>> with the exception of a couple of spots at the eastern span of the bay bridge traffic is moving nicely and no delays through treasure island. we have a high wind advisory and another closure comes up in the future and i will have the crystal ball predictions coming up in a couple of minutes. four people are dead after a horrific crash in gilroy this morning and matt keller is on the scene. >> this is tragic four people killed, one with major injuries at the hospital. that is the driver. the vehicle was just towed from the area and now is open to traffic in both directions. investigators say the vehicle 1998 black ford mustang was

speeding eastbound beyond new avenue in gilroy and it lost control and overfund off-road. c.h.p. found the crumpled car 20' deep in a dry creek. the crash was so clown someone her and it called it in. five people were in the car, two males and three females, the flee females and a male died at the scene. they appeared all to be under 30 years old. >> the driver was taken to the hospital with major injuries and investigators say he is from the area but the c.h.p. is looking into the out of the fatal victims. an officer is with the driver and at the hospital right now. there is in word on if there was any alcohol found in the vehicle. they will be giving the driver a blood test. a time with the national transportation board is on the

way to philadelphia to see why an amtrak train derailed from washington dc to new york when it derailed. can you see the scene all seven cars overturned. this is the business of the route in the country with six passengers killed in the accident and 150 were hurt and several are in critical condition. many were able to walk off the train crawling out windows in some cases to local hospitals. >> berkeley is considering a tobacco ban that would be the most restrictive in the nation. but mom-and-pop shops sounding the alarm and they were loud enough for the city council to take notice. our reporter is in the newsroom with the details. >> the berkeley city council decided to postpone the vote which would be the most restrictive tobacco ban in the country. the ordinance bans the sale of tobacco 1,000' of schools and parks in the city of berkeley. the behind is to keep the community healthy and reduce

covering san rafael, south bay, pleasanton, and all the bay area, this is abc7 news. >> it is 5:they are on wednesday. san francisco officials are urging a local mcdonald's to crackdown on drug activity. city attorney sent a letter to mcdonald's corporation complaining of the restaurant at the corner of haight streets receiving more than a thousand calls since 2012 for fights car burglaries and drug sales for lsd, mushrooms and marijuana among other things. officials would like to see the owner beef up security to crackdown on illegal activity. >> new england patriots quarterback tom brady will file an appeal are the suspension. he has until tomorrow afternoon to appeal his four-game suspension. the nfl said he was "at least generally aware," that new

showers tomorrow and a slight warming trend this weekend and when we are beyond this system we are still going to have the onshore wind and temperatures below average mid-to-upper 60s in the south bay with santa clara at 66 degrees and mainly mid-60s on the peninsula, palo alto at 67, and it could be the warm spot to 59 in millbrae and the clouds are banked against our coast so we will have temperatures in the mid-50s and may see more sunshine downtown south san francisco at 59 and same in sausalito but bodega bay still in the mid-50s and mid-60s through the north bay with novato at 64 degrees the same temperature as oakland and fremont and richmond is the cool spot at 62 along the shoreline. inland our biggest stretch of temperatures from 66 in san ramon and pleasanton to 70 in antioch and fairfield and 72 in brentwood. temperature is 59 at 12:35 warming to 62.
