>> live from the kgo-tv broadcast center this is abc7 news. >> hundreds of birds turning up on the east bay shoreline covered in a sticky substance some dead. scientists are closer to finding out what the substance is. >> thanks for joining us. and testing is happening today. it cannot come soon enough as more birds were found this morning and now even new locations. our reporter, amy hollyfield, is in san lenadro. how soon do scientists hope to have results?

>> kristen they hope to know by late this afternoon what the substance is. there are two laboratories working on it one testing the birds and the other testing the substance. news from the field is that the problem, the extent of it, is larger than they first thought. >> the focus so far has been on the east bay shore but now there is a report of unresponsive birds in foster city. volunteers will check on the birds today. they are worried about what this could mean. >> point of origin for the product may not be on this side of the bay it could be on the other side but we have not had calls. it make the situation more conflicted the more spread out it is. >> volunteers found aid more birds on the shoreline. they did not want to stress the bird by showing them to us but they are in the boxes ready to go to the laboratory for cleaning. officials say it is tough to see them covered in a mystery goo but they are staying positive. >> we are disappointed at dead

animals but we have 300 alives. 300 or so that have been saveed and 100 dead animals and that is unfortunate. the good news is that though are not endangered species but common birds to the bay area and it is sad but it is not catastrophic. >> officials still do not know what is coating their feathers. >> what we know it is not petroleum. that is good. that is the best news. but as far as further than that, we do not know at this moment. >> we are just getting word just got confirmation that the birds impacted in foster city were covered with the the mystery gunk. at 12:30, some of the first responders are going do get together and map out what their afternoon plan is going to look like. this will change the area now they will focus on. this is changing and developing as we go. we will stay on top of this

story but now it look line they will search the shoreline of the entire bay area. thanks, amy hollyfield. we are keeping an ear out for damage reports after an earthquake hit monterey county this morning. the 4.4 flag tuesday earthquake hit at 5:21 in greenfield not heavily populated. there are still no reports of damage or injuries. people have tweeted us saying they felt it as far north as half moon bay and fresno to the east and san jose. >> king tides are hit bay area higher than normal tide means certain part of the park-'n-ride lots are off limits on highway 101 in mill valley which often floods. several no packing -- parking signs are posted. barricades are up. if you parked anyway you were cited or worse, towed. firefighters say the king tide is to blame for stranding two

boaters. menlo park crews pulled them out of the mud and brought them to the marine in san jose. officials say the higher-than-normal tide could be causing some to misjudge the waters. this is the third rescue in less than two weeks. how long will the king tides last? our meteorologist mike nicco is here with answers. mike? >> good question. from the top of the broadcast center, the interesting thing about the king tide they are highest of the high but they are the lowest of the low. that is why people are getting caught on muddy river beds after the tide goes out. we will look at timetables and we are starting to recede at the golden gate bridge and we hit our peak today at 10:46. tomorrow at 11:36 a.m. and the park-'n-ride we are going up to 11:22 and then receding. the flooding occurring now and will tour. in oakland we are usually 11 minutes behind san rafael so 11:33 am today and 12:23 p.m.

tomorrow. after that they should be over. eric? happening now the city of san jose is welcoming a new group of firefighters fresh out of the academy. but it is only day one and some of them may not be planning on making san jose their home forever. matt is in san jose to explain. matt? >> yes, this is a very good job especially for a high school graduate and entry level pay is $86,000 a year but that may not be enough to keep the new graduates their entire career. >> being san jose firefighter is exciting. the department boasts they protect 200 square miles of terrain that include residential, commercial, high-rise and wild land areas. that is why thousands apply if a position but only 21 were hired graduating fire academy on friday. >> we had a strong pool of applications with a couple thousand apply. we are very pleased to see this

recruit class come through and graduate last week. >> the 21 graduates start the new careers this week joining the 700 or so firefighters across the city. although you will not notice a difference by appearance the new men and. would will make less at retirement. the pension reform initiative passed in 2012 and it put in place a tier two pension for all city employees so they will only be eligible for 65 percent of the salary after 30 areas of service compared to 90 percent. since 2012, the san jose police department has seen a huge increase? retirements and resignations as officers leave for other departments. that brings up concerns that the new firefighters will take their services elsewhere. >> we will be able to tell in one, two, three or five years whether they under up staying. we need them to stay. >> the firefighters union says the new hires are very important in bringing down the response times in the department.

the lawsuit against measure (b) is on going. matt thank you. a cardiac surgeon is in critical condition with life threatening injuries after a gunman shot the doctor in a boston hospital. the suspect was found dead in the exam room. this happened two hours ago. the gunman asked for the surgeon by name when he entered the hospital the doctor was shot twice and rushed to e.r. authorities are looking into possible relationship the suspect may have had with the doctor. >> a pre-trial hearing wrapped up in colorado with james holmes looking dramatically different, clean shaven glasses and short beard a far cry from the bizarre orange hair look we first got after the 2012 shooting. he has confessed to killing 12 people and winding 70 others. jury selection is today. if they found him guilty the jury must decide whether to

recommend the death penalty. >> renters are forced from their homes because of a health hazard. the city inspectors sent eviction notices to the tenants. there are black spores growing in the bathrooms and bedrooms. inspectors told them to take personal belongings but leave the push too because it is likely infested. residents got $2,000 to relocate. >> we should know later today if the san diego base businessman will be able to move forward with his plan to be part of oakland's proposed coliseum city development. oakland city council members have to decide whether to grant him a 90 day extension to secure financing. the decision looms as the bay area news group reports that the mayor is calling for two proposals for re-develop-the 120-acre coliseum complex. shents the a's and raiders to submit separate plans. schaaf's plan includes a new

stadium and a mix of homes and businesses. >> in two hours from now, san francisco's municipal transportation agency board will vote on a proposal to give free muni rides to seniors and people with disabilities coming after the am approved giving free muni rides to low- and moderate-income youth. right now muni sells 24,000 discounted monthly passes to seniors and the disabled and says the program will cost $4 million to $8 million a year. the board is expected to vote at 1:00 o'clock. >> new details in the controversy over a pay raise for contra costa county supervisors. the sheriff deputies have now slapped them with a federal lawsuit claiming supervisors threatened retaliation after deputies tried to curb the raise. the board voted to give themselves a 33 percent pay bump back in october. the deputy sheriff association among other groups took part in a petition to allow voters to determine pay increases. they claim that the supervisors threatened to undermine future collective bargaining efforts.

this morning, they voted unanimously to rescind the raise. tonight, the eyes of the nation are on washington dc, as president obama lays out his "state of the union" address. he has been rolling out a preview for the past several years. a focus is the middle class and wage inequality. this will be the president's first opportunity to tout the improved economy and lower gas that is leading to a rebound in his popularity. cording to a new washington post/abc news poll the president now has a job approval rating of 50 percent which is highest since the spring of 2013. you can watch the president's "state of the union" address and the republican response this evening on abc 7 with coverage at 6:00 p.m. >> new concerns of ebola and the latest scare that has doctors in new jersey acting at lightning speed. >> a freeway disaster cripples traffic in cincinnati and what caused
