>> reporter: take a good look that the video and call daly city police if you know who this man is. vic lee, abc7 news. a man accused of being drunk and running down and killing a prop lar fruit vender in east san jose facing a murder charge. prosecutors filed 12 criminal charges today against the man including murder. he is a recently convicted dui offender, now accused of drinking eight beers before he got behind the wheel last saturday afternoon. police say he lost control, then hit and cracked francisco hernandez, who died short time later. his wife is recovering at home. on the same floor of the same courthouse nearly the same time, the prime suspect in a kidnapping and killing before a judge the court a request by the attorney for six more weeks before a trial date is set. back in february, he pleaded not guilty to charges of killing the 15-year-old. the morgan hill teenager vap nished while head toggle school

a 32-year-old man is headed to prison for two shootings in oakland, including one in which a police officer was shot had in the thigh. judge alan heimer sentenced nathaniel cook to a 57 years life in prison for that january 2010 shooting on 448th avenue and east 12th street yes shot the officer during an attempted robbery. cook pleaded not guilty by reason of insanity and testified he did not remember the shootings. a judge rejected the defense and convicted cook of attempted -- jury convicted him of attempted murder. an audit on overtime spending at the oakland police department shows costs are spiraling out of control, according to the report. overtime cost increased nearly 80% from fiscal 2011 to 2014 from 14 million to nearly 25 million. the department blames staffing cutbacks and increased street protests for the soaring costs. the audit recommends a number of reforms to lower cost, including overhauling overtime approval
