causing the driver to crash and spill all the dirt it was carrying on the highway. >> all lanes of highway 101 in san jose just reopened after that truck crashed. here's another spot on the evening commute that is normally a lot of trouble. it's doing okay right now at this hour. but normally highway 101 totally backed up. but good going so far. hope it stays that way for drivers going home. here's a look at all the roadways from our traffic computer. a lot of red. heavy traffic and a lot of drivers going nowhere fast. >> good evening everybody. i'm cheryl jennings. >> and i'm dan ashley. it's not just big rigs causing problems tonight. chain saws echo throughout san francisco today as rain and old age sent trees toppling. >> the tree limb was so big and large, it took out the supporting poles and wire

structures. >> well, the rain we had overnight and this morning brought trees down in parts of the bay area, including san francisco where one man was critically injured. caroline tyler is there live tonight. the city is manning to get rid of some of those potentially dangerous trees. >> reporter: that's right dan. they are problematic. the city says it will cost between $500 to $1,500 per tree to replace them, but that plan is now on the fast track. the ficus was the tree of choice to line the city streets back in the '60s. but now they're old and weak. this is an unfortunate example of what can happen when a little bit of rain and wind hit their branches. this one fell on a man and took down a line. >> in my professional opinion,

they should be removed. >> reporter: three have toppled in the mission district this year including one this morning that crushed mildred brown's car. another one gave bay in north beach. fortunately, no children were around. the head of the department of public works is planning to replace the worst of the bunch. >> it's really critical. we're seeing a huge number of trees fall this year, compared to other years. so they've got to that age where we need to start addressing the concern. >> reporter: the tree that fell at 23rd was pruned just last week. but the maintenance program is well behind because there's not enough money. in recent years, the city shifted some responsibility onto homeowners. supervisor scott weiner believes

what's really needed is reliable funding, perhaps a parcel tax. >> and the parcel tax will be conditioned on the city taking back responsibility for all the trees. >> reporter: in san francisco, carolyn tyler, abc7 news. >> let's take you out to where the rain started very early this morning, steady showers coming down in downtown walnut creek well before daylight. >> the rain drenching the santa cruz mountains and slowing down traffic with wet, slick roads. this was the scene on highway 17 at the summit between san jose and santa cruz. that part of the bay area often bears the brunt of these storms. >> dan and cheryl, we got a pretty good amount of rain in some parts of the bay area and another chance later on. we do have some clouds around right now. and when you take a look at our

rain totals here's what we got. in the santa cruz area, 0.87 of an inch. lower elevations a third of an inch in san francisco. just over that in hayward, livermore. san to rosa, 0.1 of an inch and in san jose, 0.14 of an inch of rain. san jose is running 63% of normal. we need a lot over rain. i'll be back to let you know when you might need the umbrellas again. cheryl? >> thank you so much. a stunning discovery of hundreds of child pornography videos on a computer leads to the arrest of a 39-year-old san jose man. we're joined live now with details. chris? >> reporter: good evening. the suspect was arrested and police tell us he's being held here at the santa clara county jail in san jose. he was actually taken into

custody this morning while on the job at an office building. this all happened following an investigation by the internet crimes task force. let's take a look at his picture. this is arturo perez of san jose. authorities found more than 100 child pornography videos on a laptop he had in his possession. there are looming questions out there, including who were the children on these videos? officer albert morales with the san jose police department says they're following up. >> our internet crimes task force, our experts, they'll do whatever they need to do to identify these children. obviously they're going to conduct a lengthy interview with the suspect. >> reporter: it's unclear if the children are local or from out of state or country. but we have been told by police that the children were in these images range from toddler age all the way up to the age of 12.

but, again authorities making the arrest at an office building. as we return to a live look officials say this is a very disturbing case and will take quite some time to process the evidence. >> chris thank you very much. a man who dresses up as elmo and accused of harassing tourists at fisherman's wharf is staying in jail. a judge says adam sandler that's his name, is a flight risk. sandler is known as evil elmo. videos show him ranting and getting arrested in new york. he's charged with threatening a fisherman wharf's merchant. >> we've seen escalation of his behavior in eight months since he's been here intimidating bullying. >> they make aggressive

panhandlers go to mental health counseling. >> the judge rejected a request to set sandler free and have his father take him to oregon for counseling. a highway patrol officer in nevada uncovered $100,000. he noticed a driver acting strangely, so he pulled him over. investigators say the cash was going to be used to buy a lot of illegal drugs. in san jose, tsa officers discovered three packs of cocaine. the drugs were concealed in a package of raw meat. we first told you about two san jose police commanders accepting improper gifts from the 49ers even while police were investigating some 49ers players. well, now it turns out the chief did it, too. here's vic lee. >> reporter: last month, two top command officers received free 49er tickets, in violation of

the police gift policy. the assistant chief eddie garcia attended two events. you see him here last year. the second was this august at levi stadium. the deputy chief was also invited to the same game. but under the police duty manual officers cannot accept any gift at all. sports tickets included. the department told us the chiefs reembursed for their tickets, but only after abc7 news began inquiring. now it turns out the chief of police also got free tickets to a 49er game. the department did not return our calls, but sources tell us he also reimbursed the niners after we asked about the tickets. we learned today that the city manager met with the three chiefs. so it was the conclusion of your office that there was a

all right. get ready for more construction on the bay bridge. caltrans will spend more money and more time to fix old expansion joints on the bridge. the good news this time the work will happen without those steel plates that bring the commute to a crawl. laura anthony explains how and what it's going to cost. >> reporter: caltrans officials admit they did not foresee the problem that came with the temporary plates last month. but now they say they have come up with a fix that will banish the plates forever. >> it took an hour and a half to get there. >> reporter: how long does it usually take? >> about 30 minutes. >> reporter: those infamous steel plates that caused so much trouble for bay bridge commuters in october won't be back.

that's according to caltrans which announced they found a way to replace the aging expansion joints on the upper deck of the span without using the plates. >> what we'll be doing is we're using rapid set concrete. that way we can get in there, do the job in one night, you know, and go ahead and be done by morning. >> reporter: that is one section per night. no plates needed. the original issue came to light in april when a large hole developed on the upper deck. there were also cracks in some cases that ran all the way across the lanes. the repair work will be done between 9:00 p.m. and 5:00 a.m. six days a week instead of taking six weeks to complete, it's expected to take ten. the cost will also increase from 1.7 to $2.7 million. >> we're talking about brand new expansion joints. the ones we had were state of the art in 1936.
