el cerrito. dan? >> wayne, thank you very much. when you get there, we'll have more from the scene. thank you, wayne. breaking right now, a large fire burning in santa clara. this is video from a half hour ago after it broke out on alfred street. >> it's hope services. according to the website, they provide assistance for people with disabilities. >> on fire are donated goods like clothing, electronics or furniture. let's look live at the scene. firefighters have been able to contain the fire to the parking lot. >> robin is with hope services and joins us now on the phone. robin, are you there? can you hear us? >> caller: i'm here, thank you. we are grateful no one was hurt.

we are -- this is a staging area where we collect items that are donated to hope services. we support people with developmental disabilities. we have been around about 62 years. i think people are well aware of our trucks that go around and collect discarded items and then we collect them and then help put people to work who have disabilities that might not otherwise have jobs. >> is it mostly clothing? >> caller: we believe it's mostly clothing. it started about 4:10. everyone was gone for the day, so nobody was injured. we lost three trucks. they are trucks that collect donated items. it's an impact for us. >> it is. most of the people had gone. were some worker there is? any idea what may have started this. >> caller: no idea how it started. it started in a big that had clothing and donated items.

answer but rather a temporary solution. we have heard from coach harbaugh and the team's coo. they say a permanent solution is in the works and work on that may begin after sunday's game. at the rate the replacement process is going, the niners are hopeful the sod will be in place by tonight. there are no guarantees. the crews are pain stakingly laying the thicker sod so there won't be seams. the rolls are being compressed so they lie flat. they are turning down interview requests. they will figure out later who or what is at fault. coach jim harbaugh talked about having it ready for sunday. >> we are regrouping and retooling. new field is going in. once again, our organization, we count on them to do things at the highest level. >> reporter: slipping on the

two high school football games scheduled to be played at levi stadium friday have been postponed because of the condition of the field. they were scheduled to play teams from the sacramento area. the front office says the games will be played in late october. >> the team isn't only dealing with problems on the field, they are responding to concerns safety railings in the sky boxes are too low. a personal injury lawyer says it rails are not high enough and someone could fall. the team responded saying the stadium passed all inspections and applies with applicable laws and building codes. a schoolteacher is in custody for possession of child pornography. the crimes against children left 58-year-old mitchell wolf after serving warrant at his home. he is being held on $1 million

bail. contra costa sheriff's investigators are trying to determine if local victims are involved. new developments related to the massive recall of beef last february that came out of a petaluma slaughter house. a former owner pleaded guilty to misbranded diseased meat. singleton will testify against his former partner, jesse and two slaughterhouse workers. federal authorities say they conspired to chop off the heads of cancerous cows to pass usda inspections. >> he was not involved in the actual conduct of the meat entering the supply. he was the manager and he was aware of the conduct and allowed it to continue. >> 76-year-old is charged with distributing the meat and fraud. an angry, but peaceful rally

just ended at the federal building. it marked the 5 month anniversary of alex nieto. vic lee is live with the story. vic? >> reporter: the family says they have a lot of questions about the shooting and they don't believe the police department's account of what happened. also the medical examiner's report is not out yet. it's been five months. all those reasons why the family filed civil rights lawsuit to get answers. the march to the federal building started before 1:00 this afternoon, escorted by police, about 100 people walked from bernal heights to the district. it took three hours to reach the federal building. it was noisy, but peaceful. john burris filed a lawsuit earlier in the day.

>> this is a person who was not armed. we don't believe the narrative of him pointing a taser at the police officer at the time was true. >> reporter: the day started with a small sunrise gathering at the site in bernal heights park where alex nieto was killed. they marked it with an aztec ceremony offering prayers and calling the spirits from the other world. maria is angry at what she calls a senseless police shooting. >> policy changes need to happen. officers need better training and actually think before they shoot. >> reporter: the 28-year-old was shot and killed last march by police investigating reports and a man with a gun. officers shay they fired when he appeared to draw a weapon. it turned out to be a taser. >> this is the weapon he had. >> reporter: police chief told a town hall gathering the officers thought it was a real gun. family and friends say witnesses

told them he never pointed the taser at officers. they hope a federal lawsuit will help clear the air. >> we want the truth. we want transparency that will help the family. it will help the community heal. >> an internal police investigation cleared the officers involved in the shooting. those at this rally want another review by the justice department. vic lee, abc 7 news. in antioch, a 19-year-old man is suing the city for $2 million claiming the police used unnecessary force when they shocked him. an antioch police officer shot him on june 9th outside a home on sycamore drive. this is video taken that day. investigators say he was armed with a handgun and running from police. his attorney says his client was unarmed when he was shot. although a weapon was found in the area. it's a busy friday night. coming up, why the pentagon is

state senator ben released a statement saying he accepts complete personal responsibility for his actions after the chp arrested the 44 san diego democrat in sacramento about 2:30 this morning on drunk-driving charges. we have more from the capitol.

>> reporter: senator ben left the sacramento county jail just before noon after a rough night. senator, what do you have to say to your constituents. >> sorry? >> reporter: what do you have to say to your constituents? >> i'm going to pursue my innocence. at that time, i'm not going to make comments. >> reporter: he was driving a state-owned car the wrong way down a one-way street when he pulled a u-turn before being pulled over by officers. he showed clear signs of intoxication. >> i don't know if the officers recognized him. i don't know if he identified himself as a senator. but, it would be standard chp policy to just treat him as they would anybody else. >> reporter: he reportedly had been celebrating at a latino caucus dinner earlier in the evening. a few hours later, a senator

tweeted this video of him and members of the caucus at the capitol balcony. >> this process is over. i'm not going to comment. thank you. >> reporter: what's next for you, senator? >> find where my ride is. >> reporter: sir, can you tell us what you were celebrating last night? >> reporter: he had little to say to reporters, but acknowledged the seriousness of the situation. >> reporter: it's a serious issue. do you have anything to say about the issue itself now that you are in the center of something getting attention about it? >> i have the right to pursue my innocence. that's what i'm going to do. the city of richmond has been ordered to repay the government $1 million because it didn't manage a neighborhood stabilization program. they announced the city didn't monitor the work being performed, which led to delays and work not being done at all.

the city spent nearly $1 million for the work. the report says the city failed to make sure renovated homes were eligible to buyers. they asked the city manager to open an investigation to see if they can force the developer to repay the city. >> many bay area restaurants allow dogs to sit with owners in outdoor patio areas. the governor signed it into law effective new year's day. we have live in walnut creek to see what it means. >> reporter: let's be clear. i allows man's best friend to sit out here on a patio like this when the owner is dining. service dogs are not allowed inside the restaurant and certainly not in the kitchen. this guy doesn't realize it, but there's a new law coming to california that allows him and others like him to move on to

the patio with their human friend. >> let me say hallelujah. >> reporter: he owns the brewery and restaurant, one of many in walnut creek with a large outdoor patio area for diners. he says the signing of the law allowing restaurants to decide whether to allow canines on the patio is overdue. >> we have always allowed that to happen, even though it wasn't necessarily completely tolerated in some places. we are happy, now it allows us not to look over our shoulder and allows dog lovers to come to the patio and have fun. >> i have a dog and love my furry friend. >> reporter: not all are ready to eat up the new regulation. >> there needs to be a limit as to the amount of dogs on a patio. it can't be a dog park in a restaurant. >> reporter: others say it's the owners, not the dogs you have to worry about. >> i think it's okay as long as the dog, you know, has a

responsible owner. i think that a lot of people have breeds of dogs they don't understand and can't control. >> reporter: what about if the dog leaves a present? >> it is up to the dog owners to deal with that quickly and effectively. >> reporter: the law officially goes into effect january 1st. as you see from the replacement of the water dish, many set a place for fido. abc 7 news. we want to return to the breaking news out of santa clara where a fire is burning tonight. >> this is new video from an abc 7 news viewer. you can see the dark plume of smoke put up by the fire. it broke out in a parking lot at hope services, full of donated goods, which was mostly clothing. >> they have maintained the fire to the parking lot. fire chief bill kelly is joining

us. what can you tell us about the nature of the fire? >> caller: the fire broke out before 4:00 and found several trucks at the rear of the yard and donation bins on fire t. trucks were used to drive-through neighborhoods and collect household goods. this was the storage facility at the rear of the center. firefighters got on scene and saw the smoke. firefighters quickly brought hose lines around the back to put the fire out. >> i know it's early and you haven't started to investigate. any hunch? could it have started from a truck because of heat from an engine? >> it could have been a truck or collection bin near the truck. all the material was closely located to one another. fire can spread quickly. of course there's fuel on the trucks, tires and other things that make the smoke so thick. it's going to take awhile before we can get an investigator in there to find the exact cause an origin of the fire.

the smoke from the two fires burning around the bay area. the good thing is it's an on shore breeze bringing the cooler marine air. it should help the firefighters. we'll talk about the weekend. i'm seeing more cloud cover. it's certainly cooler right now. live doppler 7 hd is tracking fog along the coast and the bay. the tropics are heating up. take a look at the newest storm that formed. tropical storm marie, well to the south of baja. we have tropical storm lowell. carina was upgraded to a hurricane. the concern is there for beach goers and people heading to the beach. be careful. there's a high surf advisory for southern california beaches until 5:00 p.m. if you are heading down there, it may release the rip currents. foggy from the golden gate

and alongside bringing the wing tips to 20 feet. then conducted a roll. there's the p.a. it went like this. >> the p-8 was conducting surveillance when it happened tuesday. google is having to modify the self-driving car. there's no steering wheel, brakes or gas pedal. it's going to change because california is requiring all self-driving cars to include full human controls during testing. google plans to test it for a couple years so it will be awhile before they show up on public roads. a drone developed in england could be the first to carry an actual person. this is one-third the size of the full version. engineers say they plan to test the full sized hover bike as an unmanned vehicle. once they get the proper
