live from the kgo-tv broadcast center this is abc7 news. >> a serious health care for comedian joan rivers rushed to a new york hospital. good morning, i am eric thomas. the 81-year-old reportedly stopped breathing while under going a medical procedure. katie marzullo joins us from the newsroom. what happened? >> law enfollow source confirms that the fire department took joan rivers from a medical clinic on east 93rd in new york to mount sinai in critical condition. look at the video outside the hospital this morning. pretty much business as usual and some encouraging news, multiple media outlets report her condition has upgraded to

"stable." it is reported that she was having a minor procedure as a medical clinic, a throat surgery, a source tell saying they put a scope down her threat to check her vehiclal cord and she stopped breathing. her daughter and frequent co-star and her 13-year-old son have reportedly plane to new york to be by her side. this is video of her in july of 2010 promoting her movie that premiered that year and workshopped her play at magic theater in san francisco and did a show at the uptown in napa in 2011, no stranger to the bay area. yesterday she was at an ever vice president in new york promoting her book and someone said she appeared to be in good spirits and had a lot of energy and was cracking jokes.

hopefully this improved condition in the last hour upgraded now to stable is a good sign she will make a recovery. from oakland airport, a hawaiian airlines flight headed from san jose to maui was diverted. hawaiian flight 45 landed safely in oakland after a u-turn over the pack if make a few loops to bun off the jet fuel before returning. hawaiian seas the mechanical problem was not an emergency. the boeing 767 returned out of caution. developing news from the south bay west of morgan hill where the sheriff is investigating a disturbing crime, a burned body was found near oakland avenue near the reservoir near highway 101. matt has the story. >> the regulation is taking place 150 to 175 yards away from us here and this is just right

near the reservoir. the body is 20' to 30 feet off the remain bangment. the sheriff have not confirmed which sochi it is but they do know and are not releasing. someone driving by saw smoke and realized it was a person on fire and paramedics arrived and pronounced the person dead and called in law enforcement. >> obviously a homicide. very suspicious. bodies do not catch on fire on their own. obviously, we are going to hook into this and treating it like a homicide and vetoing it with all of the resources we have. the coroner will determine when and how the person died and then try to figure out what they were doing the last few hours and days of their life. it is a well traveled road during commute hours and they hope anyone who saw anything suspicious this morning will give them a call. oakland avenue is expected to be closed all day today because of

this investigation and this is the first homicide of the year for the santa clara county sheriff. thank you. san francisco police are investigating the circumstances that led to a bizarre accident that caused the death of a man hit by a city-owned garbage truck. investigators thing the man was actually on the sidewalk when he was hit. the garbage truck driver is still at the scene and cooperating. the medical examiner is going do work on identify the victim. this san death is the 10th pedestrian death this year. >> a high school teacher would made threatening streets about the students is still on the job although she was apprehended. she tweeted best help of the school career i already want stab in kids it is that bad, 19 more days. another tweet said certain students make her "trigger

could be one to ten aftershocks could be expected next week. amy hollyfield has more from napa valley. people all over napa need help and residents say just look around and it is obvious that a disaster happened here. some of them say they have declared it a disaster when the earthquake hit on sunday morning but the government doesn't work that quickly. today, the county will make it official. when there is a crack this big in the foundation can you not stay in your him. the family is now living in a motor home mention to their house which shifted off the foundation in the earthquake. she says they need to rebuild and that will cost at least $100,000. >> we don't have, insurance. >> the county will take the first step toward helping people in a meeting today and the supervisors will declare napa a disaster area and that will open
