saturday he was thrown over board. they were on a 32-foot boat that capsized by a rogue wave. sanchez was the only one who survived. >> the guilt, why me? that's the hardest part. his friends, 79-year-old jesse langely and sam garcia were last seen lifeless in the water. and so was another man, david costa. the fourth person was a woman, an acquaintance known as christie. sanchez was flown by helicopter to the hospital after swimming 20 minutes to shore. he cut his arm on the ocean rocks and twice he thought he wasn't going to make it. >> i figured it was over. i got up and ran out of breath and i sucked a little air and a bunch of water. >> they were 250 yards out in the ocean in an area where they have never had a wave sneak up on them the way it did on saturday. judy garcia says her husband, sam, was looking forward to getting some crab for a crab salad that night. he wasn't wearing a life vest and neither was anyone else on

she took her life on november 1st. in her last facebook post she says goodbye to family and friends writing today is the day i have chosen to pass away with dignity in the face of my terminal i will mess. this terrible brain cancer that has taken so much from me, but would have taken so much more. a spokesman for compassion and choices says britney died as she intended, peacefully in her bedroom in the arms of her loved ones. the 29-year-old was diagnosed with terminal brain cancer and given six months to live. they moved from alamo to oregon to take advantage of the state's death with dignity act. >> since january 1st, my diagnosis, it is like it keeps getting worse, but i guess that's what happens when you are terminally ill and you get sicker and sicker. >> it is not my job to tell her how to live, and it is not my job to tell her how to die. >> britney's mother and husband both supported her decision. >> if all my dreams came true

i would somehow survive this >> oregon was the first state to make it legal for a doctor to prescribe a life ending drug to a terminally ill patient of sound mind who makes the request. more than 750 people in oregon used the law to die as of 2013. oakland police continue to probe the death of a uc berkeley student after he fell inside oracle arena during a halloween concert. we first reported it last night at 11:00. part of the investigation will focus on how 20-year-old zachary bradley was able to enter an off limits part of the arena on friday night. a former california highway patrol officer will appear in court tomorrow to face charges of sharing nude pictures of a woman he arrested. sean harrington is accused of

forwarding pictures of a woman he found on his phone while she was being booked into jail. the victim discovered the transfer of the picture a few days later. prosecutors dropped the dui charges against her. harrington quit his job after being accused. gas prices are plummeting. they dropped so low even some bay area gas stations are selling it for less than $3 a gallon. abc7 news reporter is live in mill valley with the details. sergio? >> katie, this station in mill valley has been busy all weekend, and this is the reason why. they are selling gas, unleaded there, $2.99 a gallon. the average price in the bay area is a little higher than this. but it just so happens that this is the national average. $2.99 a gallon. drivers haven't seen prices this low in about four years. this mill valley filling station is well worth the drive. >> i live in daly city. >> wow. so did you drive all the way up? >> i am on my way to gold

46 petaluma. 49 in oakland and 51 in mountain view and currently a temperature of 49. satellite and radar, the story we are tracking, we have an area of low pressure that is flying in a lot of cloud cover. some could stream into the bay overnight tonight. we are seeing rain around seattle and portland. unfortunately that rain will stay to the north of us. the reason why is high pressure is building off the coast and the high pressure will protect us from any sort of moisture moving in over the next couple days. we will see dry skies and lots of sunshine, but also warming temperatures over the next couple days. look at the week ahead especially in san jose. tomorrow a high of 70 degrees which is below the normal high of 72. by midweek the temperatures go to about 80 degrees on wednesday and we will stay above normal throughout the next seven days. look at that. we are in the mid70s. the warming trend will stick around for at least a week. as we look at monday morning you will wake up to partly cloudy skies and temperatures in the 40s. the clouds will break down for total sunshine.

program. this comes after redwood city increased parking meter rates to $1 an hour in august amid a downtown business boom. a passing trucker catches a california state park ranger , an armed officer on patrol passed out with a beer between his legs. the abc7 news i team has been digging into the story behind the photo and has obtained new documents that show the ranger expected and received special treatment from his law enforcement colleagues. dan noyes has details. he has been getting slack from neighbors of the pictures he took of tyson young passed out with a beer between his legs. he called 9-1-huynh and -- 9-1-1 and he was arrested. he said he would do it all again. >> i saved somebody's life and it could have been joe blow's kids and wife or a tourist on there. >> the chp investigation report shows that the ranger

blew a .236, nearly three times the legal limit. officers noted his strong odor of alcohol, red and watery eyes and slow and slurred speech. yet young told officers "i'm still going to be able to be cited and released" and he was right. young did not go to jail, the normal process. the chp cited and released him to a supervisor. the chp commander tells me young fit the criteria. >> you have to not be under the influence. the person who is picking you up has to not be wanted for anything else. he has to not have been violent in the encounter or anything like that. >> but the report shows young got in a tustle with officers and resisting arrest in addition to the dui. they show this year so far the chp arrested 234 people, the vast majority booked into jail. only five including tyson young were cited and
