police shooting in two years. >> put your hands out the driver's side window. >> this cell phone video was taken bay vendor at the grand lake farmers market, showing the movements just before police opened fire and shot a man holed up inside a car. >> they were telling him to get another of the car with a megaphone, and he didn't, and then we heard them hitting the door with something. and then a few minutes later there were two shots. >> firefighters fir discovered the bmw sedan at 7:30 this morning, parked along the lake shore offramp of highway 580. they found the driver asleep and the pistol in the passenger seat. >> he is a pistol and it had in it a loaded 30-round magazine. >> oakland police officers trade for more than an hour to first wake the driver up then get him to come out. the chief says they broke the car windows and tried nonlethal together like beanbag rounds to make contact.

>> upon the last attempt to do that officers approached the car. the person at that point was awake. a confront addition ensued with the officers in person. one officer deployed a taser. a second officer deployed the firearm. >> the suspect was hit. police won't give the dials about the confrontation. it's unclear with the suspect ever picked up the gun or fired it. investigators will not say much about the driver except the car he was in was involved in a burglary in san francisco hours earlier. the officer who fired the shot has been pleased on leave. new details on a freak accident at the oakland a's game in boston. a woman has been upgraded to serious condition after an oakland player's bat shattered and win into the stands. >> this is a broken bat ground grounder. >> brett lowery's bat cracked in the second inning and part of the bat hit tanya carpenter in the head causing what was

initially described as life-threatening injuries. her family says they are grateful for people's thoughts and prayers are and requesting privacy. now to sports history. today 37 years in the making. america has a triple crown winner, and that is american pharaoh. his famous trainer runs a stable out of santa anita and the horse started his career in california running the first race at del marc north of san diego. here's more from the racetrack. >> american pharaoh. >> with this win at the belmont now taking home the biggs prize, the triple crown. it was a run for the record books for american pharaoh racing against seven rivals at the belmont, the longest and most grueling race earning the neckname otest of the champion. the winner of the kentucky derby and the preakness, american pharaoh achieved last achieved by affirmed 37 years ago. >> affirmed has a nose.

the chp and contra costa county sheriff's office are investigating. we were in emeryville as emergency crews responded to a deadly crash. it happened at 9:00 this morning at 40th in san pablo police say the woman driving was killed when her car hit a build agent high speed she was the only person in the car. police are investigating whether there was a medical emergency. lightning storms are to blame for nine wildfires near fresno and more lightning storms are possible in the area today. the fires broke out last night in the prather and awe berry areas. a they were started by lightning. >> just ridiculously dry. even with the rainfall that did come down just evaporated. >> calfire says 35 acres burn. no homes were damaged. drew tuma will have a look at where the lightning is this evening in just a few minutes.

new details about the oil spill off the santa barbara yack coast, there's a plan to move oil through the area by troubling. exxon and other companies are trying to keep their products flowing at a time when no one knows when the pipe is going to be fixed. the plan to move the oil and tanker trunks amounts to 1300 truck trips a weeping. the environmental defense center does not like the plan. >> exxon alone is proposing to send 192 trucks a day up the coast, the area just been destroyed by this oil spill. >> the county is set to make a decision as early as next week. the pipeline's owner says it has been fun in the past. the spill covered nearly 10 square miles. about a thousand mourners paid their last respects to bow biden in wilmington, delware today. the former state attorney general and son the vice-president died of brain cancer last week. he was 46 years old. president obama delivered the

take a look at this amazing view of earth. a camera on a recent spacex falcon nine flight captured some spectacular video as it fell back to earth. this is the same rocket that crashed during a tricky landing on a barge in the atlantic ocean. spacex is trying to cult the cost of space flight by creating reusable rockets. volunteers from habitat for humanity were joined by faith-based groups for a building blitz tonight. we were in martinez where volunteers were taking part in a four-day home build. an anonymous doper gave $150,000 to bring habitat together with people of different religions. for one volunteer it's the chance of a lifetime. >> our own house so exciting. it's like a dream come true. my kids are really happy. >> habitat for humanity says the
