good morning and thanks for joining us on this saturday. i'm matt keller. it's a rainy morning with a storm moving through the bay area. a live look from our golden gate bridge camera. things wet out there. what a sight to see. we really need it. meteorologist lisa argen, how is it looking out there? >> take a look at how wet on the golden gate. now come in over the bay area, the rain we've been expecting. look to radar satellite imagery. that's what's pushing in towards us and it's going to brush threw the next few hours. southerly winds right now. 20 miles an hour at sfo.

ended 30 miles away in auburn. abc 7 news reporter elissa harrington has more about the deadly shooting, man hunt and arrest. >> flowers have been placed at the auburn justice center for two sheriff's deputies killed in a violent rampage. 47-year-old sheriff's deputy danny oliver and 42-year-old placer county detective michael david davis jr. were killed. the chaotic scene started when deputy oliver responded to a suspicious vehicle at a motel, a man and woman inside opened fire with an assault rifle. >> at least one of those rounds struck deputy oliver in the forehead, which caused his death. >> reporter: the pair then shot a man they were trying to carjack and stole a red pickup truck. it was spotteded in auburn about 30 males north. the two placer county sheriffs depp ittist who approached were shot, one of them, detective

davis, was killed. his father a riverside county detecti detective, was also killed in the line of duty 26 years ago today. >> this organization, this family, has suffered a ahorrifi loss. >> reporter: law enforcement apprehended the man, 34-year-old marcelo marquez inside a house where he was holed up. a flash grenade forced him out. he was taken to the hospital. one man painted and installed two crosses. >> everybody, the whole town is hurting. >> reporter: mourners are leaving flowers and flags fly at half-staff. in auburn elissa harrington, abc 7 news. a reporter from our sister station in sacramento kxtv spoke to marquez's brother last night. he said marquez threatened him earlier this week. still, he can can't believe he shot three deputies. police are still trying to figure out a motive in yesterday's shooting spree at a high school in washington state. one girl was killed and four others injured after jaylen

fryberg opened fire in marysville. he gave no warning and calmly stared at the victims as he shot them. he then killed himself. students say fryberg had just been named homecoming prince. we've new details on how far canadian lawmakers with went it to protect their prime minister. a gunman killed a soldier at a war memorial and wounded another at the can adian parliament building. steven harper's security team hid him inside a cupboard. they report members of parliament ripped down 15 flagpoles and sharpened them into spears. they never had to use them. one lawmaker says he will keep tis makeshift weapon and keep it at home. a man under arrest, 47-year-old jose garcia of east palo alto taken in a custody at the oaks motel thursday nate. the girls' parents were changing their clothes when the father

noticed a man looking through the window. he note fade the front desk and motel staff called police. garcia is also charged with violating his probation for soliciting and resisting arrest. home prices in the bay area are hey. a property in palo alto is taking things to a new level. the home near university avenue is on the market for $1.8 million. it's in such disrepair potential buyers can't even go in. you can see the mess is inside and outside. it isn't inhabitable and is in a flood zone. it will likely be torn down and rebuilt. tonight the giants plan to start ryan vogelsong against the royals in game four of the world series at at&t park. last nate joe mnight joe montan took in the game with peter mcgowan. the royals struck again in the sixth inning. the ball ripped over gregor b n blanco's head in center driving in escobar. that put k.c. up 2-0.

a live look and the rain has arrived this morning. it's october 25. nice to see it so early in the see he son and lae is a argen will let you know what's coming up in a bit. nine weeks after the napa earthquake damaged so many homes and businesses the recovery continues but the federal assistance for individual property owners is nowhere to be found. abc 7 news reporter laura anthony has our story from napa. so this pier went down 90

feet. >> reporter: brown is not unlike most of his neighbors and hundreds of others in napa that had significant property damage after the earthquake. in brown's case, the repairs to his 19-year-old house will likely run about $150,000. and like 90% of the victims here, brown has no earthquake insurance. >> and what the guys are doing now is just kind of getting us back to ground zero on the height of the house. we have to lift the foundation back up. >> reporter: that involves inserting new piers into the ground, in some cases more than 90 feet down. the president of a company said they've looked at many houses with damage like this, but the homeowners can't afford to proceed. >> the houses are red tagged or yellow tagged and they need to get the work done but they have no way to pay for it. >> reporter: brown and thousands of property owners are wait iin for fema for assistance that could include grants or low interest loans. >> so this is actually putting

venue. not a great night for bears fans, but you have to admit, the team kept it interesting n. santa clara, katie marzullo, abc 7 news. many in the bay area are desperate to get world series tickets. a cupe are rtino couple gave th away to a former army sergeant. he is excited beyond belief. >> i've always watched it on tv. the giants play the royals. and on tv i get excited but to go in person and see the game live that's excitement. >> that's great. the form er army sergeant lost both legs and suffered severe head injuries when he ran over a bomb in afghanistan in 2011. he'll be going to the game with a marine from camp pendleton. two kayakers had to be pulled from the water last night

between piers 50 and 70 south of the ballpark. the fireboat phoenix was called in to help and the two were rescued around 8:00 p.m. this is video from the abc 7 news roof camera. now there were so many boats near the ballpark and inside mccovey co-the coast guard established a safety zone to patrol the waters. the giant american flag that fans hold during the singing of the national and them didn't quite hold up. a fan at the game sent us this fphoto and you can see that big tear right down the middle. patients, parents and staff at lucille packard children's hospital in stanford have teamed up to celebrate the world series and support a good cause. ♪ take me out to the ball game ♪ take me out to the crowd >> despite being from rival cities, the two hospitals teamed up to create the "take me out to the giants and royals" music video, encouraging fans to make

its way into the bay area, so a little bit of a slippery comm e commute. be careful if you will be heading out onto the roads anytime soon. take a look right now at live doppler 7 satellite. track the rain as it's coming in from the north bay right over san francisco and now starting to make its way did you know the peninsula and to the south bay. it will continue to push east also with those southerly winds right now it is pretty gusty out there. take a look right now at sfo so it is wet out there as well and i will check to see if we have any flight or arrival or departure delays. current conditions we're at 64 degrees. 75 in oakland. san jose 63. . a little bit cooler in morgan hill at 56. 59 at half moon bay. that is where we're going to experience very gusty conditions up to 50 miles per hour along the coast. a look at our emeryville camera raining out there in the east bay as well. our day plan her for the next 12 hours is going to be a wet commute to get us going in the

morning. once we head to noon, some scattered clouds but it will be a little bit on the dry side. once we get to 4:00 p.m., then a chance of some thunderstorms, also starting at about the santa cruz mountains as it makes its way north and then by tonight those temperatures 68 degrees. it will cool down but it will be drier. in terms of winds, we do have 20-mile-per-hour gusts at sfo. the southerly gustses will turn into northwestern winds by this afternoon. so it's going to be our first wind of the season. so what does this mean for game four? well, we do have -- change that to game four. it will be breezy, that isolated shower. it will be a little bit on the cooler side as well. pacific satellite, that rain is tracking and the winds are coming in towards the bay area. so wet and windy. that is what we can expect by this afternoon. our highs around the bay area starting with the south bay, 71 degrees in morgan hill.

along the peninsula, 70 degrees in redwood city. san francisco 68 degrees. downtown in the north bay it will remain wet for the duration of the day, 65 degrees in petaluma. in the east bay 69 degrees in be san yandro. it will be l cool. 57 degrees in palo alto. 56 in concord. 55 in napa. my accuweather seven-day forecast, we are looking at conditions drying out for tomorrow. and then warming up. 4 degrees for our inland areas. the temperatures continue to ramp up by thursday we'll be 80 degrees inland.

it'll stay dry but cooler. prop 45 would give the state's insurance commissioner the power to veto rate increases on your health insurance just as he can now for auto insurance. only 39% say they'll vote for it. we asked michael finney to take a closer look at this measure. >> reporter: back in the 1980s the government required all drivers to buy auto insurance. there were no price controls and rates were going up. consumer watchdog jumped in and it passed on the ballot. >> the sheriff has come to town and prop 103 is the sheriff. >> reporter: consumer federation of america estimates california drivers have sashed more than $100 billion because of that vote. well, it's happened again. the government is telling us we must buy insurance, this time health insurance, but there are no strict price controls.

so, again, consumer watchdog is jumping in a the fray. >> it's the law. but there's no one who says it's unaffordable. >> reporter: the consumer group that put prop 45 on the ballot. >> what prop 45 does is forces health insurance can companies to open their books, be transparent about why they're raising rates. it requires health insurance can company ceos to certify why they need a rate hike and the elected insurance commissioner can he reject the rate hike if he finds it's not necessary. >> reporter: now there is a major difference between prop 45 today and prop 103 back in the day. with auto insurance consumers were on their own. with health insurance there's a board set up to negotiate rates. >> we have to remember the affordable care act was health insurance reform. >> reporter: that's a health care advocate pictured here meeting with the president just last week. today he's speaking for the san

president reminds americans they cannot contract ebola unless they come into direct contact with the patient's bodily fluids. he praises new york's quick reaction to its first ebola case promising local officials any federal help they need. >> you have to be guided by the science. you have to be guided by the facts, not fear. yesterday new yorkers showed us the way. they did what they do every day jumping on buses, riding the subway, crowding into elevators, heading into work, gathering in parks. that spirit, that determination to carry on, is part of what makes new york one of the greatest cities of the world. that's he what we can draw on as americans as we meet this challenge together. >> meanwhile, the world health organization says this morning the number of people believe sickened by ebola worldwide has risen above 10,000. the first nurse diagnosed with ebola is now free of the virus and out of the hospital.

she received a rousing ovation yesterday from the staff at the national institute of health clinical center bethesda, maryland, and received a hug from president obama in the oval office. the 26 ye-year-old became infec with ebola while treating duncan at a hospital. she thanked her doctors and nurses as well as well-wishers worldwide. the california department of public health announced five university of california medical centers have been designated priority hospitals to treat ebola cases if they owe can kcce state. university officials say they're ready to care for patients with the illness. health care workers have recently undergone training to protect themselves from the disease. all right, so how worried should you be about ebola? you ask a physician and infectious researcher chu will answer that question today in a free event at the exploratorium.

he will answer questions from the public. the free event takes place at 1:00. now to hawaii, the big island, and one town in the cross hairs this morning. abc news report er has the stor. >> reporter: now thousands of people are threatened who live hear. a river of red-hot lava quickly oozing the length of six football fields in just the last two days. you can see just below here in these cracks actual molten lava. the flow erupted from the kilauea volcano in june. now less than one mile from the small town. it's really the geography that controls where this lava goes. sometimes speeding up, sometimes it's slowing down but it's always a threat. for some of the 10,000 people affected, evacuations could be just days away.

road construction crews are racing. it's been steadily erupting since 1983 wiping out nearly 200 homes in 1990. the volcano has been bellchichi> a berkeley man sent to prison for the death of a uc honor staunt. yesterday 27-year-old ander enfield accepted a plea deal. en field was convicted for second-degree murder but was overturned after a judge agreed his trial attorney wasn't competent at criminal law. abc 7 news has learned san jose police will launch an investigation into possible misconduct by its officers he who may have violated the

department's gift policies. this following an abc 7 news exclusive report that members of its command staff accepted free tickets for 49ers games. reporter vic lee has the story. >> reporter: the complaint was received by the office of san jose's independent police auditor judge kordell, who will trigger an investigation by police. >> once we take the complaint in, it goes immediately over to the internal affairs unit of the san jose police department and they investigate. >> reporter: the complaint is can haonfidential. it was reported after our story aired. garcia got free tickets to the niners first preseason game last year at candlestick. he's on the sidelines here in it this picture with a field pass which says invited guest. he also got tickets to this game at levi stadium. deputy chief also attended this game as a guest of the niners. the department told us they were invited because it was law

enforcement appreciation day and both complied with state regulations by filling out form 700, a declaration that they accepted the gifts. but they violated the gift ordinance that says upper echelon managers are only allowed to accept gifts worth less than $50. the team's front office told us each ticket was worth $187. the ordinance prohibits tickets to professional sporting events. we were eventually told that the chiefs had reimbursed the team for the tickets. when we asked the police department when the chiefs paid, they replied last week. that was the week after we inquired about the tickets. >> once we were made aware of the actual value of the tickets and that it did exceed that amount, we reimburse it had but, again, we're very glad to be a part of this. these partnerships help us foster stronger partnerships with the community. >> perhaps more importantly, the two chiefs appeared to have

violated the department's own duty manual. judge kordell would not comment about the specifics of our story but pointed out that under the duty manual officers cannot accept any free tickets period. >> those are deemed be to be gifts. a gratuity, favors, any of these, if they're not offered to everybody, you can't take them. >> reporter: and judge kordell said again there's nothing in the duty manual about repaying people for gifts. >> if you break the rule, you can't then undo it. if you get caught, you can't then undo it by somehow, you know, making restitution or reimbursement. >> reporter: kordell says after the police investigation is over, her office will review it to see if it was thorough, unbiased and complete. >> our office is to check on the system. so while internal affairs investigates, we are the ones that look at what they've done. >> reporter: so that investigation will go forward now that a complaint has been filed. we don't know the scope of the

giants fever still in full effect despite last night's loss. they get a chance to get back on the winning track tonight at 5:07. we he do have some rain out there this morning. leyla gulen will let you know in just a bit. still a long way from winter weather but caltrans is thinking of people traveling and being safe on the road and that means training another group of chain installers. the regional office issued 17 chain install he permits each year. each installer has to pass a written test and show they can put on the chains quickly. 60 year year herb hubert says it's a good way to make an extra buck. >> when it gets really bad and cold and nasty, it's wet and a little cool, but once you're stuffing $20 in your pocket every five minutes, you warm up pretty quick to that. >> with the ongoing drought there are no guarantees. four years ago chain installers near angels camp had 80 days of work. last queer it was just four.

look at the richmond/san rafael toll plaza, headlights are glistening off the roadways. conditions after such a dry spell, but as we take a look at live doppler 7 hd, the rain is making its way over the bay area. so right now it's traveling from santa rosa right over san fr francisco along the peninsula and now making its way, making landfall in san jose. so we are going to be experiencing some pretty wet conditions there. and it's going to last until approximately 9:00 this morning. then we'll dry out for a little bit. right now gusty conditions, in fact, our first wind of the see he son 20 miles an hour at sfo. gusty southerly wins. 15 miles per hour in fairfield. 22 in hayward. those southerly winds will turn into northwestern winds and that had will continue for pretty much the entire day. be careful. we do have a much craft advisory until 2:00 this afternoon.

wet and windy storm is going to bear down on us and by the time we get to the game that is when we're going to experience more showers and possible thunderstorms. certainly over the santa cruz mountain as it makes its way northward. as we take a look at temperatures first pitch 63 degrees. 61 degrees by the end of the game. and you are going to need that umbrella, maybe a upponcho and some warm wear. we do have our game that is going to happen today at 12:30, also showers expected. so just be prepared. 68. stanford takes on the beavers. a high for today around the bay area, 70 degrees in san jose. we have 9 degre69 degrees in sa. 50-mile-per-hour gusts are expected.
