>> live from the kgo tv broadcast center, this is abc 7 news. good afternoon, everybody. i'm larry beil. >> i'm cheryl jennings in for ama daetz. first at 4:00, a different kind of smash and grab inside san francisco's bmw dealership. this is the aftermath by a brazen burglar who broke into the building early this morning and took off with a $75,000 sports car. he smashed right through the glass window but he didn't get very far. >> abc 7 news reporter vic lee joins us from san francisco with the story. vic? >> cheryl, this is where the thief crashed the stolen bmw right here on mason street near union square right against the wall of this building and you can still see the marks and small bits from the car lodged against the wall but first let me take you back to the dealership where it all started

this morning. >> omg the m stands for the bmw m series, but today it stood for omg. >> how do you drive a bmw off a showroom floor and three feet into a sidewalk. >> that's what happened on the bmw dealership on howard street. the thief broke into the building and found the box with car keys and he took another one that did and his escape the thief drove the car over a parking meter and on to howard street narrowly missing this chevy parked at the next meter. it was john sizinger's rental car. >> i don't have to pay the deductible on the car because it wasn't hit, but i got a parking ticket. >> a parking violation for $66. he couldn't even move the car for hours because it was in a crime scene. the bmw then traveled at high speeds to gary and mason and it

turned abruptly going the right way on mason a one-way street. a worker at a nearby hotel saw the whole thing. >> he came here, and i heard the sound and the suv citied here and the car was right here. >> the bmw jumped a sidewalk and smashed into an suv with a limo driver asleep in the car and it stopped when it hit the building wall and the thief ran to the 200 block of 7th street where he was arrested. police would say only they were responding to a domestic dispute that involved the thief. vic lee, abc 7 news. >> how bizarre. >> whoa! what a story. >> like a scene out of the fast and furious. >> parts of the bay area woke up to drizzle and it's been odd. >> so happy to see any moisture here at all, and spencer christian joins us with the accuweather update. >> no evidence of any rainfall in the sky over the bay area and we did have wet spots and lettay go to live doppler 7 hd

first to keep an eye on rainy conditions and north of the organized area of rainfall during cresscent city and eureka. blue skies right now and we had wet spots in this early morning's rain and 0 .16, and 06 at children's park and 04 at petaluma. here is the scene right now looking at the western sky from the emoriville camera, blue skies over the bay and the clouds are stacked up at the coast and low to mid-70s and 77 morgan hill and 75 at half moon bay and we even have clouds that have traveled across the bay as you can see from the east bay hills camera. >> low to mid-70s at napa petaluma fairfield, concord and livermore and as we look at partly cloudy skies and low clouds will increase tonight and we'll have low clouds tomorrow

morning and it will be sunny and mild in the afternoon tomorrow and i'll give you a look at our next chance of rain in just a few moments. larry and cheryl. >> spencer thank you. >> today is d-day, d as in drought and mandatory cutbacks are throughout the state and this is all a result of the governor's drought plan. >> it means major new restrictions and pen alsoeys. abc 7 news reporter matt campbell has more. >> today the state start keeping track of the retailers. they'll have to cut water use from 8% to 36%. >> this is when the clock starts running and they have to reduce their water use by a certain percentage based on what they used back in june of 2013 so this is when they'll start comparing the numbers. >> reporter: but don't expect the water companies and city-run utilities to pay pen attes on their own. the bill gets handed down to you and they all use different formulas. the san jose water company

serves the south bay. they'll have to pay more the more water they use plus a surcharge. many have started conserving hoping it's enough to keep them from paying a penalty. >> how much more have we been using to make sure we're not in excess so that we don't have to have the fine that we don't want to pay. >> ultimately, we're talking about a finite water supply in santa clara county and we're all in this together and we don't know when the drought will end and we all need to do our part. >> here's positive news. the latest numbers shows the water use in april was reduced to 25% and they're hoping for a better may when the numbers come out in the middle of this month. in campbell matt keller abc 7 news. >> despite the drought stanford has decided to turn on its fountains for commencement and the fountains were drained more than a year ago. 60,000 gallons of water will be used to enhance commencement and the fountains will be deactivated the day after the ceremony and that will be restored and used to water trees on campus.

francisco courtroom this morning. they're fighting over clothing and money to maintain one of his homes in tiburon. his wife wants to keep her husband's slippers t-shirts and boxer shorts. williams left most of his estate to his children. >> this is a small amount of money. it's like a toy set from legoland, that's what is at stake here for susan. >> we would have been very disappointed at a minimum. i'm hopeful we can resolve this without having to come back in july. >> the j two sides until the end of july to come up with an agreement. >> we are here to support our trans brothers and sisters. >> abc 7 news was in menlo park today as a few dozen lgbt activists rallied against facebook's real name policy at the company's headquarters and any transgender people and native americans claim facebook deleted their accounts because they did not use their legal names. the two sides had appeared to reach a settlement months ago. facebook said in a statement its

the upper level low to the north has brought us unsettled weather this morning and is producing more substantial rainfall in the northwestern quarter of the state and that's lifting out now and we still have the onshore pattern that will continue for much of the week and the pattern reaches far out to sea, i might add. speaking of out to sea, how about the tropical pacific, two major storms to talk about and one is hurricane andres which is a category 3. a very powerful storm and tropical storm blanca just south of the southern tip of southwest of the southern tip of mexico. that's expected to become a powerful hurricane. over the next several days we'll see andres weakening by making a sharp right turned to northeast and blankal be parallel to the west coast of mexico. some of that moisture from anned res is likely to push into southern california to the san diego area by the weekend by

was caught on tape. check this out. a surveillance camera catches a black subaru flying through the air and into a building. the car came through a gas station parking lot somehow reaching a high speed and flew 30 feet through the air, slamming into the garage door of that auto repair shop. the driver survived. the owner of the shop says the damage could have been much worse. >> i'm surprised that he was able to clear the car that we had lined up and they weren't inexpensive cars. they're porsches and audis, and he actually did some good air. >> he got some good air. >> don't hit the porsche! >> police believe the driver may have confused the pedals in the car accelerating rather than braking. president obama is hosting a king and queen today. dutch king and queen are in the united states for the first time since taking the throne two years ago. the president praised the netherlands as one of the oldest and the most precious allies.

live from the kgo tv broadcast center, this is abc 7 news. here are the headlines of the day where you live as we approach 4:30. a thief tries to drive off with two cars off of south vanes in. the thief tried to steal a bmw and couldn't fit that car through the door and ended up driving a red bmw through the showroom window and then crash period period. police arrested the suspect shortly after the crash. a day care worker at kids building school is out on bail after police arrested him for alleged lewd acts with a minor. police arrested alexander kurtz on campus thursday. wayne freedman tweeted police assured them that none of their

kids are involved. wayne will have a live report coming up on abc 7 news at 5:00. today demonstrates are gathering in front of facebook's gay pride ban tore protest the real name policy. abc 7 news reporter sergio quintana says they give the policy a thumbs down. sergio will have more an 5:00, as well. on wednesday, oakland teachers will finally vote on the contract with the school district. some of those teachers are calling on colleagues to reject the deal. abc 7 news reporter lyanne melendez tells us why. >> students at coliseum college prep a cad me in oakland went on their last field trip. as the negotiations end so do the teachers union and the district. teachers are being offered an 8% raise through 2016 as well as a portion of all new monies the district gets from the state. >> based on the governors if that is passed as expected, as proposed it's an additional, at least an additional 3%. >> yet not all oakland teachers

are happy with that offer. >> i cannot support an agreement that does not support our community and our students. >> the union was not successful at getting a hard cap on the number of special ed students assigned to a teacher. the district argued it would have cost too much mono pep. >> we have special education students really overflowing in cass looms not getting the services that they need. >> the union leadership promises it will push for the hard caps in the next contract. the union president believes she has enough votes for the contract to be ratified. if that's the case, teachers will no longer work to rule. many of them were only teaching the required number of hours bringing attention to all the extra work they put in. as a result, some students have less homework. >> yes, at times. >> how did you feel about that? >> i asked for more homework for her. >> it's probably not that great that there was fewer homework because every day it counts towards a rigorous training to be prepared for life.

>> most parents are satisfied with the outcome of the negotiations. in oakland lyanne melendez, abc 7 news. san jose city leaders want to drive tobacco companies out out of san jose's bars and clubs. the city council will consider an initiative to ban the distribution of tobacco coupons and cigarettes from all businesses. the measure reduces the risk of young adults getting hooked on smoking. >> starting today a ban takes effect on most styrofoam food containers in los gatos. the south bay community reduced the amount of local waterways and this amounts to take-out price containers and foam ice chests. pre-packaged foods can still be sold in styrofoam. it is official san francisco ed lee is running for reelection. the mayor filed nomination papers today. lee was first elected in november 2011 and he had previously been appointed to the

board in 2011 to serve out ret mant maineder of gavin newsom's term as governor. another republican is candidate for 2016. >> i'm lindsay graham, and i'm running for president of the united states. >> cheers today for lindsay graham as he threw his hat into the ring in his hometown of central south carolina. graham was first elected to the u.s. senate in 2002 after serving eight years in the house. he plans to focus his campaign on the foreign policy experience. it will be a long shot campaign and the recent quinnipiac poll of likely gop voters shows graham getting 1% of the polls from those surveyed. martin o'malley took his attacks on hillary clinton and jeb bush to good morning america today. the former maryland governor announced his candidacy on saturday saying the presidency is not a crown to be passed back and forth between royal families. he defended that statement

during his interview with george stephanopoulos. >> i believe the ceo of goldman sachs should be fine with bush or clinton that should be a wake-up call for all of us because we have not delivered on the primes of excesses on wall street and our economy is vulnerable to that. >> the 52-year-old plans to make economic disparity in america one of his major campaign issues. >> former u.s. house speaker dennis hastert will be a rabed on thursday on charges that he lied to the fbi about paying hush money. he accuses hastert of paying $3.5 million to someone in illinois. he was paying a former male student to keep quiet about sexual misconduct. sources say there is a second victim, also a former student. the national security agency is no longer collecting phone records after key parts of the patriot act were allowed to expire last night. intelligence officials warn that this leaves us vulnerable to terrorism. karen travers in washington with what's next.

>> reporter: today the white house blasted the senate for failing to extend the government surveillance authority. >> there are specific tools that our national security professionals had previously used that they can no longer use because of the partisan dysfunction in the united states senate. >> kentucky republican senator rand paul blocked a vote to extend, but later reform the nsa's surveillance program. >> starting at midnight the nsa was no longer able to collect in bulk the phone records of americans. >> we're going to so blindly give up our freedom? >> paul is playing politics with national security. >> that falls on all of us to work diligently and responsibly to get the american people the best outcome that can be reasonably expected in this reality with which we are confronted. >> it's not like this deadline snuck up on the senate and senator paul certainly isn't

shying is, signaling his intention and he went on an eight-day recess and came back to work in a rare sunday session, just eight hours before the patriot act provision were set to expire and it wasn't just a phone data collection program that expired. the senate also failed to extend the fbi's ability to use roving wiretaps which allowed them to monitor a suspect as they changed phones. >> the lapse in the government surveillance authority may be brief. the senate is expected to take up a house measure this week that would extend the provisions that expired and reshape the phone data collection program. karen travers abc news washington. >> secretary of state john kerry is headed home after being treated for a broken leg. he boarded a helicopter in switzerland today. kerry broke his thigh bone yesterday when he hit a curb on his bicycle and fell off. he is said to be active and in great spirits. a military aircraft will take him back to boston. kerry will get more treatment and surgery is a possibility.

crews clean up after yesterday's crane accident. the crane was moving a 4-ton air conditioner when the cable snapped. the unit crashed down the front of the building, shattering glass and raining debris on to madison avenue, injuring ten people. officials said the site had no open violations and the crane appeared to be in great shape, an unexplained weight shift in the load. >> coming up the big name employer now giving new dads four weeks of paid time off. up first, fish out of water, it's not just a saying, but a real-life problem in one east coast community. >> i'm spencer christian from the east bay camera. we see low clouds at the coast and beginning to push out over the bay and will they contain any moisture? i'll have th

you have heard the phrase fish out of water, right? in new jersey these carp ran out of water and literally had to be rescued. after their lake flooded over they tried to float down the street, but they couldn't fit through the sewer grate. a good samaritan collected the fish and carried them back to the lake. what a nice guy. >> we could use some water ourselves and me might get a sprinkle. >> can we have more of that please, sir? >> we might. the clouds moving in do contain moisture and some can fall in the form of drizzle during the

overnight hours and here's a look at live doppler 7 hd and low clouds are stacking up on the coastline and let's look back at the month of may and this is june 1st, of course, and let's take a look at how cooler than actress the month of may was and we're using san jose as our indicator and only the first two days of may produced temperatures that were above average in san jose and there was one day around the 27th which was exactly average and 28 of the 31 days in may produced below-average temperatures. so it was cooler than average all over the bay area, but not so much that it was cold. it's just several degrees cooler than average and tomorrow nationally we'll see showers and thunder showers off the atlantic coast and the canadian border with north dakota and minnesota and the northwest we'll see scattered showers as well and plus california, look for a warm day in the interior sections and 85 degrees in chico and 87 in fresno and 98 down south of palm springs and here in the bay area

koofring venetia, san ramon san mateo and all the bay area, this is abc 7 news. apple is expected to make a major music announcement next week at its worldwide developer's conference in san francisco. several media reports say the company will unveil a new on-demand streaming service that would compete with spotify and pandora upon the new streaming service is not expected to replace beats music which apple purchased last year. you may remember vinyl records.

lineup on abc 7, at 8:00, the bachelorette and the premiere of "the whispers" at 10:00. at 11:35 jimmy kimmel live, and comedian adam corolla and music from hoosier. a million dollars to have lunch from one of the world's most powerful investors. the power lunch auction is happening now on ebay. all of the money goes to san francisco's live foundation, a charity that helps low-income families in our area. last year it paid more than $2 million. the auction ends on friday. it's been more than two decades since the 1991 oakland hills firestorm claimed 25 lives and destroyed thousands of homes.

memories of that tragedy are still fresh as officials detail a fema plan to remove thousands of trees and that is something that would greatly change the landscape and the character of the east bay hills. the plan would affect the areas highlighted here and the oakland hills, many residents including some who survive the firestorm says the plan to protect them goes too far. abc 7 news reporter laura anthony is live with the story. laura? >> reporter: hi, cheryl. the firestorm was nearly 24 years ago, but the debate around this issue how to best manage the vegetation behind me is as hot as ever. >> the goal is to reduce the threat of fire hazard here. >> vince is in charge of vegetation management for the oakland fire department and the plan that would have cleared thousands of eucalyptus and non-native trees is long overdue. >> the wins are coming out of the northwest right here and right out in we have a high level of brown fuels and

intermediate level brush and tree fuels and then the tree crowns. you could be looking at lengths of 100 feet if we had a fire that came through this canyon. the plan has its detractors including some firestorm survivors, and the fema's proposal as currently written goes way too far. >> they do plan to clear-cut the area. a third of the trees at the end of three years and there would be no eucalyptus pines or a cashias left. >> the group that believes it largely fueled the 1991 fire saying the fema plan doesn't go far enough in eliminating certain trees soon enough. the city council will decide whether to accept $4 million of fema money. laura anthony, abc 7 news. all right. thank you so much for joining us for abc 7 news at 4:00.

thanks for joining us. i'm cheryl jen igs. >> i'm larry beil in for dan ashley. those parents are meeting in pleasanton after police arrested a worker late last week for molestation. wayne freedman is live now where parents are looking for answers. wayne? >> reporter: they're looking for answers and a lot of people are looking for answers right now, larry. the suspect's name is alexander kurtz, 22 years old and a castro valley resident and a teacher here going back to a previous administration. he has been arrested and charged and released on bail. administrators watched that arrest on campus last thursday, later they wrote a letter to parents talking about it. now behind me a meeting going on. parents, as you can see, going through the door. now this meeting should begin at any moment. details are slowly emerging partly to protect the identity of the young female victim who was less than 14 years old. let's begin with vinita vandari

who owns this school and eight others. >> we had no reason to believe anything until that day he was arrested and the following day the authorities told us the charges were child molestation. >> what was your reaction to that? >> very shocked, but the relieving thing is that none of the schoolchildren are in danger or at risk. >> the this afternoon after that interview, pleasanton police confirmed that the alleged molestation did happen on campus late last year. the victim a former student who had attended the stool when it was known as busy bees and under previous ownership. police did not say why she returned to the school. they would only say the victim was less than 14 years old and that it appears to have been an isolated incident. at this point in the investigation we have no evidence to believe that there are any additional victims except the one that came forward. >> what
