numerous times. as the assailants begin to leave, the video pans over to victim one who is lying on his back not moving and looking disoriented. the attack happened on the 300 level on the north side of the stadium. police say it took just minutes to find the two suspects. >> stadium staff employee did point out to our folks there at the scene, there was a fight inside the restroom and our folks did respond, mean officers did respond to the restroom. >> reporter: santa clara police say the two suspects are related and may in fact be brothers. 49ers fans we spoke with today say despite the assault, they feel safe at levi's stadium. >> i think there was an abundance of security. every time you looked around. >> a lot, the alcohol has to do with. but yeah, there were a lot of police officers and security all throughout the game. >> things are going to happen. it's a shame it happens but you

can't stop absolutely everything. >> reporter: the two victims were taken to a hospital. one was treated and released. the other is in serious condition. the 49ers front office tweeted a response to this incident just a little while ago and it reads in part we would like to send our deepest concern and well wishes to the victims of yesterday's incident. we were appalled to see the video of the attack. vic lee, abc 7 news. no violence today, certainly a lot of anxious moments. the giants were hoping to sweep the washington nationals in the national league division series playoff game three. the game just went final. the nationals win 4-1 as they defeated giants ace madison bumgarner. let's go live to abc 7 news reporter wayne freedman live at at & t park with a bunch of fans exiting the game. wayne? >> reporter: well, they say baseball's a game of anticipation. the fans here today were anticipating a win and moving on to the national league championship series.

county has resigned after sheriff's deputies arrested him for having illegal drugs inside a hotel room near sacramento. thomas "woody" price leads the private branson school. why don't you pick this up? >> deputies arrested the 54-year-old while answering a call from another man worried about his friend. they found her in the hotel room, woke her up and discovered cocaine, and methamphetamine in the room. hall remains in jail. san francisco police working to track down a man for assault. surveillance video shows her walking down the street and her attacker pretending to be on his cell phone. the man attacked when she reached the door to her apartment, lifted her dress, groping her. the woman fought back screaming and chased him away. she was not physically injured. san jose has turned to the

homeless to keep the city's highway on and off ramps clean and graffiti free. the gateway project gives the homeless vouchers to cover rent, food and toiletries for their time. this is a team of volunteers at work off i-280 today. the program uses homeless workers to do cleanup chores in various neighborhoods. the workers we talked with say the programs give them hope. >> i kind of demonstrated my dependability and reliability and i am hard working. >> getting back to being real, being happy. giving back. that's the best way to feel good about yourself. >> the gateway project is funded by tivo, wells fargo and ernst and young. it is expected to bring on six people to start but could expand to as many as 60. advocates are cheering a decision by san francisco mayor ed lee approving $2 million in

legal support to help children caught in the border crisis. it will help fund legal services for children who fled violence in central america and now face deportation. governor brown is weighing in on the race for the mayor of oakland. he is now endorsing schaaf for the position, one of seven candidates for mayor. laura anthony joins us from oakland. this endorsement, does it mean much? >> reporter: well, it really doesn't if history is any indication, an endorsement from jerry brown doesn't necessarily translate to a victory. in fact, the last two endorsements did not lead to them winning the mayor's office. brown says forget about that. >> i'm here to endorse -- >> reporter: governor jerry brown said it loud and clear. his pick for number one in the oakland mayor's race is former staffer, libby schaaf.

illustrated" effect. they put your picture on the cover of the magazine, you usually lose the next game you play. >> reporter: the mayor's campaign sent a statement pointing out that kwan may not have the governor but does have quote, the strongest, broadest and most diverse coalition of endorsements in the race. laura anthony, abc 7 news. as for governor brown's own re-election bid, a new report shows he has nearly $24 million in his war chest. he spent roughly $400,000 this year. much different story for brown's opponent. he reported he spent nearly $5 million on his own campaign this year. for many people, the election actually starts today. vote by mail ballots are being sent out. this past june, 69% of all ballots cast were done so by mail. we have much more ahead on this first monday in october. >> multiple gunshots were fired in the store. >> chshoppers were inside when

e-mails released in the last few weeks as a result of the first batch, the president of the california public utilities commission recused himself from pg & e gas transmission rate proceedings and also had his chief of staff resign. now a second commissioner is implicated in this latest batch of e-mails, mike florio is in several messages between brian cherry and other pg & e staff members. cherry was released from the company last month because of these e-mails that seemed to show a very cozy relationship between him and regulators. commissioner florio spoke with me by phone today about these latest e-mails. >> my biggest concern is that people that don't know me and know my history are going to think somehow i'm being buffaloed by pg & e and in fact, i think my whole professional career has been one of not taking what pg & e says at face value. >> utilities are obligated to

report all communications with commissioners and today's e-mails are part of a filing by the company showing that it did not do that entirely. this all comes as the commission is weighing more than $1 billion in fines following the san bruno disaster and response. right now i'm going through a lot of these e-mails that were just released today and i will have details on their contents and a response from pg & e coming up on abc 7 news at 6:00. sergio quintana, abc 7 news. >> see you at 6:00. san leandro police plan to ask prosecutors to charge two shoplifting suspects with attempted murder after a shooting at a walmart store. this happened at the walmart on davis street just west of interstate 880 last night. detectives say walmart security guards spotted the men hiding items inside their clothing as they walked through the aisles. two undercover guards confronted those men as they tried to leave. >> at that time, a struggle ensued between the security officers and the two suspects who are adult males.

one of the men removed the hand gun from his waist band and opened fire. >> the economy's getting tough and you will get people like that. i think our security police officers should really step up. >> officers searched a car in the parking lot after that shooting. both suspects remain in custody. police in mountain view need your help to find these three people. police say they went into the rei store on charleston road and stole a bunch of gps watches. this happened on september 13th. police are only now releasing these images. if you happen to know any of them or have information about this case, give police a phone call, please. virginia began issuing marriage licenses to same sex couples today just hours after the supreme court decision letting same sex marriages stand in five states. this couple, jennifer and erica, got married at the arlington county courthouse. today the high court refused to hear the appeals of five states trying to keep their same sex marriage bans in place.

officials in utah, wisconsin, indiana and oklahoma are also preparing to issue same sex marriage certificates. >> feel like we a're in the twilight zone. i did not expect this whatsoever. i thought we would have to wait at least until june. >> i can tell you that i am surprised about this and disappointed. i believe the people deserve to have this hearing taking place at the supreme court level. >> the court's order effectively makes gay marriage legal now in 30 states. still, the justices stopped short of resolving the issue of same sex marriage across the country. opponents still have challenges pending in all 50 states. there are several developments in the ebola crisis tonight. a spanish nurse who treated an ebola patient at a madrid clinic is the first person to contract that virus outside of africa. in dallas, the patient being treated for ebola has been given an experimental drug but remains in critical condition. president obama says the

27th at concord, november 12th at north concord and the dates have yet to be determined for the coliseum and hayward stations. to pay those fees, drivers have to sign up in advance at b.a.r.t.'s web page. the teamsters union wants facebook founder and ceo mark zuckerberg to support a plan to unionize the company's drivers. they are paid $20 an hour and have to work split shifts and are not paid for down time. it's the second time the teamsters tried to represent shuttle drivers who take some of the bay area's highest paid workers to work in silicon valley. facebook has declined to comment on that request. investors really seem to love hewlett-packard's split up strategy. stock is up 5%. bill hewlett and dave packard famously started hp in their palo alto garage back in 1939. it's considered the birthplace of silicon valley. now the company is being carved up. each part serving different purposes. hp inc. will take over the legacy part of the company, that

is personal computers and printers. hewlett packard enterprise will look forward, emphasizing cloud computing and r & d. this company will be run by current chief meg whitman. each company laying off an additional 5,000 people by the end of next year. go-pro video can now be captured live as it's happening, livestream is a major site for broadcasting realtime video over the internet. today, it updated its app to add cameras from the san mateo company. the go-pro connects to iphones wirelessly. the iphone can be left in a pocket like a wireless hot spot. the app handles the uploading of video in real time which is pretty remarkable. on the subject of streaming, one big company is pulling the plug, bowing to competition from bay area based netflix. >> 7 on your side's michael finney is here with more on that. >> netflix will soon have less competition, at least come tomorrow. red box, streaming video service

operated by verizon, will shut down on tuesday. the service was just launched last year to compete against netflix but never really caught on. subscribers will receive e-mails notifying them of the termination of the service as well as details on refunds. if you have a problem getting your refund, let me know about it. have you ever checked into a hotel and found your usual wifi connections just won't work? that happened in nashville and now there's a huge settlement. marriott international has agreed to pay a $600,000 civil penalty for blocking people from using their personal wifi network in the gaylord opryland hotel and convention center. the lawsuit accused the hotel of blocking the signals to encourage customers to use the hotel's wifi network which of course the hotel charges for. the settlement bars marriott from using the blocking feature on its wifi monitoring system at the hotel. walmart is getting into the insurance, health, i should say, health insurance business. agents will be set up to sell

89 in santa rosa. it is currently 85 in napa. look at these temperatures, still in the mid to upper 90s. livermore, you managed to get up to 99 today. here's the gorgeous view from the emeryville camera of the high clouds that are going to be with us tonight along with the fog. gradual cooling through thursday, warming back up this weekend. but we are not expecting a heat wave. tropical storm simon still churning off the baja peninsula. it is expected to weaken and will continue to send moisture across northern and central baja peninsula. they are expecting heavy rain, three to six inches, could see isolated higher amounts and some of that moisture gets into the desert southwest by wednesday. they could be seeing flash flooding and mud slides. big ridge of pressure remains in place. that's why this hot weather is just not in a hurry to leave. but things will be changing, slowly that ridge gets nudged east this week and that's when the cooling will definitely be felt in the inland valleys. overnight tonight, the fog pushes in over the bay so some fog for your morning commute, coast and bay. give yourself plenty of time.

scientists at lawrence livermore labs say ocean temperatures in the southern hemisphere are actually warmer than we think. researchers used satellite data and climate models to support their findings. they say earlier findings and limited analysis led to conservative estimates of temperature change. 60% of the world's oceans are in the southern hemisphere. heat stored in the ocean accounts for most of the excess heat that's associated with global warming. the u.s. navy has released new video of unmanned navy boats that could be crossing the seas within a year. they are like driverless cars. they are called the autonomous

swarm boats. they use algorithms, advanced computer programs and sensors to determine how to navigate the seas and coordinate their efforts. they can even surround enemy ships to deter them from advancing into restricted waters. while the boats move on their own, their weapons systems are operated remotely by humans. early risers can expect to see a rare sight. a total lunar eclipse that coincides with the sunrise on wednesday morning. it should start to become visible about 3:25 a.m. nasa expects that sight to be colorful even for cities with lots of artificial light. the moon will turn a dim red because of sunlight scattered through the earth's atmosphere with a band of turquoise visible just before the moon is fully eclipsed. when we come back, we update the condition of an injured eagle. >> rescued by a bay area wild life group.
