spilled out. it was working for a city project to improve the sidewalk along shell avenue. the accident happened around 1:00 this afternoon. they are speaking with the driver of the truck to figure out what exactly happened. neighbors say this was supposed to be a safety project to prevent accidents in the area and protect the dozens of high school kids who walk along this road. >> they're supposed to know what they're doing. they're contractors. my own feeling, i think they should have closed the road off. there's too many cars here. if you see how many kids have if to go on this road and drive up and down and walk up and down this hill every day from the high school then you'd understand why they're doing it. >> reporter: shell avenue and pine street will be closed off for several hours tonight as this investigation continues. now we did learn the victim is a 32-year-old hairdresser. she has a 4-year-old daughter. reporting here, abc 7 news. >> just awful. thank you.

police have surrounded the home of an elderly woman where a burglar may be barricaded inside. this is happening in the 900 block of elsinore drive right now. sky 7 hd was overhead a few minutes ago where the burglar was originally seen in the back yard of this house. he entered the home where a woman in her 90s lives. the woman got out safely and is now with officers, but police believe the burglar is still inside. they've been trying to coax the person out peacefully. but it's unclear if officers are actually making contact with him. officials say a female student escaped an attempted kidnapping on her way to school. the student told authorities a man in a car offered her a ride as she was walking on lonetree way. when she got out the man got out of the car and tried to grab her, but she got away. this is the second incident like this this month involving an

antioch student. a part of sea shore could be closed. 58 year old nancy blum was killed when arch rock collapsed. another person with her was seriously injured. last week the park service posted warning signs to stay away from arch rock after a fission first appeared. a 9-year-old boy is recovering after falling through a school's domed skylight yesterday. william wells and a few friends got on the school roof and somehow he fell through. he was injured. you can see the boarded up skylight there. abc 7 news reporter has more. >> reporter: she says her son is improving, but it's too soon to know the extent of his injuries. yesterday he was playing with friends when the ball went on the roof.

according to school officials, the boys found their way through the locked garden fence removed a ladder from the shed and climbed onto the school's roof. >> apparently the boys got up on the roof and they walked around and there was a domed skylight, don't know what they were doing on it but the boy who was injured fell through. >> reporter: from sky 7 hd you can see the piece of plywood covering the hole. one of the boys stayed with william while the other went to get his mom. she quickly drove to the school. too afraid to tell the school, william walked to the car. she then took him to a local hospital. but after finding out what really happened, doctors there quickly made arrangements to have him transferred to children's hospital oakland. >> he has seven fractures on his spine, a fracture on his head. >> reporter: doctors also discovered a pre-existing benign cyst on his brain. but they are focussing on his

injuries and describing his condition as stable. they are going over security measures to see how they can avoid this in the future at the school. residents of an oakland building are fighting to stay in their homes even after a fire ravaged through several units. we have video from saturday's fire that killed two residents. the blaze destroyed one unit. the owner is using the fire to push them out. >> the building can be lived in and our landlord refuses to turn on water, power. despite the fact that it would be very easy to have utilities come in, cap off the appropriate things and let us keep living here. >> a mixed media artist was killed in the fire and so was an individualvideographer videographer. you can find a link if you want

to help at abc 7 news.com. three high school students are in custody accused of shooting a man outside their school. teams of heavily-armed officers searched the area with police dogs. officers didn't find the suspects until today. a 16 year old and 17 year old from richmond and a 16 year old were arrested on school grounds today. police booked them into juvenile hall on suspicion of attempted murder and conspiracy. prosecutors are calling to reverse course and file charges against a man who was pointing a stun gun at them. they fired 59 shots at alex nieto almost a year ago. >> reporter: protesters had been calling for an independent inquiry of this case by the federal government. and today we've learned that the san francisco district attorney's office has submitted this case to the u.s. attorney's

office for review. this demonstration started bright and early this morning at 7:00. the aim was to mark the one-year anniversary of alex nieto's death in an officer-involved shooting. organizers question why four officers fired a total of 54 rounds when they confronted nieto. his father was at this event. he said there are a lot of people demonstrating, and there will be more to come. his son was shot near sunset last march 21st. police say someone called 911 reporting a man with what looked like a gun. officerings arrived and saw someone with what they believed to be a firearm. it turned out to be a taser. the chief showed the audience the weapon. >> this is the actual weapon that mr. nieto had. >> reporter: but organizers of this protest dispute that version of events. >> there are reports that the

sight was aimed at the officers. is that accurate? >> that is police version of events. and what we need to understand is that the version given by police is a version that is a naration aimed protect them from a lawsuit. >> reporter: the district attorney's office did not file charges against those police men. this morning's elaborate demonstration remained peaceful. >> we were just monitoring what was going on in front of the station. thankfully there were no services impacted by the demonstration. >> reporter: the protest wrapped up at noon. another busy day for staffers at the marine mammal center. experts were called out to pacifica to rescue a young elephant seal. the group of hikers noticed the pup.

in san francisco, a gas line that leaked after this crash has been fixed. a suv hit a building on cabrillo street causing a leak. the building was briefly evacuated. one person suffered minor injuries in the crash. it is under vision. bay area air officials could require homeowners to get rid of fireplaces before they sell their homes. but one realtor said that would be a bad idea for business. >> reporter: well, the air

district claims that particulate matter wood-burning pollution is the number one cause of pollution in the winter. realtors dispute that. saying that causing owners to get rid of fireplaces could do more harm than good. they are fighting mad about a plan that would require fireplaces to be removed or converted before it could be sold. >> they're trying to put and find solutions to their problems on the backs of the real estate tranaction. and it's not right. >> reporter: the proposal is coming out of the bay area air quality management district which is looking at an ordinance requiring a home seller to make the change before a sale. >> it's very dit rimtal to people's health. indoors and outside the home. so the industry is looking to get input as to how we can

long-established black out rule. that means fans in local markets will get to see their team play on tv regardless of whether the game has been sold out or not. this has been a problem for the raiders, although they've been selling out consistently for the last couple years. also they will use a source other than a tv network to show a national game. next october's game between jacksonville and buffalo will be streamed online for free by an undetermined provider. an analyst believes apple will become a trillion dollar industry. it would put apple at the valuation of $1 trillion. white believes it will continue rising thanks to apple's growth in china.

americans have purchased health insurance through the program which includes stand alone insurance. many younger adults are covered covered under their parents' program up to the age of 26. the future of the affordable care act however remains uncertain. the supreme court will rule this summer on the legality of subsidies under the law. today republicans and small business owners gathered to support a bill that would take transportation fuels out of the cap and trade program. californians are now paying increased gas pricing as part of a fee that went into effect on the first of this year. the group is pushing an emergency measure to stop what they call the hidden gas tax. >> so what california is doing is taking billions from every day working people putting it into a great big, multi-billion dollar fund, and we are unsure
