good morning, i'm tiffany wilson. let's start with a quick look at the weather. here's meteorologist lisa argen. lisa. >> good morning tiffany. low fog and clouds not only shrouding the coast but they have begin to move into the bay. it's very mild out there. look at the numbers, in the 60s. a few upper 50s. three mile visibility here. but 65 in oakland. cloudy skies out toward livermore with 63. 64 in fremont. we will see another mild day on the coast but doesn't look like the clouds will clear there. and looking for more sunshine

around the bay. in oakland today mid-70s. feeling mild. but the further you get out toward our east bay valleys the smoke and the haze begin to come into play again. so upper 70s with upper 80s in the inland east bay. san francisco about 70. we will look for the clouds to hang along the san mateo coast and down around san jose look for low 80s and much of the bay in the upper 70s. a look at fall. it arrives monday. and the prospect of rain in the seven-day outlook. tiffany. >> lisa, thank you. we begin with developing news out of fremont with the death of a man closed miles canyon road. fremont police were called to the seen around 8:30 last night they launched a helicopter to look for a person of interest but were unsuccessful. police are calling the man's death suspicious, but will not say why. miles canyon road is now open. a deadly beating at a bay area gym leave friends of the victim stunned.

they are asking how could this have happened? and the man spoke with his daughters minutes before his arrest. kenneth osaka killed 43-year-old diego galindo. >> losing diego galindo has stunned the meat market he worked at as a butcher for ten years. his fellow employees are collecting money for his funeral. >> he was close to my kids. he grew up with the kids and took care of them. soccer practice movies to the beach. >> galindo was bludgeoned to death at this bally total fitness center in south san francisco. 46-year-old kenneth osaka, a plumber from south san francisco, was arrested. the police say he struck diego galindo in the back of a head with a steal gym bar. osako's daughter told us why. >> he said he came in and a man was trying to talk to his girlfriend.

>> his daughter said she spoke to her dad shortly after it happened the day of the accident. >> i've seen my dad get overtaken by anger before, but i can't imagine him being so angry. >> she suspects her father is bipolar, but he's never been diagnosed. police served a search warrant at his home and gathered evidence. the daughter apologized to the galindo family. >> i apologize. if the family wants to know anything or if they want to ask me anything, i mean, i'm here for them. >> osako is being held without bail and he will likely make his first appearance on monday. in south san francisco, alan wang, abc7 news. concern is growing this morning for a teenage girl from santa rosa who has been missing for more than two days. family members say they last saw the 16-year-old rebecca weaver in her bedroom wednesday night. the 5'8", 145-pounder is believed to have run away. rebecca has a medical condition

that requires medication, but she doesn't have it with her. family members say a recent breakup with a boyfriend may have prompted her to leave. the family of the man shot and killed by a richmond police officer last week will hold a a rally and a news conference today. police officials say 24-year-old richard perez was unarmed but trying to take the officer's gun during a struggle last saturday night. according to the perez family's attorney, several witnesses dispute the game. a rally will be held today at noon at nichols park following funeral as much as for perez. he said he's sorry and he said it many time yesterday. roger goodell and the nfl broke their silence after many days. goodell said he will not resign because he has a lot of work to do, including a new personal conduct policy for players. abc news reporter has the story. >> i'm not satisfied with what we did.

>> i would never hurt my son. goodell said he has no plans to resign. instead he wants to lead the league in implementing new programs on educating players on domestic violence, and to come up with a consistent policy on discipline. abc news, new york. >> developing news out of baltimore where ravens fans are standing in line to exchange their ray rice jerseys. here's what the line looked like from the air outside the stadium. people stood in line for more than an hour yesterday to return rice's number 27 jersey for that of another ravens players. many said they didn't feel comfortable wearing the jersey. ravens officials expect 5,000 people to take part in the two-day event. >> if you or someone you know is a victim of domestic violence there is a domestic national hotline. it is posted on our website.

abc7news.com. two men are accused of sexually assaulting a young girl in san jose. the victim said the man forced them into a van. they sect wally assaulted her and dropped her off. these are the sketches of the suspect. they are described as two men in their 30s driving a white or silver van. san francisco animal control wants to talk to the owners of eight dogs left inside a home without anyone caring for them. sheriffs deputies discovered the abandoned dogs on wednesday. the dogs appear to be malnourished and some lost their hair, possibly due to parasites. they are getting plenty of attention and food at the animal shelter. >> we have a wonderful staff of volunteers. they have put a lot of attention on them. they are getting veterinary care now. hopefully we will see them on the mend and behaviorally,

dealing with this, and hopefully they will keep it up with oxygen. >> the dog's former owner could potentially face criminal charges for animal neglect. >> a family vacation in paradise turned into a harrowing escape from disaster. one bay area family is happy to be out of hurricane ravaged cabo san lucas. with thousands still stranded and suffering, they say the u.s. isn't doing enough. we have the story. >> within hours of the hurricane slamming into cabo, this was a scary place. these are pictures of the hotel they were staying. worst part is confusion and chaos from outside the resort. >> we heard so many things but we do know is they are rioting right out there. >> this is a picture of her husband and two kids after the hurricane. no power and limited food.

sergio quintana abc7 news. a man suspected of starting a wildfire in eldorado county has been charged and could face more charges. wayne allen huntsman pled not guilty yesterday. investigators are trying to determine how many homes the fire has destroyed. if it's five or more prosecutors can seek additional charges. about 12,000 homes are in danger right now. the fire has already burned 76,000 acres since it started last saturday and only 10% of it is contained. and all that smoke could cause some serious air quality problems for us. take a look. a shift in the wind is now bringing the smoke our way. bay area residents could notice the smell of wildfires. it could impact contra costa and napa and alameda counties today and tomorrow.

the secret service wants to find out how this man captured on video could make it into one of the entrances of the white house yesterday evening before being captured. one official called it quote unacceptable. the 42-year-old from texas was unarmed. agents evacuated the west wing of the white house for a short time. the suspect went to the hospital after complaining of chest pains. president obama and his daughters had just left for camp david aboard the helicopter. posted wrists are being detoured on highway 29 and 121. the affected part of 37 won't reopen until monday at 5:00 a.m. highway will be open at night all week and next weekend, as well. for help navigating around traffic problems get the exclusive abc7 news waze app. you can download it for free from apple app store or from google play. >> it may be hard to believe,

but there was a time when students at u.c. berkeley was not allowed to protest. all that changed 50 years ago when a student was arrested. the standoff that resulted lasted two days and a free speech movement was born. today marks the anniversary. here's abc news report with the details. >> mario was the student activist most associated with the freedom of speech movement. here he is played by brady in the stage version. they are performing this saturday and sunday at the theater. lynn hollender was demonstration. >> i was working on a big report about political repression at the university. he was doing it like 20 hours a day with hardly anytime to eat or do anything else. >> hollender was also married to

you have clear skies there with the southwest winds and partly cloudy skies in concord. but the clouds have moved in to livermore. the forecast highlights, a smoke advisory again for alameda, contra costa and solano counties. some haze around today. but overall we will see more sunshine in san jose. also san francisco partly cloudy. fall, it arrives 7:29 on monday night. then after that right on cue, several cold fronts will flirt with northern california. and once again maybe light showers as the front weakens and drags some of the moisture into the bay area. today it's all about the low that will be drifting away from the coast. then actually inland. it's going to bring us the subtropical moisture. and the reason why i mention that is because it's going to bring the showers and thunderstorms for today and tomorrow in the sierra nevada. as our low clouds clears the coast, we have the hazy conditions east bay valleys, and then in the mountains upper 70s.

diagnosed with a respiratory virus called intero virus b-68. the state is issuing tips. there is no vaccine. the california department of public health recommends washing hands frequently for at least 20 seconds with both soap and water. avoid touching your eyes, nose and mouth with unwashed hands. don't share utensils or cups that can transfer the i willness avoid hugging people who are sick, and keep children home from school if they have active symptoms of an infection. a major turnaround for the city of oakland one month after turning over the city's billion dollars garbage contract to california waste solutions. oakland officials now say the company will share the contract with waste management. waste management, which has provided garbage service to oakland, filed suit after they lost the contract last month. in the new deal california waste solutions will now process

recyclables, while waste management will collect trash and compost. >> this strategic alliance is a triple win for our communities in many ways. it's been hard fought and a little bruised along the way, we have an opportunity to see these two firms that currently serve the city working together. >> the city council is expect today sign off on the new agreement at a special session on monday. happening today, it's national coastal cleanup day. san francisco is calling for volunteers to help beautify the city's southeast shorelines. events are being held throughout the bay area. last year volunteers collected more than 17,000 pounds of debris just from cleaning. some of the areas to be cleaned today include the shoreland park, gary boulevard and along cargo bay. abc7 news will come through in a big way to help rescue abandoned horses. thousands of horses or starving because of the drought.

a few weeks ago we introduced you to a rescue group that's trying to save as many as possible. ama daetz has an update on the overwhelming response to our story in this morning's assignment 7 report. >> reporter: after seeing the channel 7 news story i realized that this is exactly the right place. >> she is talking about her decision to adopt tank and dobbin. they are healthy, well-trained horses, but they were almost killed and sold has horse meat. thanks to her and her friend they are now living the good life in novato. >> he has a great disposition and demeanor. i kind of fell in love with him. >> the women learned about the huge glut of unwanted horses from an abc7 news story. the soaring costs of hay and the long drought are giving many to give up on their animals. >> especially in the central valley. people need to feed their family or feed their horse.

>> the lucky horses end up here the rescue center for abandoned horses. and abandoned horses started in the bay area and just moved to a new 400-acre home south of hollister. there are 70 rescued horses here now. monica runs the nonprofit center. she's had amazing success rehabilitating horses and finding them homes. but she's also struggling to pay for hay. >> $8,000 a month minimum. >> now the good news. as soon as abc7 news learned about the situation, help started pouring in. >> i got 600 e-mails in 24 hours. >> monica said people are volunteering, donating money and sending warm words of encouragement. some simply showed up at the ranch with cash, including the woman who delivers the mail. >> her name is brenda. she pulled up and said here you go. and she gives me a one hundred dollars bill. >> since the story aired, the center received $12,000 in donations and heard from lots of people looking to adopt.

happening today, the waters off treasure island will be filled with some different-looking boats. it's part of the dragon boat festival. this marks the 19th straight year they will be hosting event. organizers said this is a family friendly event that's free. they called it the ultimate sport because there's no star quarterbacks or kickers just the dragon boat races. races begin at 8:00. the races and festival will be held today and tomorrow. >> bart, the closer between concord and the bay point is expected to last until at least 7:15. as of 6 castro valley 45 bart said major delays. fur planning on taking bart, be prepared. >> good advice. and also this afternoon you may notice the haze in the east bay valleys. temperatures, despite the warmth, it will be a little hazy
