good saturday morning. thanks for joining us. i'm matt keller. let's start with a quick look at the weather. here is meteorologist lisa argen. all is clear and we're looking at another warm day around the bay. not as hot as yesterday as our onshore winds will kick up throughout the day, but this is going to be after 2:00. this will cool the coast down and bring san francisco's temperatures down about ten degrees today. so that sets you up for the upper 70s, to the 80s along the coast, in the city, low 90s in santa claira. matt? thank you, lisa. developing news from san jose where two-story townhouses considered a total loss after a big fire raced through last night. it started just after 10:00.

a car parked insaid the ground floor garage caught fire. flames quickly spread through the house. three people escaped without being injured. one of those people ran back inside the house to rescue dogs who were trapped inside. they all managed to get out safely. 40 firefight wrers called to get the fire under control by midnight. the cause is under investigation. also in the south bay, a are morgan hill elementary schoolteacher is in jail this morning accused of sexually assaulting a young student inside a classroom. police are worried there may be other victims. abc 7 news reporter elyssa harrington has more. >> reporter: loyd has been arrested on suspicion of sexually touching a student inside his classroom at morgan hills paradise valley elementary school. >> the sexual assault occurred at the school on two different occasions, twice within the last 30 days. >> reporter: and during school hours. loyd was arrested at his home in hollister. the victim told a staff member here at the school about her

teacher's behavior. that person then told the principal who called police. the superintendent put loyd on leave. >> student learning needs to continue to happen at that school. >> reporter: parents are appalled by the allegations. >> it's clearly shocking. it is a close knit school community. >> reporter: torres says his daughter had loyd as a teacher. she often stayed after school to get help on homework assignments. >> knowing that my daughter was by herself with two other students after school hours is concerning. >> reporter: loyd has been he at the school since 2000. he taught fifth grade and creates a newsletter called room 9 times. detectives are urging parents to talk with their kids to see if there are more victims. in morgan hills, elissa harrington, abc 7 news.

berkeley police made an arrest in one of three sexual assaults reported near the uc campus last saturday, all involving fraternities. 20-year-old eugene is accused of assaulting a woman at the frat house where he lives. they say he is not linked to the other two attacks which remain under investigation. he is being held on $100,000 bail. the family of an oakland teenager declared brain dead say they have proof the girl is not brain dead. she was dechaired brain dead last december after surgery at the children's hospital in oakland. since then she has been on a ventilator in new jersey. the family reported video showing her responding to her mother's voice. here's lillian kim. >> so she knows the difference between left and right. >> reporter: wakefield says her daughter responds to her verbal commands, proof, she says, that the oakland teenager is alive despite having been declared brain dead in december. in this clip she asked her to

move her arm. >> come on. very good. very good job. >> reporter: and in this clip she asks her to move her foot. >> come on, girl. that's very good. oh, i'm proud of you, boo. >> reporter: she and her family members gathered at their attorney's office to present what they believe is evidence that she is not brain dead. here is a photo of her about to get an mri in the presence of experts retained by the family and an image of what chris dolan says is of the child's brain. >> here is her mri. this is unequivalent proof that she has not had her brain liquefied. >> it's very sad. it's unfortunate the family has not been put in a situation to accept the reality. >> reporter: david magnet of stanford has not seen the so-called evidence but doubts she is alive. he says it is common for people declared brain dead to have random body movements. >> if you videotape long enough

you'll have things at that will coincide roughly with instructions. >> reporter: despite the critics, her mother presses on. she's going to court asking that her death certificate be reversed so she can bring her back home and get possible medical care inc california. she is currently at an undisclosed location in new jersey. >> and as long as i'm living and have a heartbeat, as long as she has one, i will never ever let anybody disconnect her. >> reporter: the court date is scheduled for thursday. in san francisco, lillian kim, abc 7 news. health occasions confirmed the first case of the ent enterovirus in san francisco. a san francisco child was admitted to a hospital last month, treated, and discharged in good condition. across the state 14 children infected. 13 of them had respiratory illnesses and yesterday health officials confirmed one in los angeles had limb paralysis which is rare. they're relieved the state hasn't seen as many cases as other parts of the country. >> i mean, we expect to see more

cases but also being today, we believe that it's positive that we have only 14 cases out of the many cases we've tested for. >> no vaccine is available for the enterovie sus. a california highway patrol investigation found caltrans did not retaliate against those who express ed concerns about the by bridge. the findings of the investigation were released yesterday. chp says they did not violate whistleblower laws. it did, however, feigned a p pattern of mismanagement that left employees fearful of being punished for raising concerns about the construction project. the report did not address the safety of the bay bridge. sizzling temperatures made it difficult for many across the bay area this week. in the east bay friday night football was a little tougher because of the heat and it's hard on firefighters keeping an eye on high fire danger. alan wang has the story. don't take too much in. stay hydrated.

temperatures are going to peak around 80 degrees today. lisa argen will have the forecast coming up. we're learning more about the night police arrested 49er ray mcdonald. we reported exclusively thursday night that mcdonald called a san jose officer around the time the 911 call was made. vic lee has more. >> reporter: the nate ray mcdonald is accused of physically abusing his fiance, listen closely. >> her fiance was hitting had he. >> reporter: a new rp, a new reporting party, meaning there was a prior 911 call to this incriminating one. who made that 911 call, and did it differ from this one? lawyers tell us the 911 calls are typically considered hear say. that's why the cop mcdonald called that night is so important. reliable sources tell us the san

jose police officer sergeant shawn pritchard and that he went to mcdonald's home after the 49er defensive end called him. the same sources say it was either before or about the time that a 911 domestic violence call was made. they tell abc 7 news pritchard also works in the secondary job as security at 49ers games. our sources say he was most likely off duty at the time. but lawyers we spoke with say that doesn't matter if this case goes to trial. attorney steven clark. >> on or off duet kty really is important. an officer made observations and those are key in the d.a. evaluating whether they should pursue this case to a trial. >> reporter: lawyer dennis luca tells us it doesn't matter if you're off-duty. if you stumble across a potential crime scene, you're still an officer of the law. as such, they can't violate their sworn duties. >> if you cross that line and engage in, again, any sort of

behavior or conduct that interferes with an official investigation, you can be -- the department can take action against you personally. >> reporter: police sources tell us pritchard was most likely told to fill out a supplemental police report outlining in detail what he saw and heard. and that could be one of the most important bits of evidence in determining whether or not to file charges against mcdonald. vic lee, abc 7 news. just weeks after apple unveiled the iphone 6 and 6 plus, the local tech titan is planning another event for october 15. according to rico.com, apple will introduce its newest ipads and macs. this will will be a more laidback affair compared to the iphone launch at the flint center. apple declined to comment. we may now know what tesla will unveil next week. a dual motor of its popular model s. this is a picture of the car. earlier this week we showed you

this mysterious tweet announcing the october 9 event. the car company is expected to reveal a prototype for its model 3. when a woman is diagnosed with breast cancer, she often needs to stop working. lyanne melendez tells us about an organization to help while the patient focuses on the most important thing, her health. >> reporter: this woman thought she would be force ed d to drop of school. that's when she heard of the breast cancer emergency fund. >> i was thinking i can never reach my goal. at least financially they give me the peace of mind and i can keep my dignity, i can continue to go to school and get through that. >> we can make it a lot easier for them to focus on their health and families by covering their rent, their utility bills, their basic living expenses. >> reporter: the majority of the women live in underserved communities. many of them are single moms.

>> and that was lyanne melendez reporting. the ritz-carlton will be lit up to bring awareness to breast cancer. breast cancer emergency fund will have its big event november 17. affordable housing advocates will protest luxury condo complex in san francisco's mission district later today. the group is calling on the city to stop the construction of a 300-unit complex at 16th and mission streets. this is video from a previous protest. the advocates are upset over rising rent and the evictions of longtime residents in the rapidly changing neighborhood. the rally begins at 1:00 at 24th and york streets. the group are will march the 16th. they will hold a protest. a santa rosa city councilman is feeling the heat after a testy exchange with a bus driver all caught on camera. >> do you realize you're over the white line? >> i know that, dude. >> you have to stay inside the line. unidentified bus driver of trying to run him over as he rode his bike through downtown santa rosa. onboard cameras captured the exchange. it was shared with abc 7 news. right now east bay water supply is at its fifth lowest level in history. the entire system is at 404,000 acre feet. the most recent time it was that low was in 1982. it was about 23,000 acre feet lower. the district's biggest reservoir comanche at 32% of capacity and 51% of its average. but eb mud points out the party reservoir is at 81% of capacity and a year's worth of water is available even if there's no rain this winter. the drought has state wildlife officials pulling out all the stops to protect the fall salmon run. they are primarily produced in hatcheries and are making their way upstream from the ocean. if the water is not cool enough, the salmon won't hatch.

they are installing refrigeration units. salmon industry brings in $1.5 billion every year. we could use more rain, but it doesn't look like we're going to get any. >> the ocean water temperatures are up eight to ten degrees above average and our afternoon highs today 15 to 18 degrees above average despite a ten degree cooldown. you follow that? it was 92 yesterday in san francisco. not going to be that hot today with 95 at sfo. and we're looking at some 80s today. a late afternoon sea breeze and the fog won't return until tonight. it's about the very, very light winds today. they're still offshore and then they'll switch ashed to an onshore component that will will help us out but not in time to cool us off. right now you can see pretty much low to mid-60s from san jose to san carlos in san francisco. upper 50s, though, half moon bay. you have climbed seven degrees in the past hour, so it's a

clear sky, that sun coming up. we're heating up rapidly and in san he jose more low 90s for you and you are in the heat advisory today where we'll see temperatures very warm once again. 56 by the delta. it's 50 in napa. we were down to 46 this morning in napa and truckee was at 28 degrees. so even though we have this october warmth, it certainly feels like fall early morning through the overnight hours. and our camera, the hottest date will be today. we'll look for dangerous surf to s santa cruz and coastal cooling later on today. that will set us up into the upper 70s to low 80s for bodega bay, stinson beach and ocean beach. the heat advisory from 11:00 to 9:00 p.m. for 80s and 90s from the san francisco bay shore, east bay shore, santa clara and santa cruz down to big sur. our dominant ridge of high pressure really isn't moving yet. it will slowly move later on

today though a light sea breeze tonight and day-to-day we'll trim off a few more degrees. notice the pressure gradient switch onshore late in the day and the fog is only up to point arena by late in the afternoon. so it's going to be a beautiful afternoon. be careful out there with the dangerous surf, the extremely dry conditions, long periods southwesterly swell brings the risk of strong rip currents from marin to santa cruz. the beautiful sky right now and with the clear conditions we'll be looking at numbers really climbing today think where from 12 to 17 degrees above average. so here is a look at the south bay. 92 san hjose. 97 in morgan hill. low 90s return for redwood city. san francisco 82 today. 91 in novato and look at the beach temperatures. nice day bodega bay but then the sea breeze later on today. castro valley, 91. 95 in san ramone.

good christian and, therefore, i should trust him. >> reporter: and so he invited her to invest in light financial services. clara didn't hesitate. >> i gave him the check and he was going to invest it for me. >> reporter: actually she wrote two checks, totaling $100,000. gway promising a 3% return on her investment. >> very congenial. very friendly. >> reporter: he befriended clara's daughter and her husband. karla was impressed with his charm and his passion for quoting the bible. >> he said god wants you to intere interest. >> reporter: she invited him to christmas dinner. he brought his mother and daughter. and when he suggested karla should invest in blake financial, she didn't hesitate either. >> i wrote him a check for $100,000. >> my check was for $25,000. >> reporter: susan ma teo and hr

partner john sands invested a total of $75,000 with gway. he had been their trusted adviser since 2001. >> we became friendly over the years. >> reporter: and so it came as a shock to susan, john, karla and clara when they found out all the money they had given to gway was gone . >> at some point he turned from being a legitimate broker into a scam artist. >> reporter: the fraud came to light when karla asked him for a statement of their account. he provided this document. but karla realized it was phony. then things got scary. >> my husband and i realized he had scammed us, so i fired him on the phone and he drove to cass tore valley where my mom lives. >> reporter: he drove karla's elderly mother and tried to put his name on her account. an alert teller called karla. then the police. >> he was getting them to invest their money in what turns out to be a nonexistent company.

>> reporter: alameda county district attorney's office charged him with stealing that money from his clients. there was no blake financial services. there were no investments and nearly $300,000 had vanished. >> i was devastated and shocked. >> reporter: he had once been a legitimate broker. he's pled no con it test test. >> it affected me very deeply over many months. >> you think you can trust somebody and they betray you like this. a massive cyber attack against jpmorgan chase may have left the company vulnerable to another one. they admitted the breach was larger than fist thought. 76 million households and 7 million small businesses in all making it the largest breach yet. it could take months for the bank to change computer programs breached by hackers. names, addresses and phone numbers were exposed.

the company says no account information was accessed. governor brown has signed a new law to protect consumers' personal information and make retailers obligated to help. the law is inspired by last year's massive data breach in target stores where millions of customers' credit and debit card numbers were compromised and a similar breach at neiman marcus stores. right now it is not against the law for retailers to sell your social security number to other companies. >> if someone can buy you social security number, then they often have ready access to who you are, where you live, where you bank, where where you shop, what credit cards you have, all of your information. it can be extremely damaging. >> the new law takes effect january 1. it will prohibit the sale ofs is is numbers and obligate retailers to offer consumers protection such as credit monitoring for one year after a breach of their security. the battle over a proposed
