reached for the officer's gun. but friends and family say he was just drunk and the officer took things too far. flowers are outside the liquor store where a 24-year-old richard perez, known as petey, was shot and killed by a police officer. >> i think nobody going to look at cops the same way. >> one woman, who did not want her face on camera, was with perez moments before the indent and says he was not armed. >> don't hurt nobody. might have been drunk but there's no use for that police officer to even have a gun pulled on that boy. >> police say the officer, a six-year veteran, stopped by the store to do a routine check, perez was intoxicated, agenting belligerent and aggressive. >> a physical altercation took on for a minute and the officer

felt the suspect pulling on his holster. >> the officer shot him three times in the chest. perez lived at his family's business himself grandparentsed a mutt he liked to drink but described hem as loving and hard-working. >> why couldn't they use a taser or something, if he is already drunk or whatever. why did they have to kill him? >> petey didn't have a gun. a knife. nothing. >> i also spoke with his father on the phone. he believes the officer used excessive force. the police chief released a statement, part of it reads: as chief of police i am committed to the greatest degree of transparency possible involving this critical incident. the contra costa county district attorney's office is investigating the shooting. >> sonoma county deputies say a bed-ridden man shot and killed his wife everybody she attacked him with a wife. it happened last night the couple's home. the man called 9-1-1, telling

dispatchers his wife came at him with a knife so he grabbed his gun and pulled the trigger. deputies found the indian home along with this wife's body. santa rosa firefighters believe a deadly fire was an accident. the department said today crews could not get inside this home last night on 11th street because too many things were piled in front of doors and windows inside. they had to cut through walls to get inside and put out the flames. a woman who lived in the house was found dead in the kitchen, under a pile of debris. crews reported every door and window in the two-store home had things piled in front of them. >> nine people were hurt when this deck collapsed during a party last night in oakland. today a barbecue and a smashed cooler were still underneath a pile of wood at the home in the oakland hills. about a dozen people were on the deck when it fell. three suffered serious injuries. one has a broken leg, another a

broken pelvis. the deck fell 15 feet. spilled crates of grapes blocked both lanes of southbound 101 this afternoon. the driver apparently had a coughing fit and drifted on to the right shoulder. chp officers say the 25 crates of grapes on the truck shifted and caused the driver lose control, spilling the grapes. >> the grapes-sweet and just -- when the get run over by car, they turn sticky, and put water on them because they're slick. >> caltrans plans to come out and cry-sweep the area as a precaution. no one was hurt. the 49ers cut domestic abuse suspect ray mcdonald in the lineup while other nfl teams took players involved in abuse allegations off the field. mcdonald has been charged but not convicted. after an incident at his home in august. the team says it will let the

investigation play out. the carolina panthers' greg hardy was convicted in july of assaulting and threatening his then-ex-girlfriend. he sat out today. ray rice of the baltimore ravens has been indefinitely suspended be the nfl and released by his team after video showed him punching his then-fiancee in february. the two are now married. also adrian peterson was sidelined after being indicted bay grand jury on child abuse charges. commissioner roger goodell is under pressure to take action. he was supposed to be at levis stadium for the opener but is a at the no, show. the nfl confirmed he would not be there. a women's group is protesting outside two nfl stadiums today. this sign, flown above first energy stadium in cleveland, features the hash tag, goodell must go. the group says the commissioner failed women by not taking action. it was slowed to fly over levi's stadium but the plane had

mechanical problems. the home opener for levi's stadium. here's how fans are doing. reporter: this is the first important big game for the 49ers because its their season home opener. but there has been prior events here, three in fact. those three eevents seemed to have been dress rehearsals for stadium operators to iron out kinks that were present for those events in traffic, and in parking. traffic was notably easier for fans heading to the stadium today, in part because so many people arrive early to pack into the green lot. it's great america's massive parking area, the amusement park is closed to accommodate 49ers fans. this is where an impressive tailgating village was set up hours before kickoff. fans are clearly excited about the first home game of exchange but they're also aware that it comes as the 49ers and the nfl are dealing with controversy over domestic violence, and there is a pending case with
