live from the kgo-tv broadcast center this is abc7 news. >> good morning. thanks for joining us. kristen sze is away. we have breaking news from san francisco. part of the city's hall of justice has been evacuated after reports of a suspicious package. it does not appear to be an explosive device but the bomb squad is on the scene. the package arrived from southern california. stay with us and our breaking news continues right now on twitter@abc7newsbayarea and our website. breaking news from hercules a major gas leak has been capped in the last few moments.

sky 7 shows the scene a few moments ago. officials ordered the immediate evacuation of several neighborhoods before 10:00 this morning. it was is urgent they said to get out and leave on foot and do not drive the car. they were concerned that vehicles could provide an ignition source because the leak was so huge and pose an enormous danger. this happened on the north side of interstate 80 including river view terrace neighborhood. crews have cap the leak and they now are working on the clean up. everyone is okay. everyone is allowed back in their homes right now. >> more breaking news oakland police are trying to put together a deadly shooting near a park this morning. it was reported at 7:00 near gulf links road near the southeast edge of the park. wayne is there and has the latest. wayne? good morning, as of this morning there were 17 homicides in oakland and now we can add

another. this is a prosperous neighborhood and now a lot of grieving and shock. this is video from sky 7 above the 4700 block of scocia avenue. the victim remains unidentified but residents say he was fairly young 23, according to a neighbor. art scott said he heard the shots and arrived shortly after it took place. >> pop. pop. pop. pop. pop. shots. seven of them. about. the young man was laying out there in the street and three bled out on the street shot in the head and bled out. >> it sound like a .22 caliber handgun. the scene around the home, people there and the surrounding streets are in shock at the drive-by shooting in this quiet neighborhood. oakland police have yet to give us more details. many of the homes around here have video surveillace cameras and a man said he believes a

next door neighbor has one of those surveillace cameras so police may have a decent starting point for the investigation. what you are looking at new behind me is a fire department truck back on the scene to clean up of what remains and this will be ongoing through the day still waiting for the details but generally sad day this this quiet oakland neighborhood. new this morning the family of jahi mcmath is suing children's of oak who died after comply cases from surgery. her parents insist she is still alive and keep her on life support. our reporter talked with the attorney filing the lawsuit today. the lawsuit named children's hospital oakland and the doctor who treated jahi mcmath accusing the team of mishandling the 13-year-old's case. i spoke with the attorney on the

phone. >> they did not treat the family with the respect they deserved and of course they never explained what happened. >> he said the hospital made a change of errors starting with doctor rosen's decision to do such an aggressive surgery for sleep apnea. she had a clotted artery in her threat. you have to be on high alert for postoperative complications. after the surgery she started pleading and went into cardiac arrest and was pronounced brain dead. the hospital sent someone to interrupt her per praying at a chapel and asking her to sign donor papers the family still refuses to take the teen off life support. her uncle posted a message on instagram part of it reads and i quote "yes jahi is alive and has graciously improved by the blessing of god and all your prayers."

>> i reached out to the hospital. a spokesman sent me a statement saying their hearts go out to the mcmat family but it is their project not to comment on any pending litigation. in the newsroom for abc7 news. after three years a morgan family said next weeks search for mayor missing teenage daughter is spending. the search for 15-year-old sierra lamar will be suspended. she disappeared on the way to school in 2012 but her body was never been found. the family has run out of places to lock. a final search is held a week from saturday and the person charged if her death, garcia-torres is due in court next month. her hair and d.n.a. was found inside his car. >> new developments in the shooting and antioch involving the discovery of a shotgun a distance away from the victim and a car crash into a home by three people now being investigated in connection with the murder.

our reporter joins us from the antioch police department. >> police have a gun in their custody. they have three people they are interviewing. this trail of evidence and these crimes impacted several residents in a couple of neighborhoods. when the car crashed into this antioch garage last night at 11:30 the woman inside said it sounded like an explosion. inside her garage, two cars were damaged and supplies for the event planning company were thrown to the ground the she welcomed us to make pictures but did not want her picture taken. >> i was afraid to look out the window. i didn't know who was involved jumped my fence or what. i was afraid. >> when she looked she almost passed out in shock. a car withinned into her garage and three people being hauled off by police. she lived here alone along with herring do pepper. >> thank god i amnesty alive -- i am alive.

it could is come through the gay and come in here. i am happy to be alive. >> the three in the car may have been trying to get away from scene the murder. >> the murder happened in front of cheryl's home on hudson court. a police officer on patrol heard the shot and saw a car without lights driving on. the officer pursued it. police found the man who was shot to death, lying on hudson court. >> crazy. trying to have my son over here and i cannot have him over here. >> too much violence in our community. we ought to come together and work as one. it will continue to go on. >> police have not announced any arrests or a motive. they continue to investigate some residents say they are thinking of moving away they are so fed up with the violence. in antioch for abc7 news.

thank you the san jose city council is considering a solution to help get some badly needed i firefighters. matt explains. >> yes each deal has a catch. this federal grant would pay for the firefighters for two years but after that the difficult would and to dip into its own pockets to keep them on the job. >> firefighters are the classic american hero first responders when you are in need. despite what the job times says when the economy tanks and the budget is falling, you are vulnerable. the great recession was bad for city jobs. according to a recent memo by the interim fire chief the san jose fire department had 198 total daily staffing july 1 of 2010. today is it 172. that could change. he is recommending that the city council approve a resolution to apply for a two-year firm grant worth more than $3.3 million to

restore 14 positions in the fire department that were lost over the recent years. >> it could allow us to restore service at a fire station that has been closed for several years. the exact deployment, however depends on the fire department strickland and where we can use the firefighters. >> if san jose is awarded the money the city council is not sent 20 accept it. the money of the grant is for two years and then the city has to pay the full amount $3 million each year. mayor liccardo said the grants are helpful but the city needs to make sure it has the money to make it work. >> it is important to do it in a way that is sustainable. we do not want to hire someone for a year or two and watch them walk out. we have to do this in a way that is responsible. i am confident we can. the city will find out by the end of september if it is awarded the grant and the city council will vote whether to accept the money.

were the engineer died this morning in los angeles. the train derailed when it struck a pickup truck that was abandoned on the tracks. police say the death could open vehicular manslaughter charges. the driver of the truck was later but released him. >> and hillary clinton is at the center of a scandal, the presidential contender is coming under fire for using a private e-mail account while she was secretary of state. "new york times" reports that she never had a government e-mail address during her four year tenure. the state department confirms she used her personal account to conduct state business and the government has no true record of communications. also at issue is security whether her account was encrypted against possible breaches. leaders say hillary clinton handed over tens of thousands of e-mails at their request last year coming to as a result as the result of a special

congressional committee investigating the attack on the consulate in libya. our ought university of california could be growing. again. there is a proposal that the university build an 11th campus with a focus on science and technology. the state is said to need a new campus for the talented students denied a place at other top ranked campuses. they are struggling to take care of the ten existing campuses. and the governor brown and uc president napolitano are facing off over how much the state should funnel into the school budget. napolitano plans to raise tuition in the fall but the governor is threatening to pull the plug on funding in that happens. the student applications are on the back burner not knowing how many spots are open. meteorologist mike nicco is ahead with the forecast. >> good morning, everyone, from the top of the broadcast center, i can smell spring with a lot of pollen in the air and how much

oakland. now temperatures, upper 50s to low 60 this afternoon from the coast into san francisco at 62. we will have mid-and-upper 60s like napa and concord at 67 and antioch and livermore at 68 degrees. tonight, the dry air coombs considerably again and a chill when you step outside tomorrow morning, and heat are may run tonight especially inland valleys mid-30s to low 40s and from fremont, palo alto south upper 30s to low 40's and everyone else in the low 40's, the area of low pressure sliding away from us and that will on the door for this area of high pressure to move in and that is going to bring us a warming trend going especially tomorrow. look what it does, average high is 65 degrees and we will be ten degrees warmer than that if you want to head to wine country napa pretty much mirrors that. my seven-day forecast shows we will touch accident in a few areas around the bay starting
