the east bay will clear. then we will look for the slow clearing across the bay. with that it will be a cool afternoon. by 10:00, we're sunny in most east bay neighborhoods. 3:00 in the afternoon, we have the clouds up along the coast. it will be in the 50s there. 60 in the city. the rest of the numbers and a look at mother's day in a few minutes. 8:01 is our time. one person is in custody after being involved in a hit and run crash in san francisco. it happened just after 11:30 last night at brotherhood way. police say two cars collided head on. one person was taken into custody for a possible dui. no word yet on any injuries. happening now the san mateo bridge is closed for the weekend. a live look from our camera. you can see this is not the normal sight that we see on a weekend. the traffic issue not the only thing that we're dealing with across the bay area.

san francisco attorney and political consultant enrique pierce has been arrested on child pornography charges. this is video from 2003 when he worked on the mayor campaign of matt gonzalez. in 2011, he led the effort to get ed lee to seek a full term in office. san jose police are thanking residents for helping them arrest a violent sexual predator. the man is accused of trying to rape a 13-year-old girl. janet has more on the arrest. >> in my opinion, he is a monster. >> reporter: police say the 31-year-old man was on the run. >> all the credit belongs to the citizens who called in with those tips. >> reporter: tips that led authorities to a home where they arrested a clean shaven kaliki. police say he tried to change

his looks from the images captured on video. the first attack happened at a market a month ago when he followed a 28-year-old woman to the bathroom. on tuesday police say he followed a 13-year-old girl as she was walking home from school. her family's video showed an assault that has been plastered all over social media. >> i seen a guy kind of looked like him walking in our neighborhood. >> i recognized him from with the beard. and then when he didn't have the beard, i didn't recognize him as much. >> reporter: jennifer only knee him as a man who lived above her. >> he would complain about our laundry. >> reporter: he lived in this corner apartment. his roommate who didn't want to be shown tells us police took a pair of his shoes and a jacket as evidence. the roommate says he moved out. he had no idea why until now. in san jose janet oh abc 7 news. dozens of people living at

decade. the funds were meant to pay for renovating and maintaining presidential palaces. mothers across the bay area are coming together this weekend in an effort to crack down on drunk driving. the madd organization will hold a day of remembrance. the event comes in response to a spring of dui-related crashes across the bay area last weekend. one killed a mother and her baby last saturday. today's event gets under way at 1:00. that event will offer support to the family involved in last saturday's suspected dui crash. after first dealing with the death of their two loved ones after the car crashed into their apartment last week the family may not be able to return home for up to two months. >> reporter: still in mourning juan finds his ford expedition

the only place to call home. his wife and three children are homeless after an alleged drunk driver smashed into their apartment. it will be two months before work will be completed. >> a couple days in hotel. they pay me one more night. >> reporter: it's day by day? >> yeah. >> reporter: it means he haents been back to work as a cook. they have provided enough support for a hotel room for two weeks. after that, it could be back living in the truck. last saturday, he was hosting a family gathering when a corvette suddenly jumped the curb and mowed down a 49-year-old woman and her daughter julie. the accident is under investigation as a possible dui. the family isn't sure whether they can live here with tragic memories. >> i don't know. i need to see. i talk to my wife. so if she want to go come or

next hour or so. we will see more of it throughout the mid morning hours and then a sunny afternoon on the way. the marine layer below. it was at 2,000 feet deep. with that in place, and a healthy onshore push, it will be clear, mild around the bay today. we're not going to change much for tomorrow. mother's day there's a weak weather system that will reinforce this cool marine air allowing for temperatures to stay in the 60s and 70s. then a stronger area of low pressure visits us again. looks like thursday and friday just like last week could bring showers, maybe activity into this sierra nevada. the low pressure that brought the snow to the norther and souther sierra, will bring snow to the rock i cans s rockies and severe weather to the midsection. a steady sea breeze and the clouds will clear to the coast. if you are headed to the coast,

developing news. oklahoma and other states in the great plains are bracing for more severe weather. the national weather service is warning there's a moderate risk of severe thunderstorms today. the greatest risk is from western kansas into western oklahoma where tornadoes and large hail are likely. the storms come days after the previous round produced more than 50 tornadoes across the plains. severe weather is blowing through parts of texas. forecasters say a few tornadoes have been spotted but no damage has been reported. survey monkey has a temporary ceo in place. the company is searching for a permanent leader. goldbe goldberg was married to cheryl

forecast. lisa, cool start to the weekend and some fog too. >> look how gray it is. can we get any color at all? temperatures are rather mild in it the low to mid 50s. but it's kind of dreary out there. we will look for the sun to reveal itself in the next couple of hours in our east bay. 53 in oakland. 50 with the fog over a mile along the coast. another shot where you see gray on gray. we're looking at temperatures in the 50s with more clouds at the coast. that's your cool spot. san francisco, partial clearing at 60. look for some low 70s in the south bay. 60s across the bay. we will pinpoint your neighborhood and talk about where you will see the sunshine and when and mother's day. that's coming up. the first major prosecution under california's ban on shark fins ends in a conviction. the case the abc 7 news eye team has been covering from the

start. dan was the only journalist in court for the story. >> reporter: the prosecution agreed to drop three counts. but he entered a plea to one count, a violation of code 2021, the shark fin ban. >> no contest plea is the same as a guilty plea in a criminal proceeding and this being a criminal proceeding, i'm going to make a fact finding that you are guilty. >> reporter: the defense tried to argue the january 2014 search of his warehouse in san francisco was improper. game wardens found more than 2,000 pounds of shark fin in forms, whole fins some ground into powder. >> we're disappointed. we thought we had a good motion run today. it was a search and seizure. we think there were problems with the validity of the administrative inspection conducted on the property back in january. >> reporter: the judge sided with the prosecution and urged the two sides to strike a deal.

as a result of his conviction, he was sentenced to 30 days in county jail. can he serve that in the sheriff's work program. three years probation. but most important of all he forfeits the ton of shark fin with a black market value of a million dollars or more. some activists were upset he was getting off with misdemeanor charges. what do you say to the activists who are upset about the thousands of sharks that those fins represent? >> well, i mean, we're following the law. the activist they have the law enacted. now somebody has been convicted. >> reporter: this is an important victory for the actist, since he was one of the most vocal opponents. >> i'm the fourth generation in my family to be involved in shark fin business. >> reporter: did he not want to comment, nor did the prosecution. the judge ordered the fins to be preserved in case they are needed for evidence. the d.a.'s office tells me they want some to be used in research into the dangers that the shark population faces.

dan noise abc 7 news. more than 30 people are recovering from injuries this morning following a fiery chain reaction crash in iowa. check out this video. authorities say two semi trucks, several cars and a bus were involved in the crash. it started when the driver of a semi slammed on the brakes to avoid a backup from an earlier accident. a shuttle bus slammed into the truck with both bursting into flames. fortunately, everyone was able to escape. in the sacramento delta, state officials have begun a construction project to retain fresh water. some call it a drought barrier. >> reporter: in a state where people keep asking what government is doing about the drought, here is a drastic mesh. construction of a temporary drought barrier in the sacramento delta. still not everyone is happy. >> this is a sad day. this is very, very sad.

the last few days to see this going on. >> reporter: when finished the rock barrier will close off 750 feet of channel and block tidal saltwater from flowing into the delta from which counties serve customers. karen cunningham has a ranch and draw was ter from the salty side of the barrier. >> are my cows going to be watered with saltwater? is my sub-irrigation going to turn salty? >> reporter: it will have spent $40 million. the construction part will be a six-week 24/7 job. is it easier to drop or pull out? >> drop in. you walk in and dump the rock in. you have to grab every bucket and pull the rock out. >> reporter: the easier and more difficult out part is one reason

construction. so does her husband. for a long time, jobs were scarce. >> we have been hard hit. >> reporter: they were glad to know they he would get a big tax refund this year. $5,200 to help pay the bills. >> pay for things for our kids and make mortgage payments. >> reporter: except they never got the refund. instead, their $5,200 went to a complete stranger. they couldn't get it back. >> somebody got a lottery on the day they got the money. it really hurt our family. >> reporter: it wasn't a scam. it was a mistake. it happens when susan and richard went to their tax preparer. they wanted their refund deposited to their bank account as usual. when it didn't show up susan called. >> we started talking about the account number. i said, wait a minute. >> reporter: the tax preparer put the wrong bank account and routing number on the returns.

all their money went into someone else's account at chase bank. the accountant insisted susan told him to deposit the money at chase. however, the couple doesn't even have an account there. >> why would i give him an account number that didn't belong to us? that's crazy. >> reporter: they signed the tax return electronically without looking at the full returns and account numbers before. so taxpayers are responsible for the accuracy of their returns. >> frankly, i broke down. i was sobbing. i was so upset. >> reporter: the couple contacted 7 on your side. we contacted h&r block. the company decided to reimburse the $5,200 after all, saying we take any client service issues seriously. it appears our policies and procedures were not followed in this one instance. we worked directly with the client to resolve the issue and deposit the refund in their account. now susan wants to warn you.

southern sierra. sunshine and foggy in the mountains. 64 in tahoe. it's drying out in southern california. they got a lot of snow around big bear. it was a pretty good little storm maker for a late season one for may. we're looking at quiet weather all across the bay. 65 in oakland. 60 in the city. breezy. partial clearing there. 71 in napa. if you are heading into at&t park later today, it's going to be cool, upper 50s 6:00. 6:05 is the game time. sun temperatures in the 50s. tomorrow is mother's day. 60s around the bay. mid 70s inland. any plans you have, bring the jacket. it will be sunny midday but nothing hot. no extremes here. we're not talking fire danger. we're talking dry though and cool monday, tuesday and maybe a shower thursday and friday.
