live from the kgo tv broadcast center. this is abc 7 news. good afternoon everybody. i'm larry beil. >> i'm cheryl jennings in for ama daetz. first at 4:00. an all-out search for a missing 17-year-old from cupertino. connor sullivan showed up for his first-period class, but then disappeared. abc 7 news reporter chris nguyen joins us. >> reporter: it's been a long day for both the family and volunteers and some of those volunteers have been searching for connor since 8:00 this morning and we are live this afternoon at monty vista high school. you can see the group that has assembled here to show their support for the sullivan family. this search effort being coordinated by the cupertino emergency response team.

as we show you some video from earlier, volunteers have been checking out local neighborhoods and going door to door trying to spread the word about the missing 17-year-old boy and they were also out at the fremont open space reserve and the dam and reservoir which are two places that connor had been known to go running. he was last seen at monty vista high school and administrators say he attended his first-period class on monday and failed to show up at his classes and back that day. we spoke to connor's parents who said this was very out of character for their son. >> i'm just afraid that somehow he's somewhere else outside of where we are searching. i'm just hoping that he stayed near home. i just want him home. i just want my baby home. >>. >> volunteers will be working into the evening. we've been told that the santa clara county sheriff's office is checking local parks and they've also been distributing flyers

but again, this door to door neighborhood search effort is being led by the citizens group. >> back here live, connor is a three-sport athlete and some of his teammates from the track cross country and wrestling teams have also come out to help with the search. if you have any information that could help authorities you are asked to call the santa clara county sheriff's office. we are live in cupertino. i'm chris nguyen, abc 7 news. >> let's hope someone knows where that young man is. barry bonds his 2011 obstruction of justice conviction has been reversed. the ruling came today from the ninth u.s. circuit court of appeals in san francisco. bonds of convicted of making false staples to a grand jury that was investigating the balco steroid scandal. prosecutors felt he was trying to avoid questions. today the court ruled that his testimony was not material to the government's investigation to steroids distribution, but it is not quite over yet. prosecutors could still ask the

bay area. >> current temperatures, 53 and morgan hill 61 54 in half moon bay and here's a view of a still cloudy coast looking wrest ward from emoriville, we have current temperatures of 71 in santa rosa and petaluma 64 and low 70s in fairfield, concord and livermore and i'll give you a look at the accuweather forecast in just a moment and we'll see how wet and which part of the weekend that will be. larry and cheryl? >> thank you, spencer. >> now to martinez. fire investigators are looking into what started a fast-moving apartment fire this morning that sense a neighbor and a police officer to the hospital, look at those flames. >> it happened on pine street and hal road in martinez. amy hollyfield has more on how neighbors helped each other safely escape the flames. >> reporter: the mission apartments went up in flames around 5:45 this morning the

video was captured by a neighbor. by the time it was discovered and 911 was call would the resident his to rely on each other to safely evacuate. >> neighbors were banging on doors saying there was a fire. i picked up my kids and i took them out and i gave my kids to my neighbors. >> he wasn't finished. as a 4 and 5-year-old kids were taken away he stayed behind to help a woman who was still inside her smoke-filled home. >> she was stuck and i asked other neighbors to come, kick the door open and that's how they got her out. >> she was trantic and she was fine. the ambulance took her. >> she was taken to the hospital to be treated for smoke inhalation. a police officer also inhaled too much smoke as he helped with the evacuation. >> he was not transported, but we are keeping an eye on him and make sure that he continues to be okay. >> everyone else in the apartment complex was okay but shaken by seeing fire come so close. >> i was scared, and very glad

that it wasn't our building. i was hoping no one would be hurt. it's just a scary thing being in an apartment complex. now the focus turns to recovery and the woman who is now in the hospital. >> she's probably about my age. so it's concerning any time somebody gets injured like that. thoughts and prayers to her and her son and hope everyone is okay. >> fire officials say four apartment units were damaged by this fire and two of those were destroyed and they're still trying to figure out what started the fire. in martinez amy hollyfield abc 7 news. some of the firefighters who responded to that fire in martinez had to knock down a fire in walnut creek minutes before that. this broke out in 3:45 this morning off of ignacio valley road. crew his that under control in a little over an hour. firefighters say nobody was home at the time and investigators are trying to figure out how they started and they believe the homeowner might be overseas

right now. a controversial bill right now requiring all california schoolchildren to be vaccinate side one step closer to becoming law this afternoon. the senate education committee passed the bill shortly after 9:00 a.m. and the proposal eliminates california's personal belief and religious exemptions and allows medical waivers only for kids who have health problems. hundreds of parents who opposed vaccinations packed the building during today's hearing and the judiciary committee will not take up that bill. police are hoping this video will help them identify two suspects where an $8500 cello was stolen. the handcrafted cello belongs to an east bay prodigy. the break in happened at a union square parking garage. police have been following several leads and they're hoping someone can identify the woman rummaging through the vehicle or the man the male accomplice who was seen in the getaway car video. a former hayward police sergeant is in jail right now

accused of bilking roughly half a million dollars out of a mentally ill woman he arrested. >> michael scott biel was arrested at his modesto home on monday. prosecutors said he met the victim when he arrested her for prostitution in 2002. she says she gave him 450,000 paying partially for a home they lived in and that they promised they would get married when they retired. they didn't know beil was engaged in any illegal activity before retiring in 2013. an islamic extremist with an arsenal of weapons was planning an attack on french churches. >> police say his plan failed after he accidentally shot himself in the leg. abc news reporter marcy gonzalez with the details. >> reporter: a close call in paris. authorities stopping what they say could have been another charlie heb doughdo type of massacre. a man caught by chance as investigators said he was about to launch a terrorist attack on

churches. >> this individual was in contact with another person who was in syria with whom he exchanged information on the condition of an attack. >> reporter: before he could, french police say the 24-year-old suspect accidentally shot himself sunday. they claim he called for help and when police arrived they followed a trail of blood to his car. there and in his apartment they found combat weapon ammunition and a bullet-proof vest as well as documents about al qaeda and isis and an outline of his plan. the suspect an algerian computer science student was already on a terror watch list because he allegedly wanted to go to syria. >> much like the boston marathon bombers on law enforcement's radar screen but not to the level that would justify any sort of ongoing surveillance. >> reporter: before he was caught, police say he did take one life shooting this 32-year-old mother to death choosing her at random, they say, because he wanted to steal

covering santa rosa, berkeley, san jose and all the bay area. this is abc 7 news. the mayors of san francisco and oakland came together today with the u.s. secretary of veterans affairs. the goal? to announce a major plan to find permanent housing for hundreds of veterans who are currently homeless. abc news reporter wayne freedman is live in san francisco with the story. wayne? >> good afternoon larry. interesting fact. if you look at all of the homeless people in san francisco, roughly one in every

five is a veteran. that's also true in san jose and in oakland. the question what can the cities do with the federal government do to get those folks off the street and get them some help? >> it has all of the comforts of home because that's what it is. one room with a building filled with small rooms on kerney street. all with veterans subsidized on the city of san francisco and the federal government. >> they saved my life. >> harry, a former navy mate and not along ago just another homeless person on san francisco streets. not anymore. >> are there more guys like you that need this. veterans affairs secretary robert mcdonald who met in san jossy and san francisco with the goal of getting homeless veterans, safe havens in tough cities. >> i think if anything before we go into a war we have to determine whether or not we've got the commitment to take care of the people after the war.

>> for san francisco today, the secretary pledged $1.8 million a year for a decade to help house veterans money for 111 more rooms in san francisco alone. 111 more homeless veterans like harry devinny. >> in a nice bed. >> reporter: simple needs complex solutions. in san francisco, wayne freedman, abc 7 news. you may know that today is earth day and to celebrate in san francisco mayor ed lee announced a new campaign to reduce greenhouse gas emissions. >> abc 7 news was at at&t park in san francisco this morning as the mayor detailed his 0-50-100 plan. the campaign's goals are to send zero waste to landfills and reach 50% sustainable travel and use 100% renewable energy. the mayor praised the giants for the team's sustainable practices. last season, get this, 96% of the waste at the stadium was either recycled or used as compost.

>> now pick up your peanut shells, right? >> part of the commitment includes more muni busses like this one. it's an all-electric bus that will be put into service in a few days along the mission line. this year muni will add about 60 all-electric and diesel hybrid busses. they can be easily rerouted to streets without those overhead electric wires when they're being blocked. >> with these coaches it's a question of pushing the button and the polls drop and we have the ability to go up to 40 miles an hour for six to seven miles off the wire. >> muni expects to replace its entire fleet of 800 busses over the next five years. on saturday, muni rolls out youth service improvement and they include bus frequency and gives some routes priority at the intersection. >> president obama used earth day as a call for action. he spoke at the florida everglades this afternoon about the importance of taking steps to combat climate change immediately. >> this is not a problem for

>> it's christmas for me. >> one thing is certain, all of that partying and carson does put more pressure on planners in oakland to find the money and get a deal done soon. in oakland laura anthony, abc 7 news. >> a wrong-way driver is being blamed for a crash that killed her on highway 50 in sacramento. the woman was driving her prius in the wrong lane about 2:30 this morning when she slammed into a pickup truck head-on. the prius driver all three men in that pickup truck died. the third driver has minor injuries. officers says it appears the prius driver had been in the wrong lane for miles before that crash. no word yet whether or not drugs or alcohol were involved. >> this was day two of the penalty phase in the boston marathon bombing case. today the brother and stepfather of a massachusetts institute of technology police officer who was killed by the convicted bomber dzhokhar tsarnaev took

the stand. each said the shootings had a devastating impact on their family. here is a photo of the jurors saw yesterday that showed tsarnaev staring into the camera flashing an obscene jestur and this was shortly after the 2013 arrest. it showed tsarnaev had no remorse for what he did. >> a lawyer for john hinckley jr., said the man who shot president reagan is no longer a danger and should be allowed to live full-time outside of a washington mental hospital. the lawyer made the comments before a hearing before a federal judge. hinckley was 25 when the jury found him not guilty by reason of insanity in the assassination attempt of ronald reagan. hinckley has spent the past 30 years living in a mental hospital and he's been allowed to spend 17 days a month at his mother's home in virginia. mr. reagan's mother patty davis says hinckley should not be released. the pressure is growing for officials in baltimore to explain how a 25-year-old african-american man died while in police custody.

now the department of justice has opened a civil rights investigation into the life of freddy gray. after the investigation was announced, hundreds gathered at the spot where gray was arrested. abc news reporter karen travers has the details. >> demonstrators took to the streets of baltimore, demanding justice for freddy gray. >> >>. >> the 25-year-old's mother collapsed in grief. his sister overcome with tears. the justice department's civil rights division has opened an investigation into gray's death which came a week after he was arrested. the cause of his death was a severe spinal injury but it is unclear how or when that happened. officials say they're cooperating with the feds. >> we are handing over a copy of all of the documents that they had for this review of this case. >> we're seeing an incident that

took place sunday april 12th in west baltimore from the auto police camera. gray and the other man ran when they saw police in the neighborhood. here, someone is seen running down the street. then a police officer on the same street walking with two bicycles. squad cars arrived. not a minute later gray is seen on the ground, two officers standing over him. >> baltimore police say they don't know when gray was injured. during the arrest or after he was put in the van. the city's mayor claims it was while gray was isolated in the vehicle. >> i have a lot of concerns about what happened in the van and i want answers to those questions. >> baltimore's mayor says they're often questions of transparency when the police department does an internal investigation. >> she welcomes the justice department stepping in. karen travers abc news, washington. >> one person is dead and more than 20 others are sick after a rare outbreak of botulism in ohio. doctors say it all started at

church's potluck. the 50 to 60 people who were there on sunday may still get sick even if they're not experiencing symptoms now. at least 23 people have already become sick. five of them are in critical condition. this bacteria is rare and usually comes from canned foods, but doctors say you cannot tell if your food is contaminated by taste. the sickness is not contagious. >> another woman is entering the race for president. former hewlett-packard chief executive officer carly fiorina will launch her campaign for the republican presidential nomination may 4th and that was reported by "the wall street journal," she will run with marco rubio, and fiorina ran for senate in 2010 losing to democrat barbara boxer by ten percentage points. the woman who received a bill for $16,000 after takinga a ride with san francisco's uber. >> 60 mile-an-hour winds and 60-foot swells the passengers

a cruise ship stuck in open water for two days during a violent storm finally docked in australia. the carnival spirit pulled into sydney harbor today. that massive ship was rocked by 60 mile an hour winds and 30-foot swells. the 2500 passengers onboard had a tough time getting around. debris was flying everywhere. >> it was scary. our patio furniture flew off the balcony. >> my suitcases were flying out of their cub boards. the tv was falling down. >> a lot of the glass had been pushed out and smashed all over the place. >> that was scary. the ship ran into the storm as

it was returning from the south pacific cruise. it forced the closure of sydney's port and that forced the ship to ride it out until the port could be resoaped and fortunately, nobody was hurt. >> there's nowhere to run and nowhere to hide. >> and at the end of your vacation. >> fortunately, it worked out. we may have some rain and nothing that serious or wild like that. >> we'll take anything. >> i can go for some wild right now and here is a look at live doppler hd and stormy east in the sierra and the thorps are weakening down, south of the rumsey area and it looks like it's about to fizzle. at&t park, as larry pointed out, a big pitcher's matchup tonight, dodgers versus giant game time 7:15 and bumgartner versus kershaw and couldn't ask for a better matchup than that.

francisco, east bay and all the bay area. this is abc 7 news. uber is apologizing for billing a woman $16,000 for a ride. they say it was an accident. jamie hessel was not happy with the service she received from the uber driver last month in new york city so she filed a complaint. uber promised to credit but it never came so she contacted them again and that's when hessel received an email from uber saying she's been charged $16 grand for that ride. obviously, she did call uber back. >> uber called me like, an hour and a half later personally finally calling me and trying to apologize, and explained the situation and i asked them you know, how can i get charged $16,000? and they're just, like, oh it was a clerical error and someone put a decimal point in the wrong place. >> uber apologized and gave

hessel a full refund and the company says she was never charged the $16,000 and they corrected the error the same day. >> tough times for diet coke. the coca-cola company said the diet drink fell 6% globally last quarter and it blames that part to a jump in coke zero sales. it pointed to an increase in diet pepsi sales as well as people turning away from diet soda altogether because of reports that they might be unhealthy. >> google's services are online. it will allow customers to pay only for the day to day use every month. the service, will not likely have much of an impact yet and it will initially only be available on the six handsets and will rely on sprint and t-mobile networks. no word on coverage areas or on whether other phone models will work on it. >> another study showing no link between vaccines and autism. >> throwing away a lot of food

and new refrigerator could come to the rescue. jane king has those story and more in today's report. >> measle, mumps and rubella vaccine and autism. the study examined claims for children between 2001 and 2007. those that received the vaccine did not receive the higher rate than unvaccinated children and it is the american medical association. and there is a slew of health-related apps to go with it. one is from the insurance company, bluecross blueshield and it monitors fiscal activity and stress and the mental research says about 15% of smartphone users regularly interact with health and fitness apps. it's depressing to throw away so much food every week when it starts to go bad but families find themselves doing it so appliance and household products makers are racing to make food last longer and one idea is a luxury fridge that uses nasa air

it was part of the curriculum and i think it's horrible that we have to do it, but you do. what i want you to do is ask around your school. there will be one school everybody hates and one everybody loves. >> that is true. if you don't find it like that, then here's how you go about picking a driving school first and check occupation alliesence of the school. you can check that license on the occupation alliesence status, information system database on the dmv website. check driving instructors license and they all need to have a license, too, and check the driving school instructor's license on the dmv and make sure you know all of the costs and always have a clear understanding of the expenses before you sign the contract and hold on to that contract and we get a lot of complaints about that and word of mouth is probably the best. >> they don't teach you parallel parking. >> you notice that on the streets. >> it's crazy. how can you not teach that? i don't know. >> another question from facebook from lawrence c.

does a person's credit score increase if the credit card bill is paid as soon as it arrives? >> a credit score isn't something that lasts. it's a snapshot. it's like this. when you ask a bank for a loan they get the snapshot and what comes up is what your credit score is based off of. so say you were buying a lot of furniture and you really charged up a bill and although you had the money and you were going to pay it off, when they look at your credit score and the furniture there has not paid off, your credit score goes way down. if you're in the middle of buying a car or house, try not to use a credit card, but if you do, what i want you to do is to pay it off before the bill gets sent out and that way they never hear about it and it never hits your credit report. >> i know you can use costco's pharmacy if you're not a member. what about their eyewear and exams? >> eyewear, you cannot buy. the eye exams you can.

>> earth day has a special meaning in san jose today. it's the annual banding day for the resident peregrin falcons city hall where the biologist finds out the sex of the three baby birds. abc 7 news reporter matt keller why enthusiasts are happy about the project. >> reporter: biologist glenn stewart is happy for whatever comes his way 18 stories high at san jose's city hall and that includes clara and fernando. and the resident peregrin falcons. baby falcons. this is a view from the john line falcon cam theiren counter with stewart. stewart has rappelled down into the nest every year since 2007 as the predatory group research group. this morning they put bands around their tiny legs for tracking purposes. he also revealed there were three little girls delighting the enthusiasts who document the event every year.

vic lee is live at at&t park in san francisco tonight with the impact of this legal development. vic? >> well dan this is certainly a legal bombshell. i mean, this case has dragged on for more than a decade and actually barry bonds was at the game last night sitting next to ceo larry baer and he was in spring training as well helping players with their batting. bonds was linked to a drug lab called balco, and he was in 2003 if his trainer ever gave him -- and he answered in a vague, meandering way and the trial opened in 2011 and the jury deadlocked on all counts except the one charging him with lying to the grand jury. he was sentenced to 30 days of home confinement probation and all the while he appealed his conviction in the ninth circuit court of appeals said essentially that barry bonds'
