good morning and thanks for starting your day with us. i'm chris nguyen. weatherwise it could be a record setting day in some parts of the bay area. here is lisa argen with a first look it at the forecast. >> chris, we could see 72 in oakland today that could be a record. still some fog settling into our east bay valleys. a big concern all weekend long because with the mild temperatures folks will want to check out the waves and the beaches. a half mile visibility in fair field. look at concord at just a quarter mile, three miles in napa with a mine and three-quarters in petaluma. breezy winds on top of mt. tamm.

25 to 35-mile-an-hour winds. mix up some of the atmosphere in the higher elevations but not at the lower elevations. that's where we're looking at the smog and the dirty air for another spare the air day today. look for 67 downtown . 70 in san jose. and in between we'll see the warmest numbers in the mid-70s at the coast. the cooler numbers out by the delta. look at the warmth tomorrow. lisa, thank you. san jose police are looking for the driver who hit and killed a woman and then took off. at around 6:15 last night police say a woman in her 60s was struck while crossing almaden expressway at via mon it te drive. she was is on the other side of the intersection where there isn't a cross walk. as far as who hit the woman, police don't have much of a description to go off of only the car might be a honda. one resident was stunned that a driver would hit someone and leave. >> we have to accept if we do a

mistake. we should stop and help them. it's going to be better for your soul than run away. >> the victim is the third pedestrian hit and killed in san jose this year. another investigation is under way this morning. this one in livermore. someone has been painting graffiti on two churches both on the same street. and police are covering the crime scene with with special patrols. abc news 7's sergio quintana has the story. >> reporter: the graffiti has been painted over at the mormon church. the campus has been tagged before so they dealt with it quickly. >> got graffitied and we cleaned it up and that was the end of it each time. >> reporter: the livermore police department is taking the situation very seriously even devoting special patrols because the mormon church and the next door lutheran church have been spray painted several times in the last few days. >> some of the tags was derogatory, comments about the church, about heaven, about god.

>> reporter: the most offensive symbols swastikas and pentagrams were quickly painted over. the vandalism is being investigated as a potential hate crime, a felony. >> we did notice i think on the night that it occurred the motion detector going on and off over there. so i'm not sure if it happened then or what. >> reporter: another neighbor tells us it took hours to clean up some of the paint. >> they're out there painting the sidewalks and scrubbing the walls. two people are in serious condition including a child after their vehicle crashed into a muni train. it hammed around 4:30 yesterday afternoon and 14th avenue in the west port neighborhood. transit authorities say the driver slammed directly into the side of the train. sky 7 d shows the vehicle's crumbled hood and the train knocked off the tracks.

the driver and a 9-year-old passenger were rushed to the hospital. no one on the train was hurt. police want to find a robber who threatened to blow up three different drugstores in santa clara county this man demanded oxycodone. it happened last month on earlier this month, once nin mountain view and twice in morgan hill. in all cases the so-called bomb turned out to be a dud. >> just by simply having a bomb threat in addition to tally seeing a device and having it there is terrifying to the public. it's scary for a police department. it takes up a lot of resources and time and it's dangerous. >> witnesses say the man had a raspy voice and wrinkled skin. he was wearing all black and left on a black sports type motorcycle. the zoeckediac killer a serial killer never identified or caught. police say he killed five victims. the zodiac has haunted investigators in letters claimed he killed 32 others.

but now abc 7 news reporter vic lee says there's a new theory on who the zone yak is. >> reporter: in september 1969 a masked man stabbed two people at lake berryessa in in anapa county. police confirmed this was a zodiac killing. chris harris was making a documentary about the zodiac and went to napa. he was sitting in a diner not far from another customer. >> then he turned around and said, do you have any idea what it's like to know you have to kill? well, i didn't say a word. i sat there in terror. >> reporter: decades went by. last year this book, the most dangerous animal of all, was published written by gary stewart who claims his father was the zodiac. chris harris was stunned. >> but this is a man who was in that diner. >> reporter: harris says he has further proof best is the zodiac.

in 1969 a cab driver paul stein was shot and killed in san francisco. days later a local peyton manning er received a letter from the zodiac saying he did it along with a piece of a bloody shirt. police had also found finger prints on a cab that may belong to the zodiac. here are earl's prints. >> and on his right index finger it definitively shows he has a scar. the zodiac left his fingerprint on the cab and that same scar on the right index finger is right there. >> reporter: again, here is best's fingerprint with the scar. this is a print left on the taxi perhaps by the zodiac. san francisco police spokesman says the book's author it did speak with investigators before, but it went nowhere. >> the information we obtained may not have had the amount of evidence that we need, or it could can be some other factors where we were not able to make that connection.

8:11 is our time. the military says two marine ss have died after their helicopter crashed during a training exercise in southern california. authorities say the third marine aircraft wing chomer went down late yesterday afternoon at the base in 29 palm. both marines onboard died as a result of their injuries. the cause of the crash is under investigation. ernie banks has passed away. he was the first african-american player joining the team in 1953. he went on to am become an 11-time all-star and was the league's most valuable player twice in 1958 and 1959. banks was inducted into the baseball hall f famof fame in 1977. november of 2013 he was award

add presidential medal of freedom. the can cubs called banks the greatest cub in franchise history. a shelter for abused women is bug accused of letting them down. some say they feel victimized again by the very people who were supposed to help. laura anthony has the story from the east bay. me and my children were being abused. we didn't have anywhere to go. >> reporter: she is a single mother, a survivor of domestic abuse who moved in a emergency shelter in contra costa county november 2013 run by an agency called stand for families free of violence. they receive money in government grants and private donations. >> i know there's not good food in the emergency shelters. old bred about two weeks old and there's no baby food for the babies there.

it's disgusting, unsanitary. >> reporter: after a few months in the emergency shelter she was accepted into longer term transition al housing. that's when she says things got worse. especially after she reported to management that a staff member was stealing he donated items meant for clients. >> i've seen verbal attacks from the staff. i've seen them yell and make accusations and lie. i've seen them kick women out with nowhere to go. >> now i'm not being abused by a man. i'm being abused by a system. >> reporter: rachel is a survivor of domestic abuse. she and her two children are in the transitional program. rachel told us she too hasintimidation from staff. >> mental abuse. i feel like i'm still with my partner. i'm going to do what you tell me to do or else.

i came here for help. the last place i think i would be abused is here. >> this is a really serious allegation. >> reporter: the longtime ceo was herself a battered woman. >> and i want you to know that the safety and security of our clients is of utmost importance to me and i hope to every person in this organization. when we get complaints we investigate them and take them very seriously. >> reporter: shelters in an undisclosed location. on the emergency side there are 24 beds. on the transitional side apartments for nine families. >> it was a shelter of violence for me. >> reporter: 66-year-old ros entered the shelter last august. she was there for five weeks. >> they're not educated enough. they have no compassion. they show you no respect when you go to complain about something. and i have another five, six women that i could could connect with you that had the same

experience. >> i brought my kids to stand to keep them safe and i feel like i'm back with my abuser. it's just not right. >> reporter: all of the week we spoke with say they spoke with their case manager. one client even wrote a letter to the editor published by "the contra costa times" saying their can concerns have been largely ignored. >> they came there on the run with a bag of whatever. they need help there and they're not getting it. >> any client who has a concern withstand stand and the way we provide services is extremely concerning to me. i will investigate any allegations that come our way. >> reporter: none of the women we talk with want stand to close its doors. they know firsthand the need is too great. in contra costa county, laura anthony. >> stand has been in contra costa county more than 30 years. last fall it was one of four to receive part of a $2.6 million grant to help prevent domestic

violence homicides. happening today the oakland city council will meet in a rare saturday session to hear from residents and community groups about the black lives matter movement. the movement grew as a response to the deaths of several unarmed black men across the country last year n. oakland peaceful protests have often turned violence with windows being smashed and items set on fire. some of the protests have ended up on the freeways blocking traffic. a discussion begins at 1:00 this afternoon at city hall. authorities have tracked town more than $300,000 worth of wine stolen from the iconic restaurant french laundry. the bottles were taken on christmas day. bottles varied in price from several hundred dollars to near nearly $10,000 each. here is the bizarre part. yesterday the napa county investigators said they found 76 bottles at a private seller in greensboro, north carolina. but no arrests have been made so far. they didn't say how the wine got

dense fog advisory. we're looking at the high surf from the sonoma county coast down to big sur. here is a look from mt. tamm where you can see some of that fog, also very sunny in san fran francisco. good morning, san jose. low 40s and you have been very mild at the coast this morning. 61 degrees, half moon bay. you may notice some of the ridge on top winds blowing pretty good and a nice look at the coast and high waves. you can see them already, 40 santa rosa. 43 in napa. low 40s and fog from fairfield and concord at 44. so we're still looking at the fog but it's gotten better in concord. went from a quarter mile visibility to just a mile now but you can still see how dense it is around fairfield. two and a half-mile visibility petaluma and no problems to the south bay. we're looking at those winds, though, up to 34 miles an hour. if you are biking up mt. tamm or

diablo maybe that is good distance. it will remain breezy above and that will allow for some warmer weather heading to the coast which will be the warmest place today. the pollutants trapped near the surface and you'll notice the poor air quality, maybe even feel it in the north bay and santa clara valley where the air will be unhealthy. once the ridge moves to the east another weather system heads our way and that should bring better air quality monday into tuesday, in fact, maybe even a sprinkle we can hope. poor air quality today, record highs are likely tomorrow. maybe a few today and then cooler and cloudier next week with the system coming up from the south. wave heights are building. in fact we're looking at ten-foot waves off the coast of monterey and we could see waves up to 15 feet. with breakers and the possibility of rip tides very dangerous. ocean beach today double barrel high pressure allowing for those offshore winds to really warm us up while at the same time

elementary school with messages of hate. we spoke to police about who may have been responsible for the crime. >> nobody should be fearful. >> reporter: graffiti was tagged all over campus. maria levy lives near by and was stunned to learn about the crime. >> it hurts. it's scary too, that maybe it might expand to something worse. >> reporter: the use of marijuana and other graphic images were spray painted all over campus. >> with the tags that were on the school property and the walls, the concrete as well as the doors, we believe they were juveniles based on what was tagged. >> reporter: the graffiti first noticed by the school's custodian was cleaned up through the day. damage was it in the thousands. >> vandalism speaks to crime. we want our students to feel

safe while there at school. >> reporter: not too far away police say one house was tagged and two vehicles smashed. c carrie dent found her car damaged by vandals. >> not appreciated at all. >> reporter: neighbors still in disbelief. >> i was shocked people would waste their time doing something destructive like that. >> reporter: the elementary school was outfitted with surveillance video. the california jobs picture is looking pretty good this morning. the state unemployment rate has fallen to 7% and 11,000 jobs were add eded last month in the bay area alone. that makes five straight years of job growth in the bay area the best showing since is the 1990s. caltrans preparing a road that's been closed since the bay area storm last month, the section of highway 1 that connects mill valley to the marin valley coast. john than bloom takes a look at why crews are working overtime

to get it fixed. >> reporter: contractors are working around the clock. >> we're working dawn to dusk. >> all in hopes of removing these detour signs by the end of next month. they've been here since last month's bay area storm. >> it wasn't as if this was the result of several dayses of rain. >> reporter: and just look it at the damage. engineers call it a slipout where the dirt slips out. >> think of an oreo cookie with three-quarters of the filling gone. all of the soil washed away so we had the pavement above and nothing beneath it. >> reporter: this is the fix. engineers call these soldier piles because they line up and stand at attention, a view shows the massive wooden wall they'll be holding up, a wall that will prevent this from happening again. you're looking at the tip of the iceberg. each one of these steel piles sticks up about six feet but go down 20 feet below where i'm standing each one encased in
