live from the kgo-tv broadcast center this is abc7 news. >> a tense stand off right now in san jose where police and swat officers armed with assault rifles surrounds an apartment building trying to get a wanted felon to surrender. our good morning thanks for joining us. we are entering the 7th how of the situation. police have evacuated the apartment complex and are trying to end this without injury. this is all happening on mckee road. we are at the scene. alyssa? >> police just closed eastbound lanes of mckee road and an armored vehicle pulled up. they do have this apartment surrounded. they say a man has barricaded

himself in a unit. officers tried using a bullhorn to negotiate and nonlethal bean bag rounds and flash grenades to get him out but nothing is work ing. >> come out. now. on the front door. >> they let family members talk to the man but not even his mother could convince him to leave. police are calling this a family disturbance. they say after 4:00 a.m. a woman called 9-1-1 to report that her cousin showed up at her san jose apartment off mckey road and would not leave. family say he might have been drunk or on drugs. when police ran the man's name they discovered he was wanted felon and violated his parole regarding robberies. there was a warrant out for his arrest. his aunts identified him as 27-year-old tyrone bear rot and is upset by the armed police presence. >> right now tyrone probably has

some issues going on but the police, to me are over here in everload. it does not take 30 cars to get a 5' 5" guy at 150 pounds out of the house. >> there are members of the swat team on the scene. the stand off comes a month after a san jose police officer michael johnson was killed in line of duty. he was responding to a suicidal man who ended up shoot the officer. police, however say this is a normal response to a barricaded suspect especially when it involves someone with a warrant. his aunt said he is not armed but police will not confirm this. another family member tells me there was good 15 minute window when he could have left the apartment so we are still trying to determine if he is in there

>> new details, napa police arrested a second suspect in a violent robbery at a journalry store at the napa valley jewelers in the outdoor mall yesterday afternoon. police say two 17 year olds took over the start one hit an employee repeatedly with a tool. that will set employee went into cardiac arrest and was taken to the hospital and is in critical condition. one 17-year-old was arrested yesterday and caught the other suspect on a bicycle in downtown napa this morning. both were on probation. they ran away from the juvenile facility over the weekend. >> update to a story we brought you on the morning news: redwood city police say that a either woulded kidnapping attempt never really happened. police say a woman told them she was taking things out of her car in the area of clinton street and lincoln avenue at 9:30 last night and someone grabbed her. now detectives say it was made up. they reinterviewed the woman and she admitted to making up the story because she wanted

hours so we are having a hard tight along with the stout sea breeze on live doppler hd of getting any sunshine. it is breaking out a little bit inland east bay and south bay so you are going to be the warmer areas headed into the afternoon. the golden gate bridge shows it could be damp from time to time for the commute and san jose is showing a few breaks in the cloud cover. tree pollen is high grass pollen is moderate and weed and mold and pollution, all are low. walnut creek southbound on 680, limited sunshine and cooler than average. we are mostly cloudy and drizzle tonight a chance of showers across the north bay tomorrow but the best chance and thunderstorms are in the sierra today and more so tomorrow. how about upper 50s along the coast into san francisco and low-to-mid 60s around the bay? mid-to-upper 60s in the south bay and the north bay and we could get to 70 around antioch and brentwood. if you head to the game tonight
