looking forward to that. >> right to the breaking news for the viewers in the west. the waters rising in texas this morning. crews going house to house, rescuing people right now. abc's matt gutman is in houston with the latest. good morning, matt. >> reporter: good morning, robin. scenes like this across texas this morning. it's the very areas that have been to meanted by rain and flooding over the past 30 days. they're getting walloped again today. these home flooded. the rain had stopped by a nearby river surged. rescuers on boats helping this woman and this child in a backpack. also overnight -- >> tornado on the ground. >> reporter: six reported tornados touching down. this one caught on camera as it strikes a gas rig. three workers sent to the hospital. >> woo! oh no! >> reporter: this video as the blanco river surges into this

home earlier this week. the moment the water burst through the glass door. chairs and toys all swept up in the waters. nearly 1,500 homes damaged. as the waters recede they reveal the damage and the dead. the body of a young boy found overnight. the death toll climbing to at least 21 in texas and oklahoma. the anguish etched on the faces of lose left people. eight people still missing this morning. in houston, officials say 4,000 homes destroyed there. inside jim's house, the floodwater receded but was hardly gone. well, that drawer is full of water. >> yeah, it's all full of water. >> reporter: we tend to think of flooding as relatively harmless like these homes that saw two feet of water but you have to dump a lifetime's worth of possessions possessions, baby shoes, couches. over there is a bead.

there. that's going through the end of the week, start of the weekend. the severe threat, same region, from western nebraska down to the mexican border. another one here. damaging wind, hail possible in the northeast. so we have a little bit on both sides. texas is where we're really focused this morning. now to the anthrax scare. nine states in all overseas too and there are fears that nearly 2 dozen military members may have been exposed. abc is tracking the latest from washington. >> today there's an urgent effort underway to make sure no one gets sick. the military personnel in south koreaia are under observation after the defense department accidentally shipped live anthrax spores. labs in nine states affected and

south korea u.s. military personnel may have used it in a training exercise. 22 personnel potentially exposed. so far no one has shown signs of sickness but health and research officials have held out to see how the deadly material was handled. the anthrax originated here in utah and the cdc is on the ground there. in this case they were shipped at a lower level because the spores were thought to be dead. anthrax is considered a potential biological weapon as the nation saw in a nightmare after the 9/11 attacks. five people killed and 17 affected when letters were sent to media companies in the fall of 2001. it's scary to think live anthrax

as he taxis on to a restricted runway and driving the aircraft off the tarmac into a communications shed. >> turn your engines off sir. kill your engines. >> authorities arrest him on suspicion of operating a aircraft under the influence and child abuse charge because his preteen son also onboard. >> by the voice of the controller he's getting frustrated but not enough tools to use. >> there are measures to screen commercial private but don't apply to private aircraft. >> corporate and commercial and private aviation have tried hard to expunge liquor from the cockpit. when you have two or more pilots it's simple to check each other but with one it's not that easy. >> this 57-year-old pilot in florida was booked into the county jail. the damage to the aircraft and equipment was minimal. >> now a lot of concern off the california coast.

killed when a walmart truck driver fell asleep at the wheel and ran into his limo. he's reach add financial settlement with walmart and abc has that story. >> good morning to you. the night of the horrific crash it's estimated that the walmart truck driver was driving roughly 20 miles over the speed limit without sleeping for over 24 hours. it's likely that this was a sizeable payout. this morning comedian tracy morgan reached a settlement in a lawsuit against walmart stemming from the crash that left him seriously injured and killed a fellow comedian in june 2014. the terms have not been released but in a statement the 46-year-old morgan said walmart did right by me and my family. i'm grateful the case was resolved am ka blly. police say kevin roper fell asleep behind the wheel smashing into the limousine van they were

riding in on the new jersey turnpike. the driver had been awake for more than 24 hours when the accident occurred. roper has pleaded not guilty to charges of vehicular homicide and assault by auto. walmart settled another suit in january brought by james mcnair's family who was killed in the accident. the star of saturday night live and "30 rock" suffered several broken ribs in the crash. he's rarely stepped out in public since the accident almost a year ago. the father of four seen struggling to walk last december. >> how is your recovery coming? >> i'm fighting every day. >> fighting every day. >> now with this lawsuit behind him. morgan able to focus on his continuing recovery. >> and among his injuries we know he suffered traumatic brain injury and his attorney said he continues to fight to get back

wednesday, his lawyer arguing the charges are overblown. >> the actual nick, the wound is smaller than a dime. >> holy potatoes. >> reporter: the 38-year-old actor best known for playing the quirky loveable geek screech on '90s sitcom "saved by the bell" on trial for reckless endangerment, disorderly conduct, and assault with a weapon for using a knife allegedly to stab someone in a bar. last christmas day according to prosecutors. this tmz video capturing diamond in the moments leading up to the fight. according to court documents diamond told police he was trying to defend his fiance, amanda schutz. who asked the other patrons to stop taking pictures when he accidentally stabbed stacy smith. prosecutors paint a different picture. saying schutz was the aggressor, shoving one of the patrons, which led to diamond using a knife to stab smith. surveillance video of the altercation was played in court. >> the conduct that i'm talking

this 7-year-old boy shot by a stray bullet while riding his bicycle. police are still searching for the shooter. thankfully he's okay. tom llamas has the story. >> reporter: this morning, police on the hunt for the person responsible for this. watch as 7-year-old divan silva is riding his bike. just outside of boston when suddenly he stops pedaling. his bike wobbles. he hits the ground. a stray bullet hit him. his mother rushing to his side. >> we heard his mom scream. he was on the ground. >> reporter: first responders lifting him off the blood-soaked sidewalk. his clothes torn apart so they could find the bullet. before rushing him to boston's children's hospital sunday. >> there's no outrage or protests about a 7-year-old being shot. >> reporter: a 20-year-old was hit in the sunday shooting. he'll survive. police are concerned that witnesses might be reluctant to come forward to help them find the shooter. >> this is an inexcusable act. we don't want to hear about this

the life of 69-year-old kimberly howe. >> are there injuries? >> i'm going to say yes. it looks pretty bad. one car is destroyed. >> bruce, are you okay? >> reporter: the reality star who, after passing a field sobriety test, walked away from the accident unharmed, is objecting to a lawsuit filed by howe's stepchildren claiming jenner was reckless. neck and careless in the incident. jenner striking back calling the accident a terrible tragedy. but denying financial responsibility to howe's stepchildren. saying they are financially dependent on are not dependent on the decedent for the basics of life. jenner's attorneys have good argument to dismiss this case. >> jenner was one of many involved in the crash. jenner has not been charged in

tory johnson has it. it's thankful thursday. a truly inspiring story. unforgettable college graduation for a young man named chris norton the he walked across the stage to receive his diploma just four years after a horrific football injury left him with virtually no chance of regaining movement below his neck. this was on sunday. we'll talk to chris and his, ooh -- fiance emily. first, his remarkable story. an incredible moment defying great odds. [ cheers and applause ] chris norton began his college career at luther college in iowa as a star football layer. then he suffered a terrible injury. fracturing his neck and come presing his final cord. doctors telling him he had a 3% chance of ever walking again.

four years later, the 23-year-old takes the stage at his graduation. leaving his wheelchair behind. taking the steps one by one with the help of his fiance emily. in the audience his mom, overjoyed. the unimaginable traps formation. all thanks to chris' determination. >> come on chris. >> come on buddy. >> reporter: he found mike barres former coach and trainer who has helped nearly 50 patients come back. >> neurological engineering is a system i have devised. >> reporter: chris worked with mike and his team five days a week four hours a day. >> he was a guy who struggled to stand on his own. now he has control of his life. >> reporter: dr. jenkins says recovery can continue for many years. and every kind of rehab helps. >> you don't get there without

walk across the stage. i set that goal. i knew i had to work as hard as i could to make it happen the. that's where we moved to michigan and just -- focused on my therapy and to make my dream happen. >> we saw hat in the piece. the hours and hours of work that you put in. former football player. when you hear that you have a 3% chance to walk again what goes through your mind when you hear that? >> honestly when it happened it went in one ear and out the other. it was not going to determine who i was or what i will be. i was going to defeat the odds no matter what. i had my mind set. i had a feeling that dpod had a bigger plan for me. and just to stay the path and do my part. >> you openly talk about your faith. faith, family, and friends is your mantra? >> absolutely. without those three things i couldn't make it through. >> and now emily joining the the family as well.

i was a little taken aback by the statement that i heard that you made if you could go back in time to the football field, when that play took place that you were injured, that you would not change a thing. >> i would not. it's given me such a purpose in life to help others. and i met emily. so -- i have it all. i really do. i feel so blessed and -- i would not change a thing. >> you met chris after the injury. tell us what it has been like the determination that you have seen. i see you whip him into shape, too, doesn't she? >> oh she's my hardest trainer i have ever had. she's so tough. >> tell us about it. >> it's been amazing. he is the -- best person i have ever met. she's such a hard-working determined person. and makes me better and inspires me to do more in my life as well. it's great to see the progress he's made. just the work that he puts in every single day, all of the hours he does it's incredible.

>> all of us can learn from watching you, chris. and -- okay so you were in on the graduation about how he was going to walk across the stage. but the night before you were not in on the proposal. so maestro, please. ♪ all of me loves all of you ♪ >> is this the song that was playing? ments it was. >> you had no idea? >> i couldn't believe it. i told him he wasn't going to be able to pull it off and surprise me. i figured out he's been planning it for three months, four mopts. i couldn't believe it. >> you have a little help there, chris? >> i did. i had help from my family and friends. to make it all happen. >> your mom and dad are here standing -- i know you have written a book along with an author. can you tell us about that, sir? >> we had an author from atlanta, georgia, approach us and said you gotta tell this story. so we've been working with her for about a year now.
