critical condition. he was riding his motorcycle on the way to a doctor's appointment when -- >> the light turned green and the car in front of me started to roll forward. all of a sudden a guy falls from the roof of the building. >> a window washer plunged 11 stories from the top of the building in san francisco's financial district where montgomery street meets california. the man landed on his back on a moving car crushing the roof just feet in front of whalely. >> it was so powerful it was like a bomb went off. the car lifted up on its wheels the whole top of the car was like totally dented in. >> the car broke the man's fall and he ended up in the middle of the street still wearing his harness. he waited for the the ambulance and held the victim's hand. >> i am happy i didn't get hurt and happy he is okay.

hopeful leahy can make it. >> the victim was rushed to san francisco general hospital. his daughter tells me he is in critical condition. he works for a family run business in concord. on their website it says they are are committed to the safety of their clients and employees. cal owe shoe -- cal-osha is investigating and said they were convicted of charges in 2008. abc7 news. >> new at 11:00, vallejo police credit good samaritans with catching a driver accused of causing a deadly roll over accident. 23-year-old jermaine tolliver was drunk when he t-boned his white nissan. it killed the driver and seriously injured the passenger. he tried running away, but witnesses held him to the ground until police arrived and arrested him. he faces vehicular manslaughter, hit-and-run and dui charges tonight.

>> now to some shocking video. a stockton pe teacher has been charged after he grabbed a 14-year-old student and tried to drag her into the swimming pool. >> i feel uncomfortable. >> this is the edison high school freshman seen on the video that has exploded on the internet. andrew garcia agreed to swim laps, but when she didn't want to get her hair wet, she got out of the pool and sat in the bleachers. before another student saw her struggle peterson went to her and grabbed her. >> i sat myself on the stairs thinking he would fall and he grabbed me by my ankles and tried to pull me down. i was like, stop, leave me alone. >> the cops were called and peterson was put on paid leave for a month, but then brought back and assigned to another stockton school.

that's why sandra and her mom are so angry and talking. they can't believe peterson was back on a campus. >> time goes by and i find out he is working at an elementary. now we are more vulnerable and he is working? >> it was this week we learned peterson faces the misdemeanor charge of corporal injury to a child. but stockton unified was not aware of that until news 10 told the district yesterday and now peater son is back on paid leave. these are sandra's bruises. their attorney is preparing a claim against the district which will likely lead to a lawsuit. we have attempted to reach the teacher for his side of the story. we haven't heard back. >> why should that teacher have done that? >> have self-control. after a little time to dry

way. a community celebration is taking place on a project that took 30 years to complete. 39 california staff senate members are looking for new jobs tonight. he cut dozens of staff positions today. the move was needed to avoid a multimillion-dollar deficit. the cuts will affect the secretary -- secretary -- secretarial pool. they are planing a walkout to protest a planned tuition hike. they were planing a sit in since wednesday. that's when the regents approved a 5% a year tuition increase for the next five years. they are vowing to stay until the regents change their minds. the walkout is planned for monday at noon. the crowds of other cal students are rallying in the big game against stanford they worked hard to nail together

120 wooden pallets for the big game bonfire. alan wang joins us with more. >> based on the excitement out here you wouldn't know that both teams are 5-5 for the season. when the big game rolls around nothing else seems to matter. 7,000 cal students packed into the greek theater with hopes of taking back the ax from stanford. cal is trying to end a four-game losing streak in this 117-year rivalry. this year they believe they can do it. they tried to erase memories of last year's 1 and 11 team that lost to stanford, 63-13. he assured the crowd that they are an entirely different team. they are a great team.

from our emeryville camera. it is stunning what little sun we had at 4:55 p.m. there was a lot of cloud cover, but we did get a beautiful sunset. now i want to show you live doppler 7hd. moisture is moving into ukiah. the rain line will be shifting southward as the night goes on. so a steady rain is still north of the bay area. now, when we look at the rain totals for the last two storms, over an inch of rain in oakland and more than two and a half in ken field. got about .13 in san jose and .44 in livermore and over an inch and a half at ben loeman mountain. did they do anything? we have actually boosted them. . 63% of normal. santa rosa 38 and livermore 46% of average. we will need a couple of wet years before we can see the drought get erased

completely. this is good news in the middle of a drought. temperatures in the 50s and this is a beautiful view. it is looking at the cloud cover. rain develops overnight and partly sunny tomorrow afternoon. we are looking at sunny and milder weather early next week. here is our storm number three. this one is a milder storm compared to the previous two. more rain is expected as the cold front slides southward later tonight. let me show you the specific timing. 11:00 p.m. we are seeing a few light showers and sprinkles in the north bay. by 5:00 p.m., the north bay to the golden gate is getting the rain. cold front is in the east bay and the south bay by 8:00 a.m. tomorrow morning. for your early plans carry those umbrellas and then the cold front is long gone by the afternoon. you will be seeing sunshine. you don't need to worry about an umbrella. about a quarter of an inch in the lower elevations. half an inch to an inch and a little under that for the santa cruz mountains. not going to amount to much in
