeing change.

from sky 7 hd. this is at the metal yard. crews are on scene. you can see all the thick, black smoke coming off the fire. it is actually a family owned business. they employ more than 220 employees. again, so far, no injuries we are hearing of. we will continue to monitor this. we have the latest throughout the newscast and it continues on twitter. people in illinois and indiana are mopping up today, following some of the heaviest rain they have ever seen. aerial shots from northeast of indianapolis where more than 10.5 inches of rain fell in a matter of hours. several homes under water. roads closed and students told to stay home from school. this looks much the same outside chicago where more than four inches of rain fell on interstate 90 in the chicago area. too much rain is triggering

mudslides in north central washington. several inches of rain with mud that undermine homes. that's 200 miles east of seattle. other homes and barns were washed off their foundation. crews spent the day clearing mud and debris that washed on roadways. sections of highway 20 and 153 were closed overnight. a new law lets pet owners in california dine with their dogs on restaurant patios. dogs are allowed inside the fence with outdoor seating. it doesn't require all businesses to permit pooches on the patio, but has guidelines for those that do. most lunchtime customers don't mind sharing space with well behaved pets. >> there needs to be some limits to the amount of dogs allowed on a patio. you can't just be a dark park in a restaurant. >> there's a lot more people

court. >> people that have been there 30 or 40 years. >> reporter: he lives in the apartments in knob hill. he's the son of san francisco mayer and now a lawyer to make sure the owners compensate the tents they want to evict. they will have to pay them $1.1 million. >> all of a sudden, they are bounced out, forced out into this market and they have to have some kind of relief for it. >> reporter: the property owners went to district court to challenge the law that requires property owner who is want to get out of the rental business to pay the difference between the current rent and comparable housing. that means having to pay $117,000 to their tenant that lives in the lower unit of their building. $117,000 would wipe out a big chunk of retirement all for wanting to have friends and family stay in a unit below. >> we are semiretired this year.

employee at dickey's barbecue pit burned her tongue a month earlier. it's sodium hydroxide or lye. >> the company didn't notice there was a hazardous substance, it wasn't properly labeled or controlled. >> reporter: dickey's did not comment on the new allegations. she drank the tainted tea earlier this month after an employee mistook the substance for sugar mixing it in. the district attorney is likely deciding whether to file criminal offices this week. >> they are treating it with the seriousness it deserves. >> reporter: dickey's restaurant saying the worker involved no longer works for the company. adding the entire dickey's family is saddened by the event that is occurred in utah and takes this incident seriously. >> i want there to be change. to whatever extent there needs

we have been trying to get there. it is the alco metal and iron company on mare island. about 3:30 this afternoon, a dark plume of smoke billowing east. the good news, if there is such a good thing, the fire is in an isolated yard. plenty of wind when it broke out this afternoon. it's since dissipated. they were fighting it from a crane so they could put more water on it. since then, the smoke dissipated. it's more gray. it doesn't look as furious as it did earlier. the news at this point is for people within the realm of that smoke. solano health has not issued warnings, yet. they are monitoring it. the smoke is blowing east over an unpopulated area. could be a lot worse. yes, frightening from a distance. we'll see it from as far away as
