>> part of the problem with using cell phone technology sometimes it freezes and that is what happened right there. we will check back with david and find out what is going with the train derailment. >> in the east bay the morning commute is recovering from a mess in berkeley with crews working do clear lanes of westbound 80 near university after a wood truck spilled the load around 6:00 this morning. the truck hit a pothole and wood dumped across several lanes. five hours later crews are securing the wood bundles with cables to lift on to different trucks. it was taking the drivers more than two hours to get from highway 4 to the bay bridge toll plaza. the c.h.p. hopes to have it cleared completely by noon. breaking news in the east bay a small earthquake in san leandro is registered 3.1 and struck at 10:07. a lot of people on social media say they felt it but so far we have in reports of damage or injuries. >> the dismantling of the san francisco 49ers picked up steam with the defensive leaders

announcing his retirement. linebacker patrick willis has a new calling. our reporter has been following reaction and we will miss this player the. >> a lot of people. even c.e.o. is praising his dedication and sacrifice. he plans to make the retirement official at a press conference today at noon. he is only 30. but accomplished a lot of success during his time as a 49er. >> the rumors started early this week. today, it is official: long time san francisco 49er patrick willis is done with the franchise. the 30-year-old linebacker has been with the team for eight years. he spend much of the season on the side lines injured. the 49ers wished him well in a tweet: to our 7 time pro bowl linebacker 52. thank you, patrick willis, we wish you the best. >> he hinted yesterday about the plans part of the statement reads and i quote "i thank you guys for everything.

waiting for paychecks several days after payday. 70 are contract workers for the city of san jose. our reporter joins us now from city hall with what is to blame for the delay. matt? eric, blame it on the weather, the checks are four days later but the john tories want to make sure the story is not swept under the rug. cleaning up the city is a big job with a big price tag. san jose pays a company called gc8 for custodial services and the employees clean up san jose facilities including the airport and police department and city hall. for many on friday the paycheck never arrived. weather caused problems with fed ex hub in tennessee where the paychecks come from. 700 have not made it to the office for distribution yet. the two workers did not want tuesday show their face out of concern for their jobs and they say this put a strain on their finances. >> mortgage bills...

>> i live paycheck by paycheck so if why get my check, i am behind. bills. >> behind on pills? >> right. >> they are paid $17.81 an hour but the hours were cut to years ago from 40 hour as week to 35 and the paycheck is smaller and now it is missing. we contacted gca and they have not responded to the request for a comment. but workers question how a storm in the east is keeping their pay out of their pockets in the west. >> i am sure there are ways of getting our paychecks, handwritten paychecks...if they have it stuck in a storm. >> a city spokesman got back with us and said that the checks were delivered to gca last night so that means the night shift workers picked it up last might and they expect all the day shift workers to have their paychecks in hand this

afternoon. that is good news, matt. developing news, in san jose police are trying to figure if any of the five people arrested in a high speed chase overnight are connected to a homicide. police trailed the vehicle along 680 to present and into dublin where the c.h.p. took over. the group surrendered in pleasanton when a tire and rim gave out. san jose police recovered a gun from the scene. >> more news in san jose a 22-year-old man is battling life threatening injuries after an early morning shooting. he was shot in the heart, abdomen and face. two men drove up to the victim and opened fire after an argument. they do not know what prompted the argument. >> marin county sheriff deputies found evidence of debt to nation of an explosive device at a home in novato even though they did not find the device itself. neighbors complained of loud explosions as the house yesterday afternoon and this is the same home where authorities found 90 explosive devices and bombmaking materials last month.

this morning both the 43-year-old laureen mason who lives there and a 33-year-old robert spear pleaded not guilty to chances from last month and will be in court march 30th. tonight, berkeley city council will consider a new law to benefit up security around liquor stores. it would require liquor stores in certain parts of the city to upgrade the surveillance systems in six months. those without surveillance cameras are required to install them. police have identified the areas of concern as downtown and university, telegraph and san pablo prompted by two deadly shootings in 2013 at this scene near san pablo and delaware street. a 34-year-old was gunned down during a confrontation and six months later a 24-year-old was shot and killed outside a liquor store in west berkeley. new details in the fraternity investigation at the university of oklahoma after a video surfaced appear to show frat members using a racist

chant. this morning, the president of the university said the school has expelled two students accused of playing a leadership role in the video. the sigma alpha epsilon national headquarters has closed the ou chapter and suspend the members. the video posted online shows students on a rented because singing racial slurs. the focus of the video is now shifting to females on the bus. while no one has confirmed which sorority they were the national chapter of one sorority said it and cooperating with investigators. bart wants your input on the new warm springs extension project in southern alameda county. the age is weighing a series of proposals about which lips are extended from the current terminal in fremont to a southern terminal in warm springs. one of the proposals affects riders in san francisco and they are holding a series of meetings gather rider input. today's meeting takes place at the fremont bartization from 4:00 this afternoon to 8:00 this morning and we have information

this was an eventy -- empty gravel truck. i want to show you something because as we walk to the northeast you will see something very interesting. you will see there is a wheel, one of the wheels that came off of the rail car. we do not know if that was compromised, if that fell off ahead of the intersection and caused the derailment or whether or not it was flung back to the position. we are told there were no injuries. the fire department sent out a haz-mat team. no hazardous materials were discovered so no evacuations were required of the apartments straight ahead. east taylor will be blocked for some time. we have heard that union pacific rail company may have to send out repair crews before the rail

cleanup will take six hours after a tanker with fuel overturned on a major east coast highway this morning. it happened on interstate 95 not far from washington, dc. the closure caused backups of five miles both directions of the freeway remaining closed while crews clean up 400 gallons of spilled fuel. hillary clinton is expected to take questions this afternoon about using a private e-mail account for business when she was secretary of state. the associated press reports that she will field questions after a speech at the u.n. in new york. the democratic presidential hopeful is under pen scrutiny and getting backlash from republicans who say show violated ethics. >> uber is adding jobs and names to fill spots with women. the san francisco-based ride sharing company plans to hire a million women in the next five

visibility in oakland and more compressive than earlier this morning with issues getting into sfo at fur miles visibility but you can see our visible satellite has a lot of the fog lifting but the high clouds and mid-level clouds are keeping the sun at a premium this afternoon. so that is why it will be cooler than yesterday. the east bay hills is an area that has seen the sunshine more prominent throughout the morning hours than the rest of us. from mount tamalpais you can see above 1500' it has been much brighter. mostly cloudy and not so warm. our chance of showers is evaporating. i will slain that in a near record warmth this weekend. i will look at san jose 280 and 17 is hazy here with high clouds and tree pollen and the main players of pine and oak and juniper. upper 50s to low 60s along the coast into san francisco. until you get to santa cruz at

66. most of the bay into the north bay is low-to-mid 60 and upper 60 in the south bay and inland east bay where we are seeing more sunshine. tonight is a very mild night. you wake up tomorrow morning and low-to-mid 50s. notice where the future radar returns: across the north bay and further to the north than that. here is the society up, two areas of high pressure the high over land will bring us the extremely bone dry layer of air right near the surface and that is what will undercut this system. the other high pressure is steering it more to the north than it is over us so mild and gray most of today and mid-level moisture is all we will get out of the storm and it will have a hard time making its way through this low layer. look at 5:00. mainly cloudy. overnight a few sprinkles in the north bay and same day tomorrow morning and by noon that was it by the afternoon hours we are
