broadcast center this is abc 7 news. good afternoon everyone. >> first at 4:00 huge clean up effort is under way in the south bay after a large tree fell on a detached garage in the yard of a home. look at that. sky 7 hd showing us the scene in san jose. this happened just before noontime abc 7 news reporter david louis live along the street with the details. >> reporter: dramatic from sky 7 hd, but dramatic here on ground level where you can see the garage was squarely demolished by the huge limbs. it fell to the north and to the northwest, nobody was home at the time, and the house was spared. and fortunately, the dogs that live here also were inside at

the time. as you can see from sky 7 hd this is a huge tree. estimated to be 50 feet tall. it fell across the yard from the neighbor's house and landed on the garage next door at home of leanne fortunately, no one was injured, her two teenage sons were at school, and she was at work. >> the tree is very old, and it's big. and the branchs limbs were very big, and i knew that if it ever fell it was going to fall on to my garage. like i just i've been talking to my neighbor. we need to do something about this. >> reporter: the base appears to have split in half one crashed to the ground while the other was standing. the family keeps the teenager ice bicycles in the garage and general storage. we tried to reach the next door neighbor where the tree sits, but no one answered the door. the tree had healthy branchs with lots of green leaves until an arborist can evaluating with it's not known if the drought contributed to its falling. the tree did not appear to do

any damage to the home. however, san jose firefighters were on hand to make sure of that. >> the fire chief and i walked upstairs to inspect the house, and he said it was all secure. so yes, i'm very grateful that not more damage was done. >> reporter: treat appears to be a tree of heaven. she says the tree has sprouted seedlings over her yard and her neighbors. as you can see there was also damage to the rear fence along the back alley. all of that is being secured by a chain linked febs. we are live in san jose david louis, abc 7 news. >> all right david, thank you. well a dangerous scene in mountainview this morning as ammunition exploded during a fire that killed a man. abc 7 news was at lowa lane around 4:00 a.m. shortly after the flames broke out. neighbor says the man who died spent time as a marksmen and took part in shooting

is live in washington, d.c. this afternoon with the details, karen. >> reporter: good afternoon, ama, a very somber president obama said today he deeply and profoundly regrets what happened and apologized to the families of those two hostages killed until the american drone strike. the cia had been watching this compound for what will the president said were hundreds of hours. targeting al qaeda operatives but they didn't believe there were any civilians inside. president obama called it a tragedy, and said he takes full responsibility. >> it is a cruel and bitter truth that in the fog of war generally, and our fight against terrorists specifically, mistakes sometimes deadly mistakes can occur. >> reporter: two aid workers held hostage by al qaeda, american warren weinstein and an italian man accidentally killed in a january 14th cia

drone strike on the afghanistan-pakistan border. the u.s. was targeting al qaeda operatives. >> based on the intelligence that we had obtained at the time including hundreds of hours of surveillance, we believed that this was an al qaeda compound, that no civilians were present. >> reporter: two american al qaeda members were killed. alaska med froouk taken out in the strike that killed weinstein and giovanni. adam gadan, a california native who served as a spokesman for the terror group. the white house said today gadan and faruk were not the intended targets. >> these two al qaeda leaders frequenting an al qaeda compound that had been identified by the united states. >> reporter: shortly after the january strikes, the u.s. had indications that non-combatants were at the target location. but it wasn't until this month when there was high confidence that weinstein and laporto were killed.

weinstein's family said today they hold the people who took him captive, ultimately responsible for his death. the white house said the u.s. government will provide compensation for the weinstein and the laporto families reporting live from washington karen travers, abc 7 news. >> thank you. more protests today in baltimore, maryland, hundreds turned out to call for justice for freddie gray. freddie gray is the man who died from a spinal cord injury while he was in police custody. protesters are demanding to know exactly how that injury happened. state troopers have been sent to maryland to help with the protests that have been going on for nearly a week now. a woman is in the hospital with life threatening injuries after she was shot by sonoma county sheriff deputies following a high speed chase. >> it took place off the south of the area. it started at 11:45 last night when someone reported a car that is going on reverse near windsor. deputies caught up with the car and the chase started. they reached speeds of nearly

100 miles per hour. when the woman finally stopped, the deputies say she refused to surrender, and as they approached, she put her car in reverse and ran down three deputies, and that's when they shot her. investigators say still have not given us the woman's name. this afternoon, a large group of staunch supporters gathered to support four east bay high school athletes accused of stealing drugs from a friend who is a drug dealer. >> the four students were in court to face charges and abc 7 news reporter is live in martinez at the courthouse, leanne. >> reporter: well larry, let me tell you that when those four teenagers walked into that courtroom in shackles wearing a green jailhouse jump suit, i could tell you everybody there was crying. men, women their friends, and everyone seemed so downhearted because they know that if these charges stick, this could mean the end of their athletic career. now, again, inside that

courtroom, it was full of supporters parents, relatives, and classmates all came out looking very distraught. now this was an arraignment where all four teens pleaded not guilty to robbery charges, one of them was also charged with using a firearm during that robbery. now here's what we know according to the complaint on april 9th the four of them went to a house on rolling woods way in concord to buy marijuana. now they left and returned later, police say to rob the drug dealer who was 18 years old. now they were apparently wearing ski masks and one of them had a gun. now three of the four teens play on the clayton valley high football team, one of them is an all-star player. the fourth james dempsey plays basketball, and this is what his mom said to us. >> anybody who's done anything in their teenage years i'm sure regrets it. at some point.

and i'm sure that they learn when they get caught. but he is a good man. and he does have a soul. >> reporter: now even though they are 17 years old, they will be tried as adults. the d.a. made the case that the robbery was well-planned and it was a serious crime. now there will be a bail hearing coming up on april 28th to see if they if that bail can be reduced, i should say in the meantime the four teens remain in juvenile hall. i'm live in martinez abc 7 news. >> leanne thank you. break in the case of a cello stolen during this vehicle back, it was during this vehicle break-in back on april 11th in san francisco. police say the $8500 instrument has been returned to its 16-year-old owner. apparently somebody walked into a downtown san francisco bar on tuesday night, they handed over the chel throe an employee and told them to call the police. the person left quickly, still no sign of the two suspects in

early saturday morning across more than just montana hamilton and we'll have warmer days ahead beginning on sunday. now let's look at what's happening in the atmosphere lite image shows weak systems moving generally out in our correction. the first will stay mainly to the north, this will not bring us rainfall. the second system although weak, may be strong enough to produce showers here in fact we think it will early saturday so let's look at our forecast animation. starting at 7:00 tomorrow evening, at which point it'll be mostly cloudy, notice lead tomorrow night just before midnight, the first hit of showers arriving in the north way up in northern sonoma county. during the overnight hours into early saturday morning, more widespread showers pushing through the bay area ahead of the frontal system, then by oh, mid-morning, it'll be pretty much over with some lingering clouds into saturday afternoon. we don't expect a lot of rain from the system, but we'll probably get some measurable rain across the region anywhere from .005 to a quarter of an

unreal at first. >> reporter: along the road in cupertino, these posted signs, not only a reminder of connor's disappearance, but of his love for nature and running the trail. back at the command post, community members leaving no stone unturned. >> we think about his father he's our neighbor. you know, and connor's our friend our brother, our son. >> reporter: holding out hope that connor will return. in cupertino, chris wynn, abc 7 news. former charles manson follower convicted of two murders won't be getting out of prison any time soon. a los angeles judge today denied parol for bruce davis. he was suitable for release based on his age and prison conduct which included earning a doctoral degree. the judge says there's still evidence davis is still dangerous and should not be freed. davis has been imprisoned for more than 40 years, he was convicted in the 1969 killings

of musician gary henman and donald shay. fresno fire investigators arrested a woman in connection with a fire that seriously injured a captain. his condition is gradually improving. on march 29th the 25-year veteran of the force was leading his crew across the roof of the burning garage when it suddenly collapsed. he fell through and suffered severe burns. 52-year-old julia harper has been charged with a arson. investigators say she lived in that home where the fire took place and does have a history with fires. after months of delays, the united states has a new attorney general. loretta lynch won senate confirmation this afternoon. she's the first african american woman in that post. abc news reporting karen travers is in washington with why it took so long for today's decision. >> reporter: it took more than five months, but loretta lynch was finally confirmed as the next attorney general. >> nomination is confirmed. >> reporter: the senate approved lynch's nomination thursday by a 56-43 vote. she becomes the first african american woman to serve as attorney general. the confirmation was a long-time coming. president obama nominated her just after the republicans won control of the senate in last november's midterm election. >> it's hard to be more qualified for this job than loretta. throughout her 30-year career she has distinguished herself as tough, as fair, an independent lawyer who has twice headed one of the most prominent u.s. attorney offices in the country. >> reporter: her nomination was bogged down in political fights over an anti-human trafficking bill and the president's immigration actions. >> should not confirm someone that leads the united states department of justice who will advance this unconstitutional policy. >> reporter: finally it week, after a deem was struck on a controversial abortion funding restriction included in the human trafficking bill the

senate moved forward on a competitor confirmation. >> i can only hope that senate republicans are show her more respect as attorney general of the united states than she has received as a nominee. >> reporter: she will replace eric holder, one of the longest serving officials in the obama administration. karen travers, abc news, washington. former celebrated military leader david petraeus was sentenced today to two years probation. and a $100,000 fine. the former cia director's career was destroyed by an affair with his biographer. the 62-year-old gave paula brod well classified material while she was working on his book. after the verdict petraeus is looking forward to moving on. the charitable foundation run by bill and hillary clinton is refiling some of its tax returns. this move coming after a reuters review found errors in at least five annual returns. those errors include how the foundation reported donations from governments. the clinton foundation and its

list of donors have been under intense scrutiny in recent weeks. the baggage handler who fell asleep inside a jet last week a apologizing for his mistake. he told abc news reporter that he was stacking cargo inside the plane at seattle tacoma airport when he dozed off. he was a little vague about how it all happened but he was simply exhausted from the long hours. junior says he woke up when a bag fell on his head. it was pitch black. >> all i could hear was the engine going, felt like the plane was descending, like going up, and in any mind i was like this is not happening. i thought it was a joke. >> junior grabbed his cell phone and tried his company, but they thought it was a prank. he then tried 911, but the call broke up. that's when he began banging away. it was so loud, passengers in the cabin above kwould hear. . junior says he thought he might die. he's still employed, but expects

first is from a person who asked via facebook what's the best health insurance you can buy? >> that's kind of a big question. it's not a one size fits all kind of question. i mean even the affordable care act comes in three different plans, bronze silver, and gold. so, let me give you the questions you need to ask yourself when you're looking for a policy. number one, what does the plan cover? does it cover just the basic like the bronds plan or cover nearly everything like the gold? the second question you need to ask is how much does the plan cost? we're talking about the monthly premium that you pay to purchase a plan, plus the out of pocket expenses you pay when you receive medical care. now those are subcombination of deductibles and co-pays. you need to know. finally number three, if you have physicians you care about, which doctors or which hospitals are in your specific plan? that is the hardest of the three to actually figure out.

you really got to ask a lot of questions to find that out. >> okay. >> if you have a credit freeze does that exempt credit bureaus from providing a free annual credit report? >> no, but that is a great question. that is an excellent question. now, a credit freeze just keeps other people from looking at your report. the credit reporting agencies get a look at it, you get to look at it they have to offer you that free report. you're good to go. >> and e-mail from social security advising know review my statement online. is this valid? >> it is. they're sending out notices like that. they used to send out a letter and say here's what you have going on. they don't do that anymore. it costs too much. they are reminding people to go online, they have got a fabulous website. go check it out, keep close track of the social security that you've paid what you will be getting, it is a lot of information there. now, if they give you a very specific site and you're a little worried about that google it instead. be very careful. remember, any rebz will have a

seven-year-old in the cross fire. he was hit by several bullets late yesterday afternoon. abc 7 news reporter wayne freeman joins us now from children's hospital in oakland with the latest wayne. >> reporter: his name is kumar, he is seven years old, we know he's in this hospital with life threatening injuries. that's all we know, that's unofficial. because his family has not come out. they've been by his bedside all day. that and the meantime as vallejo police try to find the man or men or shooters who put him here. in a neighborhood where the signs read no trespassing, they might as well also say, no talking. >> we don't talk to the police. >> why not? >> lose your life. >> why is that? >> lose your life. >> reporter: this man wouldn't tell us his real name even after as many as five people drove bay front yard gathering last night opened fire and hit kumar polk a seven-year-old boy.
