a man driving a company van hit the tree shortly before 11 o'clock last night. the driver was 45-year-old fremont resident died at scene and the only person in the van. >> we are on the storm watch this morning with wave of rain coming this morning and later today. it help reduce the drought but officers the risk of flooding. amy hollyfield is in one of those places. highway 101 and lucky drive in marin. >> this is a troubled spot. we have standing water open highway 101. cars are moving through and you can see the big flash of water so keep it in mine. it is not raining, there is still, are still pockets of standing water up here in the north bay. marin county officials have declared a state of emergency. they are doing that to try to help the county deal with all of issues because of the rain.

in tiburon there was a mudslide. some mud was dripping into someone's pool in their backyard and it seems like there are clogged storm drains and high tide. rain is driving customers home during the busiest shopping period of the year. >> we had people in the morning and the rain comes in the evening and no one is eating in the restaurants so it is a shame. it has impacted our sales. the storms have caused more than $1 million in damage to county roads and levees in county and is declaring a state of emergency to bring state and federal money to hope everyone federal money to hope everyone deal with the issues.

a menlo park neighborhood is without water right now after a water main break. here is a look at the crews fixing the broken pipe reported after 9:00 last night. a couple of homes were damaged weapon the water flowed in. crews say the ground was so saturated from the rains the weight of the soil broke the pipe and the water has been shut off to 25 homes and crews dig up the streets to fix the broken main and hope to be done later this morning. homes may see sediment stirred up by the water main break appearing in their water. appearing in their water. nick

richmond wal-mart store and were helping kids from low income families buy toys, clothes and other gifts for their relatives. 18 kids took part in the shopping spree. some of the proceeds are donated. some of the officers add their own funds to make sure the child assigned with us and their families have special gifts to open on christmas morning. officers in san mateo were doing good deeds. members of the san mateo police department spent their day bagging groceries at the whole foods store. whole foods will donate 5 james of the rest -- 5 percent to the police activity league. >> oakland police have operation mobile santa spreading holiday clear and presents for the 8 the straight area. these are pictures from last year an officer dressed up as santa was riding a motorcycle through oakland and he passed out rents to children along the way. the gifts are bought with money donated by the traffic division
