[tom] really? you wouldn't have that number on you,would you? live from the kgo-tv broadcast center this is abc7 news. >> the clock is ticking on filing charges against a man arrested in the case of a dismembered body which was discovered in a suitcase in san francisco. good morning i am eric thomas. >> i am kristen sze. >> investigators hope d.n.a. evidence will help confirm their theory on suspect the victim and the relationship. time could be running out for police. our reporter, amy hollyfield, is at hall of justice in san francisco. amy? >> kristen, the d.a. says it has not seen the case yet has not been presented with the evidence. police tell me that they know they are running out of time and

they do plan to present the case by the end of today. police do believe this is the man who killed and possibly a friend and roommate and dismembered him, leaving the torso and hims in a suitcase. they arrested 59-year-old mark andrus on saturday. he was covered with a sheet at the time of his arrest. that starts the clock. they have to charge and arraign him by tomorrow or he will be released from jail. the medical examiner is still trying to identify the victim. they are testing d.n.a. to see if it could possibly be a 57-year-old man named omar shahwan who is missing and was friends with the suspect. if the d.a. thinks the miss have a strong enough case, they will move forward. if not they will have to let him go. andres was seen on surveillance video wheeling around a suitcase on the day of the gruesome discovery so this will be determined in the next 24 hours.

nearly six months after robin williams took his wife and his dead and heirs are fighting over money rot and personal items. our reporter is in the newsroom with more. >> this is getting heated and emotional on both sides. williams wife became frightened of the three children from previous marriages because they were invading her home and take things. the kids argue these are items their dad would want them to have and taking the issue to court is adding insult to injury. >> susan first filed court documents in december accusing her late husband's three children of taking items from the home she shared with the actor without permission, items she said she is entitled to. the papers read "susan williams lost her husband through a shocking and emotionally charged event and williams trust directs

the susan trust should be funded with the residence as well as the contents." a napa home was left to the children. part of the trust reads memorabelia and jewelry should go to the kids which it gets missy. the kids took the items even those inside the tiburon house but his widow says the trust intends to distribute morningings from the napa home only. what is at stake is everything from williams toys and even his david alward for best supporting actor in "good will hunting." the kids filed an objection saying the williams children are heartbroken that the peter, his wife of less than three years, has acted against his wishes by challenging the planned he so carefully made for his estate. several pages detail the items and value and been redistracted but the kids argue they are blocked great going through

shot in the head at 94th around 8:00 last night. officer say he was taken to the hospital but died. he was a local living in pittsburg and miss have made no arrests. a $20,000ry ward is being offered for information leading to an arrest. >> developing news in southern california, suge knight has been rushed to the hospital shortly after being arraigned this morning on murder charges. the 49-year-old was taken to the hospital for unknown medical condition and the current condition is not clear. he pleaded not guilty to running down two men following an argument on a movie set last week. one of them died. his attorney says it was an accident and the rapper was trying to leave after being assaulted and could face life in prison if convicted. >> the nfl network has fired a hall of famer over soliciting of a recent constitution and assault. this is new video of him leaving a phoenix jail on monday. police say he got into an

argument with two escorts that turned physical while they were in his hotel room during super bowl weekend. he faces up to six months if jail if convicted. >> developing news authorities are searching for a man accused of sexually assaulting a little girl with her mother shopping a few feet away. alameda sheriff deputies released surveillance video of the man who preyed on an 8-year-old girl in the toy aisle of the 99 cents only store on mission boulevard. investigators say he forcefully grabbed the girl and touched her inappropriately. deputies described the suspect as latino man between 18-20 and standing 5' 6" and weighing about 150. if you see him, call the alameda sheriff. >> firefighters in san jose are trying to figure out what sparked a fire at an assisted living facility after breaking out before 4:00 this only. firefighters arrived to find an s.u.v. on fire and flames threatening the home. the flames did reach the garage but firefighters put it out

coca-cola will enter the dairy section of the grocery store. they are rolling out a premium make with less sugar, more calcium and more protein than regular make. it has been introduced in indiana and will roll out across the nation a few weeks and cost twice as much. coke has partnered with the dairy company to diversify products as americans continue to turn away from soft drinks. actually coke beverage you might say "go ahead, drink up." >> looks like it is in the pharmacy section. >> enticing is what rains sounds like to me. i don't know about you folks but mike has more. >> rain would be healthy. i don't know if you had to turn your irrigation system on to keep the trees and the bushes and everything else from being so stressed now that we are on day 40 without rain especially here in san francisco. we will look at the average

february in san francisco. we warm about two degrees on the high and low side throughout the month and 81 and 31 are the extremes. rainfall is nearly 4.5 inches the third wettest month and we will get about what of that by the time the weekend is over. live doppler hd shows the storm track is dry to the north where it has been the last in and a half and we have high clouds blown off from the storm and not enough venting pollution hanging around making this a "spare the air" day. if you were with us at the top of the show, shows has unhealthy air. from emeryville are the high clouds made for a beautiful sunrise and now they are dimming the sunshine. grab the sunglasses, in matter are you head and dress for record warmth. tomorrow is the last dry day every are so get ready. wet and breezy weather hits thursday and the rest of us through the weekend. today we are in the mid-60's around san francisco and richmond and low 70's elsewhere

and tonight is another mild night with patchy fog, mid-40's to low 50's. here is a look at our atmospheric river, it is now leading hawaii on its journey toward us and it hits the north bay on thursday hits all of us friday, saturday, and starts to slide down to the south and comes back on monday. on thursday morning, the commute with dry leaves and by 9:00 mots of the north band is light-to-moderate rain and it stays there all throughout lunch into the afternoon hours and evening hours and overnight it reloads and comes back at all of us with a vengeance on friday with moderate-to-heavy rain and friday is when i would believe we will start seeing some flooding develop in the north bay, 3-5 inches is the balance, coe have double that in the mountains. about three-quarters to 1.5 in the south bay and the rest of us in between. this will dump snow in the
