saying quote, i believe there should be equal opportunities for women and men to be venture capitalists. today's testimony focused on the investigation into the complaint she filed in 2012. she says from the beginning, she was wary of the investigator the firm hired. at times, she felt he tried to push her into answers and when he came back with a finding of no discrimination or retaliation, she wasn't surprised. she send this e-mail to senior management, i found him unprofessional, antagonistic, and bias. i do not believe his report represents an independent, unbiased perspective. the courtroom turned tense after lunch as the defendant attorney began the cross-examination. she grilled powe on her work history, exposing her lack of investment experience. she countered powe's statement that she wanted to be a venture capitalist by playing a portion of the video deposition where powe said she hoped to get into

an operations role. pao previously testified when she learned her lover was still with his wife, she ended their involvement immediately and that's when the workplace retaliation began. pao's testimony is expected to continue tomorrow. in san francisco tiffany wilson abc 7 news. tough questions today for hillary clinton, including one about gender as she addressed her e-mail controversy. clinton says she used a private domain as secretary of state but admitted it would have been better to use multiple e-mail accounts. official e-mails are supposed to be archived to an official government account. clinton maintains she has not broken any rules and has turned in 55,000 pages of e-mails but is refusing to turn over the

private server. today she spoke about it publicly for the first time. >> if you were a man today would all the fuss being made today? >>ly leave that to others to be answered, but as i said, i saw it as a matter of convenience. >> the state department says clinton's e-mails as secretary of state will be published online after they are reviewed. oakland police are mobilizing major resources to solve yesterday's shootout that killed a woman who shielded her two children from the gunfire. the shooting happened after several women got into an argument. the 30-year-old was walking with her 7 and 9-year-old children. she covered them with her body when she heard the gunshots. she died when a bullet hit her in the head. police are hoping the tragedy will spur witnesses to come forward. >> a lot of times people don't feel comfortable coming to the police department with information. but this is one of those

incidents where you have to feel compelled to give information. >> police are investigating whether a 16 and 19-year-old who were also involved might have been involved -- injured, that is, might have been involved in the shootout. in a statement, kaiser said our hearts go out to her friends and family in the wake of this terrible tragedy. tonight, we're learning more about the domestic violence arrest of 49ers fullback bruce miller. he was taken into custody thursday on suspicion of spousal battery. the scanner recording from that evening gives us a bit of an idea of what happened. >> said her boyfriend attacked her. she said then, never mind and hung up. >> the team said it will wait to collect all relevant information before making a decision on miller. water worries because of the drought are getting so much worse.

drastic measures might have to be taken. here's the story. >> reporter: if there's no significant rainfall the rest of this winter east bay mud is now projecting water storage could rival that of 1977. that was the worst year in the district's history. now with three-quarters of this rainy season over, the snow pack in the sierras just 19% of normal, the key reservoir is 90% full but only because the district is holding water there rather than releasing it downstream to other storage facilities such as comanche which is just 30% full. >> the predictions are grim. we're looking at water storage levels that are probably going to be rival what we saw in the 1977 drought. this time of year we usually have six or seven feet of snow on the ground above our sierra reservoirs. today we have about a foot and it's melting fast.

>> abc 7 news reporter laura anthony reporting on the serious water crisis we're facing. the santa clara valley water district have a proposal to increase its pump tax. increasing this tax would not directly impact residential bills, however. opponents want the district to dip into its $557 million budget reserve instead of increasing rates. board members will make a final vote in may. there at least could be some rain on the way although don't expect it to solve our water problems by a long shot. spencer christian has more. >> we have clouds thickening over the bay area. there is moisture in the clouds but we are certainly not likely to get significant rain from this system. you can see the green showing up on the radar image there indicating moisture in the

trying to figure out why two freight train cars derailed this morning in san jose. two empty cars jumped the tracks near east taylor and north seventh streets. nobody was hurt. officials describe the derailment as relatively minor. >> fortunately for us, it was not loaded. you can see behind me that it lost its back wheel. i do not have any specifics as far as technicalities on what happened for it to leave its wheels. >> the fire department says the train wasn't going faster than normal. union pacific is handling the clean-up. a hawaiian airlines plane on its way to honolulu was forced to return to oakland international airport after the pilot spotted a technical problem. this was shortly after the flight landed back in oakland. the pilot was still too far from hawaii so the crew decided to burn some fuel before returning to oakland. the passengers continued their journey on another plane. in san francisco's richmond

an emotional patrick willis made it official this afternoon. he is retiring from the nfl. there was speculation the 49ers linebacker was leaving the game to spend more time with his family and church. but willis also says his inability to play pain-free was a factor in his decision. he says he left it all on the field during his eight-year career. >> there will not have been a day in my career that i don't feel like that i gave this game everything i had. >> he sure did. the seven-time pro bowler says he has no regrets. at 6:00, we'll have team coverage of the niners and the willis retirement decision including analysis from mike shumann on what this means for the team going forward. he was a linchpin on this
