good afternoon. i'm dan ashley in for larry beil. >> i'm ama daetz. customers at a san francisco bar and grill had a lunch they will never forget when a car came crashing in. >> abc 7 news live at the comstock saloon. looks like they have arrested the driver? >> reporter: he was taken into custody about 45 minutes after this crash. right now, you can see this is the big gaping hole that his car left in front of the comstock. it's really quite astounding to see just how fast these workers are already beginning the repairs, because that car was

just towed out of here just a little while ago. this is what it looked like while investigators pieced together exactly what happened. according to police, the driver of the red bmw sedan was headed southbound on columbus avenue and missed the turn on to pacific avenue. the car came crashing to a stop several feet into the restaurant and bar. >> behind the bar, we were lucky we just weren't, you know, mere feet away from where we were standing. it's crazy. the patron got injured but he will be okay. >> as a result of our investigation we conducted a warrant check and we determined the driver of the vehicle was actually wanted out of sacramento county, $250,000 warrant for possession of marijuana for sale. >> reporter: the police did not release the name of the driver but did say he would be tested to see if he is under the influence of any drugs or alcohol while he was driving. you can see right there, that is the bits and pieces that were

left of the door that that car came crashing into. there were two injuries in this crash. both of them were customers here at the bar. police say one of those people suffered minor injuries and they didn't have details on the injuries of the second person. wildfires burning across california today have forced hundreds of people from their homes. the severe drought that we're experiencing turning the state into a tinderbox. >> abc 7 news reporter wayne freedman is live with the blaze that's being investigated as a possible crime. >> reporter: -- just over my shoulder on that hill behind us, five homes that have burned down. we can't show them to you right now because it is still a crime area. at least they think it might be a crime area. investigators are looking to see if there were signs of arson that might have caused this. so they are calling it a crime scene unofficial until they get all the information. let us begin with mike stewart

from cal fire. >> nothing surprised me. it's exactly what we expected for the entire season. >> reporter: here are photos taken by residents who watched the approaching inferno. the flames, taller than trees. moving so fast that people around here feel fortunate to have escaped with their lives. among them, eric collins, who returned today. he hoped to see the remains of his home, but cal fire kept him away while they looked for clues to the cause. >> i haven't been allowed up there. but it was right there at the top of the hill. i'm pretty sure it's burned down to the foundation. >> reporter: based on what we could see, it burned hot. up on the ridge are two abandoned fire engines and a utility vehicle. yes, fire crews left that fast, as did everyone else. >> it moved so fast, we had like half an hour, i could have grabbed things but the way the wind was blowing at the time, it was kind of blowing along the side of us but then the wind shifted and it was on top of us

almost immediately. >> reporter: by this afternoon, the flames and smoke had mostly disappeared but cal fire remains watchful. they don't take anything for granted in this dry fire season. wayne freedman, abc 7 news. two other wildfires are burning in california. flames are threatening 500 homes east of sacramento. nearly 600 people have been evacuated. the fire spread significantly overnight, burning more than six square miles. it began saturday afternoon and is just 10% contained. the elementary school district has closed all of its schools as a precaution. crews are gaining control over a wildfire racing through the central california town of oakhurst near yosemite national park. flames have scorched 21 homes. nearly 1,000 people have been evacuated. fire officials say extremely dry drought conditions are feeding the flames. a grant from fema overnight helped boost firefighting efforts. cal fire says this started as a small grass fire yesterday

afternoon that quickly grew to more than 320 acres. time for a check on the forecast. >> spencer christian is outside with a look at what's happening. >> things are looking great outside right now. we have sunny skies all over the bay area, even at the coast. but we do have some concerns about hazardous surf. let's take a look at the advisory here. here's live doppler 7 hd showing sunny skies all across the bay area. we don't even have much development of coastal clouds yet but a beach hazard statement is in effect mainly for the south-facing beaches generally for marin and santa cruz counties through tomorrow morning. a swell may produce rip currents, strong rip currents and that's a concern, of course. so beach hazard advisory in effect right now. here's a live view of golden gate bridge. it is sunny, traffic moving nicely, nice and mild to warm all across the bay area. upper 70s in oakland, 75 san jose. 85 morgan hill. 70 in half moon bay.

check out this view. it's currently 80 in santa rosa and low to mid 80s at napa, fairfield, concord and livermore. one more live view looking down into the bay under sunny skies. this is the first forecast. we will see low clouds forming this evening and overnight near the coast and bay, mix of sun and high clouds early tomorrow morning and mainly sunny tomorrow. little cooler than today but still mild with highs ranging from mid 60s at the coast to mid 80s inland. more on the week ahead, we may have some rain later in the week, in just a few minutes. >> thanks, spencer. a southwest airlines flight headed from san jose to phoenix has landed safely at oakland international airport because of a mechanical emergency. sky 7 hd shows the plane on the tarmac just a short time ago. flight 468 took off at 2:30 and the crew noticed very quickly a problem with the controller that adjusts altitude. the pilot chose to land in oakland because that airport has a maintenance base that can repair the plane. none of the 133 people on board was injured.

a top bureaucrat with the state utilities commission was forced out today in response to a series of cozy e-mails between pg & e and the cpuc earlier this year. they admit to inappropriate contact after san bruno city officials charged that e-mails they uncovered show the state agency gave advice to pg & e on how to handle the pipeline investigation. here are some of the corrective actions. cpuc's president is recusing himself from pg & e's upcoming gas transmission storage proceedings. the chief of staff who responded to pg & e's e-mail is resigning at his request, and the cpuc is hiring an outside expert to conduct a review of the e-mail situation to help prevent future violations. coming up on abc 7 news at 5:00, reporter dick lee has reaction on today's developments. moving on, authorities in stockton have revealed a new arrest, a new reward and a new person of interest in the case of misty singh, killed by police gunfire during a shootout with bank robbers in july. she was at the bank of the west

july 16th when she was taken by three robbers who used her as a human shield. two men were killed. a third was arrested. on thursday, police also arrested a 16-year-old boy who they say was -- took the intended getaway car after the shootout. there is a $50,000 reward in this case and now the atf is offering an additional $5,000 for information leading to whoever sold or gave the suspects an unlicensed ak-47, much like this one on the table. >> they are quite common. the parts and components are available on the internet, on amazon, in fact. >> police are also looking for this man, 21-year-old pablo, as a person of interest. investigators say he may have dropped the gunmen off and may be part of the same gang as the other suspects. check out the dirty little secret federal inspectors found inside a box sent from thailand. they look like regular bars of soap but inspectors were suspicious after taking an x-ray of the box. that's when they decided to take

a closer look. >> when they cut open the bars of soap, they found each bar of soap had a bottle of opium. there were 66 bars. when the opium was totaled up it was almost nine pounds. >> each bar of soap had been hollowed out with the opium in the middle. agents don't have an estimate on the value of the opium. federal authorities are investigating the northern california address listed on the box. at any moment now, workers for the golden gate bridge highway and transportation district could announce a strike over a labor dispute. the latest contract offer would increase wages by 3% each year for three years but also increase insurance premiums. union leaders say the offer does not keep up with the cost of living. there are about 450 employees from 13 unions who would be affected from bus mechanics to ferry captains and bridge inspectors. the strike would mean many of the 32,000 people who use the district's buses and ferries, well, they would have to drive instead.

all lanes on interstate 880 are open for tonight's commute but that was certainly not the case this morning. thousands of drivers were stopped in their tracks by a big rig crash in san leandro that set off a chain reaction involving nearly a dozen vehicles. all lanes were closed for several hours. no one was moving anywhere. sky 7 hd shows people who just got out of their cars and were standing around on the freeway because they had not moved for more than an hour. abc 7 news reporter amy hollyfield has more. >> reporter: one emergency responder said it felt like a

movie scene. a car was on fire, people needed help, some were screaming and running from the scene. a helicopter landed on the freeway to rescue a crash victim. cars in both directions came to a stop. >> everything was okay. >> reporter: nine people were taken to the hospital. three of them in critical condition. investigators say it was just after 3:00 this morning when an suv traveling southbound on 880 in san leandro crashed into the guardrail. a big rig then tried to avoid the wrecked car and swerved, only to end up crashing through the center divider and into oncoming northbound traffic. at least ten cars then crashed. authorities closed 880 in both directions. >> it is uncommon for the freeway to be shut down in both directions. this was a major accident and a lot of debris on the road, a lot of diesel fuel. >> reporter: emergency crews had to tow all of the cars, clean the freeway and repair the center divider, all while drivers sat and watched and waited. for hours. some even got out of their cars

to survey the situation and socialize. >> i'm just worried about our trucks that are stuck southbound. >> i have been here since 3:08 in the morning. hopefully i don't have to go into work. i have been calling in. >> reporter: some drivers got so desperate they tore down a chain link fence and drove through the hole to escape the shut down freeway. >> that's funny. in a hurry to get somewhere. i am, too. i'm supposed to be at work at 4:00. it is what it is. >> reporter: they opened lanes as they got debris cleared but it wasn't until 9:30 that they opened the final northbound lane. that's six and a half hours after the crash happened. amy hollyfield, abc 7 news. some breaking news. we are just getting word that workers for the golden gate bridge highway and transportation district will strike tomorrow for the morning commute over a labor dispute. we talked about this a moment ago. now they will strike. the latest contract offer would

increase wages by 3% each year for three years but also increase insurance premiums. union leaders have said the offer does not keep up with the cost of living. again, we are just learning that workers for the golden gate bridge highway and transportation district will strike tomorrow. carolyn tyler will have more on this coming up on abc 7 news at 5:00. we will take a look at the impact it will have on the commute. tomorrow a new state law will require drivers to stay three feet away from cyclists. it can be difficult. each year in california, more than 100 cyclists are killed in vehicle collisions. we saw this one today in san francisco. a truck struck the rider of an electric bicycle. the cyclist was taken to the hospital. california's new law will require drivers to stay three feet away and only pass a cyclist at a speed that is quote, reasonable and prudent. violators will be fined. cyclists we talked to are happy with the new law. >> it will definitely keep us safer out there. >> fosters more awareness about

bicyclists who share it with traffic. >> in san francisco, lanes are an average of eight feet wide. we tested out the three-foot buffer and found it difficult to stay three feet away from cyclists while remaining in the lane. the driver often had to follow the cyclist for blocks which could lead to serious congestion. dozens of bay area activists set off a cross country trip this morning as part of a global movement against climate change. more than 120 were aboard the amtrak train when it departed from frommoryville this morning. their goal is to take part in a massive march to take part on sunday. the activists say they are going by train because it's the most environmentally friendly form of transportation. cleanup is now under way in cabo san lucas following the strongest hurricane on record to hit the baja peninsula.

hurricane odile slammed into cabo with 125 mile per hour winds and heavy rain. authorities set up emergency shelters to hold up to 30,000 people, many of them american tourists. christina and nate mcfadden of san francisco took shelter in their hotel bathroom. >> i thought parts of the building were falling off. the vibration was really intense on the building. it felt like earthquakes. >> right before the window blew, we could feel the air pressure change and knew something was going to happen. >> flights in and out of cabo have resumed after the airport was shut down for hours. the first flight back to the bay area is expected in just about two hours now. of course, we have been in our weather department tracking that storm and following our forecast as well. >> that's right. spencer christian's here with the latest and possibly some rain. >> possibly some rain is right. we welcome it. here's a look at live doppler 7 hd. skies are sunny all across the bay area right now. you would hardly think rain is on the way. we may get a little bit later in the week. on we go to our live view from

the rooftop camera at abc 7 looking on the embarcadero. we will see some coastal low clouds developing tonight. it will be cooler tomorrow with high clouds passing through, then clouds will thicken wednesday night into thursday morning with the possibility -- in fact, maybe we can say the likelihood of light showers. don't expect a lot of rain from this system but we will probably get a little bit. here's the system well out to sea. this will be our midweek rain maker. moisture from hurricane odile continues to flow up from baja california which has received flooding rains, into western, northwestern mexico, into the southwestern u.s. and maybe even into southern california by tomorrow. here's our forecast. starting 7:00 tonight by 5:00 tomorrow morning, low clouds pushing up against the coastline and a little bit beyond but during the day, the winds will mix out the clouds, giving us mainly sunny skies. still, though, a cooler afternoon than we had today.

we will resume the forecast 8:00 wednesday morning. check out this approaching system wednesday night. we will see a little bit of shower activity developing up in the north bay. it will spread and increase overnight wednesday night into early thursday morning. then maybe some wet spots for the early morning commute on thursday, then a chance of showers continuing into the late morning to midday hours on thursday, then tapering off. so looks like we probably won't get more than a few hundredths of an inch of rain, but we welcome the rain and need it badly. overnight, look for again clouds developing near the coastline. low temperatures generally in the upper 50s to right around 60. then tomorrow in the south bay, we will see high temperatures ranging from upper 70s to mid 80s, about 86 in morgan hill, 79 in san jose. mainly upper 70s on the peninsula. from redwood city to mountain view. mid to upper 60s on the coast, up to 69 at half moon bay tomorrow. 70 degrees downtown san francisco tomorrow. up in the north bay, highs of 80. santa rosa and 81 at napa. in the east bay, look for high temperatures of 73 at berkeley,

in headlines today, at 4:30 developing news. a car crash this afternoon into comstock saloon in san francisco's north beach neighborhood. abc 7 news reporter sergio quintana was at the scene tweeting developments as first responders took care of the injured. as police took the driver into custody. several wildfires are burning across the state. films are threatening 500 homes about 60 miles east of sacramento. nearly 600 people have been evacuated. the fire has burned more than six square miles and is 10% contained. and the nfl made a move today to overhaul how the league handles cases of domestic violence and sexual abuse. abc news reporter caroline costello has the story from new york. >> reporter: the minnesota vikings will allow star player adrian peterson to play football despite criminal charges of child abuse. >> this is a difficult path to navigate regarding the judgment of how a parent disciplines his

child. >> we're something like his family here. just to have him back is good. i'm glad he's back. we're going to support him. >> reporter: the running back booked for allegedly hitting his 4-year-old son with a branch. peterson's lawyer calling it discipline. prosecutors calling it excessive. >> a grand jury determined that that discipline was not reasonable. >> reporter: but the vikings say they will allow the legal process to play out before taking peterson off the field again. yet another nfl star player has been sidelined. carolina panthers defensive end greg hardy was in uniform and ready to play sunday but just before kickoff he was pulled from the game. hardy convicted of assaulting his girlfriend in july after a neighbor called 911. >> we need the police here now. before this girl gets seriously hurt. now. >> reporter: baltimore ravens running back ray rice caught on video striking his future wife in an atlantic city casino is expected to appeal the league's decision to indefinitely suspend him.

that decision by commissioner roger goodell coming only after this video went public. >> there's a perception that the league doesn't care. >> reporter: in the face of such criticism, roger goodell has created a new position for the nfl. vice president of social responsibility. that position will be filled by a woman who will oversee the league's response to domestic violence and sexual assault. caroline costello, abc news, new york. peterson said today he wants people to understand how sorry he is about the pain he inflicted on his son. in a statement he wrote in part, i have to live with the fact that when i disciplined my son the way i was disciplined as a child, i caused an injury that i never intended or thought would happen. i'm not a perfect parent but i am without a doubt not a child abuser. reports just in now say that u.s. air power came to the aid of iraqi security forces being attacked by enemy fighters south of baghdad. officials say the strike represents the newly broadened

mission authorized by president obama to go after islamic state forces wherever they are. meantime, diplomats from around the world are pledging to fight islamic state militants by any means necessary. the declaration came from 24 nations as well as the arab league and united nations attending a conference in paris on how to deal with the extremists in syria and iraq. meantime, house republicans propose authorizing a mission to train and equip moderate syrian rebels with an explicit ban on deploying u.s. ground forces. the plan is similar to the one offered by president obama last week. >> the goal here is to ensure that we have or that there is a fighting force on the ground in syria that can take the fight to isil in syria. >> also today, the leader of iraq's kurdistan region urged the u.s. and iran to set aside their differences to fight isis. the two countries have ruled out coordinating their efforts, but the u.s. is leaving open the possibility of new talks with

iran later this week. president obama presented the medal of honor today to two heroes of the vietnam war. sergeant major benny adkins received the award for her oc h in 1966 where he dragged comrades to safety. also honored was donald sloat who threw himself in front of a grenade to save his fellow solders. the award was presented to his brother. >> you served with valor, you made us proud and your service is with us for eternity. so no matter how long it takes, no matter how many years go by, we will continue to express our gratitude for your extraordinary service. >> the medal of honor is the military's highest award. recommendations typically must be made within two years of the act of heroism and the medal presented within three years. congress granted a special exemption. a south bay man has run out

of options after being evicted from the house where he was living for the past 14 years. he may end up on the street in part because of his obesity and related health issues. david louie has the support from sunnyvale. >> reporter: randy is packing up his pots and pans and everything else he owns but the 67-year-old sunnyvale man has no idea where he's moving. it's looking more and more likely he will be living in his truck, and that won't be easy for a man who weighs 477 pounds, needs a wheelchair for mobility and requires a bathroom outfitted for the disabled. his friend, a patient advocate, has tried to find him a place to live after the landlord died and he was told to move out. >> you can't send him to a shelter because there is no bed for him that fits him. there's no bathrooms that fit him. the staff doesn't have the liability for it. the agency doesn't have the training. there's no funding. just on and on. >> reporter: a former forklift driver, he has a long list

health issues including diabetes. he needs knee replacement but needs to lose close to 200 pounds first. he has twin sons, one living in oklahoma and the other in minnesota, but wants to remain independent. he also rules out going to a nursing facility. >> no, i don't want to go to a nursing home. i still want to be independent. he doesn't understand that as much as me. he said well, you got a place to live with a roof over your head. i don't care. i saw my dad, my mom, my aunt, my uncle, when they went into the nursing home, they never came out. >> reporter: an attorney for the deceased landlord's trust says he has paid no rent in four years and the house must be sold to settle the estate's obligations. the clock is ticking with the eviction taking place next week. >> we spent probably $300 in just fuel, or i have, to look at different places. we have gone as far as copperopolis. we just haven't found anything that fits the need at this point. >> reporter: heath has few

the retailer urban outfitters is apologizing for what some are calling an appalling publicity stunt. the retailer put a kent state university sweatshirt on sale on its website splattered with what

looked like fake bloodstains. of course, the university well known for the tragic 1970 shooting death of four students during a vietnam war protest by national guard troops. urban outfitters removed the shirt and released a statement saying in part it was never our intention to allude to the tragic events that took place at kent state in 1970 and we are extremely saddened this item was perceived as such. los angeles police now say they did nothing wrong when officers briefly detained actress danielle watts while investigating a 911 call alleging lewd conduct. tmz released audio of the incident. >> somebody called the police saying there was lewd acts in the car. doesn't matter. i have to i.d. you. >> we're not doing anything. i'm with my dad. this is my boyfriend. >> i want to see your i.d. somebody called which gives me the right to be here. so gives me the right to identify you. >> watts says she was unjustly handcuffed after refusing to provide identification. she and her boyfriend brian

lucas were in a parked car and he suspects onlookers assumed she was a prostitute because she is black, he is white. >> for me, if he had come to me and said excuse me, ma'am, you seem like a respectable person, but you know, someone made a call, can we just talk to you for a second, the whole situation would have been different. but he came at it with a very condescending manner. >> watts was detained until police determined no crime was committed. last week, apple gave everyone with itunes a free u2 album. maybe you got yours. it turns out a lot of people have been trying to figure out how to get rid of it. now apple has created a new web page just for helping people remove "songs of innocence" from their devices. when you finish following the instructions, the album is removed from your account. if you change your mind later, you will have to download it again. the album is free to everyone until october 13th. we have a link to the instructions on our website, abc7news.com. michael finney is here

answering questions sent to him by facebook, twitter and e-mail. our first comes from michael m., who e-mailed is there any product that allows cleaning the outside of a vehicle without using water. >> that's a great question. there are actually quite a few out there now. it's kind of like a windex or pledge or something for your car. i really can't endorse one. i have never tested them. you can go online, i know there are some youtube videos, you can check them out. the big concern with a lot of these products are your car is out there on the road and there's a lot of road gravel, dirt and grime that gets on your car and you could be smearing it around and actually hurting your paint job. be very careful with this. if you are trying to save water, really, your best bet is to go to a commercial car wash, because they use recycled water. generally, there are three sprays in a commercial car wash, the first two are recycled water and the third is fresh water. that's why your car comes out looking so good. they use very little water, 12 to 18 gallons.

>> bobby m. e-mailed i have had cell service for a year and the calls drop out in our home. the carrier says they will charge me to cancel the contract, is this legal? >> completely legal. because you kept your car -- kept your car. you kept your phone too long. there is a universal agreement, it's not a law but all the major companies agree to it, that when you buy a phone and set up your account, you have 14 days to cancel and you get all your money back assuming everything is still in good condition. you only get 14 days. that's why we always tell everyone when you get a new phone, especially a new service, you need to go home and use it, you need to go to work and use it, you need to go to your kids' school and your parents' and where your child lives and check it out. you only have 14 days. after that, then the contract, you have to abide by. >> theresa e-mailed i own a timeshare and i want to get rid of it because we don't use it. how do you sell a timeshare? >> there's a line right over there where you can start, where everyone who owns a timeshare wishes they didn't anymore.

the newly crowned miss america was representing new york. she's actually from walnut creek. she took a ceremonial dip in the ocean this morning in atlantic city, new jersey. the first dip is a long-time tradition by miss america winners. she graduated from a local high school where today, some of her teachers recommended hmembered relentless go-getter. lyanne melendez has the story. >> reporter: i should start out by saying walnut creek is celebrating 100 years as a city and now they have a miss america. no doubt they will be celebrating but not with red plastic cups. day one on the job as miss america and kyra announced she was ready to tackle an issue that has been in the news lately. >> my platform is called love

>> reporter: well, after months of off and on negotiations and negotiating all day today, the unions have decided they will have a one-day walkout tomorrow but they say it will not impact commuters. they say it's a signal to the district they are unhappy with the current offer and what they consider unfair labor practices for the previous contract in 2012. these iron workers will put down their tools during the one-day strike. ferry service for the nearly 7,000 riders and bus service for 27,000 riders will continue, a relief for commuters. >> inconvenient, you know. i have to look for some other way to get around. >> reporter: the district has offered the workers 3% raises each of the next three years. but the union reps say they are being asked to pay 2% of that for health care. >> keep in mind that the cost of living in the bay area has gone up 3% a year now for awhile, and

so anything below 3% is actually having us fall further behind the cost of living. >> reporter: 450 workers from 13 unions are impacted, from electricians and engineers to ferry captains and deck hands. the district says its offer is fair and generous. >> our deck hands currently make 20% more than the union members at the other agencies that operate frry service. iron workers make 10% more than any of the iron workers, the federal members in the san francisco credit sector. >> reporter: the union says it accepted concessions in previous contracts and that this time, the district has the money to offer more. >> they have $138 million of extra revenue partially because they have laid off the toll takers here, they have higher revenues at the ferry and the tolls. >> reporter: but the district says that money is allocated. >> we have the barrier. >> reporte
