hiking trail in cupertino's picchetti ranch open space preserve. after an intense search with trackers, dogs and traps, department of fish and wildlife workers shot and killed the animal wednesday. the department tested the lion's dna with saliva found on the boy's teeshirt. they determined it is the same lion that attacked him. >> then we also were able to determine through the necropsy that the cat did not have rabies. that was a huge concern for all of us at the beginning. >> reporter: captain don kelly says they get calls about mountain lion sightings all the time. he's not surprised to hear about the one near san carlos. he even responded to a sighting in santa cruz last night. >> we get incident reports almost daily about somebody seeing a lion. what i think we have right now as a result of this particular attack is a heightened awareness, almost to the point of being frenzied in some cases. >> reporter: even though the lion is dead, hiking trails in the picchetti ranch open space

preserve are still closed while officials collect their equipment. the trail should be back open next week. >> here are some important tips if you ever encounter a mountain lion. first, don't run. that's the worst thing you can do. instead, face the animal, make noise and try to look bigger by waving your arms. it's more intimidating. throw rocks and other objects and if attacked, by all means with everything you've got, fight back. president obama has declared last month's 6.0 napa earthquake a major disaster, freeing up emergency federal funds. but the declaration doesn't h p homeowners or businesses yet. right now, the money will go to rebuild county and city infrastructure. homeowners and small business owners are still on their own until a second phase for them kicks in later. >> disappointed that it's not more clear-cut. i think if the aid is there, it just needs to be there across the board. >> i hope we don't have to wait too much. >> meanwhile, about 60 napa county inmates are being

transferred to neighboring solano county so workers can fix earthquake damage to the napa county jail. one concern was that because of the quake, inmates were able to chip off pieces of concrete that they would use as weapons. we will have an in-depth look at the recovery in napa county and in the hard-hit city of vallejo this sunday at 10:00 a.m. remember, you can still give where you live to help with earthquake recovery. simply text red cross to 90999 to donate $10 to the american red cross. three persons of interest are now in custody in san jose for the beating death of a homeless woman. someone found the woman's body about 2:20 this morning on the sidewalk by north 15th near commercial street. police believe she was in her 40s. locals knew her as betty and say she was very outgoing. >> she kind of just wandered around and would come up to people wanting, you know, she would make friends with everybody or try to. she used to come around, say my name's betty like betty boop, you know. she's harmless. i can't imagine someone would

actually hurt her. it's crazy. >> a lot of homeless people live in and around that area and locals say it's not unusual to see violent crime there. this is the 26th homicide of the year in san jose. police in palo alto are searching for a man accused of posing as a police officer. take a look at a sketch of the suspect. police say the man stopped two teenagers on bikes and lectured one of the boys for not following traffic rules. the man also showed the high school student a weapon, either a hand gun or a stun gun. police are looking for anyone else who may have come across this man. police arrested one man in a home invasion robbery in oakland. it happened in the city's laurel district. officers say two men robbed a home on bayo street near patterson avenue shortly before 5:30 this morning. police spent most of the hours after looking for the second man but could not find him. fairfield police are looking for the man who attacked an 82-year-old woman in her home this morning. detectives say the man was in her garage. he threatened her with a gun,

forced his way inside and pistol whipped her to the ground before handcuffing her to a chair. the man then ransacked the house and ran off. the woman's home health aide found her a half hour later. a state senator has been banned from holding public office for the rest of his life. today, a judge in los angeles county sentenced ron white to nine days in jail and 1500 hours of community service. in january, he was found guilty of lying about where he lived in order to run for office. the judge said he had no respect for the electoral process. the 62-year-old wright was convicted of eight felonies, including perjury and voter fraud. he is scheduled to start his sentence october 31st. an initiative to divide california into six states has failed to gather enough signatures to qualify for the ballot in 2016. there were claims that signature gatherers misled or even lied to people to get their support. silicon valley venture capitalist tim draper wants to

split the state to cut down on bureaucracy. san jose police are still not finished with their investigation into whether 49ers player ray mcdonald abused his fiancee. the arraignment was expected on monday but that's now been postponed. abc 7 news reporter vic lee with possible reasons for the delay. >> reporter: defensive end ray mcdonald is playing sunday at the niners home opener. he will play knowing that a possible domestic violence charge is hanging over his helmet. it's been two weeks since mcdonald was arrested at his birthday party at home. and still, police have yet to finish their probe. a 911 call said he was abusing his pregnant fiancee. attorneys we spoke to say they are taking their time, making sure they have looked at everything and talked to all the witnesses. there may be a good reason for the delay. the ray rice case. the ex-baltimore ravens star who is in the national spotlight because of his own domestic violence problems. >> that case was botched at the beginning by the police and the district attorney and i think the police and the d.a. here in

santa clara county are being extra careful not to make the same mistake. >> reporter: there may be another reason. victims often refuse afterwards to testify against their abusers. in this case, the reported victim was mcdonald's fiancee. >> it would be very rare to have a domestic violence case where the complaining witness or victim does not testify. that would be a very hard case to prosecute. >> her fiancee was hitting her at this address. >> reporter: even in criminatin audio from 911 or a police dispatch call may not be enough. >> yusing a dispatcher's report is typically considered to be hearsay, and so he can't use that and i'm not sure about the witnesses. >> reporter: we are told it may be a couple weeks before the investigation is done and the d.a. decides if he will prosecute. you can bet investigators will cross all the is and dot all the ts and because of the spotlight,

they will take all the time they need. vic lee, abc 7 news. the nfl public relations nightmare continues. today a texas grand jury indicted one of football's best running backs. a warrant has been issued for adrian peterson of the minnesota vikings for reckless or negligent injury of a child. authorities say peterson used a switch, a tree branch, to spank his son. late word from the team has peterson deactivated for sunday's game. the situation extends a troubling week for the nfl. it began with video surfacing monday morning of baltimore ravens running back ray rice punching his then fiancee in the face during an incident february in a hotel elevator. families are turning the ray rice scandal into a live lesson by making the negative something nice. take a look. young fans are wearing rice's jersey and changing the name rice to the word nice. parenting experts say the message is very powerful. this football jersey has gone viral now and in full disclosure, the young man you

traffic is still backed up near foster city after an accident just after noon. sky 7 hd shows us eastbound highway 92 and foster city boulevard, where a big rig hauling dirt rolled over, spilling dirt on to the road. the driver suffered minor injuries. crews needed a crane to help get that truck right side up again. somebody ran the red light with the little black car and i guess the van tried to avoid hitting the car, ended up in the subway. >> she really does mean inside a subway sandwich shop. this is video sent to us from a viewer. this happened at battery and pine street in san francisco. the woman driving the black car has been cited for running a red light. crews cleaned up the mess and

fortunately, no one was seriously hurt. preorders for apple's iphone 6 and iphone 6 plus began this morning and guess what? they crashed the apple store for two hours. problems are still going on. abc 7 news reporter laura anthony is live with the story. lot of people want their hands on this phone. >> reporter: well, that's right. at least for a couple of hours there were a lot of problems. right now we are told by apple things have pretty much smoothed out. despite those problems, apple claims that a record number of customers preordered the iphone 6 even though for many of them, it was a long night. eager iphone 6 seekers who stayed up late to preorder might have been greeted by this, or some other clear indication that the apple site and others associated with the new iphone were overwhelmed. maybe apple shouldn't have let their live stream crew also run the iphone preorder release, said a twitter.

jose mercury news, independent journal and times herald as well as several others and says it's considering selling some or all of the company as it seeks to stabilize its financial future. state regulators are telling uber lift and sidecar they have to shut down their new carpooling options. the public utilities commission says they are infringing on the domain of airport shuttles by charging passengers individually when multiple riders are in the car. ups says tonight that e-commerce is cutting into its business big-time. it is delivering 42% of online goods, well below the 55% that the company actually forecast. ups blames free shipping, fierce competition and the power of amazon.com. but the good news for ups is coming from a new company in san francisco called ship. abc 7 news reporter tiffany wilson explains how they are carving out a unique market. >> reporter: some say -- >> it really is like magic. >> reporter: but a better description is this.
