good afternoon, everybody. >> isis is going to lose. those words from president obama today. he's asking congress to authorize military action against the islamic terrorist group. >> mr. obama says it won't be another ground war like the u.s. fought in iraq and afghanistan. karen traverse with more now from washington d.c. >> reporter: the day after the death of kayla mueller was confirmed, the white house says if left unchecked, isis will pose a threat beyond the middle east including the u.s. homeland. >> this resolution reflects our

core objective to destroy isil. >> reporter: the president's resolution would authorize three years of military operations put no geographic limit on the campaign and ban enduring combat operations. on capitol hill, there's already push back. >> the language pertaining to ground troops which is very broad, very ambiguous. none of us know what enduring combat operations means. >> i'm concerned about the breadth of the language. >> reporter: others called it a step forward. >> i want to make sure the president has all the tool the available in order to win this fight. and as we go through this process. >> reporter: that process includes congressional hearings and the floor debate. it may not happen until the spring. abc news, washington. president obama is closely monitoring the developments coming out of peace talks in the fighting in ukraine.

russian president putin, ukrainian president poroshenko and the lead earns of france and germany are meeting in belarus. they met for several hours and are trying to negotiate a deal to end hostilities in eastern ukraine. more than 5300 people have been killed since april, and more than 1 million have been displaced. investigators are looking for the source of a diesel spill in alameda. the department of fish and wildlife doesn't know yet exactly how much fuel spilled at the alameda marina. you can see how big this is there on the water. the coast guard first received a report last night of a diesel smell. cleanup efforts are under way right now. new details this afternoon. this man has been identified as the person whose body parts were found in a suitcase in san francisco late last month. his friends and former roommate mark andrus have been arrested

and was still a person of interest in the case but andrews died last weekend, a few days after authorities released him from jail because they didn't have enough evidence. police have not said how andrews died. they say sha-juan's debtath remains under investigation. a resident who traveled has been diagnosed with measles. this is the first confirmed case of measles this year in contra costa county. the person rode on bart last week during february 4 and 6. >> it is important for people who may have been traveling on bart during those times and may have been exposed and are not vaccinated or not immune that they could catch measles. >> it becomes airborne so that if i had measles, anybody who's in this room, even an hour after we leave can become infected with measles. >> the patient who is a linked

people are immune. if you've had two doses of the mmr vaccine you are most likely immune. >> now for those people who just aren't quite sure if they've been vaccinated, what do you recommend? >> sure, so there's some general rules of thumb for adults who may not have their vaccination records. if you were born before 1957 you were most likely exposed as a child and are likely immune. for people born after that, i think it's worth discussing with your health care provider. there's a test can you get if you're not sure. there is a vaccine we gave in the early 1960s when we first had vaccine that may not have been as effective. but ever since 1967 we've had a great vaccine and we've been giving two doses of vaccine since 1989. if you're not sure check with your health care provider and you can get a test or a

vaccination. >> one more thing about symptoms. some people may have the flu and think they have contracted measles. what do you recommend to figure out what you really have? >> sure. measles does start with cold-like symptoms, a cough, runny nose and red eyes. often it takes a few days before you see the characteristic rash. if you think you are immune, then you may have cold symptoms. certainly, it's good to stay home if you're ill and stay away from others. and if you do get a characteristic rash, contact your health care provider. he'll talk to you about whether you should stay isolated or if you need testing or not. >> thank you for your time. a burglary suspect shot is in custody this afternoon. police arrested the man after he went to san francisco general to be treated for a gunshot wound.

officers shot danny rodriguez garcia after they say he drove his car at them during a traffic stop. he was able to drive off and elude police. in addition to the burg lary count he will be charged with assault with a deadly weapon on an officer. a young sea lion is recuperating from his long and mysterious trek today. >> he managed to get from the ocean all the way to lake merced in san francisco. we've got a photo of the sea lion named as persevereo. >> reporter: well, you know it's a happy story and a lighthearted story and a worrisome story. this sea lion is not a pup. this sea lion is a year ling. it is 50 pounds underweight.

he's not yet healthy but by sea lion standards, he's much happier, and he has a lant name. do you speak latin? >> i don't. >> reporter: he could fool just about anyone after he rescued persevereo from beneath a car this morning. the sea lion had journeyed more than half a mile from the nearby ocean, quite a trek. >> he was scared and thin. >> reporter: it is a distinct contrast to one of the most famous wandering sea lion, chippy who traveled the river 1 hun100 miles into farm country. baby sea lions are dying this year. and the number of desperate animals has increased week to week. they've taken in more than 100 in the last two weeks. >> all of these pups should be on the channel islands with

from tomorrow morning to saturday evening as a result of that storminess out there whipping up these big waves. the potential for rip currents. keep that in find if you're planning beach side activities. meanwhile, overnight, mostly cloudy skies. temperatures in the upper 40s. tomorrow look for sunny skies and mild to warm conditions all around the bay area. we'll see highs in the mid-70s in san jose, 75 in morgan hill. on the peninsula low 70s for the most part. on the coast, check this out, look for a high of 68 in pacifica tomorrow, 73 at half moon bay. downtown san francisco will reach 70 degrees tomorrow. up in the north bay with just a few high clouds around, but mainly sunny 72 at santa rosa. east bay 72. and inland they'll see highs

making headlines where you live at 4:30. president obama has asked congress to authorize military action against isis. the president says he is not asking for ground troops but the fight would not be restricted to a specific gee dwraf cal location. president obama says the coalition against isis is strong and that the mission will succeed. a sick sea lion pup is being treated after it was rescued in san francisco this morning. it was saved by a national park ranger and two good samaritans. there are many more undernourished pups like this one. three major chocolate brands are violating of water rules.

leanne? >> reporter: well, you know they tested hundreds of bars not once but three times. and something very interesting is that some companies like for example see's had only one bar that did not pass the test but all their other bars did. some of the organic ones failed too. first, we're told chocolate is good for you, the darker the better. now tests do on hundreds of chocolate bars found some had higher than normal levels of lead and cadmium, two heavy metals. >> we sent them to an independent lab and had them tested for lead and cadmium. >> reporter: ghirardelli had two with high levels and two that didn't. these six chocolate bars also had a higher concentration of heavy metals. how they got intoes they bars is unknown, yet there are some ideas. >> one possible theory is that

lead and cadmium from coal firepower plants, from gasoline, from pesticides get into the soil and get into the bean. >> reporter: another possibility is that somehow the lead is introduced in the manufacturing plant. the consumer health watchdog group has taken these companies to court demanding that they put warnings on the labels. see's had one that didn't pass the test the extra dark chocolate. but the national confectioner's association issued this statement. it is determined that tiny traces of naturally occurring heavy metals in food areunavoid areunavoidable and present no health risk. but these are not acceptable according to the safe drinking water act of 1986. no level of lead is safe for children. and cadmium is known to cause

shot in the leg and stomach yesterday. the windows of his silver mercedes were shot out. the suspect, mike montana was arrested. >> adult male face first in the street with his hands in his fists and blood all over his body. we started putting pressure on the wounds. it was, they were saying it was a shooting. people were yelling, he was shot he was shot! >> montana will be arraigned next week on a charge of attempted murder. court records show he filed for bankruptcy protection last year. jerry sar cain yan has died. he won 729 games, and a coaching career that spanned five decades. tark was known for chewing on his towel on the bench as he coached. also known for battles with the ncaa which went on for years and

the u.s. government is poised to withdraw long-standing rules about cholesterol. >> the nation's top nutrition advisory panel has decided to drop decades of advice about cholesterol food. it could undo about 40 years of warnings about it. there's been an evolution of thinking among nutritionists

$100. the only possibility you have do they own another restaurant? if they do you can try to say hey, you've got to use it here. >> that's a good suggestion. >> mike k asked, the sur charge on my bill at a pizza restaurant was taxed. it feels like a scam. is it? >> no. first of all i don't like the restaurants separating these out. it's a cost of doing business. they don't check for sugar or property taxes. but they separate this out because they're ticked off they have to pay for health and welfare for their workers. so they separate out this new tax. they're allowed to do that as long as they tell but it and because the state says it's not some separate tax. they're separating out, just as i explained, you have to pay tax on it. they've done the exact right thing to do. make sure they tell you in advance. the first time you're seeing it it should not be on the receipt. it should be on the menu, on the table on one of those little cardboard things. it should not just be on your bill. >> thank you michael.

patient brushed up against a lot of people getting to work and back. a live report on an investigation. and a chocolate surprise. what a bay area watchdog group says it found inside some popular sweets. i'm your meteorologist. i'll have 2004temperatures where you live coming up. this is abc 7 news. >> a measles exposure warning for bart riders as contra costa county confirms its first case. >> we begin tonight with developing news. and here's what's happening now. the infected person rode bart during the busy commute starting from a lafayette bart station. >> laura anthony is there and joins us live. >> reporter: the pool of potentially infected people is quite large, but the reality is most of those folks are immune.

it's that small percentage that could be vulnerable that health officials are most worried about. >> we determined that this individual had traveled on bart during the infectious period. >> reporter: it's a case that potentially exposed tens of thousands of people in the bay area to the dangerous measles virus. >> it's low risk if people have been vaccinated to get measles from this exposure, but it is important for people who may have been traveling on bart at those times and may have been exposed. >> reporter: the person boarded trains at lafayette, three days in a row. he or she exited at the montgomery station and went to work at linked in's offices on second street. >> measles is very infectious. it becomes airborne, so that if i have measles anybody who's in this room, even an hour after we leave could become infected with

measles. >> reporter: health officials have released the following timeline. the individual was on bart 6 to 8 am and then returned each evening from 7:00 to 9:00. the shoulders of the commute, those trains are distributed elsewhere in the system. so there is a possibility that even if you rode the richmond line you may have been on the same exact train this person was on. the person also spent time at the e and l kitchen and bar between 5:30 and 7:00. the measles patient is recovering at home and will be isolated for 21 days. in lafayette laura anthony, abc 7 news. thanks very much. this case in contra costa county gives us a total now of 15 confirmed cases in the bay area. there are three in san mateo county. two each in marin and
