this morning at california and montgomery streets. witnesses rushed to help the victim. abc 7 news reporter lyanne melendez talked to some of those people and the man inside the car and joins us live with this incredibly scary story. lyanne? >> reporter: there are moments in a reporter's career when you go wow and this was definitely one of those moments. this is a very busy intersection, montgomery and california. the window washer was taken to sf general hospital with a badly fractured arm, several broken bones, possibly his spine. the driver of that car, well, do you believe in miracles? the window washer fell from the roof of this building and landed on this toyota camry. notice how all but the driver's area is caved in. he narrowly escapes being critically injured as he was turning left on to california street. >> as soon as i made my left

turn, start my left turn, i see something hit my car very hard and impact was really hard. i didn't know what it is. >> reporter: after landing on the car, the window washer fell on to the street. witnesses ran to help. >> i'm a premed student so i said go get him towels right now, he's definitely unconscious. and he's bleeding from the ears. >> i took off my jacket, i put it over him and i started to direct traffic. i don't know anything about medical so i did what i could. >> the thud of the body on to the car and the shattering of the glass is what was i guess shock. >> reporter: the man worked for century window cleaning in concord. >> he was working on the 11th floor setting up the apparatus and there was some type of accident and one individual fell off the window washing apparatus. >> reporter: the victim may have slipped as he was adjusting the cables of this rig.

he apparently had not clipped himself on to the safety line. >> we figured out who he was by the equipment he was wearing. he had a safety harness and whatnot on. >> reporter: he had the safety -- >> yeah, he was wearing a harness. >> reporter: the window washer was taken to the hospital. meanwhile, the driver's wife came to pick him up. they both can't believe he was not hurt. >> i'm just blessed that i have him alive today standing here next to me. >> i'm happy that i didn't get hurt. i'm happy that he is okay, hopefully he can make it. i pray for him that he can make it. >> reporter: in san francisco, lyanne melendez, abc 7 news. >> unbelievable. a 4-year-old santa rosa boy has awakened from a coma after surviving a 225 foot fall off of a cliff in the north bay. sebastian johnson was at bodega bay with his family, got too close to the edge when throwing rocks and fell roughly 23 stories to the ground below. he suffered head injuries and multiple broken bones.

his father tells abc 7 news sebastian is actually playful now and doing a lot better. he's had plastic surgery. his jaw is still wired shut but his breathing mask and neck collar are now off. president obama began selling his executive order on immigration reform to the public today with a campaign style rally in las vegas. the president unveiled the plan yesterday during a prime time address to the nation. the action would effectively end the threat of deportation for five million undocumented immigrants. most of them parents of children who are legal u.s. citizens. the president now faces a daunting challenge from republicans in congress who believe he has overstepped his constitutional power. >> this action doesn't grant citizenship or the right to stay permanently or receive the same benefits that citizens receive. only congress can do that. all we're saying is we are not going to deport you and separate you from your kids. >> the president has taken actions that he himself have said are those of a king or an emperor, not an american

president. >> the president's executive order won't go into effect immediately. it may take up to six months for all aspects to be implemented. >> as the president spoke in las vegas, immigrant families gathered in san jose to get more details to see if they actually qualify. >> abc 7 news reporter david louie is live at union hall -- at a union hall with their reaction. david? >> reporter: well, the reality is starting to sink in that the president's executive order will not cover everyone. yet there is happiness among those who will qualify. here in california, those -- many of those eligible will be undocumented asian immigrants. >> this is not just a latino issue. it's an american issue. >> reporter: the president appears to be trying to broaden the appeal of the order, mentioning how it will impact the irish, haitians and ukrainians. it will also impact an estimated 400,000 or more asians in california and more than one million asians across the u.s., including filipinos.

>> some of them are nurses. they came here of course for greener pasture but because of this licensing requirement, social security, they are not able to use their education. >> reporter: there is disappointment among some immigrant families. mauricio is a dreamer covered by deferred action but his mother is not eligible for the new plan. >> i have to be the one driving them around because they're in fear of getting stopped, you know, and they can end up in deportation. you never know. we have uncles and aunts that will be able to qualify and she is very happy for them but at the same time, she's sad because she is still at risk. >> reporter: republicans remain at odds with the president. >> by deciding to work alone he creates more division in the country and that division probably will last throughout this entire congress because it's a presidential year and it's going to be hard for them to act. >> reporter: san jose's

congresswoman's response. >> if they don't like this, the remedy is obvious. pass a bill. do your job as legislators. >> reporter: those seeking immigration reform say they hold to the hope that more changes can be made in the future to include more undocumented immigrants. in san jose, david louie, abc 7 news. dozens of uc berkeley students continue their takeover of wheeler hall. the students commandeered the lobby of the building protesting a tuition increase at all university of california schools. they say they will stay there until the uc regents revoke the increased fees and show more transparency in their budget. >> their job is to support this system that we are made part of and if they are working that strongly against us they are acting not in the interests of the students, hopefully they will reconsider. >> the student protesters are also asking for the release of a 21-year-old student who was arrested for vandalism. this morning, graffiti against uc president janet napolitano appeared spray painted on wheeler hall. so far, the university hasn't

shown any inclination to remove those students forcefully. the storms that brought some seven feet of snow to western new york are now blamed for at least 13 deaths, mostly from heart attacks and exposure. several buildings have collapsed and nearly 100 homes are beginning to buckle. rescue crews are digging through all the snow trying to get to stranded residents. people are shoveling off their rooftops trying to save their homes from caving under the weight of the snow. the region is now expecting rain and a warmup and that's when the snow will quickly melt, bringing a new threat of flooding. back on the west coast, crews cleaning up today after a wall of mud hit a home in the los angeles suburb of glendora early this morning. the four foot flow blocked streets and covered a car. fortunately, nobody hurt. the slide took place in an area that was scorched bare by a wildfire earlier this week. a flash flood warning had been issued after a fast-moving storm dumped heavy rain and hail across the foothills of the san gabriel mountains from pasadena

as far east as clairmont. the ski season kicked off today with the opening of heavenly and north star, despite the ongoing state-wide drought. employees at heavenly worked overtime to make it look like winter above 9,000 feet. most of the snow there is made by man, not mother nature. they have one run open. snow seekers say they are excited nonetheless. >> i'm excited to get back on my board. can't say anything other than it's decent snow, one run, congested but loving it. waiting for the weather to come up. >> abc 7 news reporter laura anthony tweeted out this picture saying the hills are alive at heavenly. she will have live reports from south lake tahoe on abc 7 news at 5:00 and 6:00. taking a live look at tahoe right now. you can see the snow-capped trees right there. spencer christian, we aren't thinking about snow but yet

another rainstorm that's coming through. >> that's true. clouds are getting thicker right now and there are reports of sprinkles in the bay area as we speak. let's take a look at live doppler 7 hd. we will show you what's going on. lot of moisture in the clouds moving through the north bay right now and fairfield in the last half hour or so has reported sprinkles. there may be other locations now getting just some very light sprinkles or drizzle hitting the ground but no measurable rainfall yet. the real rain is up to our north, east of eureka and crescent city moving southward and of course some is developing offshore as well. let's take a look at the rainfall totals over the last two days, since wednesday we have had two storms producing widely varying rainfall totals, over an inch and a half at mt. st. helena. over an inch in oakland. only .14 in the city. here's the forecast animation starting at 5:00 this afternoon. we will see little areas of light rain developing late tonight and overnight into the

happening now, all lanes on i-80 westbound in berkeley are now open but the freeway is still feeling the effects of a big rig fire. all started just after noon when cars started honking to let the truck driver know his trailer was on fire. he pulled over as it burned. officers shut down the three right lanes of 80 and the gillman street on ramp for more than two hours until they could

tow the truck away. there are no injuries but traffic still snarled because of it. the new b.a.r.t. train service connecting the coliseum station to oakland international airport will be up and running tomorrow. >> yes. bay area leaders held a ribbon cutting ceremony today and members of the public got a preview. abc 7 news reporter lillian kim is live at the coliseum b.a.r.t. station with that story. >> reporter: that is the platform for the new train that will start taking people to the airport. i was able to ride it twice today. it was a very smooth ride, only eight minutes long. it travels 30 miles per hour for 3.1 miles and is all automated. this driverless b.a.r.t. train connecting the coliseum station to oakland international carries members of the public for the first time. for two hours, people could ride the train for free before its official opening at 6:00 a.m. saturday. >> i thought it was a nice smooth ride, smoother than i thought it would be. it went faster even though they said it was eight minutes, it seemed faster than eight minutes. >> reporter: some riders were giddy, excited they will no longer have to take the air

b.a.r.t. bus to the coliseum station to the airport which was at least a 15 to 20 minute ride. the new line runs above hagenberger road, allowing to train to bypass traffic lights and congestion on the street. >> which is fantastic. you can just take the train, the b.a.r.t. train and then get right up here and right to the airport. >> reporter: bay area leaders gathered at the platform to celebrate the completion of the nearly half billion dollar project. the oakland airport connector was 30 years in the making. >> today, the oakland international airport joins a very elite group of airports that have plane to train connections. >> reporter: the connection will cost more, $3 more than the cost for an air b.a.r.t. bus ride. mark says that's okay. he says the convenience of being able to use the clipper card is a big deal. >> that makes a huge difference for us, trying to get transportation as seamlessly and

cashless as possible. >> reporter: the trains will arrive at the platform every five, 10 or 20 minutes depending on the time of day. lillian kim, abc 7 news. >> air b.a.r.t. is certainly a big deal for oakland but not as big as what happened last night at the coliseum. the 0-10 raiders came back to beat one of their rivals, the kansas city chiefs, capturing their first win of a long season. they end a 16-game losing streak that dated back more than a year. there was the black hole. it was bedlam in the stands. joy in the locker room after the game when head coach tony sparano was given the game ball, a gesture that meant a great deal to the veteran head coach. >> i have gotten some game balls before but quite honestly, probably none more meaningful than that one. i say that because you know, what have this team has been through and how much the guys have stayed together in that

moisture over parts of the north bay right now with some locations reporting sprinkles. that includes fairfield. we have rain on the way. a live view from the east bay hills camera looking at a cloudy western sky. panning a little to the north -- the west-northwest, we can see that we have current temperature readings of 60 degrees in san francisco and oakland, 61 moffett field. san jose, 62. 63 at morgan hill. 57 at half moon bay. a nice view looking northward out beyond the golden gate bridge. currently it's 57 degrees at santa rosa, napa, novato and vacaville. concord, 58. 62, livermore. looking at the golden gate bridge, it does not appear that the pavement is wet there, at least not from current rainfall. these are the forecast features. rain developing overnight. it will be partly sunny by afternoon tomorrow and we will have a string of sunny days right on into next week. here's the satellite radar composite image and here comes the cold front that will bring us our next bout of rainfall.

more light rain to moderate rain will develop later tonight so let's get right into the forecast animation starting at 7:00 this evening. during the late night overnight hours, we will see little pockets of light and light to moderate rainfall. by 6:00 tomorrow morning, there will be more widespread rainfall, mainly across the north bay, mainly north of the golden gate but some will work its way down into the peninsula and into the santa cruz mountains, out to the east bay. after that we will see the front sweeping through the midmorning hours. behind the front, lighter rain, more widespread, more widely scattered showers and some partial clearing in the north bay. then by early afternoon, we will see partial clearing across much of the bay area with the exception of the south bay and santa cruz mountains. it won't be an all day rain event. we will see sunshine later tomorrow afternoon. rainfall projections, maybe one tenth to three tenths of an inch for most lower elevations. half an inch to an inch in the mountains. as for the sierra, well, we

amazing luck on the timing. he's now in critical condition at san francisco general hospital. abc 7 news reporter lyanne melendez spoke with the driver of that car, who escaped uninjured. you will hear from him on abc 7 news at 5:00. going to be a big day tomorrow for travelers who fly out of oakland international airport and rely on b.a.r.t. to get there. the long-on waited air b.a.r.t. automated people mover opens at 6:00 a.m. connecting the b.a.r.t. coliseum station to the airport for $6 one way, replacing the existing air b.a.r.t. shuttle bus service. police officers on the peninsula set out today on a sting operation targeting unsafe drivers and motorcyclists. abc 7 news reporter vic lee covering the story on twitter and live for us in daly city. he joins us live with the story. >> reporter: well, this big street over here, lake merced boulevard, is a dangerous roadway. this is where much of today's operation took place. it has a history of bad, bad accidents.

in february, a 72-year-old woman died after being struck by a bus on a crosswalk at john muhr drive and lake merced boulevard in daly city. folks who live nearby say the four lane roadway has had many accidents. >> couple years ago, unfortunately, two young guys died here because of speeders. >> everybody goes pretty fast. there's been a couple times where there has been people just crossing the street, you can hardly see them. >> reporter: lake merced boulevard is known for speeders. the city is now installing traffic signals at the crosswalk to help slow down traffic. police enforcement operations are trying to cut down on speeders, those in cars and a special focus today on motorcycles. >> given the proximity to san francisco state there's a high volume of motorcycle traffic that travels through here. >> reporter: motorcycle units using remote sensing devices were catching a lot of speeders, mostly drivers but also motorcyclists.

>> i got a locked speed of 65 miles per hour at 1123 feet. >> reporter: 65 miles in a 30 mile per hour zone plus he had a driver's license but not a permit to operate a motorcycle. most of the speeders didn't want to be caught also on camera. adita cortez did not mind. are you going to slow down now? >> yeah. now i learn my lesson. >> reporter: in san mateo county last year, eight motorcyclists died, 216 were injured. so far this year, there has been only one fatality. police attribute the drop in large part to safety ops like this one. vic lee, abc 7 news. a p.e. teacher is charged with abusing a child after he was caught on video trying to force her into a swimming pool

during class. the scene played out in front of a group of students. one had a camera. reporter tim daily has the story. >> his hands are right there at her chest ar. she is trying to cover her chest from being exposed. >> reporter: it was back in august when students at edison high in stockton were in a p.e. class at the school's pool. the teacher reacted this way when a 14-year-old girl said she wasn't getting in the water. he is the teacher who [ inaudible ] for ten years. the video, shot by another student, shows the teacher trying to drag the girl into the pool. how he responded that day led to a misdemeanor charge of corporeal injury to a child and likely to a lawsuit. >> it should disgust you in the way this man put his hands on a

14-year-old girl. she said multiple times my top is falling down. >> reporter: peterson was put on paid leave for a month, then brought back and assigned to another stockton school. why was the young lady so opposed to swimming that day? she had had her hair done that morning for an event happening later that night. gilbert says the teacher had the option of academic punishment but not this. >> no means no. stop means stop. this isn't a situation where she's attacking the teacher, he's defending himself. when a woman says no, and when a 14-year-old girl says no, it means no. >> reporter: tim daily, abc 7 news. >> you will hear from the mother and daughter involved in this abuse investigation coming up on abc 7 news at 6:00. still no word from the missouri grand jury deciding whether charges will be filed in the michael brown shooting case. tensions running very high in ferguson and surrounding communities as everybody is waiting to hear if officer darren wilson will be indicted

for the fatal shooting on august 9th. today, brown's family once again called for calm once the grand jury decision is announced. activists echoed those sentiments, urging both protesters and law enforcement to show restraint. >> we are looking for the police department, the national guard, homeland security, to be as equally committed to peaceful demonstrations and peaceful expressions from our community. >> even though no decision has been made, school officials in ferguson and other nearby communities have canceled classes for monday and tuesday just as a precaution. house republicans are suing the treasury and health and human services over obamacare. the second obamacare related lawsuit filed by republicans this year. they previously sued the president over his actions to unilaterally waive provisions of the law. democrats say the lawsuits are a

more for oranges very soon. you can blame the drought for this. the harvest is just getting started for this year's citrus crop and farmers say there are fewer oranges and the oranges themselves are smaller. the farmers did not have enough water for all their trees and fear this is only going to get worse. >> i had enough water to get by this year. we don't have any water going into next year. >> that's frightening. bit of good news here is that he says the oranges will still taste great but worrisome going forward. gluten free diets seem to be more popular than ever. a third of americans in a new consumer reports survey say they now try to buy gluten free foods or avoid gluten. but consumer reports says going gluten free can pose some risks. store shelves are full of foods labeled gluten free from oatmeal to pasta to chips. in this deli, even the sandwich is gluten free. about 7% of americans can't eat gluten because they have celiac disease or a diagnosed gluten

sensitivity. but how good is a gluten free diet for everyone else? to find out, consumer reports reviewed nutrition labels for more than 80 gluten free foods. >> people think that going gluten free will help them lose weight or get better digestion and a whole host of other health benefits but when we looked at those gluten free products, we found that they are not necessarily healthier and they may be less so. >> one concern, some gluten free foods contain more fat, sugar or sodium than their counterparts. for example, the gluten free bagel on the left has seven grams of fat. the regular bagel on the right has two grams. while products made of enriched wheat flower provide essential nutrients like iron and folic acid, you don't get those in many gluten free foods. another important worry, many of the gluten free products consumer reports analyzed contain rice flour or other rice-based ingredients. >> in our tests of rice and rice products, in 2012, we found that most contain arsenic.

barbara. another question, is there any requirement for auto repair shops to offer their diagnostic option first? >> i'm not sure i know exactly what a diagnostic option is but let me explain how the law is. the law in the state of california says a repair facility cannot make a repair without first giving you an estimate and you accepting the estimate. now, that estimate can be for the whole repair, like i'm going to replace your whole engine, or it can be just for the diagnostic. some cars you roll out a computer, hook it up and find out a bunch of information. they may charge you $50 or $100 for that but they have to tell you that up front. they just can't start doing that. they will say we will charge you whatever amount to diagnose the problem, then we will come back and decide how much it will cost. >> a twitter user asked how safe is the new snap cash from snapchat? >> yeah. another one of these payment systems. google is rolling them out,

and was given a clean bill of health. just two weeks ago, the unthinkable. a second cancer diagnosis at the age of 31. this time for acute myeloid leukemia. her husband and mother take turns taking care of the boys and taking trips to the hospital. >> i want to be the mom i want to be to my beautiful boys. >> reporter: j.p. is an instructor at lana's dance studio. her students took this picture of them all dressed in orange, the color for leukemia awareness, and posted it on the studio's facebook page. the morgan hill community has rallied around the murphy family. the fitness group moms run this town has organized a fund-raiser, a 5k fun run, for this saturday. >> we can only do so much. we can't take the cancer away but we can raise awareness and money to help in whatever way we can. >> reporter: j.p. is going through chemo and radiation with the hopes of beating cancer again but she will be in the hospital for at least another two weeks and eventually will

fell. he was conscious and he was aware. >> what a shock. that man is fighting for his life tonight. thank you for joining us. i'm cheryl jennings. >> i'm dan ashley. pedestrians in san francisco's financial district could not believe what they were seeing. the window washer falling 11 stories. he was on the roof of a bank building when this happened in a crowded intersection at california and montgomery streets. that's where abc 7 news reporter lyanne melendez is live tonight. just amazing what happened. >> reporter: well, it's one of those hard to believe stories, no doubt. the window washer was taken to the hospital, of course. he suffered a fractured arm. in fact, his arm is in bad shape. he also suffered several broken bones and possibly a broken spine. now, according to cal osha, who was out here investigating this accident, the rig that he was trying to get on, those rigs have to be inspected every year. the last time that rig was

inspected was august 2013. this toyota camry is where the window washer landed after falling from the roof of this building at 400 montgomery street. he was taken to sf general. the driver of that car narrowly escaped being critically injured as he was turning left on to california street. >> i made my left turn, and then i see something hit my car very hard and the impact was really hard. i didn't know what it is. >> reporter: after landing on the car, the window washer fell on to the street. witnesses ran to help. >> he was aware and as we spoke to him, explained to him help's on the way. >> i'm a premed student so i said go get him towels right now, he's definitely unconscious, we need -- and he's bleeding from the ears. >> i walked up next to him, i said you're going to be okay, just keep breathing because he was, he was
