candles and -- a sea of candles and flowers where they died. the two officers were in their marked patrol car in brooklyn when 28-year-old brinsley walked up to the passenger side of their vehicle and opened fire striking both officers in the head at point blank range. >> shots feared. >> s.w.a.t teams chased him into a subway station and passengers dropping to the ground in fear. >> get on the floor. >> brinsley then shot hems in the head. earlier that day in baltimore, brinsley shot his ex-girlfriend in the stomp mass and posted this on instagram "traveling on a bus to brooklyn. i am putting wings on pigs today" he wrote. "they took one of ours so let's take two of theirs." bel t -- >> he asked them for their gang affiliation. he asked them to follow hem on instagram and then he said watch what i am going to do.

complaint. sheriff deputies shot and killed a man who was barricaded in a burning house in the foothills. the man fired more than a hundred rounds at them and at nearby homes. even after the garage caught fire and the house started burning police say he kept shooting. a deputy ultimately shot and killed him when the man was near a backdoor around 4:00 this afternoon. the trouble began just before 11:00 this morning when the sheriff says the man maced his girlfriend. more flooding in the bay area. but this isn't because of recent rains. it is the king tide moving in. sergio is live in san francisco. sergio? >> tomorrow it is supposed to be the highest king tide for december. there are someplaces like redwood city that will see surges as high as nine feet and ten feet toward the south bay. here it is south beach harbor in san francisco. this whole platform is floating. you can see right now it is floating at about five feet. tomorrow it is supposed to

surge to as high as seven feet and actually a little beyond that which is pretty high when you consider past eight feet they run out of ruler. in marin county, the high tide caused them to sht down the stinson beach exit. it was flooded out most of the morning. in the surrounding area, the parking lots turned into the shallow pools. neither snow nor rain and high tide kept him from his uh ponted rounds. >> you have to go slow. >> he is used to this, but for tourists it was a surprise. the parking lot at this hotel flooded. >> i think it is impressive. i didn't expect our hotel would be this close to the ocean. water had to be pumped out of the foundation. operators say the building has sunk since it was built in the late 1940s. so he has to stack sandbags to keep the high tide from rushing in.

water. county officials can apply for state and federal aid to cover flood damage. let's head over to meteorologist drew who is checking our weather. >> we will be dealing with the king syed for -- king tide for 48 hours. it lasts until 3:00 p.m. on tuesday afternoon for the localized flooding along our shoreline and around the bay. that means the sea water once again could get on the roadways and the sidewalks and trails around the water. we want to give you the most recent high tide times. our next one is coming after midnight and early monday. another one is happening late monday morning around 11:00 a.m. we are entering the first week of winter, but it will feel anything but winter-like. katie? thank you, drew. berkeley police hope an autopsy sheds more light on the death of a young man near the cal campus. someone reported that the victim fell down some stairs on piedmont avenue early

yesterday morning. officers say a -- say he was not breathing when they arrived on the scene. investigators consider his death suspicious, but they don't think foul play was involved. the 20-year-old may have been a student at cal. the family of injured window washer plans to talk about his recovery tomorrow. he survived an 11-story fall one month ago. pedro perez of san leandro broke several bones and he remains in the hospital. he landed on this car and it may have cushioned his fall. they believe perez may have sliped when he was adjusting a moveable scaffold high above california street. the driver of the car was not hurt. it is down to the wire for christmas shopping. take a look and a listen to this. a little sax mu seek helped -- music helped keep it stress

youtube, and now it is drawing thousands of visitors in person. abc7 news reporter alyssa harrington is live in newark with the most festive assignment of the night. hi, alyssa. >> katie, there is nothing like this show that uses 100,000 lights timed to music. it is the perfect christmas display for "star wars" fans and it turns out there are quite a lot of them. it got so packed tonight that police were called to direct traffic and even had to tow a car. it took just five days for this youtube video of a newark home to get three million hits. it shows holiday lights timed precisely to match "star wars" music. ♪ the viral video has turned this usually quiet neighborhood into a must see attraction. thousands lined the sidewalks.

63 in san jose. these numbers are some 6 to 8 dries above normal for this time of year. right now we are hovering in the 50s. it is 56 in oakland and 50 feign in antioch and still 61 in livermore. 58 in san jose. satellite and radar and here is what we are tracking. the high pressure is right off the coast and keeping the clouds and much of the shower activity to the north around portland and seattle. for us expect a lot of sunshine and the temperatures are still above average. as we go to the future monday morning patchy fog, but watch as the clouds stay at bay. it will duplicate that picture on tuesday afternoon. not a cloud on the sky. on tuesday, the temperatures are roughly 10 degrees above normal. we would not be surprised to see a few 70s. fast-forward to christmas eve. christmas eve afternoon, 4:00 we could start to see some rain enter the north bay especially by 10:00 in the

evening. light showers will take over much of the bay area. this is a quick-moving system. it is out of here early christmas morning. we are dealing with partly cloudy skys and the rain is out of here and it looks to be a light rain event. probably a quarter of an inch. a little fog out there and otherwise we will stay in the 50s except for the north bay in the upper 40s. after the fog burns off it is a lot of sunshine on the way. 65 in downtown san francisco and getting to 67 in san jose and 69 in san tay you rosa and half -- santa rosa and half moon bay about 70 degrees. it calls for the fog early tomorrow morning and afternoon sunshine. another mild winter day around here on tuesday. wouldn't be surprised if a few inland spots get into the 70s. very warm in the mid60s. christmas eve the clouds increase in the afternoon and then there is a chance of sprinkles moving in christmas day in the wake of front and

area police agency are accusing chair chief of retaliation after complaints of being exposed to pornography. it is raising questions about how the department handles evidence. i team reporter dan noyes has the story. >> january 9th, 2013, santa rosa junior college about 3:00 in the afternoon. campus police arrested matthew whitaker for viewing child porn on a public computer. an open and shut case. he told officers, don't judge me. it is not my fault i am a pedophile. >> as he was arrested he said how much time am i gonna get?

he was not trying to deny it at all. >> fast-forward 15 months, april 26th of this past year. community service officer spotted this thumb drive plugged into a computer that records phone calls calls and radio traffic. she took it to the dispatch area to find out who owned it. >> i plugged it in and click owed a file and it was graphic, disturbing images popped up on the screen. as i went -- they all looked. >> two police dispatchers saw the pictures of girls 8 to 12 years old engaged in sexual acts with men. they have heard a lot in 24 years of a dispatcher, but seeing the child porn shook her. >> it made me feel like i had done something wrong in viewing that. it is illegal. >> it is among the most sensitive evidence you could imagine. >> jim hammer served as a

prosecutor and san francisco police commissioner. >> every time that sieved possessed by somebody or shown to somebody else that child is victimized again and again and again. >> the three santa rosa jc police employees took what happened up the chain of command and finally to the chief. >> he didn't want to have anything to do with it, sweep it under the rug and it is no big deal. you didn't see anything. go on with your job. >> mccaffrey ordered an internal affairs organization and found it belonged to a couple working for the department. a dispatcher and her husband and officer. in addition to the child porn, the thumb drive had a family photo, the couple's refinance documents and utility bills. the dispatcher and her husband did not answer my phone calls and did not speak with me when i approached them after a public swearing in satisfactory mown two weeks ago. >> i want to ask you about the child porn on your thumb drive. >> i have no comment. >> why was that there? >> we are not identifying them because it could be a mistake. the wife told internal affairs

she copied the child porn to her thumb drive to make a cd for the district attorney's office, but she neglected to delete the images from her personal thumb drive and thought she lost it several months ago. >> the internal affairs investigator tells me he wanted to interview the husband, the police officer, plot the -- but the chief told him not to and mccaffrey shutdown the investigation. the chief did not return my e-mails and phone calls for an interview and so i caught up with him after the ceremony. >> why stop the investigation into the thumb drive? >> don't you have an interview scheduled this afternoon? >> i wanted to talk to you about it. >> he did not answer my questions and referred me to the school administration. >> chief, come on. i need to talk to you as well. >> the former prosecutor says this deserves a full investigation to determine once and for all if it was a mistake or something worse. >> is this a crime? is this possibly intentionally possessed? if it is it is -- it is a
