city. and from our sutro camera look for another very sunny day today but instead of those mid-90s in san francisco, look for 80s today. so it will be a slow cooling trend from the coast to the city. very little change elsewhere with very warm day. a heat advisory for the san francisco bay shore. the east bay shore and santa clara. we will talk about the cool down coming up. matt. >> thank you, lease you a. developing news from san jose this morning where a two-story townhouse is considered a total loss after a big fire raced through it last night. it started just after 10:00. a car parked inside the ground floor garage caught fire. flames quickly spread through the house. three people inside the home escaped without being injured. one of those people ran back inside the house to rescue dogs who were trapped inside. they all managed to get out safely. 40 firefighters were called out to get the fire out by midnight. the cause is under investigation. also in the south bay, a morgan hill elementary school teacher is in jail this morning, accused of sexually assaulting a

young student inside a classroom and police are worried there may be more victims. abc7 news reporter alyssa harrington has the story. >> 52-year-old john arthur lloyd is behind bars arrested on suspicion of sexually assaulting a child. police say he inappropriately touched a student earn side his classroom at paradise valley elementary school. >> it occurred at the school on two different occasions, twice within the last 30 days. >> and during school hours. lloyd was arrested at his home in hollister. the victim told a staff member here about her teacher's behavior. that person told the principal, who called police. the superintendent sent home a letter and put lloyd on administrative leave. >> the number one priority is student safety, and that student learning continue to happen at that school. >> parents are appalled by the allegations. >> it's shocking because it's a

close-knit school community. >> amelia said his daughter had him as a teacher. she often stayed after school to get help on homework assignments. >> knowing she was there by herself and with two other students after-hours is concerning. >> he has been he school since 2008, but in the school district since 2000. he teaches fifth grade and created a news letter with his students called room 9 times. detectives are urge parents to talk with their kids to see if there are more victims. abc7 news. after a burglary police made an arrest of one of the three sexual assaults reported near the u.c. berkeley campus last saturday, all involving fraternities. a 20-year-old is a u.c. berkeley student. he's accused of assaulting a woman at the frat house where he lives. they say he's not linked to the other two attacks which are under investigation. he's being held in berkeley jail on $100,000 bail. the family of an oakland

teenager declared brain dead say they have proof the girl is not brain dead. she was declared brain dead last year after surgery in oakland. since then she's been on a ventilator in new jersey. now the family has released video reportedly showing her responding to her mother's voice. here's lilian kim. >> so she knows the difference between left and right, she knows her fingers. >> she said her daughter responds to her verbal commands. proof, she said, the oakland teenager is alive, despite having been declared brain dead. in this clip she asks her to move her arm. very good! very, very good. >> and in this clip she asked jahi to move her foot. >> come on. there you go! very good! >> winkfield and other family members gathered at their attorney's office to present

evidence that they say proves she is not brain dead. here's a photo of her about to get an mri in the presence. experts retained by the family and an image of what the attorney said is of the child's brain. >> there's jahi's mri. this is unequivocal proof that jahi has not had her brain liquefied. >> it's sad. it's unfortunate they have not been put in a situation to accept reality. >> a bioethics medical professor has not seen the evidence but doubts she's alive. she said it's common for people who are declared brain dead to have random movements if you videotape long enough you will have movements that correspond roughly with instructions. >> but despite the critics, her mother presses on. she's going to court asking that her death certificate be reversed so she can get her home and get possible medical care in california. she's at an undisclosed location in new jersey. >> i said as long as i'm living and i'm living and as long as she has one i will never let anybody disconnect her. >> the court date is scheduled for thursday. in san francisco, lilian kim, abc news.

health officials have confirmed the first case of the quickly spreading enterovirus d-68 in san francisco. five cases are reported in the bay area this year. a san francisco child was admitted to a child last month, treated and discharged in good condition. across the state 14 had illnesses. 13 respirator illnesses. yesterday one in los angeles had limb paralysis, which is rare. health officials say they are relieved the state has not seen as many cases as other parts of the country. >> i mean we definitely expect to see more cases, but today we believe it is positive that we have only 14 cases out of the very many we've tested for. >> no vaccine is available for the enterovirus. >> an investigation by the california highway patrol found no retaliation during the construction of the new span of

the bridge. and also caltran didn't violate whistleblowers laws. if did find a pattern of miss management that left employees being fearful for raising concerns against the project. it did not address the safety of the bridge. >> in the east bay, friday night football was tougher because of the heat, and its also tougher on firefighters, keeping an eye on fire danger. we have the story from the east bay. >> don't take too much in. hydrate all day long. >> the mercury shot past 90 degrees in parts of berkeley and oakland. it was hotter here along the bay than in antioch and pittsburgh. >> oh, my goodness. i'm melting. >> and by the end. the first quarter, the berkeley jv football team had experienced a total meltdown. vacaville leading 28-0. >> we are going to stay hydrated all day long and see if we can get the win today. >> how is the weather treating you? >> we aren't used to it.

>> this is abc7 news. >> good morning. a look at the tower lit up for the giants in orange october. it's also a hot beginning to october, as well. temperatures in the mid-90s in many spots. lisa argen will have the forecast coming up in a bit. we are learning more about the night police arrested 49er ray mcdonald after he was accused of abusing his pregnant fiancee. we reported exclusively thursday night that he called an officer around the time the 911 officer was made. that was a san jose officer. vic lee has more. >> this was audio of the police dispatch the night ray mcdonald is accused of physically abusing his fiancee. listen closely. >> there's a new -- her fiancee, we are taking her to the center. >> the dispatcher said there's a new r.p., a new reporting party, meaning there was a prior 911 call to this incriminating one. who made that 911 call, and did it differ from this one?

lawyers tell us the 911 calls are typically considered hearsay. that's why the cop who macdonald called that night is so important. reliable sources tell us the san jose police officer is sergeant shawn pritchard, and that he went to mcdonald's home after the 49er defensive end called him. those same sources say it was either before or about the time that a 911 domestic violence call was made. they tell abc7 news pritchard also works in a secondary job as security at 49er games. our sources say he was most likely off-duty at the time. but lawyers we spoke with say that doesn't matter. if this case goes to trial. attorney steven clark. >> on or off-duty really isn't important. it's the fact that a police officer made certain observations. and those observations are key in the d.a. evaluating when they should pursue this case to a trial. >> lawyer dennis luca, a former

lieutenant, also told us it told us it doesn't matter if you are off-duty. if you stumble across a crime scene, you are still an officer of the law and as such you can't violate your duty. >> if you cross that line and engage in any sort of behavior or conduct that interferes with an official investigation, you can be -- the department can take action against you personally. >> police sources tell us pritchard was most likely told to fill out a supplement police report outlining in detail what he saw and heard. and that could be one of the most important bits of evidence in determining whether or not to file charges against macdonald. vic lee, abc7 news. just weeks after apple unveiled the i-phone 6 and 6-plus, the local tech type is planning another event for october 15th. they will introduce their newest ipads and macs. they said it will be a more

laid-back affair. apple declined to comment we may now know what tesla will unveil next week. another version of their popular model s. earlier this week we showed you this mysterious event announcing the october 9th event. the palo alto car company is expected to reveal a prototype for a model 3 and maybe a self-driving car. when a woman is diagnosed with breast cancer, she often needs to stop working. abc7 news reporter lyanne melendez tells us about an organization that takes care of some of the household expenses while the patient focuses on the most important things, they are health. >> when anita was diagnosed with breast cancer, she thought she would be forced to drop out of school. that's when she heard of the breast cancer emergency fund. >> i was thinking i can never reach my goal. but they stepped in, at least financially they give me the peace of mind and i can still maintain by dignity, okay, i can

keep going to school, i can get through that. >> with can make it a lot easier for them to focus on their health and their families by covering their rent, utility bills, their basic living expenses. >> the majority of the women who get help live in under served communities. many are single moms. anita will now work at the organization to help asian women diagnosed with breast cancer navigate their way through the system. >> i found out, especially for the new immigrants, they don't know where to get help. they are lacking resources. >> october is breast cancer awareness month. emergency fund has its yearly signature fundraiser called "this old bag" where designers and others donate handbags to be auctioned. the ritz-carlton is also a big supporter. we created a pink cocktail where proceeds will be going back to the organization. >> the drink is called "the girl." for every cocktail sold, the emergency fund will get one dollar. the hotel will also donate ten dollars for each tea seating. it's part of the hotel's

commitment to communities around the world. >> underprivileged children, poverty, environmental conservation in the communities in which we do our business. >> that was lyanne melendez reporting. the ritz-carlton will be lit up throughout the month to bring awareness to breast cancer. breast cancer emergency fund will have their big event october 17th at the bentley reserve. affordable housing advocates will protest the development of a luxury condo complex in the mission district today. a group is calling on them to stop the construction of a 300 unit complex at 15th and mission streets. here's video from a previous protest. they are upset over rising rents and the rapidly changing neighborhood. it begins at 1:00 at 24th and york street. the group will march to 16th and mission where they will hold a 3:00 protest there.

san jose city councilman is feeling the heat after a testy exchange with a para-transit bus driver and it was all caught on camera. >> get over the white line on on the bleep. and bleep. you ought to stay by the line. >> councilman gary acuses the unidentified bus driver of trying to run him over as he rode his bike through downtown santa rosa. on-board cameras captured the tense exchange. the video was obtained by the santa rosa press democrat that shared it with abc7 news. right now east bay mud's water supply is at their fifth lowest level in history. the entire system is at 404,000-acre feet. only four times before has it been this low. most recent in 1992. it was about 23,000-acre feet lower. the district's biggest reservoir, comanche, is at 42% capacity and 51% of it's average. they point out the other residents plants store is 81% capacity and a year's worth of water is available even if

autumn. 55 in fairfield, 58 concord with 55 in livermore and a cool 48 in petaluma. sfo, it's clear and we will look for a sunny start to the day. the hottest day will be today out of the next seven. but we do have dangerous surf from stinson to santa cruz and the coastal cooling gets underway by the afternoon. not soon enough to cool us off. here's the heat advisory from santa clara, the san francisco shoreline, the east bay shore, monterey north and south, and further south into big sur. so another warm one for sure with only the 70s far north up in bodega bay. it's all about high pressure. it's beginning to slide slightly to the east. and as it does that, in response, we will get a return of that sea breeze. it's not going to be strong and it is going to be late in the day. in fact still the winds offshore now, but by 1:00, 2:00, you see the direction turns and from point arena down through about

abc7 is honoring hispanic heritage month. today we recognize roxanne cruz, first generation latin american who is on the board of director for the richmond community foundation. that's roxanne seated in the center of this photo. we have more information on her work on in straw gram at abc7 news bay area. the beaches near vandenberg air force base will be closed after a great white shark attacked a surfer. it bit a 28-year-old man on the knee thursday evening. the shark was about 10 feet long. the surfer was rush to the hospital and is expected to survive. great white shark killed a surfer at the same beach in 2010

new this morning, a renewed call from president obama to help struggling middle class families in america. the president is calling for a higher federal minimum wage to provide some relief with the eroding middle class incomes. he made the request during his weekly address. it's time to stop punishing some of the hardest working americans. it's time to raise the minimum wage. it will put more money in workers' pockets. it will help 28 million americans. recent surveys show a majority of the small business owner supports a gradual increase to $10.10 an hour. the folks who keep blocking the minimum wage increase are running out of excuses. >> the republicans responded by blasting president obama for higher taxes and said that burdens small businesses. they made a call to repeal the president's affordable healthcare act. a new video was released by isis. this time it appears to show a beheading of a british hostage. allen henning. now an american hostage is threatened. martha raditz reports. >> this is the 26-year-old

american, peter cassig, on his knees. a hooded isis fighter at his side, warning he could be the next victim of isis executioners. he is a former army ranger. he was in syria has an aid worker, saying he wanted to find purpose in his life. he became a medic and founded an organization to help refugees. but last year, at almost exactly this same time, he disappeared. the isis fighter in the video by his side, directing a message to president obama, saying you have started area bombardment which keeps striking our people. he then threatens to kill more americans. just before cassig is shown, another british aid worker, allan henning, appears to be executed. the executioner, like the one who killed the three other hostages, has a british accent, but it is unclear whether it is the same man. the u.s. and arab partners have

been pounding isis targets in syria and iraq. we watched the nonstop operations from the u.s. aircraft carrier george h.w. bush just days ago. with fighter jets loaded with bombs and missiles, headed for targets weather isis could be found. the targets are getting more difficult to spot, as senior officials said isis has now stopped using long convoys of vehicles, has taken off the black flags on equipment, and is trying to blend into the population. >> and that was martha raditz reporting. cassig's family released a statement saying, quote, we ask everyone around the world to pray for the henning family, for our son, and for release of all people being held in the middle east and around the globe. marin county officials are putting a youthful twist on gun buyback events. later this morning kids can trade in toy guns and violent video games in exchange for ben and jerry's ice cream and raffle tickets. it will be the first of events taking place across the county in october. they want to spread a message of

peace among marin county youth. event starts at 10:00 at the novato police headquarters. turning to a chilly tale about a man who used charm and bible quotes to work his way into the personal lives. bay area residents. he gained their trust and took their money. the perpetrator has been arrested and prosecuted. michael finney has the story. >> i was totally taken in by his story. >> 89-year-old clara has a hard time talking about this man. john guay of san jose. >> it makes me shutter to even think of it. >> she met guay two years ago when he called her, claiming he was referred by her long time broker. >> he told me that i hadn't been investing for a while, and i needed to see him. >> so she went and clara quickly grew fond of guay. he was friendly, polite, and given to quoting moral lessons

$75,000 with guay. he had been their trusted advisor since 2001. >> we game friendly over the years. >> and so it came as a shock to susan, john, carla and clara, when they found out all the money they had given to guay was gone. >> at some point he turned from being a legitimate broker into a scam artist. >> the fraud came to light when carla asked for a statement of their account. he provided this document. carla realized it was phoney. then things got scary. >> my husband and i realized that he had scammed us. so i fired him on the phone, and he drove to castro valley, where my mom lives. >> guay drove carla's elderly mother to chase bank and tried to put his name on her account. an alert teller called carla, then the police. >> he was getting them to invest their money in what turns out to be a nonexistent company.

>> almeda county district attorney nancy o'malley's office charged guay with stealing the money from his clients. there was no blake financial services, there were no investments, and nearly $300,000 had vanished. >> i was devastated to begin with, of course. and i was shocked. >> guay had once been a legitimate broker and now his license is revoked. he's pleaded no contest to fraud and grand theft, and was sentenced in superior court to a year in jail. >> it affected me very deeply over many months. you think you can trust somebody and they betray you like this. >> michael finney, 7 on your side. >> this light of recent data breaches, governor brown signed a new law to protect personal information make retailers obligated to help. he was inspired by last year's massive data breach in target stores where million of customers' de debit and credit card numbers were compromised and a similar breach against neiman marcus store.

the sea breeze after 1:00. here's emeryville right now with the clear sky. it's 65 in the city. 59 here in oakland. 59 in san jose with just 50 on the coast, but no fog. and from mt. tam this morning you see the presunrise colors here. pretty nice with 50 in santa rosa. 46 napa, 48 petaluma. mid-50s livermore and 58 concord. feeling pretty nice tonight with some cooler temperatures, and by tomorrow we will be looking at a cooler second half of the weekend. but today holding on to the heat. sutro, pretty sunrise. hottest day today dangerous surf from stinson beach to santa cruz and coastal cooling by about 2:00. so the heat advisory has it modified for the bay shore, the san francisco bay, north bay and east bay valleys out of it but it will still be very hot for santa clara. 11:00 to 9:00 p.m. and monterey is included in this, as well as the big sur

coast. so we've got not only high pressure in mind for another day, but the winds are still offshore for the bulk of the day. but as the high begins to slide east, a little bit of that sea breeze. and about 1:00, 2:00, see right now the winds are offshore. look what happens in the afternoon. then the fog comes this, point arena, point reyes. it will be patchy tonight. and we will look at another cool evening. it should be pretty nice tomorrow too. but we will be out of the upper 90s. so more like low 90s. in terms of the beaches with the higher water temperature, boy, it's tempting. in the mid-and upper 60s at some of the beach coastal locks. we are looking at a long period of southwesterly swell, allowing for dangerous rip currents once again today. a heat advisory in san diego. looking at very warm temperatures. los angeles 95. a red flag warning for parts of the sierra nevada, the southern sierra. 89 this monterey.

the relief not coming quite yet for the afternoon with 98 in fresno. and temperatures then around the south bay, very similar with low 90s santa clara. a little cooler santa cruz at 86. we will look for 90 menlo park, 89 in san mateo. san francisco 82 degrees and up in in the north bay numbers ranging from about 80 stinson, 92 sonoma. near east bay, 88 hayward. 92 in fremont. you head inland, numbers in the mid-rod's here. the accuweather seven-day forecast looking at temperatures much cooler throughout the afternoon. today we are still in the mid-and upper 70s for the festival in golden gate park. you notice the temperatures go back, then we warm up by thursday and friday of next week. >> getting back to more normal temperatures. >> yeah, eventually. >> thank you, lisa. in sports, the giants continue their winning streak in the layoffs, knocking off the nationals in game one of their
