chase. police tell us the fatal bullet came from an emeryville officer. there's cell phone video that was taken moments after the shooting happened. you can see the chaos. this is one of the videos that will become part of the investigation along with surveillance tape from the home depot and other stores. there was lots of cameras pointed at the area where the chase began. you can see the scene a few minutes later in this video from the ground swarming with police officers. we spoke with a witness who was there when it happened. he told reporters it's quite possible the police saved his life. he was parked at the self-storage facility with his friend when that woman came running up to them. >> they approached his car or she approached his car first. came right up on the car. pointed the gun at him that's what he told me. and then he shut his window, started to move. she ran over to my car. that's when everything exploded. >> we cannot share with you at this time if the suspect fired any shots. we additionally cannot share

with you how many shots the officers fired or if both officers fired. that will all come out in the investigation. >> my imagination would say they were saying put down the gun. but next thing i know boom boom boom. >> here again from sky 7 hd you can see the friend's pickup truck part of a crime scene, won't be able to get it back for quite some time. the owner is at the police department giving a statement. of course, this investigation is going to take a long time. it's also going to involve three agencies the oakland and emeryville police departments and the district attorney's office in alameda county. there are lots more details to uncover including the name of the suspect and whether or not she had a prior criminal record. those details will all come out as the investigation proceeds. jonathan bloom, abc 7 news. more breaking news. another deadly police shoopting in the east bay, in antioch. sky 7 hd is over the scene on

claudia court. the contra costa county sheriff's department was serving a move out order in a domestic violence case at 12:30 this afternoon. the person had a wep ond and came after a deputy. that deputy then fired at the man and killed him. antioch police the sheriff's office and the district attorney are all investigating. still more breaking news. this time in san francisco. the district attorney just announced he will not file charges against a suspect accused of killing a person and carrying some of the butchered remains in his suitcase. the police have to let him go. carolyn tyler is live from the haul of justice to explain why. carolyn. >> well, the district attorney is very disturbed by the facts of this case but there simply wasn't enough evidence to prove the case beyond a reasonable doubt. so the suspect will not be formally charged which is likely to be a relief for his best friend who says he never

believed he was guilty. >> it's a crying shame. i'm supporting him, i'm praying for him. >> it was here at marquis tenderloin apartment on friday that san francisco police arrested his good friend mark andres on suspicion of murder. he's suspected of murdering a person whose headless torso was found in an abandoned suitcase last wednesday. other body parts were found nearby. this video obtained by abc 7 news shows the suspect lugging a suitcase down the street. >> did he have that suitcase in hand? >> not that i know of. no. >> he says andres stayed here off and on over the past two years and twice brought his roommate omar whom the san francisco chronicle whom investigators believe may be the victim. >> i know omar for two years, good guy. >> police tell us that's speculation. the victim has not been

identified. >> investigators have been receiving inquiries from all over the country about concerned family members and friends who are worried that this person could be a loved one of theirs. >> police and the medical examiner are trying to figure out who the victim is what was the cause of death, the murder weapon. former police chief tony robbera said he's sure investigators have been retracing the suspect's steps trying to figure out where he's been in the last few weeks. >> see if you can't get search warrants to search those locations to see if there's any sign of a struggle. if there's any sign of blood. any sign that would make it a crime scene. >> i just talked with public defender jeff adachi heading to the jail to talk with his client because under the law mark andres must now be released. live in san francisco carolyn tyler, abc 7 news. carolyn, thank you. an outpouring of emotion this evening for an oakland

rapper. ♪ >> that's the music of the jacka, the well-known oakland artist shot and killed last night. his real name is dominique newton. fans are tweeting condolences. the hash tag is trending. damian lord calls him a legend. abc 7 news reporter laura anthony has spoken to newton's manager and she joins us live from an emeryville recording studio tonight. laura. >> hi, ama. this is where friends of newton are gathering this afternoon to remember him and just to be together at this point while police won't say why they think he was killed. his friends just want to remember his legacy as a man and a musician. >> all i heard was a lot of boom, boom boom. it was like six rounds. >> six distinct shots that's what neighbor eileen freeman told us she heard just after 8:00 last night.

it sounded like it was close. >> it's sad that people are just taking guns and just shooting, shooting, shooting. especially when you have someone that's so good to the community and that has given to the community. >> the victim was 37-year-old dominique newton from michigan. stage name the jacka. newton got a start in the music business in the early 1990s as a member of a group. he became a solo artist about ten years later. >> it's unbelievable. don't know you know. still numb don't know how to feel. we had a big loss. just tremendous loss for us personally. for the bay area. for music. for his family. for his children. >> he always was smiling. he always was willing to give you somethingment so many rappers got verses from him. you know what i mean. at good rates. he was just a fair good, honest man. >> today dozens of people

stopped by to pay respects at a sidewalk memorial created in his memory. >> this is a sad day here. we lost a good friend great man and a legend of the bay. he's going to be deeply missed by all of us. >> investigators would not comment on newton's murder except to say they're asking for witnesses or anyone with tips to contact oakland police. laura anthony abc 7 news. a fremont-based hip hop organization is calling on google to stop targeting -- users of rappers with ads or guns and gun paraphilia. the hip hop chess federation is calling on google to conduct independent audits specifically as it relates to minority youth. the founder claims it shows gun ads repeatedly appear before the start of rapp videos. we've reached out to google and are waiting for a response. it's a nonprofit which claims to fuse music chess and martial arts to promote unity, strategy

and nonviolence. san francisco's mayor and police chief got an earful this morning when they visited the street corner where a mother was killed by a stray bullet in front of her children. mayor he hadly and police chief gathered in the bayview district. neighbors and community members asked the mayor and the chief for more police patrols in the area and more job opportunities for those attracted to street violence. >> it's a start. i think we're going to trim trees and make sure lighting is better. that was brought up. i think that the community groups want to help and will. these kids need opportunity. what they -- they need hope. >> the mayor promised to do more to include teens from the bayview in his summer job program. california attorney general harris is applauding the historic conviction of a san diego man who ran a revenge porn website. 28-year-old kevin boll ard was

found guilty on 27 counts on monday. he ran a webb site where people posted nude pictures of exes and then they had to pay to take down the i am ajts. he faces up to 20 years in prison. harris says the conviction sends a message to criminals attempting to hide behind a computer screen. >> you think that just because you're sitting behind a computer committing what is essentially a cowardly and criminal act you will not be shielded from the law or jail. so let's be clear, the crime he committed is no different than the crimes we acknowledge happening on the streets every day. >> this is believed to be the first criminal prosecution in the united states involving cyber exploitation. out of the ashes. just ahead, the one bright spot after a neighborhood was chased away by flames. plus -- >> it's only about nine or ten minutes. >> nothing more than an hour.

>> hi. it was nice today and the family was invited to city hall where alessandro gonzalez was presented with a commendation by the board of supervisors. the 13-year-old was acknowledged by the supervisor who called him a remarkable kid for acting quickly and knowing what to do during that fire. he was surrounded by his parents, siblings and grandmother. also there was fire chief who encouraged him to consider a career as a firefighter. last wednesday night, alessandro was at home alone, he escaped the fire by breaking the window. he then got on to the fire escape and tossed his dog and then jumped and landed on an awning. firefighters were waiting below. more than 50 people living in the apartment complex on 22nd and mission streets lost everything in their fire. >> i'm very proud of myself and i think everybody in the

building deserves this award. they all helped each other. >> in case you were wondering, his dog buddy who he rescued was not at city hall because, well, dogs aren't allowed at city hall. shucks. alessandro and his family are now staying at the red cross shelter in the mission district on valencia street. i also spoke to the fire chief who said that she knows that the fire started on the third floor of that apartment complex the cause unknown. but it doesn't appear foul play was involved. i'm live at city hall lyanne melendez. california's $68 billion high-speed rail project could harm the protected kip fox. the fresno bee reports that the high-speed rail authority and federal railroad administration are out of compliance with environmental commitments for building the bullet train from fresno, me der a area the u.s.

fish and wildlife service says the contractor's preliminary work infringed on habitats for the fox. the contractor denies the claims. it's been on the endangered species list since 1967. the commute is bad in the bay area but it's congestion we can count on. a new study by the metropolitan safety commission found santa clara county has the lowest average commute times compared to the other eight bay area counties. the longest drives are in contra costa county. the bay area has the third worst traffic congestion compared to other big metropolitan areas. we have one advantage over the rest of the country. our commute times are the most reliable. >> normally commute from -- it takes about 20 minutes. it's always the same. >> you have a problem when your boyfriend's house he has a hard time getting to work. >> he has to take main roads.

still up today. better air quality this week. partly cloudy and mild on wednesday. rain for the north bay on thursday. then expect wind and rain on friday. here is what is slowing down the storms. it's high pressure pretty strong still. so we're not expecting the onset of rain as quickly as we had thought. more storms to follow. it is still going to get wet beginning on thursday. but not for everyone. let's take a look at the atmospheric river. this is going to play a part. high moisture content near hawaii. still coming in our direction. by friday it's aimed at northern california. we'll get a piece of the energy here. then a shift towards southern california over the weekend. we'll continue to see some rain here. all right. let's start the timeline here. 5:00 a.m. on thursday. maybe a few sprinkles north of the bay area. we have to wait until 10:00, 11:00 in the morning when the north bay gets wet. by 4:00 p.m. the rain line may temporarily shift southward into san francisco and eastward into the

east bay only to lift back and stall right over the north bay thursday night. we are looking at pockets of moderate rain there. friday is heavier rain still stalled over the north bay at 5:00 a.m. for the start of the commute and then finally by 1:00 p.m., we start to see the shift southward across the rest of the bay area. the wind will definitely pick up. gusts up to 50 miles an hour and that means trees and power lines may go down. rainfall estimates very impressive in the sonoma county mountains. up to 8 inches. this is by 1:00 p.m. on friday. that's not including the weekend stuff. golden gate, we're looking at about .1 to .25 inches. dry for parts of the south and the east bay. as we fast forward and take you through time right on through sunday, we're going to show you the additional rain we're expecting for the north bay. 2.a to 5 inches. south bay about half an inch to an inch. urban and small stream flood advisory likely get issued if
