abc7 news begins with breaking news. the breaking news is out of best where the jury has reached a verdict in the boston marathon bombing trial. the court set to reconvene to announce dzhakhar tsarnaev' fate in the worst terrorist attack on united states soil since 9/11. >> in boston the announcement is expected at any moment. massachusetts banned the death penalty in 1984 but tsarnaev was tried in federal court so he could face the death penalty. >> tsarnaev attorney as mitted her client took part in the april 2013 bombing so a guilty verdict on some of the 30 counts

is widely expected but she said her client's brother was the mastermind behind the bombings. he died in a shoot out with police days after the attack. not jury fines tsarnaev guilty the same jury will then decide whether he gets life in prison with no parole or the death penalty. the pair of blasts at the finish line on april 15 2013, killed three people and injured 260. >> good morning, i am eric thomas here for kristen sze. >> you can see the painful injury suffered by an 82-year-old woman after being robbed and dragged by a car. the attacker toll her purse while she was closing the real door of an s.u.v. outside her home in oakland on saturday. amy hollyfield joins us with the victim's story. amy? >> yes, i just met with the victim. she is doing better. her spirits are up. she is familying okay. she said she does not want her

name or her face or her address shown on tv. she is still afraid of her attackers. >> how is your family? scared? >> well... [ inaudible ] >> the 82-year-old grandmother showed us her extremely bruised arm and said she was in intense pain the first two nights, so much pain she could not sleep. she is sleeping now and the pain has subsided. he is very grateful for her nape's surveillance video that captured attack and hopes to find the police who did this. they grab the woman's purse from her and she goes to the car and reaches into the car to get it back and they take off dragging her with them. she then falls to the ground. the camera unfortunately did not capture the license plate. this happened on saturday morning in oakland's diamond

united states marshal service tracked him to a home in gulfport and took him into custody. authorities say carter's family helped with the escape. his brother joseph drove him to reno where he got on a bus. the brother has been arrested in helping with the get away. the sheriff wants to make sure nothing similar happens again. >> obviously we cannot prepare for everything that could arise but when it does happen, everything is under review and changes are made. >> the united states marshal broke his arm during the raid at the house and carter and waiting to be extradicted. >> police in san jose are investigating the latest murder. investigators say a 33-year-old sacramento woman was found shot to death near stoke street before 10:00 last night. the woman had been shot inside a white sedan park on the street and dragged out of car after the shooting and the man behind the wheel drove away. two other people were in the car stayed behind, a woman and child the victim near the killer and

the killing was not random. >> outrage and frustration on the streets of north charleston after a black man is gunned down by a white police officer. he was just fired from the job and now charged with murder. we are hearing from the victim's family. >> a police officer is behind bars. the f.b.i. is investigating. and a community is grappling with a senseless death. >> the officer michael slager of morals charleston, south carolina police department has been charged with murder in the death of the 50-year-old walter lamar scott. this cell phone video shot by a bystander shows the final seconds of the encounter on saturday morning starting with a routine traffic light for a broken tail light. the man had an outstanding warrant for child support and he fled to the field and slager fired the weapon eight times at scott's back. until that video came to light the north charleston police said

the officer fired on scott because he felt threatened. and that scott grab his stun gun . subject down. he grabbed my taser. >> when they became aware of the tape. it was over. done. charged. >> police drop an object near his body and it is not clear whether it is slager's stun gun or something else. >> i almost couldn't look at it to see my son running defenselessly being shot. it tore my heart to pieces. >> slager was denied born at a bail hearing on tuesday. he did not enter a plea. >> walter scott family said justice has been served but scott's civil rights were violated. they will be filing lawsuits. a paramedic bryan stow may have been awarded $18 million after being beaten by two fans

in 2011 but he will likely never see even a third of it. the doctors are responsible for just under $14 million of the award and lawyers will receive $3.6 million. the dodgers insurance company is expected to sue to collect $3.4 million which is legal. san francisco general hospital has a lien for $1.2 million leaving only $6 million for bryan stow but the medical costs and rehabilitation will top $30 million. house minority leader pelosi of san francisco could be losing the confidence of some of her colleagues. a couple of senior house of representatives members say new blood is needed to bring back a democratic majority in congress. massachusetts democrat lynch asked pelosi to give up her leadership post. in a statement a spokesman for pelosi reminded that she was re-elected unanimously in november including by those two gentleman. while there could be disagreements in the caucus, she

tsarnaev, the young man that along with his brother set off dual bombs at the boston marathon on april 15th, 2013. three people were killed. 260 were injured. the jury has now found tsarnaev guilty on the first of 30 counts on which he is facing. that count is using a weapon of mass destruction resulting in death. this is a charge that carries the potential of a death penalty. so as we speak, the jury is revealing its findings on the remaining 29 counts but we do know this. this trial is now headed into a second and key phase. the death penalty phase. the same jury of seven women and five men will now have to decide whether dzhokhar tsarnaev will be put to death. he want to bring in abc's tom llamas. tom, guilt or innocence never seemed to be an issue in this trial? his own lawyer said at the start it was him but they did try to paint a picture of a young man that was naive and under the

sway of his older brother tamerlin who died in a shootout. the hope is that they will spare him the death penalty because he was under the sway of the brother. >> reporter: that's correct. that is the defense strategy. we won't know what the jury will decide until the sentencing phase as early as monday. the big story. the jury has reached a verdict in the guilt phase. it took them only about 11 hours, which is not a whole lot of time to come to this conclusion. you can imagine those jurors 16 days of tort uous testimony. more than 90 witnesses. they had to see that bombing video over and over again. they had to look at graphic images of some of the injuries. we know right now, many of the victims are inside court right now listening to the verdict as it is being read. we know the family of little martin richards his parents are there right now and one of the most haunting images of this entire trial was the richards

family standing ble martin by the fence, his mother is smiling and tsarnaev in the background. the prosecution showed he could see the family, he did not care about children and, in fact a phrase in closing arguments was "tsarnaev did not think the children were innocent and he does not like them because they are americans," something that resonated likely with the jury. >> and the martin richard will loom largely >> the jury is continuing to read the verdict. we know that on counts one, two, and three he has been found guilty. back to you tom give us color if you would, the detail on the death penalty phase. when is it likely to start? owe long will it run? what does it entail? >> potentially we know the prosecution will start open monday with three or four days and they will take a break because it will be marathon monday in over a week. they do not want any trial

of wet weather which is good because this morning some locations in the east bay picked up a quarter of an inch of rain. outside emeryville we have sun mixing with the puffy clouds and temperatures are in the 50s from san francisco oakland, san carlos in the mid-to-upper 50s and 57 in san jose and half moon bay at 55. another shot from the sutro tower camera showing san francisco soaking up the sunshine and 53 in napa and 55 in concord and livermore at 58. from the east bay hills we have clouds up there in some spots and some clouds have a chance through the afternoon to drop an isolated shower throughout the region. otherwise, we are turning warmer for thursday and friday and a dry pattern prevails through monday. we have low pressure responsible for the cycling showers yesterday morning and still close enough to bring us the left over sprinkles today and into the afternoon.

high pressure is building off the coast and that is going to move over us tomorrow and dry out our skies and bring back the sunshine. this afternoon, 3:00 or 4:00, there is a threat of a shower but nothing widespread and as we head into the evening the clouds dissipate and we turn to clear skies and for thursday expect plenty of sunshine and warmer temperatures on the way. as we look at the highs today we have 56 at half moon bay, 61 in san francisco, 64 in oakland, up to a high of 65 in san jose and 64 is the high in napa. as we look at the game forecast tonight, as the rangers take on the athletics, a shower threat over by 7:00. we have a temperatures 57 degrees. as the game lets out at 10:00 temperatures drop into the lower 50s. tonight we will have mainly clear skies, chilly spots in the sheltered valley and 37 in napa dropping to 47 and the low
