and now it's in flames. >> a school bus with 38 students bursting into flames on the highway. quick-thinking driver hustling the kids to safety. her incredible 911 call. and take a look at this, a terrifying moments when a stroller rolls away from a grandfather and lands on the train tracks. how strangers managed to outrace the train and pull the toddler to safety. and good morning, america. let's get right to the explosive grand jury decision. no indictment for a new york city police officer in the death of eric garner from a chokehold. >> protests all over the country last night. people, many of them want to hear -- have their voices heard. and abc's ron claiborne joins us now with the latest. good morning. >> reporter: good morning. this is the site of the violent confrontation last july that

ended in the death of eric garner. many people both stunned and angry about that grand jury decision. overnight, hundreds of people pouring into new york's times square to protest the grand jury's stunning decision. in grand central terminal, hundreds more laying down on the floor in what they called a die-in. others laying down on a new york city highway. police officers arresting dozens. protests growing nationwide from oakland, california, philadelphia, atlanta and washington, d.c. overnight, the family of eric garner expressing their grief. >> how could we put our trust in the justice system when they fail us like this? >> reporter: it was back on july 17th that police tried to arrest garner for allegedly selling loose cigarettes. the dramatic confrontation videotaped by bystanders. first garner resisting their attempt to arrest him.

>> don't touch me. >> reporter: then officers grabbing on to the 300-plus pound suspect. officer pantaleo seen with his forearm around garner's throat and wrestling him to the ground. >> can't breathe. i can't breathe. >> reporter: garner, a father of six pronounced dead at a nearby hospital just minutes later. the coroner said the death was from compression of his neck and chest. this morning, the u.s. justice department is launching an investigation into possible civil rights violations against the officer. and bill de blasio urged peace and talked about his own biracial son. we have had to literally train him as families have for decades in how to take special care with any encounter he has with the police officers who are there to protect him.

>> reporter: officer pantaleo, of course, will face possible federal charges that i mention. and also a civil suit and a departmental investigation by the nypd that could end up, george, costing him his job. but no criminal charges here. >> that's from the grand jury. ron claiborne, thanks very much. let's talk about it with dan abrams. a lot of people look at the video tape, how could they not indict? >> what happened here, they weren't able to get 12 of the 23 grand juriy jurors to say they thought there was probably cause to indict. people are going to look at that and they are going to say, chokeholds are not allowed by the nypd. how could there not be an indictment in this case. it's important to note, as a legal matter, just because it's not permitted by the nypd doesn't necessarily make it a crime. you heard ron talking about that. the fact the nypd is going to do their own investigation here. but i have to tell you, having the videotape, and being able to watch it, there was a stronger case for an indictment here even more than ferguson. there you had conflicting testimony about what happened. here you had the video tape of what happened.

and as a result you're seeing a lot of outrage. >> dan, you bring up the ferguson case. a lot of people are talking about the differences. no video there. as you said, there was video here. and all the talk about putting body cameras on police officers, a lot of people, even on social media, are saying what difference is that going to make? >> this is going to be case by case. but don't give up on the video cameras. they're really important. i think it's a great thing that police officers in new york city and i'm sure increasingly around the country are going to be using these body cameras. we want to be able to see exactly what is happening. it is better for us as citizens. i think it is better for the police. both sides, to be able to have that video evidence. so we can now have a conversation about what happened in the garner case and be able to see exactly what happened as opposed to what happened in ferguson where there's a whole dispute about exactly what occurred there. >> let's talk about what is next

right now. eric holder saying there's a federal civil rights investigation. >> nothing is going to happen from the federal civil rights investigation. the standard is higher for a federal case than state. but there will be a civil lawsuit. and potentially a very strong one. >> and hard to believe that the officer is going to return to the force? >> hard to believe because it seems pretty clear that he violated at the very least, nypd procedure. >> dan abrams, thanks very much. >> all right. and moving on to other breaking news, a video released by al qaeda showing an american they are holding hostage and threatening to kill. abc's chief investigative correspondent brian ross is here with more on this. good morning, brian. good morning, this is not isis in syria, but al queda group in yemen. 33-year-old luke somers was working as a journalist and translator when he was kidnapped 14 months ago in yemen. he appeared in the video looking gaunt and clearly under coercion as he spoke for about 30 seconds.

>> basically i'm looking for any help that can get me out of this situation. i'm certain that my life is in danger. >> reporter: elsewhere on the tape, the al qaeda leader said he would meet what he called his inevitable fate unless president obama met the unspecified demands in three days. now, somers was the object of a u.s. special forces raid nine days ago in yemen. it turns out, somers had been moved two days before the raid but the u.s. and yemeni forces were able to free eight or nine other hostages, robin. >> any reaction from the white house? >> no, but they are looking for clues that might help them find luke somers. >> hopefully they will. and now to the record-breaking storm pounding the west coast, causing mudslides, flash floods, and massive sink holes in the streets. san francisco hit so hard. aditi roy is there. good morning. >> reporter: good morning, george. i'm standing next to a sink hole that's 20 feet long and 40 feet deep. take a look. you can't even see down the

bottom. so large, you can fit an entire car down there. so large it shut down an entire intersection. one of the signs of destructive storms sweeping through california. this morning a gaping sink hole in the middle of this san francisco street. raging storm water causing the water pipe underneath the asphalt to burst. the roadway, crumbling. neighbors scrambling. >> i called several neighbors and could tell that this was a bigger issue than just my home. >> reporter: breaking overnight, authorities residuing more than a dozen people trapped in their cars that were stuck in at least four feet of mud. the powerful storm turning roadways into waterways. look at this major freeway just north of san francisco. three lanes of u.s. 101 submerged. the on and off ramps, shut down. a car in this park and ride parked underwater while the water-logged interstate turned into a parking lot. look at the miles of grid lock. >> you couldn't go anywhere. it was a standstill. >> reporter: police in mill

valley, california, urging residents to stay at home. this man who ventured out using a paddle board to get around. and nearly 100 miles east near stockton, california, take a look at this decimated home, part of a massive oak tree crashing treu through the roof. crews have been literally working round the clock to fix this sinkhole. the good news is, the intermittent showers are expected to end tomorrow. george? >> okay, aditi, thanks very much. now let's go over to robin. . >> and the health news, the flu vaccine, the cdc says it may not be a good match for this season's strain of the virus. abc's chief health and medical editor, dr. richard besser is here. so tell us what's going on. >> yeah, this is a big alert to doctors. it's early, but the cdc looked at more than 1,000 flu viruses. it's something called h3n2 train which causes bad flu years.

the bad news is that 52% of the strains are not a good match for the vaccine because of mutations that have taken place in the flu. and they're concerned people won't be as well protected this year. so people are waking up saying, do i get the flu shot, not get the flu shot? what do i do? >> i understand the concern. the cdc says still get the vaccine. i think that's good advice. because it should provide some protection. here's what they're saying that's a little bit different. if you're in a high-risk group, doctors are recommending that within 48 hours of developing flu symptoms they start you on an anti-flu medication. children under 2, people over 65, people with medical problems like heart disease, lung disease, immune problems. pay attention to whether flu is in your community. if you develop the symptoms, call your doctor and get on the medication early. >> you'll be on twitter to answer everybody's questions? >> i will, i'll be there right now. let's get the other developing stories, amy. good morning. and good morning. we begin with brecking news. a suspect taken into custody in the murder of a colorado teacher at a luxury mall in abu dhabi. a female suspect dressed in

black was caught on surveillance video. authorities have just released video showing the arrest. they revealed the suspect was planning to place a bomb in front of another american's home, indicating this was a targeted attack. much more in this case coming up at 7:30. also breaking, nasa is launching the first-ever test flight of a space capsule that could eventually bring man to mars. david kerley is standing by in tell us what happened? >> reporter: first it was a boat, now it's wind. which is holding the heavy rocket on the ground. on top of it, orion capsule. it will be a 4 1/2 hour mission. they still have an hour and a

they today the launch was scrapped. amy, they're going to try tomorrow. and new details about another high profile police shoot, this one in cleveland. 12-year-old tamir rice was fatally shot last month when he was carrying a toy gun. the officer had resigned from his previous police job after suffering an emotional breakdown during firearms training. his bosses described him as weepy and unable to follow simple instructions. and the first major lawsuit was filed against president obama's executive order on immigration. texas is leading that suit, followed by 16 other states, challenging the president's order to allow up to 5 million undocumented immigrants to stay in the u.s. it accuses the president of failing to enforce laws enacted by congress. the president insists he is acting within his legal authority. falling oil prices, a new low for drivers in the u.s. in this gas station in oklahoma, take a look, it is believed to be the first in the country to drop the price below $2 a gallon. several other states, mostly in the south, are close to following suit.

and in texas, a surveillance video shows a truck crashing into this car dealership. the driver is okay, but the crash caused $300,000 in damage. one woman had just walked in to sign the papers for her car which was among those totalled in the crash. some heart-stopping video, shows a moment a stroller with a toddler inside, rolls on to the railroad tracks in australia. you see there, the grandfather, running to try and reach his baby granddaughter. she is okay. he had become distracted on the platform and didn't notice that the stoler's brakes weren't working. happy everyone is okay there. and finally, one robber who just couldn't hold on to his cash, literally. take a look at this surveillance video, showing him trying to get away after holding up an armored truck in china. here's the problem. the bag is loaded with the equivalent of $290,000 in cash. it's so heavy he can't carry it

and more importantly, he can't get it up on to his motorcycle to make his big escape. he was promptly arrested. no cash, no dignity, so sad. the bag weighed more than 180 pounds. just didn't really think that one through. >> had to go to china to get a dumb criminal this week. >> apparently it's a worldwide problem, george. >> you think adrenaline would have kicked in. >> something. >> hit the gym. okay, the latest now on jameis winston, the college football star facing sexual assault allegations telling his side of the story for the first time in an on-campus hearing at florida state. if officials rule against him, he could be kicked out of school. >> reporter: this morning jameis winston sharing his story in the alleged sexual assault scandal that put his college career in jeopardy. winston saying, quote, i did not rape or sexually assault the accuser. the accuser had the capacity to consent to having sex with me and she repeatedly did so by her

conduct and her verbal expressions. is the comments, part of a five-page written statement he read about hat his conduct hearing on wednesday. in it, he goes into detail about his interactions with his accuser, first at a tallahassee nightclub, then later at his apartment. though he declined to answer any questions about the episode. >> i think it's significant because it's the first time he told his side of the story. >> reporter: winston also struck back at his accuser saying, the only thing as vicious as rape is falsely accusing someone of rape. their public campaign to vilify me guarantees the false allegations will follow me for the rest of my life. the unnamed woman also testified during the two-day hearing. >> i think knowing the facts of the case and what has been presented, there's a good chance of it happening. >> reporter: a decision is expected in two to three weeks. for "good morning america," t.j. holmes, abc news, new york. >> thanks, t.j. for that. and michael, shining the spotlight on a hero this morning. >> oh, when, we are.

this is an amazing story. a florida bus driver is being hailed as a hero this morning. she helped safely rescue nearly 40 children from a burning school bus. >> 911 emergency. >> reporter: a driver's cell phone capturing the flames leaping from this bus which mysteriously caught fire wednesday in polk county, florida. >> yeah, he was still going when it was on fire. he didn't know it was on fire. >> reporter: on board, 38 middle schoolers. >> i had looked in the back and if was smoke, like smoke in the back of the bus. >> reporter: and a quick-thinking driver, kristina burrman. >> a student yelled at me and said there's smoke coming in the bus. as soon as she yelled smoke in the because, i immediately pulled over. >> reporter: the smoke so thick, blocking out traffic cameras. she dialed 911 herself. >> i'm a bus driver. i was driving down the interstate. all of a sudden my bus started smoking. and now it's in flames. >> reporter: and listen to this. as she deals with the dispatcher, you can still hear

her herding the kids away from the fire. >> line up against the block, please. line up, please. >> they got off the bus in a single file line, moved quickly. >> reporter: the fire growing so hot, blew out the windows, peeling away paint and the police say flattening the bus' tires. >> the bus driver did a fabulous job getting the kids off in time. or, as you had known, if they wouldn't have gotten offer, it would have been a terrible thing. >> reporter: under the rainbow, a miraculous thing, every single child on the bus, unscathed. great job by the driver getting them out of the bus. and literally calm under fire. she really proved that term. >> and that rainbow. >> i love that. >> the ultimate happy ending that everybody is fine. i don't know that i could have been that calm, cool and collected. congrats to her. >> she was. >> as a former school bus driver myself, kudos to her. they don't get the attention that they deserve. >> no, they have some serious precious cargo. >> precious cargo indeed there, lara. now to the storm bringing all the rain to the west coast. you have the latest on this, ginger. >> look at this, the pictures streaming in overnight.

the bay area receiving most of the rain. get this. san francisco had more rain in the last four days than in all of 2013. that's the three-year drought we have been talking about. look at the numbers. over 4.5 inches into midnight and sacramento, still going, over 3. it really stacks up to how dry it has been. it's not going to solve the drought by any means. and southern california becoming much drier. especially today through the end of the weekend. and then saturday we're going to see another storm, san francisco to the north. also going to include parts of oregon and washington, d.c. so you could see more up to 3 inches possible through the end of the week and the start of the weekend. leave you with a look right there, phoenix getting rain as we start the morning and going into the day but it's not going to be anything that should flood. more so northern california.

an american school teacher and mother of two stabbed to death in a mall. the alleged killer was captured on video but covered head to toe in black. alexander marquardt is in abu dhabi. >> reporter: good morning. the interior minister has just announced that a female suspect has been taken into custody for a stabbing death of i bolya ryan in a mall bathroom. after the stabbing, that person tried to plant a bomb outside of another person's home. this is the person suspected of murdering american school teacher ibolya ryan. it happened here in abu dhabi at the upscale mall. just after 1:00 she strolls casually out of the mall's elevators, dressed in black, her face covered. she strolls past a security

guard. before taking a newspaper. 90 minutes later, she runs out of the batroom. back in the bathroom. the murder weapon left on the floor. ryan, mother of twin boys, later died of f of her wounds. then she entered this apartment where another american lives and planted this explosive device after she drove off in her white suv. emergency vehicles arrived and deactivated the bomb. s.w.a.t teams storm the door. they find the woman and drag her away. they soon find the suv. on the steering wheel, blood, in the back. suitcase and bomb-making materials. a schoolteacher tells us she

still feels safe, but the community is stunned. >> it's very rare. it's not something you would hear about. >> reporter: the police would not say what the motive of the attacker is, or who she is, but comes after authorities warned against jihadists attacks against american schools and teachers. robin, george. >> a lot more to learn there. move now to the arizona teen who got creative after getting locked out. tried to get into the chimney and got stuck until his cell phone and a smart 911 operator saved the day. abc's neal karlinsky has the story. >> reporter: even the 911 operator couldn't believe it at first. >> i'm stuck down a chimney. >> did you say you're trapped in a chimney? >> reporter: a 14-year-old boy locked out of his home, decided that climbing on the roof and shimmying down the chemny santa claus style, sounded like a good idea. he held on to an electrical

cord, but didn't have enough room and it didn't go as planned. he had just enough room to reach his cell phone when he got stuck. >> i understand. they're all coming to help you. >> literally, it was about this wide up top, where he went in, about like that, so he literally went down, hanging on to that rope, got down to that area, realized he couldn't go out and sat there and called 911. >> reporter: it was such a tight squeeze, they couldn't get him back up. >> i'm scared. >> i understand. everybody is there. they are going to get to you. >> okay. you're not hurt right now, are you? >> no. >> you're stuck. i know. it's scary. try to slow your breathing down. okay? you've got plenty of air. you're not going to run out of air or anything. you're just stuck. >> reporter: the 911 operator tried to calm the boy as fire fighters scrambled to figure out how to get him. >> if it makes you feel better, close your eyes and try not to think about it. think of a big open field. >> reporter: it took an hour, but they eventually got him by taking apart the fireplace. >> unique situation.

the visibility has actually fallen to less than a quarter mile. a lot of times what happens, the moisture gets trapped there, it's a tool fog this morning. you see nevada popping up with visibility issue, but also san antonio, new orleans, charleston, all with foggy areas. if you have plans to drive early, get the brights off, visibility will improve as the morning goes on and through the afternoon. here's what is happening. warm front coming on through. there's actually a mix, rain and snow, in kentucky and tennessee. and moving to the east throughout the day. and temperatures 75 in new orleans. you saw new orleans started with that fog. you want to get cold, though, head right to the great lakes and the northern plains. marquette, 21, bismarck, 23. these are afternoon high temperatures. it's not happening now. that's afternoon. lexington, 34, erie, 33, and st. louis, 38, chicago, 34. things are more moderate next week. starts this really mild trend for december. i know you'll want to hear all about that. for now i have to leave you with >> good morning, i am meteorologist mike nicco.
