good morning, america. and tron the tracks. the desperate search for passengers still unaccounted for in that deadly amtrak derailment. and the new evidence uncovered by investigators. >> the train was traveling at approximately 106 miles per hour. >> the train going more than twice the speed when it derailed. the abc news exclusive this morning. what the engineer behind the controls of that high-speed train is now saying. new overnight -- dangerous flooding. the south soaked by torrential rain, cars swept away, dozens saved from raging waters, this sinkhole opens up. more severe storms on the way. frightened father. a panicked dad's 911 call after leaving his baby in the car on the way to work. >> i left my 1-year-old baby in my suv by accident this morning. >> the race to save the child.

and airborne at indy. the three-time champion's spectacular crash, spinning out of control at over 230 miles an hour. the incredible video from inside the car. this morning, how he walked away without a scratch. and good morning, america. we have a lot to get to this thursday. and we begin with all the fallout from that deadly train derailment. there's the aerial footage right now. new details coming in overnight. a brand-new satellite image from google. it shows the train off the track, the cars toppled. >> at least seven people now confirmed dead. more than 200 injured. we're learning the name of the engineer of the train that was going more than 100 miles an hour. well over the speed limit. we'll hear from his attorney in a moment. but first, paula faris starts

off our team coverage this morning. good morning, paula. >> reporter: good morning, robin. the mayor calling the driver reckless and irresponsible. meanwhile, the ntsb acknowledging speed was a factor. telling me this morning they have a lot of long days ahead in regards to the investigation. it's been nearly 36 hours since the crash. for the families still missing loved ones, a race against time. as the search to find missing passengers intensifies this morning, authorities are zeroing in on the speed of the train and this man, 32-year-old engineer brandon bostian. he was driving the train more than 100 miles an hour. even though the speed limit leading up to the curve is 50 miles an hour. >> the train was traveling at approximately 106 miles per hour. >> reporter: the ntsb says the speed made the train jump its tracks. the first car

twisted into a mangled heap, killing at least seven passengers, injuring 200. >> there's people stuck in here. they can't get out. >> reporter: this surveillance video shows the moment of when the train rounds the bend. what looks to be several explosions follow. officials say bostian applied the emergency brakes just moments before the accident. decreasing from 106 to 102 miles an hour. it was too late. >> he remembers driving a train. he remembers going to that area generally. has absolutely no recollection of the incident or anything unusual. >> reporter: he's been questioned but says he has no recollection of the accident or how it could have happened. >> i asked him if he had medical issues. he said he had none. >> reporter: the violent crash injuring 200 people and killing 7. including rachel jacobs, a ceo and mother of a 2-year-old. she texted her husband an hour before the crash. >> i remember her as a wonderful young lady.

always full of life and energy. >> reporter: as well as dr. derrick griffith. an academic from new york dedicated to improving city schools. this morning, the frantic search continues for the passengers unaccounted for. including bob gildersleeve, a businessman from baltimore whose son is still searching for his dad. >> my name is mark gildersleeve. please help me find my dad. >> reporter: and questions whether this could have been prevented. there are systems that can limit a train's speed. positive train control which some rail lines contain including parts of the northeast corridor but not in this part of the system. as of this morning, 42 remain hospitalized, 10 in critical condition. the engineer suffered a concussion and was banged up. he's been released from the hospital. george? >> thanks, paula. we're joined by brandon bostian's attorney, robert goggin. thank you for joining us. your client got pretty beat up. how is he doing?

>> he has 15 staples in his head. stitches in one leg. the other knee is immobilized. he has a concussion. on top of that, he looked exhausted. >> mayor nutter, the mayor of philadelphia, calls mr. bostian reckless and irresponsible. your response? >> i don't know the basis for that. we know the train was going at excessive speed but the reasons why are still to be determined. >> we know the emergency brake was hit but has your client given you any information as to why the train was going so fast? >> he has not. i believe as a result of the concussion he has absolutely no recollection whatsoever of the events. i'm told that his memory is likely to return as the concussion symptoms subside. >> he spent six hours with the police. what did he tell them? >> everything he knew. he cooperated fully. >> what is the last thing he remembers?

>> he remembers coming into the curve. he remembers -- um -- attempting to reduce speed. thereafter, he was knocked out, thrown around just like all the other passengers in the train. >> he remembers deploying the emergency brake? >> he does not remember deploying the emergency brake. it was, in fact, deployed. the last thing he recalls is coming to, looking for his bag, getting his cell phone, turning it on, and calling 911. >> had your client been drinking at all? >> nothing. in fact, the police department requested a search warrant for his blood. he consented immediately. >> no drinking. >> they don't need the search warrant. no drinking, no drugs, no medical conditions. nothing. >> how about speaking on the phone or texting? he's turned over his cell phone as well. >> his phone was off and in his bag, as is required by amtrak rules. >> has he ever had any kind of

mishaps before as an engineer? >> no, none. >> no explanation for what happened? >> i can give you nothing. you'll have to wait for his memory to come back or other facts be ascertained by the ntsb investigation. >> when will he be meeting again with investigators? >> when they ask. >> what does he want the victims to know? >> we didn't discuss that. i can tell you that he was distraught as he learned of the devastation. he was distraught. >> mr. goggin, thank you for your time this morning. >> thank you. >> all right, george. back to the scene now. and new questions about safety on the rails. abc's david kerley is there and david, i can imagine that the ntsb is anxious to talk to the engineer. >> reporter: absolutely, robin. we now know what happened. speed was involved here. twice the limit on the corner

just on the other side of those buildings behind me. the question is why. you just heard the attorney say the engineer has no recollection. i just spoke with a member from the ntsb board who is here about what they want to do, what they want to learn from that engineer. >> we have not interviewed the engineer. we look forward to that opportunity. i want to point out that it's not unusual for somebody who has been through a traumatic event to have some memory loss, at least short-term memory loss. >> reporter: will they speak to him today? it's a possibility. that's unlikely. they may wait a day or two until he recoverers a little bit more. you mentioned infrastructure. that is a problem with some of the rails. there is a safety system and paula mentioned positive train control. it is on parts of rails all over the place. all rails are supposed to have it by the end of this year. the ntsb does not believe they'll meet that deadline. it's the rail telling the train, you're going too fast, and it slows it down. it's not on that piece of track

behind us. robin? >> thank you, david. we move on to the dangerous flooding in the south. texas and oklahoma swamped by heavy rain. dozens of water rescues. rob marciano is tracking it all. >> another day. another night of torrential rains. across this state. some areas getting three to six times the normal amount for this month. this mailman having a difficult time. a difficult night last night for sure. overnight, texans evacuating as downpours bring flooding across the state. >> got the animals out. got clothes. gotta have something to wear. >> reporter: scary scenes from the nonstop rain. this car swept downstream. parts of houston getting ten inches in the past 24 hours, leading to at least 20 water rescues. this pickup helping to push a stranded driver. store owners sandbagging. in anticipation of more rain. >> i've been stuck in the parking lot for four hours. >> reporter: in the northern part of the state, officials taking the unusual step of

releasing water from swollen lakes. nearly a foot of rain has fallen in the last few days. opening those flood gates is submerging nearby neighborhoods. >> this store is really flooded. >> reporter: outside dallas, heavy rains blamed for this massive sinkhole. rainwater making its way into the hospital. >> we're hoping for the best. >> reporter: the red cross setting up emergency shelters. for those flooded out. flash flood watches in oklahoma. dry for now across texas but more rain on way. we stretch across the plains, another one to two inches in these areas. still have swollen rivers. this comes with a severe weather threat through the weekend, robin. we'll talk more about that throughout the program. the latest now on deflategate. a new espn/abc news poll finds 76% of avid fans support the suspension and the penalties.

brady has until this afternoon to appeal the decision. he's hired a high-profile lawyer. ryan smith is here with the latest. >> reporter: good morning to you, robin. that lawyer has been a thorn in the nfl's side from the legal standpoint, winning multiple cases against them. as brady gears up for that appeal, a teammate is letting brady know the team has his back. this morning, the new england patriots making it clear the team is standing by their star quarterback. >> he's an unbelievable player. he has full support from myself and the organization. >> reporter: this is tom brady now reportedly lawyering up for a showdown with the nfl over deflategate. a source telling espn brady's adding big-time football lawyer jeffrey kessler, famous for taking on the nfl, to his legal team. kessler just last year helping reinstate both ray rice and adrian peterson after their suspensions for domestic violence. the four-time super bowl winner is racing the clock. he has until 5:00 p.m. today to appeal the decision suspending him for four games after a

deflategate investigation found it is more probable than not that tom brady was at least generally aware of the release of air from patriots game balls. >> a lot of athletes appeal. occasionally they're overturned. maybe the four games could be lessened to two. that's possible. >> reporter: if brady appeals, the big question, will roger goodell hear it or designate someone to hear it? under his watch, several players have had their suspensions reduced or overturned. >> he has until this afternoon? >> until 5:00. we move to the race to the white house now. jeb bush playing defense over comments he made about the iraq war. his republican rivals pounce. he wrestles with his older brother's legacy. jon karl is in washington with the latest. >> reporter: good morning, george. jeb bush is not an official candidate yet. he's already had his first big stumble, offering four different answers to a basic question about the iraq war. for jeb bush, it was a moment of shock and awe. >> knowing what we know now,

would you have authorized the invasion? >> i would have. >> reporter: really? he would have invaded iraq even if he knew there were no weapons of mass destruction? now bush is saying he misheard the question. >> i heard -- whatever i heard was translated, knowing what you knew then, what would you do? >> reporter: the misheard question and the less than smooth clarification has put the iraq war, the most unpopular decision of his brother's presidency, front and center in the campaign. bush's republican rivals are pouncing. >> we know that intelligence was false. no way we would have gone to war with iraq. >> i want to directly answer your question, that's what i do. if we knew then what we know now and i was the president of the united states, i wouldn't have gone to war. >> i think at the time invading iraq was a mistake. >> reporter: bush is declining to answer the question he misheard. talking about whether the war should have been fought does a disservice for those who served.

>> going back in time and talking about hypotheticals i think does a disservice for them. >> reporter: he says we should focus on the lessons learned from the war. although he hasn't yet said what those lessons are. jeb bush's latest answer on this is quote, given the power of looking back, of course anybody would have made different decisions. still not crystal clear. he's gotten much closer to that direct no answer that his rivals have given. >> and they did that fast. jon karl, thank you very much. now to amy with the other stories. starting with the strange attack here in new york. >> a dramatic scene that unfolded. right near busy penn stagts. surveillance video capturing the moment. a man with a hammer attacked a police officer. they spill into the street where her partner then shot the man. that suspect in critical but stable condition. he's wanted in other hammer attacks in the city. the police officer was not seriously injured. breaking overnight, the taliban is taking responsibility for an attack on a hotel that left an american citizen and 13

other people dead. gunmen stormed the restaurant and siege lasting for hours. now to the desperate search for a u.s. military helicopter missing in nepal. it was on a mission to help earthquake victims with six marines on board. terry moran joins us with the latest. good morning, terry. >> reporter: these are anxious hours for the marine corps and the families. two days since those marines and their colleagues disappeared after reporting fuel issues on board that aircraft. and still, no sign of them. this morning, at first light, the search for the u.s. helicopter intensifies as the hours pass. across this incredibly rugged terrain, eight helicopters, a drone, and a battalion of nepalese soldiers all searching. the mountains, valleys and forests. trying to catch any kind of signal from the chopper's emergency beacon.

agents were quote more likely than not impaired by alcohol. one of them, the number two man in the president's detail, has announced he's retiring. a warning about tire safety. after this crash in louisiana. an rv towing a truck flipped over on the highway. police say a dried out front tire blew. thankfully, no one was seriously injured. scientists say it is unheard of. an alarming new study finds that 40% of honeybee colonies in the u.s. have died in the last year. accelerating what was already a crisis. it's taking a major toll on farmers who depend on honeybees to pollinate crops. you can say this woman was left hanging during her b.a.s.e. jump. off this bridge in idaho. a gust of wind caught her leap in mid leap tangling her parachute on the bridge and left

a new twist in the case of the new york woman charged with killing her fiance on a kayaking trip. prosecutors say she confessed to tampering with his kayak so he would drown. abc's linzie janis has been tracking the story. >> reporter: good morning, george. for the first time, prosecutors laying out their case, saying she told police she felt happy as she watched her fiance drown. they say she did it all for money. this morning, bombshell allegations against angelina graswald. walking back to jail after being charged with the second-degree murder of her fiance. prosecutor saying she admitted to investigators that she tampered with 46-year-old vincent viafore's kayak so he would take on water. saying she knew those actions would contribute to his death. they say she told police she watched him struggle in the icy water in upstate new york for several minutes before he went under. something she also told this

local tv station in the days after viafore's death. >> i saw him struggling. he was trying to figure out how to paddle the waves. >> reporter: she didn't tell reporters that it felt good knowing he was going to die. this was her only way out. viafore's body has never been found. prosecutors saying she did it all for two life insurance policies that could benefit her a total of $250,000. and talked about what she could possibly do with the money. this morning, graswald's lawyers plan to challenge the alleged confessions. they say much like the smiling pictures she had online after her fiance's death, the statements may be the product of a cultural difference. a language barrier, or worse. >> we'll find out what happened. whether they were voluntary, coerced, forced. it will all come out. >> reporter: graswald hasn't yet entered a plea.

her bail is set at $3 million. it will be interesting to watch the case unfold. now to a love triangle involving golf champ john daly. his ex-wife and fiance battling in court. with his fiance fighting back. against claims she broke up his marriage. this case could go all the way to the supreme court. abc's gio benitez is here with much more on this. >> reporter: good morning, robin. a wild one. daly's 2010 divorce from his ex-wife turned into a public spectacle. they were married for nine years. now the woman scorned is taking on someone else. the other woman. on the course, he's the pga legend. >> that is an excellent golf shot. >> reporter: two-time major champion, john daly, one of golf's most colorful characters. off the green, his hard partying earning him the nickname wild thing. famously gambling away $55 million. >> i had a lot of fun doing it. >> this morning, he's at the center of a legal love triangle.

which could be headed to the supreme court. >> the motto of my life is karma. >> reporter: she's suing his girlfriend, anna cladakis, for unspecified damages, arguing she broke up the six-year marriage between miller and daly. miller claims that cladakis, who is also his caddie, was having an affair with the golfer. causing alienation of affection and intentional infliction of emotional distress. >> you have to prove there was love in the marriage. that somebody broke up that love. >> the so called alienation of affection law exists in six states. one of them, mississippi, that's where miller filed the suit. saying that while none of them live there, daly and cladakis had some trysts in the state. now cladakis is fighting back asking the court to throw the mississippi suit out. arguing the state has no jurisdiction. in a statement overnight, daly

tells abc news, can't wait to get on stand and tell them that anna is the greatest woman in my life. legal experts say this is a tough case for a person to win. a court has to decide with clear evidence whether there was alienation of affection. of course, it had to have happened in mississippi. >> which is one of six states that has it? >> yes. >> i have a story myself, gio. a frightening scene caught on camera in preparation for the indianapolis 500. driver helio castroneves spinning out and going airborne. we can see there. he somehow walked away. he's speaking about it with t.j. holmes. >> reporter: frightening moments on the racetrack. watch has helio castroneves in that car, spins out of control, hits a wall, flips, goes airborne, almost doing a complete 360. before crashing at the indianapolis motor speedway.

watch again from the three-time indy 500 champion's perspective. he's trying to control the car. steering it as it spins out. to no avail. one minute, he's looking at the track, the next, miles of clear blue sky. >> all of a sudden, the rear of the car just stepped out. i tried to overcorrect. unfortunately, didn't have enough time. the car spun out. then it started taking off. that's when i'm like, oh, snap. this is going to hurt. >> you can see him crouching and bracing for impact. >> i closed my eyes. when i opened, i was in my seat again. >> reporter: somehow, he managed to walk away without a single scratch. >> i'm very lucky to be able to come out of that kind of crash without injuries. >> reporter: he was in town practicing for next weekend's indy 500. he says this accident won't keep him from getting behind the wheel. >> we're ready to go again. no wasting time. >> reporter: for "good morning america," t.j. holmes. abc news, new york. >> doesn't have a scratch on
